RESOLUTION NO. 94-14
A RESOLUTION OF THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS AWARDING A
CONTRACT FOR THE EXTENSION OF TROPHY WOOD
DRIVE TO SUNMOUNT CORPORATION; PROVIDING
THAT THE SAID AWARD IS CONTINGENT AND
CONDITIONAL UPON THE TOWN RECEIVING THE
EXTENSION RIGHT-OF-WAY BY GRANT FROM THE
OWNER OF THE LAND ON THE EFFECTIVE DATE
HEREOF; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Town of Trophy Club, Texas (the "Town"), in accordance with State
law, heretofore issued a request for sealed bids for the construction of an extension of
Trophy Wood Drive (the "Trophy Wood Extension") as set forth in the bid documents; and
WHEREAS, in accordance with the request for sealed bids, the Town received _
7 bids on or before September 1 5. 1994; and
WHEREAS, the lowest bid submitted was submitted by Sunmount Corporation; and
WHEREAS, the award of the bid provided for herein is contingent upon the Town
acquiring the necessary right-of-way for the extension of Trophy Wood Drive by grant from
the landowner; and
WHEREAS, the Town Council, having reviewed the bids submitted and having
received the recommendation of the Town Staff, now desires to award the bid for the
Trophy Wood Extension to Sunmount Corporation.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS:
Section 1. The above and foregoing premises are true and correct and are
incorporated herein in their entirety.
Section 2. The Town Council does hereby award and accept the bid for the Trophy
Wood Extension as described in those certain specifications made a part of the Town's
Invitation for Bids for the Trophy Wood Extension (together with all documents
accompanying the Invitation for Bids, all of which documents are incorporated herein and
made a part hereof by this reference) dated 1994 to Sunmount
Corporation in the amount of Eighty -Two Thousand Eighty and 70/100 Dollars ($82,080.70);
provided, however, that the acceptance of the bid from Sunmount Corporation and the
award of the said contract to Sunmount Corporation for the Trophy Wood Extension is
hereby made expressly conditional and contingent upon the Town receiving by grant from
the owner of the land (as of the effective date hereof) of the right-of-way necessary to
construct the Trophy Wood Extension.

Section 3. The Mayor is hereby authorized and empowered to do all acts and take
all steps necessary in relation to the award made hereby.
Section 4. This Resolution shall take effect from and after its date of passage.
PASSED AND APPROVED by the Town Council of the Town of Trophy Club,
