Nominations 9 D.5 Receive and discuss the 2008 Volunteer Citizen of the Year Committees' recommendation, and take appropriate action as necessary. Council member Edstrom requested that Council consider deferring the item until the April 20th meeting when Council is scheduled to announce the recipients’ names. Council member Edstrom felt that dealing with the item now lessens the excitement when Council makes the actual announcement. Citizen of the Year Committee (COYC) representatives Pearl Ford and Peggy Sweeny addressed the Council stating that the COYC requests the Council consider expanding the Teenage Category to a Youth Category to include eligibility for children under the age of 12. The COYC discussed the categories for each nominee; agreeing that some nominees were submitted in a category not applicable to the definition for that category. The COYC also requests the Council provide direction as to the Committee’s obligation to recommend a recipient in a particular category, should the nominees not meet the criteria for the category they were submitted for. Mayor Pro Tem Sterling suggested that the category be left blank on the nomination form, leaving the Committee to designate the category. Motion made by Moss, seconded by Sterling to receive 2008 Volunteer Citizen of the Year Committees' recommendation. Motion passed 4:1, with Wilson abstaining. 10 The following action occurred at the March 2, 2009 Town Council meeting: C.3 Discuss and take appropriate action regarding the Citizen of the Year Committee. A. Each Council Member and the Mayor to select one nominee to serve on the Committee. The Volunteer Citizen of the Year Committee will make a recommendation to the Town Council at their second meeting in March. The Committee will be comprised of one nominee from each Council Member and the Mayor, as well as past Volunteer Citizen of the Year recipients who are able to participate. Any member of the Selection Committee sharing a close, personal relationship with a nominee (such as a relative, etc.) should recuse themselves from the Committee. EXPLANATION: Ordinance 2009-04 approved by the Town Council on February 16, 2009, repealing and adopting a new Article VIII entitled “Tree Preservation and Removal” of Chapter 12 of the Code of Ordinances of the Town of Trophy Club, Texas, Section 8.02 “Tree Board”, allows two additional members to be appointed to serve on the Tree Board. Term of Membership: Members of the Tree Board shall be appointed by the Town Council for a two (2) year term, but serve at the pleasure of and subject to removal and re-appointment by the Town Council. Two (2) members shall be appointed to serve one (1) year terms for the first year of the Tree Board; and three (3) members shall be appointed to serve a two (2) year term. All successive terms shall be served on the basis of two (2) year terms for all members. In the event that a vacancy occurs on the Tree Board, the Town Council will appoint a new member to complete the un-expired term. A member ceasing to reside in the Town, or elected to public office during his/her term of office shall immediately forfeit his/her membership. In cases where applications exceeding the number of open seats were received during the Annual Appointment process, applicants who were not appointed during the annual appointment process will be considered first. The Town Secretary will confirm those applicants’ continued interest and then forward the previously submitted application to the Town Council for review and consideration for appointment. In cases where applications did not exceed the number of open seats during the Annual Appointment process the vacancy will be posted. EXPLANATION: Background: HB 1777, governing Texas telecommunication franchise fees, went into effect on Sept 1, 1999. This bill required that fees be based on a per-access line method beginning in March, 2000. In October, 1999 the Public Utility Commission (PUC) established three categories of access lines; residential, non-residential, and point-to-point. Each city was required to submit its 1998 “base” franchise amount to the PUC. The PUC then calculated a maximum access line rate for each of the three categories based on that entity’s 1998 “base” franchise amount prorated by the actual number of lines per category. History of Rates: In March, 2000, the PUC established maximum initial access line rates for 1106 cities. These cities were then allowed to 1) exempt life-line customers, 2) choose lower rates, and 3) update base amounts and allocation formulas. Using the input, the PUC established and implemented final access line rates in April, 2000. State law allows a city to change its rates annually, and update its allocation once every 2 years. These changes must be initiated by the city each September and become effective the following January. In 2002, the PUC began an annual adjustment of access line rates by half of the increase in the Consumer Price Index (CPI). The PUC has notified us that our maximum CPI access line rate increase for 2008 is 2.07%. In April 2008, the Council unanimously adopted the CPI-adjusted rates establishing that action as the default for future years. Therefore, the 2009 rates will reflect the 2.07% CPI adjustment unless the Council takes other action and reports such to the PUC by April 30, 2009. RECOMMENDATION: Should Council not wish to approve this adjustment, we are required to notify the PUC no later than April 30, 2008. 78 ACTION BY COUNCIL: In order to accept the new CPI adjusted 2009 rates, no action is required. In order to decline the CPI adjusted rates, Council must take action to do so and advise the PUC. (kd) Attachments: 1. March 25, 2009 - Letter from the Public Utility Commission of Texas 79 80 81 COUNCIL MEMORANDUM From: The Office of the Town Manager Date: 4-20-2009 Subject: Agenda Item No.C.7 Discussion of drainage ditch that runs between Village Trail and Lakeshore Drive and consideration of improvements for area to create a linear park; take appropriate action as necessary. EXPLANATION: RECOMMENDATION: ACTION BY COUNCIL: Attachments: 1. Lakeview Ditch Maintenance Schedule 82 Lakeview Ditch Maintenance Schedule Yearly Maintenance: 1. Spray the cattails annually in May/June (at this time they are still dead from last year’s treatment). 2. Once a year we will remove dead cattails, additional vegetation and all debris. 3. We installed rip rap near the bridge to address a problem area and will continue to do this once a year Quarterly Maintenance We repair any run-off areas or fissures that have formed along the ditch to prevent erosion and additional silting. We repaired two large fissures last year to address both safety and erosion concerns. Biweekly Maintenance We remove the trash near the entrances of Lakeshore Drive, Village Trail and the bridge area every two weeks. Mowing Schedule 1. Spring to Fall we mow this ditch area every two to three weeks depending on rainfall. 2. Winter we mow as needed. 83 COUNCIL MEMORANDUM From: The Office of the Town Manager Date: 4-20-2009 Subject: Agenda Item No.C.8 Discuss and take appropriate action regarding the date for the first regular Town Council meeting in May. EXPLANATION: Early Voting will be conducted in the Council Chambers April 27, 2009 through May 5, 2009. Given the number of eSlate Voting Machines and Election set-up, staff asks that the Town Council consider rescheduling the May 4, 2009 meeting to Wednesday, May 6, 2009. None 84 COUNCIL MEMORANDUM From: The Office of the Town Manager Date: 4-20-2009 Subject: Agenda Item No.C.9 Receive a progress report on the Highlands of Trophy Club Public Improvement District #1, discussion and appropriate action regarding same. EXPLANATION: A substantial portion of the public improvements for the Highlands at Trophy Club PID #1 is nearing completion. The purpose of this item is to provide a progress report for all of the funded items, whether completed, under construction, or proposed. Several of the Developer projects have been completed or near completion. There will be an updated PowerPoint presentation detailing the project costs to date versus the budgeted projections. Additionally, we will present a complete and detailed analysis of all expenditures to date. RECOMMENDATION: No action is recommended. ACTION BY COUNCIL: (bse) Attachments: 1.
