As a wellness and general benefit to employees, Management is requesting consideration of allowing employees access
to the Pool and Splash Pad without charge. The proposal is to provide employees with a standard family pass (four (4)
people) at no cost with payment of the $10 fee (resident rate) for each person on the pass above the four (4) family
members.

Dear Mike:
On May 26, 2011, 5 bids were received for the above referenced Town project. A bid
tabulation has been prepared and attached for record. JRJ Paving submitted the lowest
qualified base bid of $1,405,425.64.
As part of the requirement of the bid, experience and qualified references were also
considered to determine the lowest-qualified bidder. Based on confirming these
qualifications and checking references, JRJ Paving has met the bidding requirements.
TNP has reviewed the scope and construction timeline with JRJ Paving and they have
confirmed the project scope and their bid.
Based upon these factors, JRJ Paving meets the requirements necessary to be
awarded this project.

RESOLUTION NO. 2011-14
A RESOLUTION RELATING TO THE GIVING OF NOTICE OF
INTENTION TO ISSUE TOWN OF TROPHY CLUB, TEXAS
COMBINATION TAX AND REVENUE CERTIFICATES OF
OBLIGATION, SERIES 2011 AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Town of Trophy Club, Texas (the “Town”), pursuant to
Subchapter C, Chapter 271, Texas Local Government Code, as amended, is authorized
to issue its certificates of obligation for the purpose of paying contractual obligations to
be incurred for the purposes set forth below; and
WHEREAS, the Town Council of the Town has found and determined that a
notice of intention to issue certificates of obligation should be published in accordance
with the requirements of applicable law;
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS, THAT:
Section 1. The findings and determinations set forth in the preambles hereto
are hereby incorporated by reference for all purposes.
Section 2. The Town Secretary of the Town is hereby authorized and directed
to issue a notice of intention to issue certificates of obligation in substantially the
following form:
NOTICE OF INTENTION TO ISSUE CITY TOWN OF TROPHY
CLUB, TEXAS COMBINATION TAX AND REVENUE
CERTIFICATES OF OBLIGATION, SERIES 2011
NOTICE IS HEREBY GIVEN that on July _, 2011, the Town Council of the Town
of Trophy Club, Texas, at 7:00 p.m. at a regular meeting of the Town Council to be held
at the Town Hall, 100 Municipal Drive, Trophy Club, Texas, the regular meeting place of
the Town Council, intends to pass an ordinance authorizing the issuance of not to
exceed $950,000 principal amount of Combination Tax and Revenue Certificates of
Obligation, in one or more series, for the purpose of paying contractual obligations
incurred for the following purposes, to wit: (i) designing, developing, constructing,
improving, extending, and expanding streets, thoroughfares, sidewalks, bridges, and
other public ways of the Town, including street lighting, signalization, right-of-way
protection, and related storm drainage improvements; and acquiring rights-of-way in
connection therewith (the “Project”); and (iv) to pay for professional services of
attorneys, financial advisors and other professionals in connection with the Project and
the issuance of the Certificates. The Certificates shall bear interest at a rate not to
exceed fifteen percent (15%) per annum, and shall have a maximum maturity date of
not later than forty (40) years after their date. Said Certificates shall be payable from

the levy of a direct and continuing ad valorem tax against all taxable property within the
Town sufficient to pay the interest on this series of Certificates as due and to provide for
the payment of the principal thereof as the same matures, as authorized by
Subchapter C, Chapter 271, Texas Local Government Code, as amended, and from all
or a part of the surplus revenues of the Town’s parks and recreation system, such
pledge of surplus revenues being limited to $1,000.
THIS NOTICE is given in accordance with law and as directed by the Town
Council of the Town of Trophy Club, Texas.

Section 3. The foregoing notice in Section 2 shall be published once a week
for two consecutive weeks, the date of the first publication being not less than the
thirtieth (30th) day prior to the date set forth in the foregoing notice for passage of the
ordinance or ordinances authorizing the Combination Tax and Revenue Certificates of
Obligation. Such notice shall be published in a newspaper of general circulation in the
area of the Town of Trophy Club, Texas.
Section 4. That this resolution shall take effect from and after the date of its
passage.

On June 6, 2011, the Town Council of the Town of Trophy Club, Texas,
convened at 7:00 p.m., in a regular meeting at the regular meeting place thereof, the
meeting being open to the public and notice of said meeting, giving the date, place and
subject thereof, having been posted as prescribed by Chapter 551, Texas Government
Code, as amended; and the roll was called of the duly constituted officers and members

TITLE

EXPLANATION:
The current firearms ordinance appears to permit hunting in Town and does not control any other type of weapon. With
the growth in Town, the areas in which it would be permissible or advisable to hunt have largely been eliminated. This
revision to the Code of Ordinances puts controls on the use of a bow and arrow and an air gun in Town. Further, it limits
Federal Firearms Licensees from storing black or smokeless powder for retail sale and requires certain storage and
notification measures by licensees.

AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS
REPEALING ARTICLE FIVE ENTITLED “DISCHARGE OF FIREARMS”
OF CHAPTER TEN ENTITLED “PUBLIC SAFETY” OF THE CODE OF
ORDINANCES OF THE TOWN AND ADOPTING A NEW ARTICLE FIVE
ENTITLED “DISCHARGE OF FIREARMS AND REGULATION OF
WEAPONS” OF CHAPTER TEN ENTITLED “PUBLIC SAFETY” OF
THE CODE OF ORDINANCES; PROVIDING FOR THE
INCORPORATION OF PREMISES; PROVIDING FOR AMENDMENTS
TO CHAPTER TEN AS SET FORTH IN THE ORDINANCE; PROVIDING
A CUMULATIVE REPEALER CLAUSE; PROVIDING A SAVINGS
CLAUSE; PROVIDING SEVERABILITY; PROVIDING FOR

WHEREAS, the Town adopted an ordinance regulating the discharge of firearms
within the Town that has been codified in Article 5 of Chapter 10 of the Code of
Ordinances of the Town; and
WHEREAS, upon review of Article 5, Town staff determined that as currently
written, Article 5 was in need of update to ensure that hunting within the Town is
prohibited, that other types of weapons are included in the regulations, and that certain
regulations are included; and
WHEREAS, in order to protect the public health, safety, and welfare, it is
necessary to amend Article 5 as set forth herein; and
WHEREAS, the Town Council hereby finds that the repeal of the existing Article
5 entitled “Discharge of Firearms” of Chapter 10 of the Code of Ordinances of the Town
and the adoption of a new Article 5 entitled “Discharge of Firearms” of Chapter 10 of the
Code of Ordinances of the Town as set forth below is in the best interests of the health,
safety and welfare of the citizens of the Town.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS:

SECTION 1.
INCORPORATION OF PREMISES
The above and foregoing premises having been found by the Town Council to be true
and correct are incorporated herein and made a part hereof for all purposes.
SECTION 2.
AMENDMENT
2.01 Article V entitled “Discharge of Firearms” of Chapter X entitled “Public Safety” of
the Code of Ordinances of the Town of Trophy Club is hereby repealed and a new
Article V entitled “Discharge of Firearms and Regulation of Weapons” of Chapter X of
the Code of Ordinances of the Town is hereby adopted and shall be and read in its
entirety as follows:
“Article V. Discharge of Firearms and Regulation of Weapons.
Section 5.01 Definitions.
A. Airgun means any device designed, made, or adapted to expel a projectile
through a barrel by using the energy generated by compressed air and
including, but not limited to, air guns, BB or pellet guns, air-soft guns, paint
ball guns and other similar devices.
B. Archery Equipment shall mean a long bow, compound bow, recurved bow,
crossbow or other similar device.
C. Domestic Animal shall mean any animal other than Wildlife as defined
herein.
D. Firearm means any device designed, made, or adapted to expel a
projectile through a barrel by using the energy generated by an explosion
or burning substance or any device readily convertible to that use.
E. Wildlife means any wild mammal, aquatic animal, wild bird, amphibian,
reptile, mollusk, or crustacean, or any part, product egg, or offspring, of any
of these, dead or alive.
Section 5.02 Discharge of Firearms Prohibited.
A. Discharge. It shall be unlawful for any person to fire or discharge any
Firearm within the Town. Notwithstanding the foregoing, the following actions
shall be allowed:
1. The discharge of a Firearm done in the necessary and lawful protection of a
person, premises or property, unless such discharge is reckless or negligent
under the circumstances existing at the time.
2. The discharge of a Firearm by a duly authorized peace officer while lawfully
carrying out his official duties.

Section 5.03 Firearms Dealers.
A. Generally. A person making application to hold or holding any federal Firearms
license to conduct business in the Town shall:
1. Comply with all Federal, State, County, and local regulations regarding all
applicable license applications and/or the operation of such Firearm or
Firearm related business.
2. Advise the Chief of Police or his or her designee of the theft or loss of any
Firearm in the possession or control of such person and shall supply the
make, model, and serial number of any such Firearm stolen or lost.
3. Secure all Firearms in his or her possession in a secure device designed for
the purpose of storing Firearms.
B. Prohibited Conduct. No person holding any federal Firearms license to
conduct business in the Town shall store black or smokeless powder for retail
sale.
Section 5.04 Other Weapons.
A. Archery Equipment. It shall be unlawful for any person to discharge any
Archery Equipment within the Town. Notwithstanding the foregoing, the
following actions shall be allowed:
1. The discharge of Archery Equipment in an establishment properly fitted
and arranged for the purpose so that no danger arises therefrom;
provided, however, that an archery range shall only be allowed in an
establishment which has as its primary operation the sale and/or repair
of sporting equipment or Archery Equipment.
2. The discharge of Archery Equipment done in the necessary and lawful
protection of the person, premises or property unless such discharge is
reckless or negligent under the circumstances existing at the time;
3. The discharge of Archery Equipment on private property when all
projectiles discharged remain contained within the confines of property
controlled or owned by the person discharging or allowing the discharge
of the archery equipment.
4. The discharge of Archery Equipment by a person under the age of
eighteen (18) on private property when such minor person is under the
supervision of an adult person controlling or owning the property and all
projectiles discharged remain contained within the confines of the
property.
B. Archery Equipment – Animals. No person shall use Archery Equipment to
intentionally, knowingly, or recklessly injure or kill either a Domestic Animal or
Wildlife.
C. Airguns. It shall be unlawful for any person to discharge an Airgun within the
Town. Notwithstanding the foregoing, the following actions shall be allowed:

1. The discharge of an Airgun on private property when all projectiles
discharged remain contained within the confines of property controlled or
owned by the person discharging or allowing the discharging of the Airgun.
2. The discharge of an Airgun by a person under the age of eighteen (18) on
private property when such minor person is under the supervision of an adult
person controlling or owning the property and all projectiles discharged
remain contained within the confines of the property.
D. Airguns – Animals. No person shall use an Airgun to intentionally, knowingly, or
recklessly injure or kill either a Domestic Animal or Wildlife.
Section 5.05 Hunting.
A. No person shall hunt Wildlife within the Town of Trophy Club or on property
leased by the Town of Trophy Club, except as follows:
1. When acting pursuant to a written contract with the Town of Trophy Club.
2. When acting in the course and scope of employment with the Trophy Club
Police Department in accordance with such person’s job description.
3. When acting pursuant to a written contract with the U.S. Army Corp of
Engineers or a permit issued by the U.S. Army Corp of Engineers. “
Section 3.
Penalty
It shall be unlawful for any person to violate any provision of this Ordinance, and any
person violating or failing to comply with any provision of this Ordinance shall be fined,
upon conviction, not less than One Dollar ($1.00) nor more than Two Thousand Dollars
($2000.00), and a separate offense shall be deemed committed upon each day during
or on which a violation occurs or continues. The penalty provided herein shall be
cumulative of all other remedies available for enforcement of the provisions of this
Ordinance. The remedy provided herein shall be cumulative of all other remedies
authorized by law.
Section 4.
Cumulative Repealer Clause
This Ordinance shall be cumulative of all other Ordinances and shall not repeal any of
the provisions of such Ordinances except for those instances where there are direct
conflicts with the provisions of this Ordinance. Ordinances or parts thereof in force at
the time this Ordinance shall take effect and that are inconsistent with this Ordinance
are hereby repealed to the extent that they are inconsistent with this Ordinance.
Provided however, that any complaint, action, claim or lawsuit which has been initiated
or has arisen under or pursuant to such Ordinance on the date of adoption of this
Ordinance shall continue to be governed by the provisions of that Ordinance and for
that purpose the Ordinance shall remain in full force and effect.

Section 5.
Severability
If any section, article, paragraph, sentence, clause, phrase or word in this Ordinance or
application thereof to any person or circumstance is held invalid or unconstitutional by a
Court of competent jurisdiction, such holding shall not affect the validity of the remaining
portions of this Ordinance, and the Town Council hereby declares it would have passed
such remaining portions of this Ordinance despite such invalidity, which remaining
portions shall remain in full force and effect.
Section 6.
Savings
All rights and remedies of the Town of Trophy Club, Texas, are expressly saved as to
any and all Violations of the provisions of any other Ordinance affecting the discharge of
firearms which have secured at the time of the effective date of this Ordinance; and, as
to such accrued Violations and all pending litigation, both civil and criminal, whether
pending in court or not, under such Ordinances same shall not be affected by this
Ordinance but may be prosecuted until final disposition by the courts.
Section 7.
Publication
The Town Secretary of the Town of Trophy Club is hereby directed to publish the
Caption, Penalty Clause, and Effective Date Clause of this Ordinance as required by
Section 52.011 of the Texas Local Government Code.
Section 8.
Engrossment and Enrollment
The Town Secretary of the Town of Trophy Club is hereby directed to engross and
enroll this Ordinance by copying the exact Caption and Effective Date clause in the
minutes of the Town Council of the Town of Trophy Club and by filing this Ordinance in
the Ordinance records of the Town.
Section 9.
Effective Date
This Ordinance shall become effective from and after its date of adoption and
publication as provided by law, and it is so ordained.
PASSED AND APPROVED by the Town Council of the Town of Trophy Club,
Texas this 6th day of June, 2011.

TITLE

EXPLANATION:
The Town Charter provides authority for the Mayor to execute various documents authorized by Council. Additionally,
per the Charter, the Town Manager serves as the Town's Chief Administrative Officer with the responsiblity of
implementing the final budget approved by Council and performing other duties as prescribed by Council by ordinance or
otherwise.
The Town's Procurement Policies designate the Town Manager as the person with oversight over Town purchases. The
Town Manager has been authorized in the past to execute various documents consistent with approved expenditures.
The proposed ordinance would better define the parameters of the Town Manager's authority relative to purchases and
other operational matters necessary for efficient and responsive operations. The proposed ordinance also documents the
Mayors signature authority with an ordinance as referenced in the Charter.

AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS,
AMENDING CHAPTER 1 OF THE CODE OF ORDINANCES OF THE
TOWN, ENTITLED “ADMINISTRATION”, BY ADDING SECTION 2.01
ENTITLED “SIGNATURE AUTHORITY – MAYOR AND TOWN
MANAGER” TO ARTICLE II, ENTITLED “TOWN MANAGER”, SETTING
FORTH THE SIGNATURE AUTHORITY OF THE MAYOR AND THE
TOWN MANAGER; PROVIDING FOR THE INCORPORATION OF
PREMISES; PROVIDING FOR AN AMENDMENT; PROVIDING A
CUMULATIVE REPEALER CLAUSE; PROVIDING A SEVERABILITY
CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Town is a home rule municipality organized under the
Constitution and the laws of the State of Texas; and
WHEREAS, Sections 3.06 and 3.06A of Article III of the Town’s Home Rule
Charter provides that the Mayor shall sign, after authorization by the Council, all
contracts, conveyances made or entered into by the Town, all bonds, warrants and any
other obligations issued under the provisions of the Charter, in the manner prescribed in
the ordinance authorizing the signing of any such obligation; and
WHEREAS, Section 4.05 of the Town’s Home Rule Charter sets forth specific
duties of the Town Manager which include the duty to implement the final budget
approved by the Council in order to achieve the goals of the Town and to perform other
duties as prescribed by Council via ordinance; and
WHEREAS, the Town Council has adopted procurement policies allowing the
Town Manager oversight of procurement for the Town; and
WHEREAS, in order to facilitate the efficient operation of the Town and the
implementation of the final budget, it is necessary to authorize the Town Manager to
execute certain documents; and
WHEREAS, the Town Council has determined that pursuant to the Charter, the
Mayor and the Town Manager should be authorized to execute documents in
accordance with the guidelines set forth below; and
NOW THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF
TROPHY CLUB, TEXAS:

SECTION 1.
INCORPORATION OF PREMISES
All of the above premises are true and correct and are hereby incorporated in the
body of this Ordinance as if fully set forth herein.
SECTION 2.
AMENDMENT
2.01. Chapter 1 entitled “Administration” of the Code of Ordinances is amended to add
Article II entitled “Town Manager,” Section 2.01 entitled “Signature Authority – Mayor
and Town Manager” which is hereby adopted and shall be and read in its entirety as
follows:
“2.01 Signature Authority – Mayor and Town Manager.
A. Mayor. The Mayor of the Town of Trophy Club or designee
(hereinafter “Mayor”) is hereby authorized to execute all documents
as authorized by the Town’s Home Rule Charter.
B. Town Manager. The following contracts may be entered into and
executed on behalf of the Town by the Town Manager or designee
(hereinafter “Town Manager”) without further Council authorization:
1. Contracts for the purchase of goods or services equal to or less
than twenty five thousand dollars ($25,000.00) for which funds
have been budgeted or anticipated in the fiscal year during which
payment is due;
2. Contracts for the purchase of goods or services in excess of
twenty five thousand dollars ($25,000.00) for which funds have
been budgeted in the fiscal year during which payment is due
and which are purchased from a cooperative purchasing vendor
approved by Resolution in accordance with the Town’s
Procurement Policies and Procedures;
3. Contracts for goods or services which do not require an
expenditure of funds and which are determined necessary for the
efficient operation of the Town and the implementation of the
final budget;
4. Contracts for the use of Town owned facilities;
5. An individual Contract Change Order for an amount of Ten Thousand
Dollars ($10,000.00) or less or multiple Contract Change Orders with a
cumulative total of Twenty-Five Thousand Dollars ($25,000.00) or less;

6. Settlement Agreements after approval by Town Council;
7. Contracts for purchases made pursuant to the Emergency
Management Policy and Procedure for the Town of Trophy Club
in effect at the time of the purchase; and
8. Contracts for which the Town Council has otherwise expressly
provided authorization for execution by the Town Manager."
SECTION 3.
CUMULATIVE REPEALER
This Ordinance shall be cumulative of all other Ordinances and shall not repeal
any of the provisions of such Ordinances, whether codified or uncodified, except for
those instances where there are direct conflicts with the provisions of this Ordinance.
Ordinances or parts thereof in force at the time this Ordinance shall take effect and that
are inconsistent with this Ordinance are hereby repealed to the extent that they are
inconsistent with this Ordinance. Provided however, that any complaint, action, claim or
lawsuit which has been initiated or has arisen under or pursuant to any such Ordinance
on the date of adoption of this Ordinance shall continue to be governed by the
provisions of such Ordinance and for that purpose the Ordinance shall remain in full
force and effect.
SECTION 4.
SEVERABILITY
If any section, article, paragraph, sentence, clause, phrase or word in this
Ordinance or application thereof to any person or circumstance is held invalid or
unconstitutional by a Court of competent jurisdiction, such holding shall not affect the
validity of the remaining portions of this Ordinance, and the Town Council hereby
declares it would have passed such remaining portions of this Ordinance despite such
invalidity or unconstitutionality and that such remaining portions shall remain in full force
and effect.
SECTION 5.
ENGROSSMENT AND ENROLLMENT
The Town Secretary of the Town of Trophy Club is hereby directed to engross
and enroll this Ordinance by copying the exact Caption and Effective Date in the minutes
of the Town Council and by filing this Ordinance in the ordinance records of the Town.
SECTION 6.
EFFECTIVE DATE
This Ordinance shall become effective from and after its date of adoption and
publication as provided by law, and it is so ordained.

A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF
TROPHY CLUB, TEXAS, NOMINATING ONE MEMBER TO THE
BOARD OF MANAGERS OF THE DENCO AREA 9-1-1 DISTRICT; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, Section 772, Health and Safety Code, provides that two voting
members of the Board of Managers of an Emergency Communications District shall be
appointed jointly by all cities and towns lying wholly or partly within such District; and
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF
THE TOWN OF TROPHY CLUB, TEXAS:
Section 1. That the Town of Trophy Club, Texas, hereby nominates __ as a
member of the Board of Managers for the Denco Area 9-1-1 Emergency

THE END IS NEAR: FINAL MARCHING ORDERS
As the 2011 legislative session draws to a close, here are the top five issues that city officials
should speak out on. We urge you to pick the one or two items that matter most to your city and
contact your legislators now.
1. Elections: S.B. 100 by Sen. Leticia Van de Putte would effectively eliminate the May
uniform election date in even-numbered years for the majority of Texas cities. If the
Senate-approved version of the bill passes, the vast majority of cities could be forced to
conduct their elections in November. Please urge your state representative or senator to
preserve a viable spring election date for your city.
2. Budget: The conference committee report for House Bill 1 contains cuts to both the
mixed beverage tax and to local parks grants. The conference committee report has yet to

be adopted by the House or the Senate. Please contact your state representatives and
senators and urge them to restore those funding cuts.
3. ATV Sales Tax: H.B. 2237 by Rep. Lanham Lyne would reclassify all-terrain vehicles,
off-road motorcycles, and arguably golf carts as “motor vehicles.” (The same provisions
have appeared in versions of H.B. 2357 by Rep. Joe Pickett, an omnibus bill relating to
the Texas Department of Motor Vehicles.) That classification would subject them to the
motor vehicle sales tax, which means that the state would continue to collect its full sales
taxes as it does on cars and trucks, but cities would lose all their sales taxes on these
vehicles. H.B. 2237 has been referred to the Senate Transportation and Homeland
Security Committee. Please contact members of the committee to express your
opposition.
4. Court Fees: Today the House plans to consider an omnibus fiscal matters bill, S.B. 1811
by Senator Steve Ogden and sponsored by Representative Jim Pitts. Proposed
amendments to this bill include an increase in the State Traffic Fine from $30 to $45 and
a $5 court fee for indigent defense. We urge you to contact your state representative to
express your opposition to these amendments. (Note: S.B. 1811 is critical to the state
budget. The bill has been postponed numerous times over the past days. If it does not
pass, the legislature will be forced to call a special session to deal with funding issues
contained in the bill.)
5. Open Government: S.B. 1826 by Sen. Mario Gallegos would expand the statutory
definition of a “deliberation” under the Open Meetings Act to include written and e-mail
communications. The bill has passed the Senate and would make it even more difficult
for city officials to receive information on important city issues outside of a posted city
council meeting. S.B. 1571 by Senator Kirk Watson would make the personal e-mails or
text messages of a city official or employee that relate to city business subject to the
Public Information Act. The bill also would subject the records of most city vendors to
the Public Information Act and would require cities to handle open records requests for
information belonging to private vendors doing business with the city. Please contact
your state representative or state senator to express your opposition to these bills.
As is true every session, much action in the final days of the session will take place in conference
committee. These committees invariably will do some or all of the following: (1) meet in secret
with no chance for League staff or anyone else to participate; (2) go “outside the bounds” of the
rules to inject bad ideas from other bills into the final conference report; and/or (3) go “outside
the bounds” to inject bad ideas into final conference bills that weren’t even considered at all in
other bills during the session. League staff will be as vigilant as possible during this process, but
direct contact from city officials on the items that matter most will have the most impact at this
stage.
The next issue of the Legislative Update will contain a summary of all the city-related bills that
pass, and city officials are urged to register for the Legislative Wrap-up Workshop that will be
held in Austin on June 27.

ADDITIONAL BILLS OF INTEREST
In lieu of the usual Recent Actions section, this section will list some of the bills that – in addition to
those in the final marching orders above – could be detrimental to municipal authority and are still alive
as stand-alone legislation. In addition, any of them could be amended to other bills at any time.
H.B. 3372 (T. King)/H.B. 3391 (S. Miller) – Rainwater Harvesting: would enact
various provisions relating to the promotion of rainwater harvesting. Of particular
interest to cities, the bills would – among other things – provide that: (1) the Texas
Commission on Environmental Quality develop rules regarding the installation and
maintenance of rainwater harvesting systems that are used for indoor potable purposes
and connected to a public water supply system; (2) a person who intends to connect a
rainwater harvesting system to a public water supply system for use for potable purposes
must give written notice of that intention to the municipality in which the rainwater
harvesting system is located before connecting the rainwater harvesting system to the
public water supply system; and (3) a city is not generally liable for issues relating to the
connection of the rainwater harvesting system.
H.B. 3823 (Thompson) – 911 Dispatcher Training: would – among other things – provide
that the Texas Commission on Law Enforcement Officer Standards and Education shall
require a state, county, special district, or municipal agency that employs
telecommunicators (defined as “a person acknowledged by the commission and
employed by or serving a law enforcement agency that performs law enforcement
services on a 24-hour basis who receives, processes, and transmits public safety
information and criminal justice data for the agency by using a base radio station on a
public safety frequency”) to provide each telecommunicator with 24 hours of crisis
communications instruction approved by the commission on or before the first
anniversary of the telecommunicator's first day of employment.
S.B. 361 (Duncan) – Indemnification: would prohibit “broad form indemnity” in
construction contracts, which could increase litigation and insurance costs for cities.
S.B. 766 (Estes) – Sport Shooting Ranges: would limit the authority of cities to
regulate sport shooting ranges.
S.B. 1420 (Hinojosa) – Red Light Photo Enforcement: This is the Texas Department
of Transportation (TxDOT) sunset bill. The bill – among many other things – would: (1)
provide that a local authority may not install a photographic traffic signal enforcement
system at an intersection approach located on a state highway under the jurisdiction of
TxDOT unless TxDOT, after notice and a public hearing, approves the installation of the
system; and (2) prohibit TxDOT from approving the installation of a photographic traffic
signal enforcement system under (1) in a city with a population of less than 40,000.
The good news is that, while some of the above bills could be detrimental to cities, the list is
fairly short. Of course, during this time of numerous amendments and conference committees on

hundreds of bills, League staff will remain vigilant as we attempt to ferret out any “legislative
tomfoolery” in the final days of session.
CITY OFFICIALS TESTIFY
When the legislature is in session, nothing compares to the effectiveness of city officials
testifying at the Capitol. City officials who take their time to travel to Austin to speak out on
important city issues should be applauded by us all. Among the city officials who recently
testified in front of legislative committees are the following:
