AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS
REPEALING ORDINANCE NO. 2005-20 PROVIDING FOR THE
ADOPTION OF A NEW SCHEDULE OF FEES FOR THE TOWN
RELATED TO NEW CONSTRUCTION; PROVIDING A
CUMULATIVE REPEALER CLAUSE, PROVIDING A
SEVERABILITY CLAUSE; PROVIDING FOR ENGROSSMENT
AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Ordinance No. 2005-20 was adopted on August 1, 2005 and
provided for the adoption of a new schedule of fees for the Town of Trophy Club
(hereinafter referred to as "Town") related to new construction; and
WHEREAS, due to changed circumstances, the Town Council adopted
Ordinance No. 2005-29 on December 5, 2005, which provided for the adoption of a new
schedule of fees for the Town related to new construction; and
WHEREAS, with the adoption of Ordinance No. 2005-29, the schedule of fees
for new construction enacted pursuant to Ordinance No. 2005-20 was repealed due to the
terms of the Cumulative Repealer Clause of Ordinance No. 2005-29; however Ordinance
No. 2005-20 was not specifically repealed by number in Ordinance No. 2005-29; and
WHEREAS, as a matter of housekeeping, the Town Council finds it appropriate
to adopt this Ordinance specifically repealing Ordinance No. 2005-20.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF
THE TOWN OF TROPHY CLUB, TEXAS:
SECTION 1.
REPEAL OF ORDINANCE NO. 2005-20
The Town Council of the Town of Trophy Club, Texas does hereby repeal in its
entirety Ordinance No. 2005-20 adopting a new schedule of fees for the Town related to
new construction.
SECTION 2.
CUMULATIVE REPEALER CLAUSE
That this Ordinance shall be cumulative of all other Ordinances and shall not
repeal any of the provisions of such Ordinance except those instances where those
provisions are in direct conflict with the provisions of this Ordinance; provided however,
that Ordinance No. 2005-20 of the Town shall be and is hereby repealed.
SECTION 3.
SEVERABILITY
If any section, article, paragraph, sentence, clause, phrase or word in this
Ordinance, or application thereof to any person or circumstance, is held invalid or
unconstitutional by a Court of competent jurisdiction, such holding shall not affect the
validity of the remaining portions of the Ordinance, and the Town Council hereby
declares it would have passed such remaining of the Ordinance despite such invalidity,
which remaining portions shall remain in full force and effect.
SECTION 4.
ENGROSSMENT AND ENROLLMENT
The Town Secretary of the Town of Trophy Club is hereby directed to engross
and enroll this Ordinance by copying the exact Caption and Effective Date Clause in the
minutes of the Town Council of the Town of Trophy Club and by filing this Ordinance in
the Ordinance records of the Town.
SECTION 5.
EFFECTIVE DATE
This ordinance shall be in full force and effect from and after its passage and
publication as required by law, and it is so ordained.
PASSED AND APPROVED by the Town Council of the Town of Trophy Club,
Texas, this the 9"' day of January, 2006.
