STATE OF TEXAS § COUNTY OF DENTON § The Parks & Recreation Board of the Town of Trophy Club, Texas, met in a Regular Session on Tuesday, January 8, 2013 at 6:00 p.m. The meeting was held within the boundaries of the Town and was open to the public. Chairman Lentzner called the meeting to order at 6:00 p.m. noting a quorum was present. REGULAR SESSION Citizen Presentation: none 1. Discuss and take appropriate action on the approval of the November 13, 2012 Board minutes. Board Member Hanna made a motion to approve the November 13, 2012 Board minutes, correcting “Marshall Creek Park” in item #2. Board Member Hocker seconded the motion. The motion passed unanimously. Parks and Recreation Board 4 of 23 February 12, 2013 2. Discuss and provide direction concerning potential revisions to the Park Ordinance. See Parks and Recreation Ordinance draft. Parks and Recreation Board comments are in red. 3. Staff update on the following items; discussion of same: a. Park Bond projects The Facility Sub-Committee met and agreed that a playground at the end of Trophy Club Drive should be included as a top priority; creating a “destination” in Trophy Club, rather than adding little amenities throughout the town. Director Adams will have quotes on all approved Park Bond projects to share with the Board very soon, including playground options for the location at the end of Trophy Club Drive. Staff has contacted local churches to see if there is any interest in partnering together for the purchase/use of a van/bus, and will be putting together a survey for residents to see if there is interest in such a purchase. b. Christmas Celebration The Find Santa 5K and Fun Run had about 200 participants. Both Beck and Lakeview Elementary had a choir singing at the Christmas Celebration. The Dallas Morning News estimated that there were approximately 1000 in attendance. In 2013, we need to address parking and a louder sound system. c. Linear Park North There was a large clean-up at the Highlands/Broadway. Small trees, brush and debris were removed to correct a sink hole that developed. There is a concern about beavers and large nutria in the area. d. Trophy Club Park Staff met with the Corp regarding finalizing the Master Plan. Board Member Trotter updated the Board on activities by the Trails Sub-Committee: kiosk at the beach, linear trail, and White Chapel installed (with boxes for trail maps), trail map has been finalized, low-water crossings have been put in priority order for repairing, 911 maps have been updated, Board Member Mills will be conducting a training on the 911 markers in the TCP trail system, there is anticipated usage of at least 21,000 park users in 2013, there was minor vandalism of posts being removed, Shirley Greer offered to be “group volunteer coordinator”, and the sub- committee is working with the park manager, Jacob Lohse on selecting a date for the National Trails Day event. Director Adams asked that the sub-committee record their volunteer hours spent at TCP. e. Independence Park Staff is still working with the contractor to finish a few projects. Director Adams is also working with the contractor on pricing for the trail that will connect to the LDS trail. Tables for the front pavilions have been ordered. The fence that will be installed along the corner of Parkview/Bobcat will be installed soon. f. Harmony Park The Facility Sub-Committee was onboard with moving the three modular (small kid) pieces into the covered area. The basketball courts are complete. Staff is ordering a bench that will be installed in honor of the high school student who was tragically killed in an automobile accident in 2012; with a ceremony to be held in March. g. Roundabout Lighting Dazzlers danced, Andy Eades spoke, Council and MUD attended. The Town now owns the lights that were used on the tree, and the tree has been planted on Shasta Drive. h. Freedom Dog Park Parks and Recreation Board 5 of 23 February 12, 2013 Staff will be switching the “large dog” side with the “small dog” side for turf maintenance. City attorney will determine what words need to be defined, as well as their definitions. For the purposes of this article, the following terms, phrases, words and their derivations shall have the meaning given herein. When not inconsistent with context, words used in the present tense include the future and words in the plural number include the singular, and words in the singular include the plural. The word “shall” is always mandatory and not merely directory. Sec. 1-10-2. – Prohibitions. Within the limits of any park located within the corporate limits of the Town, it shall be unlawful for any person or persons to engage in any of the acts hereinafter specified, except as may otherwise be provided: A. To hitch, fasten, lead, drive, or let loose any animal, provided that this shall not apply to dogs when led by a chain, cord, or leash with the exception of supervised dogs within the fenced area of Freedom Dog Park. B. To ride or drive any horse or other animal. C. To carry or discharge any firearm, fireworks, air guns, paintball guns, BB guns, slingshots, any manner of propelled weaponry, or knives (name specific knives?). D. To operate any model, helicopter or radio controlled device, or rocket except in such areas as may be specifically designated for such purposes by the Director of Parks and Recreation. To use or operate any motorboat, boat or watercraft propelled by a motor, (clarify kayaks) on the waters of any lake, pond, or stream except as designated by the Director of Parks and Recreation F. To damage, cut, break, injure, deface, disturb, mark, write upon, paint, or disturb any tree, shrub, plant, rock, building, monument, fence, bench, or other structure. G. To swim, bathe, wade in or pollute the water of any pond, lake, or stream. Except for emergencies? H. To make or kindle a fire, except in Town-installed Bar-B-Q pits or in areas designated for such purposes by the Director of Parks and Recreation. I. To discharge any noxious liquid, grey water, or solids on or into any grounds, ponds, fountains, lakes, or stream. J. To leave litter, garbage, cans, bottles, or other refuse elsewhere than in refuse containers provided for such purpose. K. To participate or engage in any activity when such activity will create a danger to the public or may be considered a public nuisance. L. To disrupt in any manner any picnic, meeting, service, concert, exercise, or exhibition. M. To distribute post, place, or erect any advertising handbill, circular, notice, paper, or other advertising device without permission from the Director of Parks and Recreation. Excluding political materials? Clarify for political purposes. N. To fail or refuse to remove and properly dispose of solid animal waste of pets or other animals brought onto public property. O. To sell or offer for sale any food, drinks, confections, merchandise, or services except as operated by the Town, an approved agreement, or by permission of the Director of Parks and Recreation for a town authorized special event. P. To practice carry on, conduct, or solicit for any trade, occupation, business, or profession. Q. To play golf or use or play with golf balls or clubs. R. To bring, carry, transport, or possess a glass container. Parks and Recreation Board 8 of 23 February 12, 2013 S. To possess or consume alcoholic beverages of every kind. T. To play or bet at or against any game which is played, conducted, dealt, or carried on. U. To operate any public address system or other amplified sound system except as authorized by the Director of Parks and Recreation. Allow during sporting events/games/tournaments? V. For any person over the age of six years to use the restroom and washrooms designated for a member of the opposite sex. W. To loiter or remain in any Town Park at a time when the park is closed. Signs indicating hours operation shall be posted at conspicuous locations to give notice thereof, which shall be as follows: a. All Town parks and athletic facilities, except as provided herein, shall be closed from one hour after sunset until one hour prior to sunrise the next day, unless such facilities are have been scheduled for athletic use, a special event or program. b. Freedom Dog Park hours of operation shall be one half hour prior to sunrise and one half hour after sunset. c. Independence East facilities may remain open until 10:30 p.m. Sunday through Thursday and until 11:00 p.m. on Friday and Saturday. During tournaments the Director of Parks and Recreation may extend hours during Sunday through Thursday until 11:00 p.m. if necessary. Don’t specify time – leave open for Director’s permission/discretion. Should the word tournament be removed? Add “drop dead” time of midnight. d. Independence West facilities may remain open until 10:30 p.m. Sunday through Thursday and until 11:30 p.m. on Friday and Saturday. During tournaments the Director of Parks and Recreation may extend hours during Sunday through Thursday until 11:00 p.m. if necessary. Add “drop dead” time of midnight. e. Harmony Park facilities may remain open until 10:00 p.m. Sunday through Thursday and until 11:00 p.m. on Friday and Saturday. During tournaments the Director of Parks and Recreation may Parks and Recreation Board 9 of 23 February 12, 2013 extend hours on during the Sunday through Thursday until 11:00 p.m. if necessary. Sec. 1-10-3. – Vehicular Regulations. Within the limits of any park or located within the corporate limits of the Town, it shall be unlawful for any person or persons to engage in any of the acts hereinafter specified, except as may otherwise be provided: A. To drive a vehicle at a rate of speed faster than 15 miles per hour upon any drive or parking lot unless otherwise posted. B. To exhibit any unnecessary acceleration of a vehicle such as to cause gravel to be thrown, tires to squeal, or cause the vehicle to behave in an unsafe manner. C. To operate or drive a motorized vehicle, or motorized assisted scooter anywhere within the limits of a park, green space, or common area with the exception of Town or MUD vehicles or as authorized by the Director of Parks and Recreation. What about segues and motorized kids’ scooters? D. To park in areas other than those set aside for purpose or as authorized by the Director of Parks and Recreation. E. Where parking stalls have been designed, all vehicles shall be parked within and between the lines designating a single vehicle parking space and not otherwise. F. No vehicle shall be parked or left behind any other vehicles in the parking line or back of such parking line in any manner so as to obstruct, block, or hinder ingress or egress from the line. G. Where a vehicle is parked or left in violation of this section in such a manner as to obstruct or block traffic and the owner or operator of the vehicle cannot be found or refuses to remove such vehicles, police officers or an authorized representative of the Town may have your vehicle removed/towed. No variation to the requirements of this paragraph shall be allowed unless authorized by the Director of Parks Parks and Recreation Board 10 of 23 February 12, 2013 and Recreation. Include verbiage that states how long a vehicle may be left … overnight? Any exceptions? Incorporate PD protocol. Sec. 1-10-4. – Exemptions. All police, fire and ambulance units shall be exempt from this article when such vehicles are being operated under emergency conditions. Remove? Sec. 1-10-5. – Roller skates, roller blades, in-line skates, skateboards, coasters, scooters and bicycles. A. The use of roller skates, roller blades, in-line skates, skateboards, coasters, scooters and bicycles or similar device upon any sidewalk, pathway or park trail is permitted, except as provided in this section. B. No person shall ride or use any roller skates, roller blades, in-line skates, skateboards, coasters, scooters and bicycles Include “yield to pedestrians.” Add locations/structures that are not allowed to be ridden on. Should number of feet from a structure or people be stipulated? Sec. 1-10-5. – Use of tobacco products. It shall be unlawful for any person to use any tobacco product or to smoke, or possess a burning tobacco, weed or other plant product in any park or park facility. Spitting – can’t spit on ground? Smoking – parking lots and open space only? Explore “nuisance” clause. Restrictions from certain facilities? Designated areas? No smoking at youth events or sports facilities? “Distance from” clause? Sec. 1-10-6. – Peanuts and Sunflowers seeds Need to discuss with associations. Restricting peanuts is fine. Seeds – prohibit only where there is concrete? Don’t sell seeds? Sec. 1-10-8. – Enforcement A. Officials. The Director of Parks and Recreation and any member of the police department shall, in conjunction with their duties imposed by law, diligently enforce the provisions of this article. B. Ejectment. The Director of Parks and Recreation and any member of the police department shall have the authority to demand that any person acting in violation of this article leave the park or park facility. It shall be unlawful for any person to remain within the park premises after receiving such an order. Such failure shall constitute criminal trespass. Baseball Facility(ies) shall mean all structures or grounds within Independence East and Independence West that are utilized for baseball or T-ball activities. Director shall mean the Director of Parks and Recreation for the Town of Trophy Club or his designee. Park Property shall mean a park, playground, athletic facility or any other area in the Town owned or used by the Town, and devoted to active or passive recreation, including all creeks, ponds and lakes maintained by the Town. Special Event Permit shall mean a permit issued by the Town of Trophy Club pursuant to the Town’s Special Event Ordinance. Sec. 1-10-2. – Park Property Generally – Prohibited Acts. Within the limits of any Park Property located within the corporate limits of the Town, it shall be unlawful for a person or persons to engage in any of the acts set forth in this section or to engage any in conduct specifically prohibited by another section of this Ordinance. The following acts are prohibited on all Park Property. Except as otherwise provided, it shall be unlawful: Parks and Recreation Board 14 of 23 February 12, 2013 A. To ride, hitch, fasten, lead, drive, or let loose any animal, provided that this prohibition shall not apply to dogs when led by a chain, cord, or leash or to dogs utilizing the fenced area of Freedom Dog Park. B. To carry or discharge any firearm, fireworks, air guns, paintball guns, BB guns, slingshots, any manner of propelled weaponry, knives or other similar lethal instruments. C. To use or operate any model, helicopter, plane, boat or rocket except in areas specifically designated for such purposes by the Director of Parks and Recreation. D. To use or operate any motorboat, boat, kayak, canoe or watercraft on the waters of any lake, pond, or stream except in areas specifically designated for such purposes by the Director. E. To damage, cut, break, injure, deface, disturb, mark, write upon, paint, or disturb any tree, shrub, plant, rock, building, monument, fence, bench, or other structure. F. To plant or place any tree, shrub, plant, rock, building, monument, fence, bench or other structure except in areas specifically designated for such purposes by the Director. G. To swim, bathe, wade in or pollute the water of any pond, lake, or stream. H. To make or kindle a fire, except in Town-installed Bar-B-Q pits or in areas specifically designated for such purposes by the. I. To sell or offer for sale any food, drinks, confections, merchandise, or services except as authorized by the Town pursuant to an approved written agreement, or by written permission of the Director for a Town authorized or sponsored special event or when such sale is operated by Town. P. To practice, carry on, conduct, or solicit for any trade, occupation, business, or profession, except when operated or sponsored by the Town. Q. To play golf or use or play with golf balls or golf clubs, except when operated or sponsored by the Town. R. To bring, carry, transport, or possess a glass container. S. To possess or consume alcoholic beverages of any kind. T. To play or bet on any game which is played, conducted, dealt, or carried on. U. To operate any public address system or other amplified sound system or device except when operated by the Town or for amplified sound systems or devices, as authorized by a Special Event Permit . V. For any person over the age of six years to use the restroom and washrooms designated for a member of the opposite sex. W. To loiter or remain in or upon any Park Property at a time when the Park Property is closed. Signs indicating hours of operation shall be posted at conspicuous locations to give notice thereof. Hours of operation for Park Property shall be as follows: a. The tennis facility may remain open from one half hour prior to sunrise until 10:00 p.m. for tennis related activities only. e. Harmony Park facilities may remain open until 10:00 p.m. from Sunday through Thursday and until 11:00 p.m. on Friday and Saturday for scheduled uses, programs, or events. During tournaments or other special uses, programs, or events, the Director may extend the hours of operation to 11:00 p.m. Sunday through Thursday as determined necessary. C. To operate or drive a motorized vehicle, device or motorized assisted scooter anywhere in or upon Park Property, including without limitation, a green space or other grassy area, a common area, a pathway, or a sidewalk, unless such area is specifically designated for that purpose by the Director. D. To park in areas other than those specifically designated for Parking or as otherwise authorized by the Director . E. Where parking spaces are marked, all vehicles shall be parked within and between the lines designating a single vehicle parking space and not otherwise in a manner that utilizes more than one parking space. F. No vehicle shall be parked or left behind any other vehicle in the parking line or in any location or in any manner to obstruct, block, or hinder ingress or egress from the line, a parking space, or a parking area. Where a vehicle is parked or left in violation of this section and the owner or operator of the vehicle is not in control of the vehicle, a peace officer or an authorized representative of the Town may have the vehicle removed at the owner’s expense. No variation to the requirements of this section shall be allowed unless specifically authorized in writing by the Director. G. To park or place either an inoperable motor vehicle or an operable motor vehicle on any parking area for a period of more than twenty-four (24) continuous hours. Sec. 1-10-4. – Vehicular Regulations - Exemptions. Parks and Recreation Board 18 of 23 February 12, 2013 All Town and MUD1 vehicles shall be exempt from the restrictions of this Article. Sec. 1-10-5. – Roller Skates, Roller Blades, In-Line Skates, Skateboards, Coasters, Scooters and Bicycles – Prohibited Acts. A. The use of roller skates, roller blades, in-line skates, skateboards, coasters, scooters and bicycles or similar device is permitted upon any sidewalk, pathway or park trail. Notwithstanding the foregoing, a person shall ride or use any roller skates, roller blades, in-line skates, skateboards, coasters, scooters and bicycles in an area where a sign prohibiting such conduct is posted. Sec. 1-10-5. – Use of Tobacco Products. It shall be unlawful for any person to use any tobacco product or to smoke, or possess burning tobacco or other plant product in any park or park facility where signs prohibiting such conduct are posted. Smoking is allowed in Town parking areas. Sec. 1-10-6. – Peanuts and Sunflowers seeds It shall be unlawful for any person to use, distribute or sell unshelled seeds or nuts of any variety in any Baseball Facility, except during tournament play. Sec. 1-10-7. – Freedom Dog Park A. No dog shall be permitted in Freedom Dog Park except when in the care, custody and control of a person at least twelve (12) years of age. Any person under twelve (12) years of age must be accompanied by and be under the direct supervision of an adult. B. All dogs shall be at least four months of age and shall display a tag displaying a current rabies vaccination. It shall be a violation for a Parks and Recreation Board 19 of 23 February 12, 2013 person to allow or permit a dog to utilize or to be located within Freedom Dog Park if the animal does not meet the foregoing requirements. C. Dogs belonging to Trophy Club residents shall display a registration tag issued by the Town. D. No animals other than dogs shall be permitted within the fenced area of Freedom Dog Park except as authorized by the Director for the purpose of a special event or program. E. All dogs shall remain on-leash while entering and exiting the park. F. Dogs over thirty-five (35) pounds shall not be allowed in the area identified as the “small dog” area. G. Food shall not be allowed in the park, including without limitation, treats used for training purposes, except when authorized by the Director for a special event or program.
