ANNOUNCEMENTS AND REPORTS
2. Receive Town Manager Class' update and provide input regarding the following (T. Class):
Community Pool Opening – Scheduled to open on Saturday, May 26th. Additionally, he invited residents
to join the Metroport Veterans Association on May 26th at 10:00 a.m. to assist with flag planting along
Trophy Club Drive and throughout Medlin Cemetery in honor of Memorial Day. A ceremony would be
held at Medlin Cemetery on May 28th at 10:00 a.m., courtesy of the Metroport Veterans Association.
Also, Town Hall offices would be closed on May 28th in observance of Memorial Day.
Volunteer Appreciation Reception – Scheduled for June 21st and evites had been sent out to Council,
volunteers, and Staff.
3. Receive Town Council Liaison update; discussion of same (H. Fimbres):

Council Liaison - Council Member Philip Shoffner
Council Member Shoffner advised that the majority of the Parks and Recreation Board meeting was on Park
updates. The Board discussed seeking volunteers to conduct a tree audit throughout the Town that would be an
inventory of all trees on Town owned properties, including parks and medians. Also they discussed seeking
volunteers to assist with maintenance of the flower beds in the beautification area within Trophy Club Park, which
was currently not being maintained.
CONSENT AGENDA
All matters listed as Consent Agenda are considered to be routine by the Town Council and will be enacted by one
motion. There will not be a separate discussion of these items. If discussion is desired, that item will be removed
from the consent agenda and will be considered separately.

Judge Mark D. Chambers administered the Statement of Appointed Officer and Oath of Office to Rhylan Rowe,
elected Council Member Place 3.
Mayor Sanders presented Mayor Pro Tem Rowe with a Certificate of Election.

Remarks to and from Rhylan Rowe, Council Member Place 3 (H. Fimbres).
Mayor Pro Tem Rowe expressed his gratitude to have the opportunity to serve another three years.
Council Member Jensen commented that it spoke volumes of the respect that residents had for Mayor Pro Tem
Rowe since he ran unopposed for three elections, in May 2014 for an unexpired term, in May 2015, and in May
2018.
Council Member Fleury congratulated Mayor Pro Tem Rowe and she looked forwarding to working with him for at
least a couple more years. She thanked him for his guidance and assistance through her first year serving on the
Council.
Mayor Sanders recognized Mayor Pro Tem Rowe for his involvement and guidance with PD-30 related items that
assisted in crafting something that would be successful for the residents.
8. Receive an update from Town Staff and take appropriate action regarding Town maintained property with
acquisition potential for adjacent property owners (Council Member Shoffner and Council Member Jensen).
Town Manager Class advised that at the April 24th Council meeting, Staff was provided direction to seek to acquire
The Woods property adjacent to Trophy Club Drive; excluding the brick wall, which was currently being maintained
by Park Staff in exchange for the continued maintenance. Likewise, Staff was provided direction to seek to acquire
property along Indian Creek Drive (from the edge of 2 Lake Forest Drive to the Hogan’s Glen property); excluding
the fence, which was currently being maintained by Park Staff in exchange for the continued maintenance.
Additionally, Staff was directed to convey to the property owners that should they approve the acquisition of the
property in exchange for continued maintenance, the Town would pay all legal, surveying, and platting fees
associated with the transaction. During the May 8, 2018 Council meeting, Council Member Shoffner requested
additional specificity with regard to the impacted properties located along Indian Creek Drive. Based upon a
review of aerial photographs, Staff sought to acquire the property along Indian Creek Drive, more specifically
described as adjacent to:
1.2 Troon Drive;
2.11 Muirifield Court;
3.13 Muirifield Court;
4.14 Muirifield Court;
5.1 Cypress Court;
6.2 Cypress Court;
7.4 Cypress Court;
8.11 Colonial Court;
9.12 Colonial Court; and
10.14 Colonial Court.

Staff would also seek to acquire The Woods property along Trophy Club Drive, more specifically described as
adjacent to:
1.1 Michelle Court;
2.7 Michelle Court;
3.9 Jennifer Court;
4.10 Jennifer Court; and
5.11 Jennifer Court.
Letters would be mailed to the above listed property owners and a meeting would be set to discuss the potential
acquisition of the property that would exclude the fence/wall areas or the possibility that the maintenance
responsibility be returned to the property owners. In the case of The Woods property, Staff would also be seeking
to transfer water and electricity back to the residents should they not desire the Town to acquire the property in
exchange for the Town to continue maintenance.
Council Member Jensen inquired if there had been any discussions with the property owners up to this point.
Town Manager Class responded that a discussion took place between the Director of Parks and Recreation and one
of the property owners in The Woods advising that letters would be sent, but no terms were discussed.
Council Member Jensen asked if the Town was currently maintaining the properties. Town Manager Class
responded that the properties were currently being maintained by the Town.
Mayor Pro Tem Rowe desired for ownership and maintenance to line up. He was not opposed to continuing
maintenance of the areas mentioned because they were not large pieces of property. If maintenance was to
continue, he hoped that a solution would be achieved to bring the property under the Town’s control.
Council Member Shoffner advised that he requested this item to be presented because the Main Motion as
Amended, specific to Indian Creek Drive, made at the April 24th Council meeting should have included the portion
from Lake Forest Drive to Troon Drive.
Motion:
Motion made by Council Member Shoffner, seconded by Council Member Jensen, that the Town work to acquire
the property along Indian Creek Drive that the Town currently maintained in order for the Town to own the
property; to acknowledge to the property owners when the offer was made that the Town would maintain the
land if they were willing to authorize the Town to acquire the land excluding the fence; and pending permission
from all the homeowners to release their property along Indian Creek Drive, then the Town would be responsible
for all legal fees, surveying, and platting fees to acquire the land allowing for the Town to be responsible for
maintaining the property.
Council Member Shoffner noted that he did not include The Woods property because action had already been
taken and approved. His motion was a blanket to cover the properties along Indian Creek Drive that the Town
currently maintained.
The vote was taken.

9. Discussion of items for Future Agendas to include agenda items for consideration on the June 12, 2018
Council agenda and items from the Town Council Future Agenda Items list (H. Fimbres).
This item allows Council to request the placement of items on upcoming agendas when the topic of discussion
requires research and review that cannot be accomplished in the time frame between regular Council meetings.
However, a Council Member may request that an item be placed on the next regularly scheduled meeting without
first placing that item on the Future Agenda Items list. All requests for agenda items must comply with Charter
requirements.
A) Item No. 1 - Review negotiating with the Trophy Club Municipal Utility District No. 1 to transfer the title for
the land that the Annex Building is built on and the maintenance building by the Wastewater Treatment
Plant. (Lamont 11/10/2015) (1-February 9, 2016) (2-May 10, 2016) (3-August 9, 2016) (4-November 8,
2016) (5-February 14, 2017) (6-May 23, 2017) (7-May 22, 2018)
Mayor Sanders commented that the new Trophy Club Municipal Utility District (TCMUD) No. 1 Board of Directors
had not discussed these two properties.
Council Member Shoffner commented that these items could be discussed at the Joint Session that would be held
in July 2018 between the Town Council and the TCMUD No. 1 Board of Directors. He was in favor of Town
Manager Class reaching out to the TCMUD No. 1 General Manager to notify him of the Council’s intention to have
these items discussed at the Joint Session to allow the TCMUD No. 1 Board of Directors to potentially discuss the
items beforehand.
B) Item No. 3 - Receive an update from Town Staff regarding Entryway Monumentation and Landscaping for
the Town of Trophy Club. (Sanders 2/27/2018) (1-May 22, 2018)
Town Planner Payne provided an update regarding Entryway Monumentation, Wayfinding, and Parks signage.
Staff researched options and locations based on direction given at the Council Subcommittee meeting that was
held on March 7, 2018.
The signage types that Staff researched included the following:
Type 1 – Entryway Monument signs (Entryway Monument locations and potential locations);
Type 2 – Wayfinding signs (Points of Interest); and
Type 3 – Parks signs (Park monument locations, trailhead signs, and pedestrian signs).
She displayed an aerial view of existing and potential locations of Entryway Monument signs:
1.Trophy Wood Drive marquee;
2.Trophy Club Drive marquee;
3.Trophy Club Drive logo;
4.Trophy Lake Drive marquee;
5.Roundabout;
6.Potential on Marshall Creek Road; and
7.Potential on Bobcat Boulevard.
Town Planner Payne presented Points of Interest identified by potential Wayfinding signs:
1.Town Hall / Police Station;
2.Harmony Park;
3.Fire Station;
4.TCMUD No. 1;
5.Country Club (golf course & clubhouse);
6.Medlin Cemetery;
7.Country Club (Tennis / Pool);
8.Lakeview Park;
9.Military Veterans Memorial;
10.Independence Park West;
11.Community Pool;

12.Independence Park East;
13.Freedom Dog Park; and
14.Trophy Club Park.
She noted that an existing wayfinding sign was located at the intersection of Trophy Club Drive and Trophy Park
Drive. Additionally, she exhibited an illustration of existing and potential Parks monument signs:
1. Harmony Park;
2. Independence Park West;
3. Community Pool;
4. Independence Park East;
5. Trophy Club Park (Corps property outside Town limits);
6. Potential at Freedom Dog Park; and
7. Potential at Lakeview Park.
Mayor Sanders noted that the Lakeview soccer fields had not yet been named.
Town Planner Payne presented a map that denoted trailhead and pedestrian signs. Lastly, she went over the next
steps that included the following:
Finalize potential sign types and locations;
Identify local universities to develop a thematic signage design;
Determine right-of-way, easements, and other logistical needs;
Identify fabrication and installation contractor; and
Coordinate installation of signs.
Mayor Pro Tem Rowe was in favor of having the Wayfinding and Entryway Monumentation portion set aside in
order to focus on the Parks piece. The majority of the Parks signage had a solution established and just needed
some repair. He desired to concentrate of Parks monument and trailhead signage. The current monument sign at
Independence Park East was six to seven years old and did not require anything further. His recommendation was
to have the major Parks to have monumentation signage brought up to that standard. Likewise, there was already
a theme set for the trailhead at Trophy Club Park and Skyline with the rock signage; therefore he suggested that
for any new trailheads added within Town limits that the Town replicate the theme established.
Motion:
Motion made by Mayor Pro Tem Rowe, seconded by Council Member Shoffner, to direct the Town Manager to
work with Staff to bring back a plan for repairing and updating Parks monument signs and a plan for standardizing
trailhead signs.
Mayor Pro Tem Rowe commented that this could be phased into the budget over a couple of years.
Mayor Sanders commented that Harmony Park and Independence Park West signs were potentially repairable and
should be updated. His concern was the monument signs at Independence Park did not indicate the commonly
used East and West reference.
Council Member Fleury recommended reviewing the cost associated with having the wood portion of the Parks
monument signs that had stone columns replaced with stucco or stone since wood easily showed sun damage over
a short period of time and deteriorated. She commented that stucco or stone would provide an up-to-date
appearance and that it may be appropriate to add the East and West reference to Independence Park signage.
Council Member Shoffner believed that it may be more suitable to remove the Parks monument signs, including
the wooden portion and stone columns, and replacing them with an updated sign similar to the Independence
Park East monument sign. Having the signs backlit was not necessary since Town Parks closed at specific times
dependent on the season. He agreed that East and West should be referenced on the signage with the inclusion of
notations for Fields 1 through 4 and Fields 5 through 8.
Mayor Sanders agreed with replicating the Independence Park East monument sign at the other Parks but he
would like to know the cost associated with rebuilding the signs versus repairing the signs.

Mayor Pro Tem Rowe recommended reviewing multiple options for installing signage for Fields 1 through 4 and
Fields 5 through 8, such as placing the information on a metal pole sign.
Council Member Shoffner offered the suggestion that the reference to field numbers could potentially be placed
on the stone columns.
The vote was taken.
Motion passed unanimously 5-0-0.
Mayor Sanders remarked that the Wayfinding signage could be brought back to Council with three design concepts
with the Subcommittee’s approval.
Council Member Shoffner relayed Council Member Kurtz’s, who was part of the Subcommittee, desire to engage
with a university to get their talents and provide options for Wayfinding signage. This would serve as a great
opportunity for a university to tackle this portion and then make a presentation before the Council. Additionally,
Council Member Shoffner suggested performing a sign audit because there was an overnight parking sign that
referenced an ordinance no longer in place and to confer with the TCMUD No. 1 for verification of their required
signage; therefore possibly eliminating some signs that did not necessarily need to be in place.
Council Member Fleury proposed to install a more substantial sign at Freedom Dog Park as opposed to the current
metal sign on the chain link fencing.
Motion:
Motion made by Mayor Sanders, seconded by Council Member Shoffner, to direct the Town Manager to work with
Staff to come up with a design plan for Freedom Dog Park to be brought back to Council at the first opportunity.
Council Member Shoffner clarified that the Motion that was just approved captured the Mayor’s intent because it
was broad enough to cover all Town Parks.
Mayor Sanders withdrew the Motion and Council Member Shoffner agreed.
Mayor Sanders inquired if the Council’s Subcommittee’s intended to engage with a university for assistance with
the design of monument signage. Town Planner Payne responded that was the intent because they had students
who studied that specific area.
Council Member Shoffner commented that the intention was not to get locked into an agreement at the beginning
of conversations with a university but instead present this to a few universities and seek their ideas, then an
agreement could be established.
Town Planner Payne reiterated that her understanding from tonight’s conversation was to provide a few
universities with the information presented and have them design the signs.
Mayor Pro Tem Rowe remarked that the design language was determined by the approved Motion to use the
existing Independence Park East monument sign and existing trailhead signs as the design standard.
10. Consider and take appropriate action regarding the appointment of the Mayor Pro Tem; discussion of same
(H. Fimbres).
Mayor Pro Tem Rowe nominated Council Member Shoffner to serve as the Mayor Pro Tem.
Mayor Sanders received no further nominations and requested a vote to appoint Council Member Shoffner to
serve as the Mayor Pro Tem.

RESOLUTION NO. 2018-08
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF
TROPHY CLUB, TEXAS, REPEALINGRESOLUTION NO. 2015-15AND
ADOPTING A NEW MUNICIPALITY OF TROPHY CLUB HANDBOOK
FOR ELECTED AND APPOINTED OFFICIALS; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS,
the Town benefits by having its citizens involved in local government
through service on Town Boards and Commissions and has established several boards
andcommissions that perform various functions for the Town; and
WHEREAS,
the Town initially adopted the Municipality of Trophy Club Handbook
for Elected and Appointed Officials” (hereinafter “Handbook”) to establish guidelines and
procedures for Town Boards, Commissions and Corporations and to ensure uniform
treatment of all persons applying for and serving on those bodiesand has adopted
amendments to those guidelines as determined appropriate since the initial Handbook
adoption; and
WHEREAS,
the guidelines established in the Handbookare in addition to those
requirements imposed by the Texas Open Meetings Act and other applicable state law;
and
WHEREAS,
the passage of this Resolution repeals Resolution No. 2015-15, and
all other conflicting Resolutions adopting or amending the Handbookand adopts a new
Handbookwhich has been determined by the Council to be beneficial to the Town and
its residents and to serve the public welfare.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS:
Section 1. That the foregoing recitals are adopted and incorporated herein as
findings.
Section 2.That the Town Councilhereby repeals Resolution No. 2015-15and
all other conflicting Resolutions adopting or amending the Handbook and hereby adopts
the new“Municipality of Trophy Club Handbook for Elected and Appointed Officials”,a
true and correct copy of the new Handbook being attached hereto and incorporated
herein as Exhibit “A”.
Section 3.That this Resolution shall become effective upon its passage, and
that upon passage of this Resolution, the Handbook (Exhibit “A”) shall become effective.

Introduction
In order to be “A Great Place to Call Home,” the Town of Trophy Club encourages and is
indebted to our dedicated citizens who serve on Boards, Commissions, and Corporations. In
accordance with Section 4.16 of the Town Charter, the citizens who serve do so without
compensation. They are appointed to serve after indicating their interest through the
application process, and they serve at the discretion of the Town Council.
Generally, members of each Board, Commission or Corporation are charged with researching
pertinent projects and with making recommendations to the Town Council. Members serve in
an advisory capacity. The exceptions are the Zoning Board of Adjustment and the Building
Standards Commission, which have quasi-judicial duties. The exact duties and requirements of
each Board, Commission or Corporation can be found in the ordinance establishing that specific
body and/or applicable enabling statute.
Each Board, Commission, and Corporation consists of members, a Chair/President, a Town Staff
Liaison and a Council Liaison if one is appointed by the Council.
Applicant Requirement for Boards, Commissions, or Corporations
Applicants for Boards, Commissions, or Corporations must be United States Citizens and
registered voters prior to their appointment and must also be Trophy Club residents for at least
six (6) months prior to their appointment. Based upon good cause shown, Council may waive
the voter registration and/or length of residency requirement for a person appointed to a
Board, Commission, or Corporation, except where restricted by State law. Neither Town elected
officials, nor persons appointed to fill vacancies on any elected Town governmental body may
serve on a Town Board, Commission, or Corporation, per Town Charter.
The technical expertise of applicants shall be a consideration in gaining appointment.
Residency Requirement/Temporary Change in Residency Status
In addition to the residency requirement forcitizens making application to serve on Town
Boards, Commissions, and Corporations, a person serving as a member must reside within the
Town of Trophy Club during his or her term of service in order to continue serving. However, if
during the term of appointment or during the time frame for reapplication, the residency status
of a then current member of a Board, Commission or Corporation temporarily changes for a
period of no more than six (6) months, the member may request that the Council review
his/her specific circumstances affecting residency. If the temporary change in residency status
does not disqualify a member of a Board, Commission, or Corporation from continuing to serve
either because of a Charter or state law requirement for service on his/herrespective Board,
Commission, or Corporation, the Council may authorize the continued service or
reappointment of the member until such time as the member returns to permanent residency
status.

The Town Secretary will also notify each member whose term is expiring that they must
resubmit the Board, Commission and Corporation Application.
Application Process for Annual Appointments
Applications will be accepted each year in July or within a time frame as otherwise directed by
Town Council. A received application will be considered active for one year following the date
of receipt, provided it meets all previously stated requirements.
Applications are available in the Town office and online at the Town’s website. The completed
application shall be submitted to the Town Secretary and forwarded as soon as possible to the
TownCouncil Appointments Committee and ex-officio members, all additional members of the
Town Council, the Chair/President of the respective Board, Commission, or Corporation, and
the Staff Liaison.
Town Council Appointments Committee
At the first Town Council meeting in June, the Council shall establish a Town Council
Appointments Committee tasked with making recommendations to the full Council regarding
appointments to all Boards, Commissions, and Corporations (hereinafter “Appointments
Committee”). The Appointments Committee shall be comprised of the Mayor and two (2)
Council members, and the Committee shall have the discretion to add additional non-voting ex-
officio members to the Committee as determined appropriate.
At the first Town Council meeting in June, the Council shall establish a Town Council
Appointments Committee tasked with making recommendations to the full Council regarding
appointments to all Boards, Commissions, and Corporations (hereinafter " Appointments
Committee"). The Appointments Committee shall be comprised of three (3) Council members,
and the Committee shall have the discretion to add additional non-voting ex-officio members to
the Committee as determined appropriate.
Interview Process – Appointments Committee
Interviews shall be conducted by the Appointments Committee after the close of each
application period.
Staff Liaisons shall be responsible for scheduling interviews for each candidate who submits an
application for their respective Board, Commission, or Corporation. Typically these interviews
will be held at a regular interval as determined by the Appointments Committee. In the event

of scheduling conflicts or workload demands, alternate dates may be selected. Group
interviews are conducted for most vacancies. However, individual interviews may be conducted
for certain positions at the request of the Appointments Committee.
After conducting interviews, the Appointments Committee shall provide its recommendations
relating to nominations for appointment to the Town Manager preceding the Council meeting
at which such appointments are to be considered. Appointments generally will be made by

resolution at the second (2) Town Council meeting of the month.
The Appointments Committee and Council will not evaluate applicants on the basis of race,
color, religion, sex, national origin, ethnic group, age, or disability. Recommendations for
appointment to a Board, Commission or Corporation will not be made based on stereotypes or
assumptions about the abilities or traits of individuals of a certain race, color, religion, sex,
national origin, ethnic group, or age, or individuals with disabilities.
Mid-Term Vacancy / Resignations
When a Board, Commission, or Corporation member resigns mid-term, a written notice of
resignation shall be submitted to that body’s Chair/President. The Chair/President shall forward
the notice to the Staff Liaison who shall then forward the notice to the Town Secretary and
Town Council.
Upon receiving notice of vacancy, the Town Secretary shall initiate the application process in
accordance with the Posting Process set forth above, and interviews shall be conducted in
accordance with the Interview Process as set forth above.
Members appointed to fill vacancies shall be appointed to serve out the remainder of a
predecessor’s term. Council may directly appoint an applicant whose application is previously
on file under the established application process provided that the applicant is still willing to
serve on the Board, Commission or Corporation that he/she applied for without the
requirement of an additional interview.
Removal
Members of Boards, Commissions and Corporations serve at the discretion of the Town Council
and may therefore be removed at the sole discretion of Council at any time; provided however,
that members of the Building Standards Commission may only be removed for cause on a
written charge. Before the decision regarding removal is made, the Council shall hold a public
hearing on the matter if requested by the member that is subject to the removal action.
Removal shall be by majority vote of the Council.
Appointments Process
Terms of office for Board, Commission, and Corporation members shall begin in October unless
Town Council extends the time period for the application process or otherwise determines it
appropriate to alter the annual appointment schedule.
Term Lengths
Term lengths are set forth in the ordinance establishing the Board, Commission, or Corporation

and/or applicable enabling statutes.
Terms are staggered, with the Council making annual appointments to replace members whose
regular terms expire in any given year.
Compensation
Members appointed to a body by the Town Council shall serve without compensation; provided
however, that they shall be entitled to reimbursement of any necessary expenses incurred in
the performance of their official duties, when approved by Council or its’ designee.
Maximum number of Appointments
It is the goal of the Council to afford the opportunity to serve on Town Boards, Commissions
and Corporations to as many interested residents as possible; however, except as otherwise
specifically provided in this Section, if the number of open Board, Commission, or Corporation
seats exceeds the number of qualified applicants, the Council may allow a person to serve on
more than one (1) Board, Commission, or Corporation. In the event that the number of
qualified applicants exceeds the number of open Board, Commission, or Corporation seats, it is
the goal of the Council to first appoint those qualified applicants not already serving before
taking action to appoint an applicant who is already serving on a Town Board, Commission, or
Corporation. Council may act to replace a current member who is serving on more than one
Board, Commission or Corporation prior to the end of his or her term, provided there is an
adequate number of qualified applicants.
Exception: Since the Building Standards Commission (BSC) and the Zoning Board of Adjustment
(ZBA) do not meet on a regular basis but meet only as needed, it is the intention of the Council
to utilize a dual appointment process when making appointments to the BSC and ZBA.
Therefore, a person may be appointed to serve on both the Building Standards Commission and
the Zoning Board of Adjustment concurrently.
Open Government Training
Elected and appointed public officials are required by State law to receive training in Texas
open government laws. The Office of the Attorney General offers free video training courses,
which were developed to ensure that all elected and appointed government officials, have a
good command of both open records and open meetings laws.
Each elected or appointed official who is a member of a governmental body subject to the
Open Meetings Act or the Public Information Act must attend training. Additionally, employees
who serve as a governmental body's designated public information coordinator are required to
complete the Public Information Act training course.
Officials who are elected or appointed shall complete the required open government training
within ninety (90) days after taking elected office or after appointment. Staff Liaisons from the
individual groups requiring the training shall be responsible to ensure that all members of their
group receive the training. Training CDs are available in the Town Secretary’s office.
Certificates of completion must be maintained by the member's governmental body and made

available for public inspection upon request. The original Certificate shall be forwarded to the
Town Secretary to be kept in permanent records.

Nepotism
Members of an Economic Development Corporation, Building Standards Commission, Zoning
Board of Adjustment or Planning and Zoning Commission cannot be related to a Council
member.
For all other Boards, Commissions, and Corporations, the following rules shall apply:
A Board, Commission, or Corporation Chair/President cannot be a relative of the Mayor

or of a Council Member; and
No more than one (1) member on any given Board, Commission, or Corporation may be

a relative of a Council Member. A person is a relative if he/she is related in the first degree
by consanguinity (blood) or by affinity (marriage).
Guidelines for Members
All members of Boards, Commissions, and Corporations have specific duties and
responsibilities.
All members of Boards, Commissions, and Corporations are expected to participate in formal
and informal training sessions.
Many Boards, Commissions, and Corporations deal with technical issues that can require a
foundation of certain knowledge that must be updated from time to time. The Town will
provide reasonable opportunities for members to acquire and keep current in these training
efforts. Members are expected to participate.
Regular attendance
Effectiveness as a member requires regular attendance. Should a member of a Board,
Commission, or Corporation fail to attend three consecutive regular meetings without being
excused by the Board, Commission, or Corporation, the Council may declare that member’s
appointment forfeited. A member who is unable to attend a meeting shall notify the Staff
Liaison of his/her inability to attend the meeting and shall provide an explanation of the conflict
or other reason that prevents his/her attendance. Notice to the Staff Liaison shall be provided
as soon as practicable after the member becomes aware of the impending absence.
It is particularly important that all members attend briefing sessions and work sessions prior to
formal meetings to promote effective and efficient meetings. If a member finds difficulty in
maintaining regular attendance, it is suggested that the member consider whether they have
sufficient time to be an effective member. It is the responsibility of a member in this position to
initiate a discussion with the Chair/President or Staff Liaison about attendance.

The Chair/President of the Board, Commission, or Corporation is to maintain a charted
attendance record for all members. If attendance becomes an issue, the Staff Liaison will
attempt to secure a written resignation.
The Staff Liaison is responsible for submitting periodic reports to the Town Council on behalf of
the Board, Commission, or Corporation noting progress and members’ attendance.
Avoidance of contacts and individual discussions
It is not uncommon for applicants, opponents, or their representatives to approach individual
members to solicit support or disapproval of a pending issue. These individual contacts shall be
declined by members of the Building Standards Commission, Zoning Board of Adjustment and
by members of the Ethics Commission.
Requests for sponsorships/donations/agreements with vendors
Unless acting jointly with a Staff Liaison pursuant to the direction of their respective Board,
Commission, or Corporation, members do not have the authority to seek donations, to make
agreements with vendors, or to give the impression that they are acting as an agent for the
Town. Furthermore, Board, Commission and Corporation members are not permitted to
obligate any Town funds or enter into any agreements without prior written approval of the
Town Manager or the Manager’s designee. All actions requiring the obligation or expenditure
of funds shall be in accordance with the applicable approved budget.
Ethics
All members of the Town Council, Boards, Commissions, and Corporations shall be familiar with
the requirements of the Town’s Ethics ordinance.
Effective Meetings
All members of Boards, Commissions and Corporations should familiarize themselves with the
elements of a successful meeting. These include:
Having a purpose for the meeting;
•
Giving adequate notice;
•
Posting public notice when required;
•
Preparing for the meeting in advance;
•
Preparing an agenda;
•
Allowing for appropriate participation from all parties;
•
Selecting an appropriate meeting place;
•
Determining the outcome or results of the meeting;
•
Keeping an accurate record of all proceedings; and
•
Keeping discussion focused on items listed on the agenda.
•
Members should avoid common mistakes that can make meetings unproductive, including but
not limited to:
Lack of control at the meeting, appearing unfair, being unable to bring issues to a vote and
•
wasting people’s time.
The Staff Liaison and all members are responsible for compliance with the Texas Open

Meetings law. Meetings of all Boards, Commissions and Corporations are open to the public. All
meetings shall be held in such a fashion that all participants have assigned seating with clearly
visible nameplates. Board Members must take care to speak into the microphone at all times
while in session. If a meeting is recorded with only audio and no video, each person must
identify themselves prior to speaking. Prior to initiating a closed or “Executive Session,” the
Staff Liaison and Chair/President shall receive approval from the Town Attorney.
Prior to any meeting, the Chair/President and Staff Liaison shall prepare an agenda describing
actions to be taken by the group. The agenda shall be prepared in a format approved by the
Town Attorney and shall be posted in compliance with State law.
The Chair/President shall allocate sufficient time for both applicants and opponents of an issue
to present their information. Regardless of whether an agenda item is listed as a public hearing
item or not, members of the public shall be given a reasonable opportunity to present their
information and opinions. The Chair/President must allocate and manage the time to be
allotted and shall use discretion based upon the agenda, the Council Rules of Procedure and
other factors; provided however, that the Chair/President shall have the discretion to allow
additional time without objection by a majority of the Board, Commission or Corporation.
The Chair/President shall endeavor to see that all persons attending or participating in
meetings are treated with respect and dignity. All members must refrain from prejudicial or
stereotypical comments. All members must refrain from questioning that takes the form of
“badgering” or “debating” with those providing testimony/comment.
All members need to be cautious of publicly representing their positions beyond the scope of
the business at hand. The official position of the Town shall be represented only by Town staff,
as established by the Town Council.
Conduct in meetings
Board, Commission, and Corporation members should act in a professional manner. If a
resident presents a complaint to the Board, Commission, or Corporation at a meeting the
information should be taken and referred to Staff to reply to the resident.
Rules of Decorum
Meetings of all Boards, Commissions, and Corporations shall be conducted in accordance with
adopted Town Council Rules of Procedure.

Responsibilities of the Chair/President
Each Board, Commission, or Corporation shall have a Chair/President. A Board, Commission, or
Corporation at the Council’s discretion, may be asked to make a recommendation for a
Chair/President with the final determination left to the Council. The Chair/President should
have some experience as a member of the group. The Planning and Zoning Commission’s Chair
will be determined entirely by the Council.
The Chair/President must act as the “leader” and take responsibility for the group’s efficient
and meaningful operation. The Chair/President must ensure that roles are clearly spelled out,
meetings are efficiently conducted and necessary information is readily available, which helps
create a good working environment.
Appointment of a Chair/President
The Council will have final determination on the appointment of a Chair/President for each
Board, Commission and Corporation, except where state law requires appointment of a
Chair/President by another method. Following the appointment of a new Chair/President, the
Mayor or his or her designee and a Staff Liaison will arrange a meeting with the new
Chair/President to review this Handbook and share ideas on how to run an effective meeting.
The Chair/President should manage the meeting to ensure that:
A few members do not monopolize discussion or questions;
•
Appropriate time is taken for presentation and discussion;
•
Dialogue and interactions are maintained in a courteous and professional Manner;
•
Minutes of each Board, Commission, and Corporation meeting are taken and maintained
•
by the Staff Liaison;
Staff and members treat each other with mutual respect at all times;
•
Discussion is limited to those items on the agenda. However, the Chair/President or Staff
•
Liaison may place any item on a future agenda for discussion;
All Board, Commission, and Corporation meetings shall be recorded as required by the
•
Texas Open Meetings Act.
The Chair/President must ensure that effective communication exists between Board,
Commission, Corporation, Council, Staff and the public. This requires frequent interaction with
the Staff Liaison and Council Liaison to the Board, Commission, or Corporation. The Town
Manager is responsible for ensuring that that the Staff Liaison is efficient in providing requested
technical assistance and information to members.This includes helping to develop appropriate
rules and procedures for the group in order to complete its duties. It also requires preparation
of proper meeting notices and agendas, gathering and relaying pertinent information in a
timely fashion to members and providing support at meetings. If the Staff Liaison is not

effectively operating in this manner, the Chair/President should first discuss the issue with the
Town Manager. If satisfactory results are not achieved, the Chair/President should next contact
the Mayor and Council Liaison to the Board, Commission or Corporation if a Council Liaison has
been named.
It is the responsibility of the Chair/President to be mindful of the attendance, actions and
activities of individual members, as well as to discuss with these members any deviations from
the rules.
The Chair/President shall be responsible for communicating to the Staff Liaison any requests to
be placed on the Town Council agenda for consideration.
The Chair/President and Staff Liaison shall define the scope, objectives and criteria for
completion of any project to be undertaken by the group that has not been referred directly
from Council. This should be done prior to the initiation of all projects. For items referred to a
Board, Commission or Corporation by Council, it is the responsibility of the Chair/President and
Staff Liaison to see that proceedings of the Board, Commission or Corporation fulfill the
direction provided by Council in whole and in a timely manner, with appropriate information
and context.
Prior to a Board, Commission or Corporation undertaking any project or initiative that requires
the expenditure of funds, other than those authorized in the approved Town budget, such
initiative or project shall be submitted to the Staff Liaison for action by the Town Manager.
Responsibilities of the Staff Liaison
A member of the Town staff will be assigned to each Board, Commission, or Corporation. The
Staff Liaison shall not assume the responsibility or task of the group. Rather, the Staff Liaison
shall provide information that group members need to perform their obligations. The Staff
Liaison shall also serve as a communication link between members of the group and the Town
staff. The Staff Liaison shall be responsible for making periodic reports to the Town Council
regarding the activities of his/her Board, Commission or Corporation. The Staff Liaison, when
appropriate and in accordance with the Texas Open Meetings Act, shall place an item on the
agenda for his/her designated Board, Commission or Corporation to allow the Council Liaison to
provide an update regarding the actions, direction and input of the Town Council.
Responsibilities of the Council Liaison and Council members
A member of the Town Council may be assigned as liaison to each Board, Commission, or
Corporation. The Council Liaison shall not assume the responsibility or task of the assigned
body. The Council Liaison shall serve as a communication link between the Board, Commission
or Corporation and the Town Council. The Council Liaison shall make periodic reports to the
Town Council regarding the activities of their assigned Board, Commission or Corporation.
In order to maintain appropriate separation of responsibilities between Council and boards,
Council Liaisons and Council members are expected to exercise restraint in providing input to
boards, but if they choose to do so, shall clearly and definitively state that they are providing
input as an individual and do not represent the Council as a body in any way. Council members

may freely speak before any Board, Commission or Committee on behalf of their own personal
interest and concerns; in which case, they shall publicly state the nature of their interest and/or
concern and that they are appearing only in their private capacity. The Council Liaison should
communicate with the Chair/President throughout the year to ensure Boards, Commissions and
Corporations focus on their missions and roles and to stay abreast of board activities. Council
Liaisons should be accessible to Board, Commission and Corporation Chairs/Presidents to offer
feedback and guidance. Council members and Council Liaisons may address a Board,
Commission or Corporation and express his or her individual opinion when that Board,
Commission or Corporation is addressing a matter that personally impacts the Council Liaison or
his or her personal property or interests; however, all other statements made by Council
members or Council Liaisons shall reflect the opinion, advice or direction of a majority of the
Town Council.

Agenda Item:
Consider and take appropriate action regarding a Developer’s Agreement between the Town of
Trophy Club and NAP Trophy Club, L.P.; and authorizing the Mayor or his designee to execute
all necessary documents (T. Uzee).
Background and Explanation:
On January 27, 2018, Council approved the Final Plat for Trophy Club Town Center (PD-30)
consisting of 51 commercial, office, multifamily, townhome, and open space lots across
approximately 26.355 acres of land. The Developer’s Agreement was not presented and
approved with the Final Plat due to legal circumstances. As a result, the Developer’s Agreement
is now ready for consideration so that all of the property’s infrastructure may be constructed,
followed closely by the construction of the multifamily building.
NAP Trophy Club, L.P. is responsible for the public improvements principally listed in Section II
(A) of the Developer’s Agreement, as shown below.

Due to the multiple developers associated with this site, the owner of each lot will be
responsible for the remaining improvements.

Section II (A) of the Developer’s Agreement also identifies whether the Property Owners’

each lot on the property. Additionally, the satisfaction of Parkland Dedication is noted.

Not applicable.
Legal Review:
The Town Attorney and Fire Marshal have reviewed the Developer’s Agreement and saw no
items of concern.

AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS,
AMENDING SECTION 8.02.003,DECLARATION OF NUISANCE, OF
ARTICLE 8.02, NOISE, OF CHAPTER 8, OFFENSES AND NUISANCES,
OF THE TOWN OF TROPHY CLUB CODE OF ORDINANCES TO
ALLOW ACTIVITY ON SUNDAY TO BE TREATED THE SAME AS ON
MONDAY THROUGH SATURDAY; PROVIDING FOR INCORPORATION
OF PREMISES; PROVIDING FOR AMENDMENTS; PROVIDING A
SAVINGS AND REPEALER CLAUSE; PROVIDING A SEVERABILITY
CLAUSE; PROVIDING A PUBLICATION CLAUSE; PROVIDING A
PENALTY NOT TO EXCEED TWO THOUSAND DOLLARS ($2,000.00)
FOR EACH VIOLATION; PROVIDING AN ENGROSSMENT AND
ENROLLMENT CLAUSE; AND PROVIDINGAN EFFECTIVE DATE.
WHEREAS,
the Town Council of the Town of Trophy Club, Texas is a home rule
municipality empowered to do all acts and make all regulations which may be necessary
or expedientfor the promotion of the public health, safety, and general welfare; and
WHEREAS,
the Town Council has the authority to generally review and make
changes to the Code of Ordinances as determined appropriate; and
WHEREAS,
the Town Council hereby finds that amending Section 8.02.003,
Declaration of nuisance,of Article 8.02,Noise, of Chapter 8, Offenses and Nuisances,
of the Town of Trophy Club Code of Ordinancesas further specified herein serves the
best interests of the Town to allow activity on Sunday to be treated the same as on
Monday through Saturday.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS:
SECTION 1.
INCORPORATION OF PREMISES
That the above and foregoing premises are true and correct and are incorporated
herein and made a part hereof for all purposes.
SECTION 2.
AMENDMENTS
2.01
Section 8.02.003, Declaration of nuisance, of Article 8.02, Noise, of Chapter 8,
Offenses and Nuisances, of the Town of Trophy Club Code of Ordinances is hereby
amended in its entirety as follows:

CHAPTER 8 OFFENSES AND NUISANCES
ARTICLE 8.02NOISE

SECTION8.02.003DECLARATION OF NUISANCE
(a) The following acts, among others, are declared to be nuisances in violation of this
article, but said enumeration shall not be deemed to be exclusive:
(1) The playing of any radio, phonograph, tape player or other electronic
device of a similar nature, or any musical instrument, in such manner or with
such volume, during the hours between 10:00 p.m. and 7:00 a.m., as to
annoy or disturb the quiet, comfort, or repose of persons of ordinary
sensibilities in any dwelling or other type of residence, such persons being
indoors or outdoors at any such location.
(2) The use of any loudspeaker or amplifier of such intensity that annoys or
disturbs persons of ordinarysensibilities in the immediate vicinity thereof,
except by permit issued by the town manager or designee in accordance with
section 8.02.005of this article.
(3) The running of any automobile, motorcycle, or vehicle so out of repair or
so loaded, or operating a vehicle in any such manner, as to create loud or
unnecessary grating, grinding, jarring, or rattling noise or vibrations.
(4) The discharge into the open air of the exhaust of any steam engine,
stationary internal combustion engine, motor vehicle engine or boat engine,
except through a muffler or other device which will effectively prevent loud or
explosive noises therefrom.
(5) The use of any mechanical device operated by compressed air, unless
the noise to be created is effectively muffled and reduced to prevent loud or
explosive noises therefrom.
(6) The erection, including excavation, demolition, alteration or repairwork
on any building, other than between the hours of 7:00 a.m. and 6:00 p.m.on
or during the weekdays of Monday through Saturday, inclusive, except in
case of an urgent necessity in the interest of public safety and convenience,
and then only by permit from the town manager or designee in accordance
with section 8.02.005of this article, specifying the nature of the emergency
and the days and hours such work is to be allowed, which permit may be
renewed by the town manager or designee during the time the emergency
exists.
(7) The operation of any heavy equipment, machinery or apparatus for
excavation, construction, grading, earth moving, paving, cement laying or

pouring, drilling or work of any nature, or the operation of any chain saw,
within 1500 lineal feet of any occupied residential dwelling, other than
between the hours of 7:00 a.m. and 6:00 p.m.on or during the weekdays of
Mondaythrough Saturday, inclusive, except in case of an urgent necessity in
the interest of public safety and convenience, and then only by permit from
the town manager or designee in accordance with section 8.02.005of this
article, specifying the nature of the emergency and the days and hours such
work is to be allowed, which permit may be renewed by the town manager or
designee during the time the emergency exists.
(8) As a part of any business, other than between the hours of 7:00 a.m.
and 9:00 p.m., Monday through Saturday, inclusive, within 1500 linear feet of
any occupied residential dwelling, the operation of any heavy equipment,
truck or machinery which emits noises of such intensity or loudness that
annoy or disturb persons of ordinary sensibilities within such distance, except
in the case of urgent necessity in the interest of public safety and
convenience, and then only by permit from the town manager or designee in
accordance with section 8.02.005of this article, specifying the nature of the
emergency and the dates and hours such work is to be allowed, which permit
may be renewed by the town manager or designee during the time the
emergency exists.
(9) Construction work performed on any of the following holidays: New
Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day,
Christmas Day.
(b)Notwithstanding any of the above, the town manager or designee shall have the
authority to and may issue a permit in accordance with section 8.02.005of this article
for alteration or repair work or for new construction in connection with owner-occupied
residences when the particular work is to performed by the owner-occupant of the
premises where the work is to be performed and when such work is to be performed
between the hours of 6:00 p.m. and 9:00 p.m., Monday through Saturday, inclusive, or
between the hours of 9:00 a.m. and 6:00 p.m. on Sunday.
SECTION 3.
SAVINGS AND REPEALER
This Ordinance shall be cumulative of all other ordinances of the Town affecting
setting Fee Schedulesand shall not repeal any of the provisions of such ordinances
except in those instances where provisions of those ordinances are in direct conflict with
the provisions of this Ordinance; whether such ordinances are codified or uncodified,
and all other provisions of the Ordinances of the Town of Trophy Club, codified or
uncodified, not in conflict with the provisions of this Ordinance, shall remain in fullforce
and effect. Notwithstanding the foregoing, any complaint, action, cause of action or
claim which prior to the effective date of this Ordinance has been initiated or has arisen
under or pursuant to such repealed Ordinance(s) shall continue to be governed by the

provisions of that Ordinance and for that purpose the Ordinance shall be deemed to
remain and continue in full force and effect.
SECTION 4.
SEVERABILITY
If any section, article, paragraph, sentence, clause, phrase or word in this
Ordinance, or its application to any person or circumstance is held invalid or
unconstitutional by a Court of competent jurisdiction, such holding shall not affect the
validity of the remaining portions of this Ordinance; and the Town Council hereby
declares it would have passed such remaining portions of the Ordinance despite such
invalidity, which remaining portions shall remain in full force and effect.
SECTION 5.
PUBLICATION
The Town Secretary of the Town of Trophy Club is hereby directed to publish the
Caption, Penalty Clause, and Effective Date Clause of this Ordinance as required by
Section 52.013 of the Texas Local Government Code.
SECTION 6.
PENALTY
It shall be unlawful for any person to violate any provision of this Ordinance, and
any person violating or failing to comply with any provision of this Ordinanceshall be
deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in a sum
not to exceed two thousand dollars ($2,000.00), and a separate offense shall be
deemed committed upon each day during or on which a violation occurs or continues.
SECTION 7.
ENGROSSMENT AND ENROLLMENT
The Town Secretary of the Town of Trophy Club is hereby directed to engross
and enroll this Ordinance in accordance with the Town Charter.
SECTION 8.
EFFECTIVEDATE
This Ordinance shall become effective from and after its date of passage and
publication as required by law.

WHEREAS,
the Town Council of the Town of Trophy Club, Texas is a home rule
municipality empowered to do all acts and make all regulations which may be necessary
or expedientfor the promotion of the public health, safety, and general welfare; and
WHEREAS,
the Town Council has the authority to generally review and make
changes to the Code of Ordinances as determined appropriate; and
WHEREAS,
the Town Council hereby finds that amending Section 2.01.001,
Definitions, Section 2.01.004, Fees, Section 2.01.007, Maximum number of animals,
Section 2.01.019, Licenses and tags, Section 2.01.020, Special requirements for
keeping miniature pigs, ferrets, and fowl, of Article 2.01, General Provisions, of Chapter
2, Animal Control; and amending Subsection (d), Notification of owner, of Section
2.02.001, Generally, and Section 2.02.003, Adoption of impounded animals, of Article
2.02, Impoundment, of Chapter 2, Animal Control, of the Town of Trophy Club Code of
Ordinancesas further specified herein serves the best interestsof the Town so that
registration of household pets no longer be required.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS:

SECTION 1.
INCORPORATION OF PREMISES
That the above and foregoing premises are true and correct and are incorporated
herein and made a part hereof for all purposes.
SECTION 2.
AMENDMENTS
2.01
Section 2.01.001, Definitions, Section 2.01.004, Fees, Section 2.01.007,
Maximum number of animals, Section 2.01.019, Licenses and tags, Section 2.01.020,
Special requirements for keeping miniature pigs, ferrets, and fowl, of Article 2.01,
General Provisions, of Chapter 2, Animal Control, of the Town of Trophy Club Code of
Ordinances are hereby amended as follows and all other sections not expressly
mentioned hereafter shall remain the same:
CHAPTER 2 ANIMAL CONTROL
ARTICLE 2.01GENERAL PROVISIONS
SECTION 2.01.001 DEFINITIONS
Abandon. To dump, desert, or leave any animal on public or private property with the
intent of terminating any further responsibility for said animal, and shall also mean
failing to properly redeem or properly release any animal impounded or quarantined by
the town.
Animal. Any living creature classified as a member of the animal kingdom, including but
not limited to dogs, cats, cows, horses, birds, fish, mammals, reptiles, insects, fowl, and
livestock, but specifically excluding human beings.
Animal control services or division. An establishment that is operated, controlled, or
contracted with by the town for the confinement, safekeeping, control and/or destruction
of animals which come into the custody of the town.
Animal control officer. Any individual employed, contracted with, or appointed by the
town for the purpose of aiding in the enforcement of this act or any other law or code
relating to the licensure of animals, control of animals, or seizure and impoundment of
animals, and includes any state or local law enforcement officer or other employee
whose duties in whole or in part include assignments that involve the seizure and
impoundment of any animal.
Animal shelter. A facility operated by the town or with which the town has contracted for
the purpose of impounding or caring for animals held under the authority of this chapter
or state law.

At large. Shall mean when an animal is not confined to the premises of its owner by a
fence of sufficient strength and/or height to prevent the animal from escaping therefrom,
inside the house or other enclosure, or secured on such premises by a leash of
sufficient strengthto prevent the animal from escaping from the premises, and so
arranged that the animal will remain upon such premises when the leash is stretched to
full length in any direction. An animal shall not be considered “at large” when held and
controlled by a person of adequate strength by means of a leash, cord, chain, or rope of
proper strength and length to control the actions of the animal, or while confined within a
vehicle. An “invisible fence” will suffice as sufficient restraint so long as the animal is not
found outside the premises of the owner and the invisible fence is registered with the
animal control services or division.
Bite. Any abrasion, scratch, puncture, tear or piercing of skin caused by an animal.
Cat. All domestic species or varieties of Felis catus, male or female, alive or dead.
Certificate of registration. The town shall register and issue a certificate of registration
and a license to any person living in the town who owns or possesses a dog or cat
requiring vaccination to prevent rabies who files an application meeting the
requirements of this chapter. Such certificate of registration is for the purpose of owner
identification and in cases where the dog or cat might become impounded, lost or
injured. Application for the certificate of registration/license shall be made by the owner,
in writing or in person, and be accompanied by proof that the dog or cat is currently
vaccinated against rabies in accordance with the Texas Administrative Code, title 25,
part 1, chapter 169 (Zoonosis Control, Rabies Control and Eradication). If there is a
change in ownership, the new owner shall have the identification tag transferred to his
name within ten (10) days after taking possession of the animal.
Coop. An enclosure in which fowl are confined.
Dangerous dog. Any dog that, according to the records of the appropriate authority:
(1) Has bitten, attacked, or endangered or has inflicted severe injury on a
human being on public or private property;
(2) Has more than once severely injured or killed adomestic animal while
off the owner's property;
(3) Has been used primarily or in part for the purpose of dog fighting or is a
dog trained for dog fighting; or
(4) Has, when unprovoked, chased or approached a person upon the
streets, sidewalks, orany public grounds in a menacing fashion or apparent
attitude of attack, provided that such actions are attested to in a sworn
statement by one or more persons and dutifully investigated by the
appropriate authority.

Dangerous wild animal.
(1) A lion;
(2) A tiger;
(3) An ocelot;
(4) A cougar;
(5) A leopard;
(6)A cheetah;
(7) A jaguar;
(8) A bobcat;
(9) A lynx;
(10)A serval;
(11)A caracal;
(12)A hyena;
(13)A bear;
(14)A coyote;
(15)A jackal;
(16)Ababoon;
(17)A chimpanzee;
(18)An orangutan;
(19)A gorilla; or
(20)Any hybrid of an animal listed in this section.
Dog. All domesticated members of Canis familiaris, male and female, alive or dead.
Euthanasia. To humanely cause the death of an animal by a method which:

(1) Rapidly produces unconsciousness and death without visible evidence
of pain or distress; or
(2) Utilizes anesthesia produced by an agent which causes painless loss of
consciousness with death following such loss of consciousness.
Fowl. Chickens, turkeys, pheasants, peacocks, quail, geese, ducks, or similar feathered
animals, regardless of age, sex, or breed, excluding roosters.
Harboring or harboring of animal. The keeping and caring, including but not limited to
feedingand providing water, for an animal for seventy-two (72) hours or longer.
Impound. To seize and hold in the custody of the local rabies control authority or other
authority such as a veterinarian.
Invisible fence. Any fence which cannot be seen with the human eye but that is
designed to keep an animal enclosed in a space by means of laser technology or sound
technology. Such invisible fence must not be capable of causing pain or discomfort to
any human being that crosses its path.
Law enforcement officer. Those authorized to enforce the provisions of this chapter,
namely, the local rabies control authority, any animal control officer, or any law
enforcement officer.
Livestock. Any horses, mules, donkeys, cattle, hogs, goats and sheep of any and all
kinds, and shall include both the male and female species of such animals.
Local rabies control authority. The animal control officer is designated as the local
rabies control authority and has authority to appoint representatives to enforce the
provisions of this chapter, receive reports of animal bites, investigate animal bites,
insure quarantine of possibly rabid animals and otherwise carry out provisions of state
law pertaining to control and eradication of rabies.
Neuter. The surgical removal of the male reproductive organs of an animal to render it
unable to reproduce.
Owner. A person who harbors, keeps, possesses, or permits to be harbored, kept, or
possessed an animal in his care, on or about his premises, without regard to title,
purchase, or acceptance of the animal as a gift.
Person. Any individual, firm, association, partnership, or corporation or any other legal
entity.
Police dog. Any dog used by a law enforcement agency or its officers in the
administration of official duties.

Pot-bellied pig. A varietyof swine that is no more than eighteen inches (18") in height at
shoulder level when full grown, \[having\] short erect ears, and a straight tail. Swine shall
not be considered a pot-bellied pig if its weight exceeds sixty (60) pounds, or unless
registered with a licensed breeder.
Prohibited animals. An animal not normally considered domesticated including, but not
limited to, venomous lizard, poisonous snake, boa, python, raccoon, skunk, fox, bear,
elephant, kangaroo, monkey, chimpanzee, antelope, deer, anyprotected, threatened, or
endangered species as defined by the Texas Wildlife Commission and the U.S. Fish
and Wildlife Service, or any other wild animal capable of, or inflicted to do, serious
bodily harm to humans or other animals of any kind.
Proper enclosure of a dangerous dog. Shall mean, while on the owner's property, a
dangerous dog is securely confined indoors or in a securely enclosed and locked pen or
structure, suitable to prevent the entry of young children (nine (9) years of age or
younger) and designed to prevent the animal from escaping. Such pen or structure shall
have secure sides and, where appropriate, a secure top to prevent the dog from
escaping over, under, or through the structure and shall also provide protection from the
elements.
Quarantine. Strict confinement under restraint by closed cage or padlock or in any other
manner approved in this chapter or state law on the private premises of the owner or at
a facility approved by the state board of health or its designee, or the local rabies control
authority.
Severe injury. Any physical injury which results in broken bones, multiple bites, or
disfiguring lacerations requiring sutures or reconstructive surgery.
Spay. The surgical removal of the female reproductive organs of an animal to render it
unable to reproduce.
Unprovoked. An action by an animal that is not in response to being tormented, abused,
teased or assaulted by any person; in response to pain or injury; or in protection for
itself or its food, kennel, immediate territory, ornursing offspring.
Vaccinated. Properly injected with a rabies vaccine licensed for use in that species by
the United States Department of Agriculture and administered by a veterinarian licensed
to practice in the state in an amount sufficient to provide immunity and satisfies the
following criteria:
(1) The animal must have been at least four (4) months of age at the time
of vaccination;
(2) At least thirty (30) days have elapsed since the initial vaccination; and

(3) Not more than twelve (12)months have elapsed since the most recent
vaccination, or, if a three (3) year vaccination, then not more than thirty-six
(36) months have elapsed since the most recent vaccination.
Veterinarian. One licensed by state board of veterinary medical examiners, qualified
and authorized to treat diseases and injuries of animals.
Vicious animal. Any individual animal that has on two previous occasions, without
provocation, attacked or bitten any person or other animal, or any individual animal
which the local rabies control authority or his representative has reason to believe has a
dangerous disposition likely to be harmful to humans or other animals.
Wild animal. Includes all species of animals that commonly exist in a natural unconfined
state, usually not domesticated, and any species of animal illegal to own under federal,
state or local law. This shall apply regardless of state or duration of captivity. The term
shall include but is not limited to foxes, panthers, wolves, alligators, crocodiles, apes,
elephants, rhinoceroses, and all forms of poisonous or constricting reptiles, and other
like animals.

SECTION2.01.004 FEES
All fees for licensing, daily handling, impoundment, disposal, quarantine, lost or
destroyed tags, and/or transfer to the animal shelter are stated on the schedule of fees,
to be revised from time to time by the local rabies control authority and approved by the
town council. The schedule of fees is located in appendix Aof the town's Code of
Ordinances. A copy of the schedule of fees can be obtained from the local rabies
control authority or the town secretary.

SECTION2.01.007 MAXIMUM NUMBER OF ANIMALS
(a) Declaration of nuisance. The keeping of more than the maximum number of
animals permitted by this section shall be considered a public nuisance.
(b) Maximum number. It shall be unlawful to keep or harbor more than four (4)
animals of any one species six (6) months of age or older or more than a total of six (6)
animals on any premises used or zoned for residential purposes and less than two
acres in area.
(c) Exemptions. The provisions of subsection (b) shall not apply to: (i) licensed
residential breeders, (ii) licensed residential foster owners, or (iii) a person(s) who keeps
or harbors more than four (4) dogs and four (4) cats six (6) months of age or older in
violation of subsection (b)., if the person has obtained town certificates of registration for

each animal on or before July 31, 2006 and continuously maintains current town
certificates of registration. Failure to maintain a current license for residential breeders
or,a current license for residential foster owners or current registration of each such
animal as required in this section shall result in a forfeiture of this exemption.

SECTION2.01.019 LICENSES AND TAGS
(a) Owner identification and rabies vaccination tag required. A person within the town
who is the owner or harborer of a dog or a cat that is three (3) months of age or older
shall place and maintain a collar on the animal which collar shall have:
(1) A current identification tag listing the owner or harborer's name, current
address and current telephone number; and
(2) A tag evidencing compliance with the requirements of state law
regulating rabies vaccination under the Rabies Control Act, as amended, and
chapter 2of this Code of Ordinances.
(b) Possession of unlicensed dog or cat prohibited. A person commits an offense if he
possesses within the town an animal which has not been licensed according to
subsection (a) of this section. The owner of an animal shall, upon request, show to the
law enforcement officer enforcing this chapter the receipt for the animal's town
registration. The failure or refusal of an owner to produce to the law enforcement officer
the receipt for the animal's town registration or a current license tag shall constitute
prima facie proof that such animal has not been licensed according to the requirement
contained in subsection (a) of this section.
(cb) Issuance of tag; wearing of tags.Upon presentation of the vaccination certificate
and payment of the licensing fee, the town manager or the manager's duly authorized
representative shall issue to the owner a license tag. The license tag and The
vaccination tag shall be affixed to a collar, which shall be attached to the animal's neck
and worn by such animal at all times.
(d) Lost or destroyed tags. In the event a license tag is lost or destroyed, a new tag
shall be issued by the town manager or the manager's duly authorized representative
upon presentation of a receipt showing the payment of the initial license fee and upon
the payment of a replacement fee, the amount of which is to be as designated on the
fee schedule in appendix Aof this code. The replacement license tag shall be valid only
for the period of time that remained on the original license receipt.
(ec) Failure to obtain license tag. A person commits an offense, without regard to his
mental state, if he owns an animal without a current licensing tag for the animal.
(fd) Defenses. It is a defense to prosecution that:

(1) The animal was younger than three (3) months of age; or
(2) The owner of the animal has resided in the town less than thirty (30)
days.
(g) Transfer of registration or licensing. Town registration or licensing of an animal is
not transferable to another animal.
SECTION2.01.020 SPECIAL REQUIREMENTS FOR KEEPING MINIATURE PIGS,
FERRETS, AND FOWL
(a) Pot-bellied or miniature pigs.
(1) It shall be unlawful for any person to keep, harbor or raise more than
two (2) adult pot-bellied pigs in any one (1) residence within the town.
(2) It shall be unlawful for any person to keep a pot-bellied pig outdoors
other than those times necessary for the elimination of waste or for exercise.
Pot-bellied pigs are subject to all applicable sections of this chapter, including
the prohibitions against animals at large.
(3) It shall be unlawful for any person to keep, harbor, or raise a pot-bellied
pig which has not been altered (spayed or neutered), and its tusks removed
from its body.
(4) It shall be unlawful for any person to keep a pot-bellied pig at any
location within the townunless such person has first filed with the local rabies
control authority a registration application to keep such an animal and such
application has been approved. The information required in the application
shall be determined by the animal control services or division. The application
shall be accompanied by thenecessary veterinary documents and licensing
fee as required on the schedule of fees for pot-bellied pigs.
(b) Ferrets.
(1) It shall be unlawful for any person to keep, harbor, or raise more than
four (4) adult ferrets in any one (1) residence within the town.
(2) It shall be unlawful for any person to keep, harbor, or raise a ferret
which has not received annual ferret rabies and distemper vaccinations and
that is not spayed or neutered.
(3) Cages used for keeping of ferrets shall be made to prevent the animal
from escaping and being large enough to ensure compliance with this
chapter.

(4) It shall be unlawful for any person to keep, harbor, or raise any ferret
which is not registered and licensed with the animal control services or
division. The licensing fee for ferrets is set out in the schedule of fees.
(c) Fowl.
(1) Location and maximum number. Fowl shall only be allowed on property
zoned for single-family residential use. It shall be unlawful for any person to
keep, harbor,maintain, or allow more than four (4) fowl of any species six (6)
months of age or older upon property owned, leased or controlled by such
person within the corporate limits of the town.
(2) Roosters prohibited. It shall be unlawful for any person to own, control,
keep, harbor, maintain, or allow one (1) or more roosters upon property
owned, leased, or controlled by such person within the corporate limits of the
town.
(3) Location and other requirements for coops. A coop shall comply with
the following requirements. A coop shall:
(A) This section shall not apply to pet birds kept within residential or
commercial structures, nor shall it apply to bird houses for the keeping of
migrating or wild birds;
(B) Be a minimum of twenty feet (20') from any street right-of-way;
(C) Be located a minimum of ten feet (10') from rear and side lot lines;
(D) Not be located in any front or side yard(s); and
(E) Be fully screened from public view in accordance with applicable
town regulations.
(4) Nuisance. It shall be unlawful for any person who owns, controls, has
custody of, keeps, maintains, or harbors fowl to intentionally, knowingly or
recklessly cause, allow, or maintain property, including but not limited to
yards, pens, sheds, coops, orother enclosures in which fowl are confined, in
such a manner as to give off odors offensive to persons of ordinary
sensibilities residing in the vicinity; or in such condition as to attract flies,
mosquitoes or other noxious insects or rodents and/or thebreeding of flies,
mosquitoes or other noxious insects or rodents; or in any manner or condition
that endangers the public health, safety or welfare, or creates a public
nuisance as defined herein or by state law; or to cause or allow the
encroachment of associated debris of any nature or feces across any
property line.

SECTION2.02.003 ADOPTION OF IMPOUNDED ANIMALS
(a) A person who desires to adopt an animal from the town shall:
(1) Register and license the animal withthe town;
(21) Have the animal vaccinated for rabies within five (5) days after
adoption. If the animal is not of proper age for vaccination, then the animal
must be vaccinated within fourteen (14) days of reaching the proper age;
(32) Have the animal spayed or neutered within fourteen (14) days after
adoption, provided the animal is of proper age for such procedure. If the
animal is not of proper age for the procedure, then the animal must be spayed
or neutered within fourteen (14) days of reaching the proper age; and
(43) Sign a promise in writing that the animal will be vaccinated and
spayed/neutered within the time limits prescribed in subsections (21) and (32)
of this subsection. The animal control services or division shall keep such
written promise on file. It is an offense under this section for the owner of the
animal to fail to provide proof of vaccination to the animal control services or
division withinfive (5) days from the date of adoption. It is a separate offense
under this section for the owner of the animal to fail to provide proof of
spaying/neutering to the animal control services or division within fourteen
(14) days from the date of adoption or the date when the animal reaches the

proper age. If (i) an owner makes a promise to vaccinate or spay/neuter in
writing, (ii) the animal is thereafter impounded a second time, and (iii) it is
determined that the animal was not vaccinated and/or spayed/neutered in
accordance with the written promise, then the impoundment fee shall be
doubled as required in the schedule of fees adopted by the town.
(54) For any subsequent impoundment of such animal that remains
unvaccinated and/or unspayed/unneutered atthe time of impoundment, an
additional impoundment fee as set forth in the town's schedule of fees shall
be assessed.
(b) The local rabies control authority shall make the final determination as to whether
an animal is healthy enough for adoption. Provided, however, that such a decision by
the local rabies control authority shall not constitute a warranty, either express or
implied, of the health or age of the animal.
SECTION 3.
SAVINGS AND REPEALER
This Ordinance shall be cumulative of all other ordinances of the Town affecting
setting Fee Schedulesand shall not repeal any of the provisions of such ordinances
except in those instances where provisions of those ordinances are in direct conflict with
the provisions of this Ordinance; whether such ordinances are codified or uncodified,
and all other provisions of the Ordinances of the Town of Trophy Club, codified or
uncodified, not in conflict with the provisions of this Ordinance, shall remain in fullforce
and effect. Notwithstanding the foregoing, any complaint, action, cause of action or
claim which prior to the effective date of this Ordinance has been initiated or has arisen
under or pursuant to such repealed Ordinance(s) shall continue to be governed by the
provisions of that Ordinance and for that purpose the Ordinance shall be deemed to
remain and continue in full force and effect.
SECTION 4.
SEVERABILITY
If any section, article, paragraph, sentence, clause, phrase or word in this
Ordinance, or its application to any person or circumstance is held invalid or
unconstitutional by a Court of competent jurisdiction, such holding shall not affect the
validity of the remaining portions of this Ordinance; and the Town Council hereby
declares it would have passed such remaining portions of the Ordinance despite such
invalidity, which remaining portions shall remain in full force and effect.

SECTION 5.
PUBLICATION
The Town Secretary of the Town of Trophy Club is hereby directed to publish the
Caption, Penalty Clause, and Effective Date Clause of this Ordinance as required by
Section 52.013 of the Texas Local Government Code.
SECTION 6.
PENALTY
It shall be unlawful for any person to violate any provision of this Ordinance, and
any person violating or failing to comply with any provision of this Ordinanceshall be
deemed guilty of a class C misdemeanor upon conviction and shall be fined, except as
otherwise provided herein, in a sum not to exceed two thousand dollars ($2,000.00) for
each offense, and a separate offense shall be deemed committed upon each day during
or on which a violation occurs or continues.
SECTION 7.
ENGROSSMENT AND ENROLLMENT
The Town Secretary of the Town of Trophy Club is hereby directed to engross
and enroll this Ordinance in accordance with the Town Charter.
SECTION 8.
EFFECTIVE DATE
This Ordinance shall become effective from and after its date of passage and
publication as required by law.

Background and Explanation:
The purpose of this presentation is to highlight the upcoming July 4th Celebration and
adjustments made to the fireworks display. Four activitiestakeplace in honor of the 4th of July
celebration in Trophy Club; Flag Planting, Patriot 5K & Fun Run, Parade of Patriots, and
Celebration and fireworks display.
Due to minor turf damage at Byron Nelson High School from the burning debris of last year’s
show, Staff had to explore using alternative locationsfor this year’s event. Through
coordination with stakeholders Northwest Independent School District, City of Roanoke, Trophy
Club Country Club, and Pyrotex Incorporated, the location of this year’s launch site has been
moved to Independence Park West. This change will result in a similar quality fireworks show
with 2-3” shells which do not travel as high as the 6” shells used previously. As a result of the
change in location, some off-site viewing locations will have different viewing experiences.
To best manage resident expectations, Staff will take a proactive approach and develop an
effective communications plan utilizing the Town’s website and all appropriate social media
outlets.
Financial Considerations:
The event is budgeted in the FY17-18 Hotel Occupancy Tax fund.

Staff Recommendation:
Staff seeks Council’s direction regarding each item to improve the budget process and overall

Per the approved Interlocal Cooperation Agreement for Administration of Fire Protection
Services, Section 3.1, Budget and Funding, Subsection A, Budget Preparation: Town shall
prepare a budget for Fire Protection Services and present that budget to the Town Council and
District for approval at a joint meeting before August 1 of each year. Both parties shall approve
the contractual budget by August 15 of each year.
Also, direction was given at the May 22, 2018 Council meeting to place the following item on
the Joint Session agenda: Review negotiating with the Trophy Club Municipal Utility District No.
1 to transfer the title for the land that the Annex Building is built on and the maintenance
building by the Wastewater Treatment Plant.
Financial Considerations:
The Town’s Finance Department shall prepare a budget for Fire Protection Services and present
that budget to the Town Council and District for approval at a joint meeting before August 1 of
each year.

RESOLUTION NO. 2018-09
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF
TROPHY CLUB, TEXAS, REPEALING RESOLUTION NO. 2017-33AND
ADOPTING A NEW RESOLUTIONAPPOINTING A COUNCIL LIAISON
ON THE PARKS AND RECREATION BOARD; REAFFIRMING
EXISTING APPOINTMENTSAND CHAIRPERSON; DESIGNATING
TERMS OF SERVICE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS,
the Town of Trophy Club, Texas, benefits by having its citizens
involved in local government through service on Boards, Commissions, and Corporations;
and
WHEREAS,
the Trophy Club Town Council is responsiblefor making appointments
to the Boards, Commissions, and Corporationsserving the Town; and
WHEREAS,
onOctober 24, 2017, the Town Council of the Town of Trophy Club
adopted Resolution No. 2017-33,making appropriate appointmentson the Parks and
Recreation Board;and reaffirming current appointments, Chairperson, and Council Liaison
for the 2017-2018 fiscal year; and
WHEREAS,
by passage of this Resolution, the Town Council hereby repeals
Resolution No. 2017-33andadoptsthis Resolution, appointing a Council Liaisonon the
Parks and Recreation Board; and reaffirmingcurrent appointmentsandChairpersonfor
the remainder of the 2017-2018 fiscal year.
NOW THEREFOREBE IT RESOLVED BY THE TOWN COUNCIL OF THE

TOWN OF TROPHY CLUB, TEXAS:
Section 1.That the foregoing recitals are incorporated herein as if written word
for word.
Section 2.That the Town Council hereby repeals Resolution No. 2017-33and
adoptsthis Resolution to make appropriate appointments and reaffirm, as applicable, the
following individuals to serve on the Parks and Recreation Board with respective terms of
service ending on September 30 of the year specified below for each individualfor the
2017-2018 fiscal year:

Consider and take appropriate action regarding appointing three (3) Council Members to a
Council Subcommittee formed for the purpose of providing fiduciary oversight of the budget, as
well as providing input regarding the administration of the budget and the budget process (H.
Fimbres).
Background and Explanation:
Per Chapter 1, General Provisions, Section 1.02.033, Council subcommittee, of the Town’s Code
of Ordinances: At the first meeting in June of each year, the Town Council shall take action to
designate three (3) of its members to serve on a Council subcommittee formed for the purpose
of providing fiduciary oversight of the budget, as well as providing input regarding the
administration of the budget and the budget process. The subcommittee shall meet with Town
Staff and shall provide updates to the full Council as the budget is developed.
Currently serving on the Finance Subcommittee is Mayor Sanders, Mayor Pro Tem Shoffner,
and Council Member Lamont.
