consult with its attorney on a matter in which the duty of the attorney to the
Governmental Body under the Disciplinary Rules of Professional Conduct of the

The Town Council of the Town of Trophy Club, Texas, met in a Regular Session on Monday, November 4, 2013. The
meeting was held within the boundaries of the Town and was open to the public.

Mayor White announced the date of November 4, 2013, called the Town Council to order and announced a
quorum at 6:10 p.m.
WORKSHOP SESSION
1. Discussion of agenda items posted for consideration on the Regular Session Council Agenda for November 4,

2. Discussion of proposed agenda items for the November 18, 2013 Regular Session Agenda.

The Invocation was offered by Fire Chief Danny Thomas.
The Pledges were led by Town Manager Mike Slye.

Pam Sellers with North Texas Children’s Charities addressed the Council and thanked the Town for the support
during the 2013 North Texas Bicycle Rally. Pam also request that the Town partner with the group next year for the
Family Fun Ride (bike rodeo) to help offset expenses. Already scheduled for next year is the North Texas Bicycle
Rally for October 11, 2014 at Byron Nelson High School. Please visit their website www.bicyclerally.org for
additional information.

Motion made by Council Member Rose, seconded by Council Member Mayer, to approve the Consent Agenda as
corrected at the dais.
Motion carried 4-0-2. Motion passed unanimously.
REGULAR SESSION
6. Consider and take appropriate action regarding terms of agreement with Elizabeth Goodson for Trophy Club
Farmers Market and authorizing the Town Manager to negotiate and execute a contract reflecting those terms
and other necessary provisions.
Council Member Mayer read a letter from Mike and Jeanne Buck, 2401 Lilyfield Drive outlining their concerns
regarding the farmers market and requesting this item be tabled until further research can be done.
Tracey Hunter, 19 Monterey Drive, addressed the Council regarding the Famer’s Market listing the items according
to HB970 that are not allowed be sold at farmer’s market. Also believes the Famer’s Market should be held behind
the roundabout.
Julie Foley, 2407 Lilyfield Drive, addressed the Council regarding the farmer’s market. Concerned with the noise,
trash and everything about holding the Farmer’s Market in the Community Pool parking lot, would support the
Farmer’s Market in a different location.
Scott Foley, 2407 Lilyfield Drive, addressed the Council regarding support of the others supporting the farmer’s
market being tabled until more locations are vetted.
Jim Parrow, 8 Brookfield Court, addressed the Council in support of the farmer’s market being tabled until a more
suitable location (away from homes) is identified.
The Parks & Recreation Director provided an overview of the locations (public properties) vetted for the Farmer’s
Market. Staff added Indy East as a possible alternative parking lot location and indicated that there are several
power sources around the parking lots, reducing the need for generators. The Health Inspector would review the
contract to ensure all food and drink items were allowable by state law.

Motion made by Council Member Lamont, seconded by Council Member Mayer to table this item until further
research can be done on alternate sites.
Town Manager Slye asked that the Council amend their motion to state not on public property. Mayor White
expressed her concerns regarding giving this a try for four weeks.
Motion withdrawn.
Motion made by Council Member Lamont, second by Council Member Mayer to table that the pool & Harmony
Park are not acceptable locations and would like the farmer’s market on private property.
Motion carried 2-2-2 with Council Member Rose & Mayor White in favor and Council Member Lamont & Council
Member Mayer in opposition.
Motion failed.
No action taken.
7. Consider and take appropriate action regarding a Final Plat of Neighborhood 7, Phase 3C, of The Highlands
at Trophy Club, an approximate 31.487 acre tract of land, consisting of 107 residential lots and 4 open space
lots. Applicant: Peloton Land Solutions on behalf of High Trophy Development, LLC.
A. Consider and take appropriate action regarding a Subdivider's Agreement between the Town and High
Trophy Development, LLC., for Neighborhood 7, Phase 3C of The Highlands at Trophy Club, an
approximate 31.487 acre tract of land; and authorizing the Mayor or her designee to execute all
necessary documents.
Motion made by Council Member Rose, seconded by Council Member Mayer, to approve the Final Plat of
Neighborhood 7, Phase 3C, of The Highlands at Trophy Club, and the subdivider’s agreement authorizing the
Mayor or her designee to execute all necessary documents.
Motion carried 4-0-2. Motion passed unanimously.
8. Consider and take appropriate action regarding a Final Plat for Neighborhood 4, Isle of Turnberry, of The
Highlands at Trophy Club, an approximate 10.783 acre tract of land, consisting of 14 residential lots and 4
open space lots. Applicant: Corwin Engineering, Inc. on behalf of Standard Pacific of Texas, Inc.
A. Consider and take appropriate action regarding a Subdivider's Agreement between the Town and
Standard Pacific of Texas, Inc., for Neighborhood 4, The Isle of Turnberry of The Highlands at Trophy
Club, an approximate 10.783 acre tract of land; and authorizing the Mayor or her designee to execute
all necessary documents.
Motion made by Council Member Rose, seconded by Council Member Mayer, to approve Final Plat for
Neighborhood 4, Isle of Turnberry, of The Highlands at Trophy Club and the Subdivider’s agreement that goes with
it.
Motion carried 4-0-2. Motion passed unanimously.
9. Consider and take appropriate action regarding a request for approval of a revised Site Plan to add a
monument sign to Planned Development No. 23 (PD-23), Trophy Club Medical Plaza. Applicant: Richard
Brown, Chandler Signs, LP, LLC on behalf of the property owner, HCP CRS1 Trophy Club TX, LP.
Motion made by Council Member Rose, seconded by Council Member Mayer, to approve the revised Site Plan to
add a monument sign to Planned Development No. 23 (PD-23), Trophy Club Medical Plaza.
Motion carried 4-0-2. Motion passed unanimously.

10. Consider and take appropriate action regarding appointees serving on the PID Water and Wastewater
Operational Services Council Subcommittee; provide update regarding first meeting between Town and
MUD1 subcommittee; consider and take appropriate action regarding same.
Motion made by Council Member Mayer, seconded by Council Member Rose, to approve Council Member Rose
replace Council Member Schroeder and appoint Mayor White as representative to join Council Member Mayer to
the PID Water and Wastewater Operational Services Council Subcommittee.
Motion carried 4-0-2.
Motion passed unanimously.
11. Consider and take appropriate action regarding a Resolution of the Town Council casting its one allocated
vote for a person to serve as a member of the Tarrant County Appraisal District Board of Directors; and
providing an effective date.
Motion made by Council Member Mayer seconded by Council Member Rose, to vote for David Averitt to serve as a
member of the Tarrant County Appraisal District Board of Directors and approve Resolution 2013-31.
Motion carried 4-0-2.
Motion passed unanimously.
12. Consider and take appropriate action regarding a Resolution of the Town Council casting its twenty-one (21)
allocated votes for a person or persons to serve as a member of the Denton County Appraisal District Board
of Directors; and providing an effective date.
Motion made by Council Member Rose, seconded by Council Member Lamont, to approve Resolution 2013-32
casting our twenty-one (21) allocated votes for current Vice Chairman, John Mahalik.
Motion carried 4-0-2. Motion passed unanimously.
13. Consider and take appropriate action to provide topics and questions as requested by the Governance Sub-
Committee of the Blue Ribbon Panel.
Mayor White noted that we no longer need to address this item, as the Blue Ribbon Panel has indicated they are
making progress.

Mayor White and Council Members updated the Council and addressed questions regarding meetings attended;

16. Items for Future Agendas.
This item allows Council to request the placement of items on upcoming agendas when the topic of
discussion requires research and review that cannot be accomplished in the time frame between regular
Council meetings. However, a Council Member may request that an item be placed on the next regularly
scheduled meeting without first placing that item on the Future Agenda Items list. All requests for agenda
items must comply with Charter requirements.
No changes were made to the list.

replacing the “J” driveway and installation of an 8’ privacy fence and proceed with condemnation if agreement
cannot be made.

Recognition of Life Saving Award by Fire Chief Danny Thomas and Police Chief Scott Kniffen and

Explanation:
On July 27, 2013 Trophy Club resident Paul McClure had a heart attack at the family residence.
He was unconscious, had no pulse and was not breathing. His wife Linda McClure started CPR.
Trophy Club Firefighter/Paramedics Sam Johnson, Steve Rusk and Cy Conditt, Fire Lieutenant
Donnie Hurd, and Engineer Greg Boos responded and began Advanced Cardiac Life Support
(ACLS) procedures. Police Sergeant Wess Tyler, Officer Wade Montgomery, and Officer Dale
Ramirez responded and Sergeant Wess Tyler assisted the Firefighter/Paramedics with CPR.
Following ACLS procedures the patient regained a pulse, and by the time the medic reached
Baylor Grapevine Hospital the patient was breathing on his own and speaking with the
Firefighter/Paramedics. A few days later Mr. McClure underwent a cardiac procedure and
Coronary Bypass Surgery. He was released to rehab on August 8, 2013.

have been certified and returned to the proper judges and clerks thereof; and

Explanation:
The Town has received a formal proposal from GSBS Architects for design and engineering
services for development of a new Trophy Club Police facility. The Town Council previously
accepted the Facilities Planning Report on October 7, 2013 that was prepared by GSBS. The
report detailed the necessities for a police facility that would last 30 – 40 years accounting for
department growth, community build-out and expectations, technological and environmental
efficiencies, etc. The RFP outlines a project timeline that anticipates a June 2014 construction
start date, contingent upon property purchase negotiations.

DESIGN PHILOSOPHY
Our philosophy is simple—to create ‘Evolved Places and Spaces’. To evolve
means ‘to come forth gradually into being’. For GSBS, that means collaborating
with each client to gradually develop a design that meets their specific needs and
creates a sense of ‘place’. In few other places is this goal as important as it is
in municipal design—where evolved facilities create inviting spaces that improve
productivity, encourage efficiency and provide safety to staff and visitors. Well-
designed public spaces promote staff and visitor communication. Beautiful buildings
create a personality, set a mood and enliven a space in order to establish a sense of

LEED INNOVATORS
In 1998, GSBS began to work with the U.S. Green Building Council in the creation of the
Leadership in Energy and Environmental Design (LEED®) rating system. Through this
work, GSBS was able to certify the 2002 Olympic Speed Skating Oval as one of the first
13 LEED pilot projects. We continue to embrace LEED design, with a portfolio of over 33
LEED projects built or in design—with construction cost in excess of $544 million. As a
matter of fact, we are listed on ENR’s Top Green Design Firms list, which features the
top 100 green design firms in the nation.
TREND SETTING DESIGN: NET ZERO
As we strive for the most efficient buildings, we push the limit—with Net Zero design.
Net Zero is a building with zero net energy consumption and zero carbon emissions
annually. Zero energy buildings generates enough energy for their use and can be
independent from the energy grid supply. The Salt Lake City Public Safety Building has
been designed to achieve a net zero demand on utility consumption—incorporating wind
turbines, photovoltaic panels, geothermal energy, light harvesting and LED lighting. It
will also utilize a “misting” fire suppression system and 100% renewable finishes.

Win or lose, season after season, Principal Tom Batenhorst is an avid and dedicated
Nebraska Cornhusker fan. And that same dedication is evident in every project
he oversees at GSBS. He believes that architecture is translating dreams into
reality—listening is the key ingredient to the process. For Tom, providing excellent
service—going above and beyond for every client—is the key to a successful project.
His 31-year architectural career has encompassed the design and management of

• Normal design services as described in AIA contract B101, Standard Agreement between
Owner and Architect.
• Design disciplines and associated fees include:

Dogs at Large citations for 2012: 60
Dogs at Large citations 2013: 64 (thru November 15, 2013)
• Includes dogs that were found to be At Large and were either adopted or transferred to a
rescue group because the owner could not be located.
• Does not include calls made for a Dog At Large to Animal Control or the PD that resulted in
an unable to locate disposition.
The Police Department does not maintain records of Dogs at Large that are not processed
through the PD. There are occasions when a dog is found to be at large and is returned to its
owner directly by the citizen who found the dog by the citizen calling the Police Department for
identification using the Trophy Club Animal Registration Tag.

OCCURS OR CONTINUES; PROVIDING FOR PUBLICATION;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Town Council of the Town of Trophy Club, Texas has the
authority to adopt ordinances for the good government of the Town; and
WHEREAS, the Town currently has a process under which pet owners are
required to obtain a one-time license from the Town for each pet over the age of
three months; and
WHEREAS, the Town Council has determined it appropriate and in the
best interest of the public to repeal the requirement that pet owners register their
pets with the Town and to adopt a requirement that pet owners place a collar on
their pet displaying an owner identification tag and a current rabies vaccination
tag,; and
WHEREAS, the Town Council hereby finds and declares that it is in the
interest of the public health, safety and general welfare to establish the
regulations set forth in this ordinance for the annual licensing of animals within
the limits of the Town of Trophy Club.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF
THE TOWN OF TROPHY CLUB, TEXAS:
SECTION 1.
INCORPORATION OF PREMISES

That the above and foregoing premises are true and correct and are
incorporated herein and made a part hereof for all purposes.
SECTION 2.
AMENDMENT
2.01 Subsection 1.20(A)(1), entitled “License Required” of Section 1.20 entitled
“Licenses and Tags”, of Article I entitled “Animals” of Chapter II, entitled “Animal
Control”, is hereby amended so that Section 1.20(A)(1) shall be entitled “Owner
Identification and Rabies Vaccination Tag Required” and shall be and read in its
entirety as follows:
Section 1.20 Licenses and Tags
A. Owner Identification and Rabies Vaccination Tag Required.
1. A person within the Town who is the Owner or harborer of a dog or a cat that is
three (3) months of age or older shall place and maintain a collar on the animal
which collar shall have: (1) a current identification tag listing the Owner or
harborer’s name, current address and current telephone number, and (2) a tag
evidencing compliance with the requirements of state law regulating rabies
vaccination under the Rabies Control Act, as amended, and Chapter 2 of the
Code of Ordinances of the Town of Trophy Club.
2.02 Subsection (A) entitled “Registration” of Section 8.06 entitled “Animal
Control” of Article VIII entitled “Schedule of Fees” of Chapter 1 entitled
“Administration” imposing a $5.00 fee for the registration of animals within the
Town is hereby repealed in its entirety, and the remainder of Section 8.06 of
Article VIII of Chapter 1 is hereby ratified and affirmed and shall be remain
unaltered.
SECTION 3.
SAVINGS AND REPEALER
That this Ordinance shall be cumulative of all other Ordinances of the
Town affecting Animal Control and shall not repeal any of the provisions of such
Ordinances except in those instances where provisions of those Ordinances are
in direct conflict with the provisions of this Ordinance; whether such Ordinances
are codified or uncodified, and all other provisions of the Ordinances of the Town
of Trophy Club, codified or uncodified, not in conflict with the provisions of this
Ordinance, shall remain in full force and effect. Notwithstanding the foregoing,
any complaint, action, cause of action or claim which prior to the effective date of
this Ordinance has been initiated or has arisen under or pursuant to such
repealed Ordinance(s) shall continue to be governed by the provisions of that
Ordinance and for that purpose the Ordinance shall be deemed to remain and

continue in full force and effect.
SECTION 4.
SEVERABILITY
If any section, article, paragraph, sentence, clause, phrase or word in this
Ordinance, or application thereof to any person or circumstance, is held invalid or
unconstitutional by a Court of competent jurisdiction, such holding shall not affect
the validity of the remaining portions of the Ordinance, and the Town Council
hereby declares it would have passed such remaining of the Ordinance despite
such invalidity, which remaining portions shall remain in full force and effect.
SECTION 5.
ENGROSSMENT AND ENROLLMENT
The Town Secretary of the Town of Trophy Club is hereby directed to
engross and enroll this Ordinance in accordance with the Town Charter.
SECTION 6.
PENALTY
It shall be unlawful for any person to violate any provision of this
Ordinance, and any person violating or failing to comply with any provision of this
Ordinance shall be fined, upon conviction, not less than One Dollar ($1.00) nor
more than Two Thousand Dollars ($2,000.00), and a separate offense shall be
deemed committed upon each day during or on which a violation occurs or
continues.
SECTION 7
PUBLICATION
The Town Secretary of the Town of Trophy Club is hereby directed to the
Caption, Penalty Clause, and Effective Date Clause of this Ordinance as required
by Section 52.011 of the Texas Local Government Code.
SECTION 8.
EFFECTIVE DATE
This Ordinance shall take effect on January 1, 2014 after its passage and
proper publication in accordance with law, and it is so ordained.
PASSED AND APPROVED by the Town Council of the Town of Trophy

REVENUES Property Taxes – Property taxes are billed in October and due by January 31. Most payments are
received in December and January before they become delinquent on February 1st. During the
fiscal year, the Denton Central Appraisal District (DCAD) makes supplemental assessments.
Those assessments are billed by Denton County. Collections to date are 2.1% (includes current,
delinquent, and penalties and interest).
Sales Tax – As shown below, the Town’s total current sales tax collections are exceeded by the
prior year’s sales tax collections by $17,468 (17.96 %). Sales Tax Revenues are at 7.72% of the
budgeted amount.

Franchise Fees – Franchise Fee revenue for the year totals $4,094 (0.6% of the budgeted
amount).
Licenses & Permits – Licenses and Permits revenue for the year totals $72,592 (7.7% of the
budgeted amount).
Intergovernmental – Represents amounts to be received from the Municipal Utility District and
EDC 4B.
Fines and Fees – Several fees related to recreation fall within this category and are seasonal.
EMS transport revenues are lower than anticipated at this time of year.
Other Financing Sources – Represents transfers to be received from Trophy Club Park for
services provided by the General Fund.
Miscellaneous Revenue – Includes extraordinary and non-recurring sources of revenue.
EXPENDITURES
Any existing outstanding expenditures for Fiscal Year 2013 will be subsequently recorded provided
they are paid prior to November 30th.
Information Services – Incode support paid annually (Software and Support) at the beginning of
the fiscal year.
Facilities Management – The Town’s annual property insurance premium was paid for in full
under Facilities Management in order to take advantage of an early payment discount. (This
expense represents 67.4% of the department’s budget).
