ORDINANCE NO. 2010-21
AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS REPEALING ORDINANCE
NO. 2003-20 CHANGING THE DESIGNATION OF THE OFFICIAL NEWSPAPER OF THE
TOWN; PROVIDING FOR THE INCORPORATION OF PREMISES; PROVIDING FOR THE
DESIGNATION OF THE FORT WORTH STAR TELEGRAM AND ITS AFFILIATES AND
SUBSIDIARIES, INCLUDING THE TIMES REGISTER AS THE OFFICIAL NEWSPAPER
OF THE TOWN ; PROVIDING SEVERABILITY; PROVIDING A CUMULATIVE REPEALER
CLAUSE; PROVIDING FOR PUBLICATION; PROVIDING FOR ENGROSSMENT AND
ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, on 20th day of October , 2003 , the Town enacted Ordinance No. 2003-20 designating
Alliance Regional Newspapers (hereinafter "Trophy Club Times") as the official newspaper of the Town;
and
WHEREAS, the name of the paper utilized by the Town as the Official Newspaper has changed
from the Trophy Club Times to the Times Register, both newspapers are owned by the Fort Worth Star
Telegram ; and
WHEREAS , as a result of and consistent with that change, the Town Council of the Town of
Trophy Club, Texas (the "Town") desires to clarify its designation of an Official Newspaper of the Town by
designating the Fort Worth Star Telegram and its affiliates and subsidiaries, including the Times Register
as the official newspaper of the Town ; and
WHEREAS, the Council finds that the Fort Worth Star Telegram and its affiliates and
subsidiaries, including the Times Register, meet all of the requirements of State law to serve as the
official newspaper of the Town , and finds it in the best interests of the Town to contract with that
newspaper to serve as the Town's official newspaper in accordance with Section 52 .004 of the Texas
Local Government Code .
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF
TROPHY CLUB, TEXAS, THAT:
SECTION 1.
INCORPORATION OF PREMISES
The above and foregoing premises are true and correct and are incorporated herein and made a
part hereof for all purposes .
SECTION 2.
DESIGNATION OF OFFICIAL NEWSPAPER
The Fort Worth Star Telegram and its affiliates and subSidiaries , including the Times Register is
hereby designated as the official newspaper of the Town of Trophy Club and shall serve as the Town's
official newspaper in accordance with Texas Local Government Code Section 52 .004 , as amended, and
other applicable laws , and a non-exclusive contract between the Town and the Fort Worth Star Telegram
and its affiliates and subsidiaries , including the Times Register shall be executed as necessary to effect
this Ordinance . Publication in the Fort Worth Star Telegram and/or any of its affiliates, including the
Times Register, shall satisfy the requirement to publish in the Town 's Official Newspaper.
SECTION 3
SEVERABILITY

If any section, article, paragraph, sentence, clause, phrase or word in this Ordinance, or
application thereto, any person or circumstance is held invalid or unconstitutional by a Court of competent
jurisdiction, or otherwise, such holding shall not affect the validity of the remaining portions of this
ordinance; and the Town Council hereby declares it would have passed such remaining portions of the
ordinances despite such invalidity, which remaining portions shall remain in full force and effect.
SECTION 4.
CUMULATIVE REPEALER CLAUSE
That this Ordinance shall be cumulative of all other Ordinances of the Town affecting the Town's
Official Newspaper and shall not repeal any of the provisions of such Ordinances except in those
instances where provisions of those Ordinances are in direct conflict with the provisions of this Ordinance;
whether such Ordinances are codified or uncodified, and all other provisions of the Ordinances of the
Town of Trophy Club, codified or uncodified, not in conflict with the provisions of this Ordinance , shall
remain in full force and effect. Notwithstanding the foregoing , any complaint, action , cause of action or
claim which prior to the effective date of this Ordinance has been initiated or has arisen under or pursuant
to such repealed Ordinance(s) shall continue to be governed by the provisions of that Ordinance and for
that purpose the Ordinance shall be deemed to remain and continue in full force and effect.
SECTION 5.
ENGROSSMENT AND ENROLLMENT
The Town Secretary of the Town of Trophy Club is hereby directed to engross and enroll this
Ordinance in the Ordinance records of the Town and to properly record this Ordinance in accordance with
the Town Charter.
SECTION 6.
EFFECTIVE DATE
This Ordinance shall become effective from and after its date of adoption and publication as
provided by law.
PASSED AND APPROVED by the Town Council of the Town of Trophy Club, Texas, this 13th
