The Pledges to the American Flag and Texas Flag were led by Council Member Bone. CITIZEN PRESENTATIONS This is an opportunity for citizens to address the Council on any matter whether or not it is posted on the agenda. The Council is not permitted to take action on or discuss any presentations made to the Council at this time concerning an item not listed on the agenda. The Council will hear presentations on specific agenda items prior to the Council addressing those items. You may speak up to four (4) minutes or the time limit determined by the Mayor or presiding officer. To speak during this item, you must complete the Speaker's form that includes the topic(s) of your statement. Topics of presentation should be limited to matters over which the Council has authority. There were no citizen presentations. ANNOUNCEMENTS AND REPORTS 1. Receive Town Manager Norwood’s update and provide input regarding the following (S. Norwood): November and December 2019 Meeting Dates – There would only be one Council meeting in November and December; therefore there would be no Council meeting on November 26th and December 24th due to the holiday schedule. Holiday Schedule – Trash and recycling pick up during the week of Thanksgiving would be moved from Friday to Saturday, November 30th. Town CouncilPage 14 of 178Meeting Date: December 10, 2019 Capital Improvement Project on Trophy Club Drive – the project began two weeks ago and the pavement demolition was expected to be completed in the next three to four weeks. Several changes have been made based on resident, contractor, and Staff input. Construction would occur in phases and the final completion was anticipated to be in April 2020. 2. Receive Town Council Liaison update; discussion of same (S. Norwood): *Charter Review Commission, October 28, 2019 and November 11, 2019 Council Liaison - Council Member Philip Shoffner *Parks and Recreation Board, November 4, 2019 Council Liaison - Council Member Michael Geraci Council Member Shoffner reported that the Charter Review Commission continues to review the Town of Trophy Club Charter and they would present their finding to the Council once completed. Director of Parks and Recreation Jaramillo provided an update regarding the November 4, 2019 Parks and Recreation Board meeting. Staff recognized Tom Mills and Lou Hocker for volunteering countless hours at Trophy Club Park, with their efforts qualifying them for the Presidential Volunteer Service Award. Also, Staff was recently contacted by an outside organization to host a Youth Baseball World Series event at Independence Park from June 26, 2020 to July 1, 2020. Families would be encouraged to stay at one of the Town’s hotels and some logistics still needed to be worked through. This item would be presented to the Council at a later date. Lastly, the Board appointed three board members to a Sports Subcommittee, which consisted of Dean Murray, Joel Morace, and David Stout. They would meet on an “as needed” basis to discuss any important topics that need to be addressed before the next scheduled Parks and Recreation Board meeting. Council Member Monger thanked the Parks Department and Fire Department for helping move the Veterans Day Celebration from the Veterans Memorial to the Fire Station, due to inclement weather. CONSENT AGENDA All matters listed as Consent Agenda are considered to be routine by the Town Council and will be enacted by one motion. There will not be a separate discussion of these items. If discussion is desired, that item will be removed from the consent agenda and will be considered separately. 3. Consider and take appropriate action regarding a Proclamation of the Town Council recognizing November 11, 2019 as Veterans Day in Trophy Club; and providing an effective date (Council Member Monger and Mayor Sanders). Council Member Monger read the proclamation into the record. Motion: Motion made by Council Member Monger, seconded by Council Member Shoffner, to approve Proclamation No. 2019-25, recognizing November 11, 2019 as Veterans Day in Trophy Club; and providing an effective date recognizing November 11, 2019 as Veterans Day in Trophy Club; and providing an effective date of November 12, 2019. Motion carried unanimously 6-0-0. Mayor Sanders presented Bill Splichal, World War II and Korean War veteran, with the proclamation. 11. Receive an update from the Greater Northwest Soccer Association (GNWSA) regarding their current season (S. Norwood). Director of Parks and Recreation Jaramillo stated that Matt Tibbitts, President of GNWSA, was unable to attend the meeting, but Mr. Tibbitts wanted to relay to the Council that he was extremely happy with the services that the Parks and Recreation Department was providing to GNWSA. No action was taken on this item. 12. Receive an update from the Trophy Club Roanoke (TCR) Youth Baseball Association regarding their current season (S. Norwood). Brandon Hennig, President of TCR Youth Baseball Association, commented that they had another successful Fall season with very few cancellations due to inclement weather. They had roughly 1,100 players registered for the Spring and Fall seasons, with 49 percent of the players being Town residents. He commended the Parks Department for working hard to meet their needs. Mr. Hennig responded that there were approximately 200 select players for the Spring and Fall seasons out of the 1,100 registered players. Mayor Pro Tem Jensen asked if they have encountered any issues finding spots for players. Mr. Hennig stated that they usually have a few late registrations, but they order additional jerseys and hats to help accommodate those players. He added that registration opened two weeks early for Trophy Club and Roanoke residents before registration was opened to the rest of the community. No action was taken on this item. 13. Receive an update from the Bobcat Youth Football Organization regarding their current season (S. Norwood). Daryl Fowler, President of Bobcat Youth Football Organization, reported there were a total of 389 registered, out of which 210 were registered to play football and 179 registered for cheerleading in grades kindergarten through sixth. They had 14 teams that played in a league with area schools from Northwest, Argyle, Southlake, Grapevine, Colleyville, Coppell and Lantana. Approximately 98 percent of their players feed into Byron Nelson High School (BNHS). Their organization participates in the Town’s 4th of July Parade and BNHS Homecoming Parade, and they work closely with BNHS coaches. Additionally, he applauded Director of Parks and Recreation Jaramillo and his Staff for working hard to provide field space at Independence Park. Council Member Fleury thanked Mr. Fowler and their organization for putting forth numerous volunteer hours. No action was taken on this item. 14. Discussion of and take appropriate action regarding setting a date for the 2020 Council Retreat and discuss potential agenda items (S. Norwood). Town Manager Norwood stated that he was finalizing the agenda for the Council Retreat but it would be set around goal setting. The two tentative dates to schedule the Council Retreat was either January 18, 2020 or January 25, 2020. Town Secretary Fimbres confirmed that there would be a Council meeting on January 14, 2020 and Staff would propose to cancel the January 28, 2020 meeting. Mayor Sanders and Council Members Fleury and Bone preferred to have the Retreat on January 25, 2020. Mayor Sanders asked that Staff contact Council Member Geraci to make sure that he did not have a conflict with that date. No action was taken on this item. 15. Discussion of items for Future Agendas to include agenda items for consideration on the December 10, 2019 Council agenda and items from the Town Council Future Agenda Items list (S. Norwood). This item allows Council to request the placement of items on upcoming agendas when the topic of discussion requires research and review that cannot be accomplished in the time frame between regular Council meetings. However, a Council Member may request that an item be placed on the next regularly scheduled meeting without first placing that item on the Future Agenda Items list. All requests for agenda items must comply with Charter requirements. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS: SECTION 1. INCORPORATION OF PREMISES The above and foregoing premises are true and correct and are incorporated herein and made a part hereof for all purposes. APPLICABLE REGULATIONS,DISCONTINUATION, & REVOCATION In all respects the Land shall be subject to the applicable regulations contained in the Comprehensive Zoning Ordinance and all other applicable and pertinent ordinances and regulations of the Town, including without limitation regulations governing PD Planned Development No. 30and all amendments thereto. TheSpecific Use Permit granted by this Ordinance shall control in cases of conflict between this Ordinance and/or PD Planned Development No. 30and/or theComprehensive Zoning Ordinance. The Specific Use Permit granted hereby shall discontinueif the use for which this Specific Use Permit is granted ceases to be operated at the permitted location for a minimum period of six (6) continuous months.Further, this Specific Use Permit shall be subject to revocation in accordance with the Townof Trophy ClubCode of Ordinances. SECTION 3. SAVINGSAND REPEALER This Ordinance shall be cumulative of all other ordinances of the Town affecting the regulation of land and zoning and shall not repeal any of the provisions of those ordinances except in those instances where the provisions of those Ordinances are in direct conflict with the provisions of this Ordinancewhether such Ordinances are codified or uncodified, and all other provisions of the Ordinances of the Town of Trophy Club, codified or uncodified, not in conflict with the provisions of this Ordinance, shall remain in full force and effect.Notwithstanding the foregoing, any complaint, action, cause of action or claim which prior to the effective date of this Ordinance has been initiated or has arisen under or pursuant to such repealed Ordinance(s) shall continue to be governed by the provisions of that Ordinance and for that purpose the Ordinance shall be deemed to remain and continue in full force and effect. SECTION 4. SEVERABILITY The sections, paragraphs, sentences, phrases, clauses and words of this Ordinance are severable, and if any section, paragraph, sentence, phrase, clause or word in this Ordinance or application thereof to any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this Ordinance, and the Town Council hereby declares that it would have passed such remaining portions of this Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. PENALTY It shall be unlawful for any person to violate any provision of this Ordinance, and any person violating or failing to comply with any provision hereof shall be fined, upon conviction, in an amount not less than One Dollar ($1.00) nor more than Two Thousand Dollars ($2,000.00), and a separate offense shall be deemed committed each day during or on which a violation occurs or continues. The penalty provided by this section shall be cumulative of all other penalties allowed by law, including without limitation, civil remedies available for enforcement of this Ordinance. SECTION 6. PUBLICATION The Town Secretary of the Town of Trophy Club is hereby directed to publishthe Caption, Penalty and Effective Date of this Ordinance as required by Section 52.011 of the Texas Local Government Code. SECTION 7. ENGROSSMENT AND ENROLLMENT The Town Secretary of the Town of Trophy Club is hereby directed to engross and enroll this Ordinance by filing this Ordinance in the ordinance records of the Town. CATERER'S PERMIT (CB) Permit authorizes Mixed Beverage Permittee to sell mixed beverages on a temporary basis at a place other than the premises for which the Mixed Beverage Permit is issued but only in areas "wet" for the sale of mixed beverages. Background and Explanation: The Town was approached by HG SPLY Trophy Club (HG SPLY) to allow them to valet park patron’s vehicles on Town owned property. The request was for approximately 50-60 parking spaces in a mixture of parking areas including parking identified as; Town Hall Gravel Lot (south of the Town Hall building) and the Town Hall Lot north of Holiday Inn. HG SPLY is also requesting the opportunity to install an improved parking area for golf cart parking in the grassy area between HG SPLY owned property and the Town owned improved temporary parking lot constructed west of HG SPLY. The golf cart parking is required to be similar in structure to the grasscrete golf cart parking at Meat U Anywhere. In exchange for the allotted parking spaces HG SPLY is being asked to add traffic flow marking to the driveway and approach assisting in the mitigation of traffic issues exiting the HG SPLY lot onto Trophy Wood Dr. The agreement allows HG SPLY to utilize 35 of the 83 parking spot within the Town Hall gravel lot and 32 of the available 53 parking spots in the Town Hall Lot north of Holiday Inn. All vehicles will be required to be moved prior to the closing of the valet services each night. The agreement allows for any party to terminate the agreement with a written 90 day notice. Financial Considerations: The agreement has no financial impact to the Town. All entities are collectively referred to as Parties in this Agreement (“Parties”). Town owns three properties described in Exhibit A, Exhibit B, Exhibit C and Exhibit D and attached and incorporated herein. HG desires to use the three properties owned by Town for parking. Background and Explanation: Following Council concerns and approvals, the Storm Water Master Plan was updated by Freese and Nichols, to address a Phase II plan of action for the creek flow for the Skyline branch creek, from the bridge at Indian Creek Drive and Skyline Drive through the culverts at T W King Drive. Also considered, was opening the new box cell culvert installed on the last phase of construction on the upstream side of the bridge on Indian Creek Drive. The project included updating the previous hydrologic and hydraulic models to reflect existing (2019) conditions. With this information, floodplain maps were generated for the 10% and 1% annual chance event (ACE) storms. Suspected structures that may be inundated during an event were identified. It was identified that the FEMA FIRM (Flood Insurance Rating Map) is not accurate and should be updated, as well. A brief synopsis of the study: Due to downstream channel conditions, there is very little difference between the 3- 8’x5’ box culverts and the 4-8’x5’ box culvert conditions. Alternative 1 removes all of the houses downstream from the culvert from the floodplain and eliminates overtopping of the Indian Creek Road. Alternative 2 fully channelizes the flow and eliminates overtopping of the T.W. King Road. WHEREAS, Section 6.03 of the Tax Code provides for the selection of members for the Denton Central Appraisal District’s Board of Directors based on the standard process of nominations and selection by the voting units in a taxing jurisdiction; and WHEREAS, the Town of Trophy Club, Texas, based on the tax levy for the Town, was allocated a total of twenty-one(21) votes to cast for nominated candidate(s) named on the ballot provided by the Chief Appraiser of the Denton Central Appraisal District; and WHEREAS, uponreceiving the selections submitted by all voting units of the taxing jurisdiction, the five nominees receiving the most votes will be appointed as members of the Board of Directors for the Denton Central Appraisal District; and WHEREAS, it is the desireof the Town Council of the Town of Trophy Club, Texas, to cast the Town’s twenty-one(21) allocated votes to__________for placement on the Board of Directors for the Denton Central Appraisal District. NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS: Section 1.That the Town of Trophy Club, Texas, hereby casts it’stwenty- one(21)allocated votes for__________to serve onthe Board of Directors for the Denton Central Appraisal District. Section 2.That this Resolution, indicating the votes cast and candidate(s) selected, shall be submitted to the Chief Appraiser of the Denton Central Appraisal District prior to December 15, 2019.
