A bid tabulation has been prepared and attached for record. JRJ Paving submitted the lowest qualified base bid of $1,405,425.64. As part of the requirement of the bid, experience and qualified references were also considered to determine the lowest-qualified bidder. Based on confirming these qualifications and checking references, JRJ Paving has met the bidding requirements. TNP has reviewed the scope and construction timeline with JRJ Paving and they have confirmed the project scope and their bid. Discharge of Firearms and Regulation of Weapons. Section 5.01 Definitions. A. Airgun means any device designed, made, or adapted to expel a projectile through a barrel by using the energy generated by compressed air and including, but not limited to, air guns, BB or pellet guns, air-soft guns, paint ball guns and other similar devices. B. Archery Equipment shall mean a long bow, compound bow, recurved bow, crossbow or other similar device. C. Domestic Animal shall mean any animal other than Wildlife as defined herein. D. Firearm means any device designed, made, or adapted to expel a projectile through a barrel by using the energy generated by an explosion or burning substance or any device readily convertible to that use. E. Wildlife means any wild mammal, aquatic animal, wild bird, amphibian, reptile, mollusk, or crustacean, or any part, product egg, or offspring, of any of these, dead or alive. Section 5.02 Discharge of Firearms Prohibited. A. Discharge. It shall be unlawful for any person to fire or discharge any Firearm within the Town. Notwithstanding the foregoing, the following actions shall be allowed: 1. The discharge of a Firearm done in the necessary and lawful protection of a person, premises or property, unless such discharge is reckless or negligent under the circumstances existing at the time. 2. The discharge of a Firearm by a duly authorized peace officer while lawfully carrying out his official duties. Town Council 23 of 51 Meeting Date: June 6, 2011 Section 5.03 Firearms Dealers. A. Generally. A person making application to hold or holding any federal Firearms license to conduct business in the Town shall: 1. Comply with all Federal, State, County, and local regulations regarding all applicable license applications and/or the operation of such Firearm or Firearm related business. 2. Advise the Chief of Police or his or her designee of the theft or loss of any Firearm in the possession or control of such person and shall supply the make, model, and serial number of any such Firearm stolen or lost. 3. Secure all Firearms in his or her possession in a secure device designed for the purpose of storing Firearms. B. Prohibited Conduct. No person holding any federal Firearms license to conduct business in the Town shall store black or smokeless powder for retail sale. Section 5.04 Other Weapons. A. Archery Equipment. It shall be unlawful for any person to discharge any Archery Equipment within the Town. Notwithstanding the foregoing, the following actions shall be allowed: 1. The discharge of Archery Equipment in an establishment properly fitted and arranged for the purpose so that no danger arises therefrom; provided, however, that an archery range shall only be allowed in an establishment which has as its primary operation the sale and/or repair of sporting equipment or Archery Equipment. 2. The discharge of Archery Equipment done in the necessary and lawful protection of the person, premises or property unless such discharge is reckless or negligent under the circumstances existing at the time; 3. The discharge of Archery Equipment on private property when all projectiles discharged remain contained within the confines of property controlled or owned by the person discharging or allowing the discharge of the archery equipment. 4. The discharge of Archery Equipment by a person under the age of eighteen (18) on private property when such minor person is under the supervision of an adult person controlling or owning the property and all projectiles discharged remain contained within the confines of the property. B. Archery Equipment – Animals. No person shall use Archery Equipment to intentionally, knowingly, or recklessly injure or kill either a Domestic Animal or Wildlife. C. Airguns. It shall be unlawful for any person to discharge an Airgun within the Town. Notwithstanding the foregoing, the following actions shall be allowed: Town Council 24 of 51 Meeting Date: June 6, 2011 1. The discharge of an Airgun on private property when all projectiles discharged remain contained within the confines of property controlled or owned by the person discharging or allowing the discharging of the Airgun. 2. The discharge of an Airgun by a person under the age of eighteen (18) on private property when such minor person is under the supervision of an adult person controlling or owning the property and all projectiles discharged remain contained within the confines of the property. D. Airguns – Animals. No person shall use an Airgun to intentionally, knowingly, or recklessly injure or kill either a Domestic Animal or Wildlife. Section 5.05 Hunting. A. No person shall hunt Wildlife within the Town of Trophy Club or on property leased by the Town of Trophy Club, except as follows: 1. When acting pursuant to a written contract with the Town of Trophy Club. 2. When acting in the course and scope of employment with the Trophy Club Police Department in accordance with such person’s job description. 3. When acting pursuant to a written contract with the U.S. Army Corp of Engineers or a permit issued by the U.S. Army Corp of Engineers. “ Section 3. Penalty It shall be unlawful for any person to violate any provision of this Ordinance, and any person violating or failing to comply with any provision of this Ordinance shall be fined, upon conviction, not less than One Dollar ($1.00) nor more than Two Thousand Dollars ($2000.00), and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. The penalty provided herein shall be cumulative of all other remedies available for enforcement of the provisions of this Ordinance. The remedy provided herein shall be cumulative of all other remedies authorized by law. Section 4. Cumulative Repealer Clause This Ordinance shall be cumulative of all other Ordinances and shall not repeal any of the provisions of such Ordinances except for those instances where there are direct conflicts with the provisions of this Ordinance. Ordinances or parts thereof in force at the time this Ordinance shall take effect and that are inconsistent with this Ordinance are hereby repealed to the extent that they are inconsistent with this Ordinance. Provided however, that any complaint, action, claim or lawsuit which has been initiated or has arisen under or pursuant to such Ordinance on the date of adoption of this Ordinance shall continue to be governed by the provisions of that Ordinance and for that purpose the Ordinance shall remain in full force and effect. Severability If any section, article, paragraph, sentence, clause, phrase or word in this Ordinance or application thereof to any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this Ordinance, and the Town Council hereby declares it would have passed such remaining portions of this Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 6. Savings All rights and remedies of the Town of Trophy Club, Texas, are expressly saved as to any and all Violations of the provisions of any other Ordinance affecting the discharge of firearms which have secured at the time of the effective date of this Ordinance; and, as to such accrued Violations and all pending litigation, both civil and criminal, whether pending in court or not, under such Ordinances same shall not be affected by this Ordinance but may be prosecuted until final disposition by the courts. Section 7. Publication The Town Secretary of the Town of Trophy Club is hereby directed to publish the Caption, Penalty Clause, and Effective Date Clause of this Ordinance as required by Section 52.011 of the Texas Local Government Code. CUMULATIVE REPEALER This Ordinance shall be cumulative of all other Ordinances and shall not repeal any of the provisions of such Ordinances, whether codified or uncodified, except for those instances where there are direct conflicts with the provisions of this Ordinance. Ordinances or parts thereof in force at the time this Ordinance shall take effect and that are inconsistent with this Ordinance are hereby repealed to the extent that they are inconsistent with this Ordinance. Provided however, that any complaint, action, claim or lawsuit which has been initiated or has arisen under or pursuant to any such Ordinance on the date of adoption of this Ordinance shall continue to be governed by the provisions of such Ordinance and for that purpose the Ordinance shall remain in full force and effect. SECTION 4. SEVERABILITY If any section, article, paragraph, sentence, clause, phrase or word in this Ordinance or application thereof to any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this Ordinance, and the Town Council hereby declares it would have passed such remaining portions of this Ordinance despite such invalidity or unconstitutionality and that such remaining portions shall remain in full force and effect. SECTION 5. ENGROSSMENT AND ENROLLMENT The Town Secretary of the Town of Trophy Club is hereby directed to engross and enroll this Ordinance by copying the exact Caption and Effective Date in the minutes of the Town Council and by filing this Ordinance in the ordinance records of the Town. SECTION 6. EFFECTIVE DATE This Ordinance shall become effective from and after its date of adoption and publication as provided by law, and it is so ordained. We urge you to pick the one or two items that matter most to your city and contact your legislators now. 1. Elections: S.B. 100 by Sen. Leticia Van de Putte would effectively eliminate the May uniform election date in even-numbered years for the majority of Texas cities. If the Senate-approved version of the bill passes, the vast majority of cities could be forced to conduct their elections in November. Please urge your state representative or senator to preserve a viable spring election date for your city. 2. Budget: The conference committee report for House Bill 1 contains cuts to both the mixed beverage tax and to local parks grants. The conference committee report has yet to NOTICE This is the final TML Legislative Update of the Eighty-Second Regular Session. Town Council 48 of 51 Meeting Date: June 6, 2011 2   be adopted by the House or the Senate. Please contact your state representatives and senators and urge them to restore those funding cuts. 3. ATV Sales Tax: H.B. 2237 by Rep. Lanham Lyne would reclassify all-terrain vehicles, off-road motorcycles, and arguably golf carts as “motor vehicles.” (The same provisions have appeared in versions of H.B. 2357 by Rep. Joe Pickett, an omnibus bill relating to the Texas Department of Motor Vehicles.) That classification would subject them to the motor vehicle sales tax, which means that the state would continue to collect its full sales taxes as it does on cars and trucks, but cities would lose all their sales taxes on these vehicles. H.B. 2237 has been referred to the Senate Transportation and Homeland Security Committee. Please contact members of the committee to express your opposition. 4. Court Fees: Today the House plans to consider an omnibus fiscal matters bill, S.B. 1811 by Senator Steve Ogden and sponsored by Representative Jim Pitts. Proposed amendments to this bill include an increase in the State Traffic Fine from $30 to $45 and a $5 court fee for indigent defense. We urge you to contact your state representative to express your opposition to these amendments. (Note: S.B. 1811 is critical to the state budget. The bill has been postponed numerous times over the past days. If it does not pass, the legislature will be forced to call a special session to deal with funding issues contained in the bill.) 5. Open Government: S.B. 1826 by Sen. Mario Gallegos would expand the statutory definition of a “deliberation” under the Open Meetings Act to include written and e-mail communications. The bill has passed the Senate and would make it even more difficult for city officials to receive information on important city issues outside of a posted city council meeting. S.B. 1571 by Senator Kirk Watson would make the personal e-mails or text messages of a city official or employee that relate to city business subject to the Public Information Act. The bill also would subject the records of most city vendors to the Public Information Act and would require cities to handle open records requests for information belonging to private vendors doing business with the city. Please contact your state representative or state senator to express your opposition to these bills. As is true every session, much action in the final days of the session will take place in conference committee. These committees invariably will do some or all of the following: (1) meet in secret with no chance for League staff or anyone else to participate; (2) go “outside the bounds” of the rules to inject bad ideas from other bills into the final conference report; and/or (3) go “outside the bounds” to inject bad ideas into final conference bills that weren’t even considered at all in other bills during the session. League staff will be as vigilant as possible during this process, but direct contact from city officials on the items that matter most will have the most impact at this stage. The next issue of the Legislative Update will contain a summary of all the city-related bills that pass, and city officials are urged to register for the Legislative Wrap-up Workshop that will be held in Austin on June 27. Town Council 49 of 51 Meeting Date: June 6, 2011 3   ADDITIONAL BILLS OF INTEREST In lieu of the usual Recent Actions section, this section will list some of the bills that – in addition to those in the final marching orders above – could be detrimental to municipal authority and are still alive as stand-alone legislation. In addition, any of them could be amended to other bills at any time.  H.B. 3372 (T. King)/H.B. 3391 (S. Miller) – Rainwater Harvesting: would enact various provisions relating to the promotion of rainwater harvesting. Of particular interest to cities, the bills would – among other things – provide that: (1) the Texas Commission on Environmental Quality develop rules regarding the installation and maintenance of rainwater harvesting systems that are used for indoor potable purposes and connected to a public water supply system; (2) a person who intends to connect a rainwater harvesting system to a public water supply system for use for potable purposes must give written notice of that intention to the municipality in which the rainwater harvesting system is located before connecting the rainwater harvesting system to the public water supply system; and (3) a city is not generally liable for issues relating to the connection of the rainwater harvesting system.  H.B. 3823 (Thompson) – 911 Dispatcher Training: would – among other things – provide that the Texas Commission on Law Enforcement Officer Standards and Education shall require a state, county, special district, or municipal agency that employs telecommunicators (defined as “a person acknowledged by the commission and employed by or serving a law enforcement agency that performs law enforcement services on a 24-hour basis who receives, processes, and transmits public safety information and criminal justice data for the agency by using a base radio station on a public safety frequency”) to provide each telecommunicator with 24 hours of crisis communications instruction approved by the commission on or before the first anniversary of the telecommunicator's first day of employment.  S.B. 361 (Duncan) – Indemnification: would prohibit “broad form indemnity” in construction contracts, which could increase litigation and insurance costs for cities.  S.B. 766 (Estes) – Sport Shooting Ranges: would limit the authority of cities to regulate sport shooting ranges.  S.B. 1420 (Hinojosa) – Red Light Photo Enforcement: This is the Texas Department of Transportation (TxDOT) sunset bill. The bill – among many other things – would: (1) provide that a local authority may not install a photographic traffic signal enforcement system at an intersection approach located on a state highway under the jurisdiction of TxDOT unless TxDOT, after notice and a public hearing, approves the installation of the system; and (2) prohibit TxDOT from approving the installation of a photographic traffic signal enforcement system under (1) in a city with a population of less than 40,000. The good news is that, while some of the above bills could be detrimental to cities, the list is fairly short. Of course, during this time of numerous amendments and conference committees on Town Council 50 of 51 Meeting Date: June 6, 2011 4   hundreds of bills, League staff will remain vigilant as we attempt to ferret out any “legislative tomfoolery” in the final days of session. CITY OFFICIALS TESTIFY When the legislature is in session, nothing compares to the effectiveness of city officials testifying at the Capitol. City officials who take their time to travel to Austin to speak out on important city issues should be applauded by us all.
