Staff met with representatives of the Corps of Engineers on 11/13/17 to discuss the Loop Road,
determine if anything, regulatory or otherwise, had changed from the Corps perspective since
the attached 12/3/14 denial letter, and to determine the Town’s options in moving forward
with a potential appeal if deemed appropriate.

proposing for the UNT Practice Facility. If this is going to be a viable route we need to get
something formalized with them as well as get the Corps blessing on how we cross through their
property.

Didn't want you to think this proposed project is 'dead' ... pretty expensive road, but wanted you
to see what we are thinking. TCCC will soon begin developing their northern most property for a
possible UNT golf team practice area thatwe would need to gain ROW from for this
project. TCCC and the Town has had preliminary discussions and it didn't appear that the issue
would be a problem in the future. Just thought you'd like to see what a proposed design of this
project would look like. Please don't float this out to the public ... we've got a long, long way to
go to secure necessary easements from the Corps ... and a tremendous amount of staffing
before we would ever be ready to propose this to our citizens.

11/13/17 Corps Meeting:
Prior to meeting with Corps representatives on 11/13/17, Town Manager and staff reviewed
the 2001 Grapevine Lake Master Plan which is a supplement to the original Master Plan of
1971. The purpose of the plan was to identify Environmentally Sensitive Areas (ESA) on all
Corps lands, with the objective being to minimize the number of easements granted once the
ESA’s were established. As a result, the following restrictions were placed on subsequent
easement requests which have had a negative impact on the viability of the proposed Loop
Road:
1.Requests are only granted when no practical alternative exists.
2.The request must have the least identifiable environmental and visual impact.
3.The request must consider routing the easement to adjacent land outside the ESA when
possible.
Factors the Corps uses to determine a “demonstrated need” for easements in ESA’s:
1.Whether there is adjacent private land outside the ESA that can be utilized for the
easement (Trophy Club Country Club). If yes, chances are virtually none for approval
according to the Corps representatives present.
2.Whether the proposed roadway qualifies as a regional arterial (traverses multiple
jurisdictions). If no, chances are virtually none for approval according to the Corps
representatives present.

3.Whether there is a demonstrated “public safety” need.According to the Corps
representatives present, public safety is not a significant factor in overriding the ESA
designation especially when adjacent private land exists.
The 11/13/17 Corps meeting confirmed the following facts pertinent to the Loop Road, and the
likelihood of a positive result in appealing the decision outlined in the rejection letter:
1.The Master Plan remains in effect and there have not been any changes to the ESA
designation since 2014 that would be favorable to Trophy Club’s request for
consideration of the Loop Road.
2.Recent changes to the Clean Water Act and the definition of what constitutes Waters of
the US (WOTUS) as identified in the 2017 Presidential Executive Order 13778, is not tied
to the ESA designation granted Grapevine Lake, and are therefore not applicable to a
review of the Loop Road proposal. Essentially, the prohibiting factor is the ESA
designation and not whether Grapevine Lake or its tributaries are considered WOTUS.
According to Corps representatives, should the Town decide to appeal the 2014 decision the
appeal process would start at the local Grapevine Lake office and work up the chain through
the Regional office, Fort Worth office, National Corps office, and ultimately to the Department
of the Army. The final decision rests with the Assistant Secretary of the Army for Civil works,
who is the only individual with the authority to override existing national policy as it relates to
ESA designations, and potentially provide relief as it relates to the Loop Road.
Following the 11/13/17 meeting, the Town Manager re-engaged with Corps Grapevine Lake
Manager Kenneth Myers on the appeal issue which is documented below:

It was pleasure meeting you as well.
I believe the denial letter back in 2014 was written by our Trinity Region Operations Project
Manager, as the Grapevine Lake Manager position was vacant at the time. Since the denial was
strictly based on the road policy and restrictions for development within an ESA
(Environmentally Sensitive Area) the appeal would be more of a challenge to our policy rather
than the denial of the road request. The road policy that I'm referencing was a district policy
that was adopted nationally.
We do strive to find ways to work with our partners while remaining in compliance with policies,
and the Corps did propose one crossing of the ESA at the narrowest point possible. Even though
this proposal is technically outside of the policies cited above, we believe the impact to the
resource is minimal and a possible exception could be made. However, I don't believe we ever
received a response for that proposal.
The best way to approach this from here is to update your request with any changes you may
see as a viable alternative and resubmit the request. Hopefully I've answered your question, but
please give me a shout if you need to discuss further.

Based on the above information, staff proposes the following options in determining the
ultimate viability of the proposed Loop Road project:
1.Based on the Corps acknowledgement that the impact to the ESA is minimal and a
possible exception could be made, submit an update of the Loop Road project with any
changes the Town considers as a viable alternative, and request consideration.

In the event the updated request is denied:
2.Engage with Trophy Club Country Club representatives and determine the viability of
utilizing nearby Country Club property for the Loop Road.
3.Identify Local Council, State Senate and House, and/or Federal Congressional support

4.Hire an environmentalist to conduct an independent Environmental Impact Study to
support a potential appeal of the 12/3/14 decision. Based on the result, potentially:
5.Contract with TNP to conduct a cost analysis, place before the residentsas a Loop Road
Proposition, submit an appeal, or administratively close.

Explanation:
Town staff, with the assistance of Teague Nall & Perkins (TNP), went out to bid for a Capital
Improvement Project specifically forIndian Creek Drive (from Fair Green Drive to
Meadowbrook Lane) and Phoenix Drive (from Pebble Beach Drive to Shields Drive). A total of
six (6) contractors provided bids on the project. Based on specific qualifications, similar project
experience and evaluating various references, TNP determined and recommended that Quality
Excavation, LTD met the requirements and submitted the lowest qualified bid of $2,337,137.00.
There is a scheduled Pre-construction meeting on February 6, 2018.

Club Town Center Addition, Lots 1 - 51(X), Block A,located in Planned Development No. 30, on
the northeast corner of SH 114 and Trophy Club Drive (L. Payne).
Request:
The applicant, Stantec Consulting Services, is requesting approval of a final plat of 26.355 acres
for the purpose of creating a mixed-use development to include retail, multifamily, and
townhomes.
Location:
The subject property is located north of SH 114, east of Trophy Club Drive, south of The Estates
of Hogans Glen subdivision, and west of Lake Forest Village subdivision.
Zoning:
The subject property is zoned PD-30 and is required to comply with the development standards
created specifically for this project.
Details:
The proposed final plat for the PD-30 property, called Trophy Club Town Center Addition, is
composed of 5 large development lots, 39 individual townhome lots, 5 HOA lots, and 2
common area lots. The property is currently vacant except for an existing office building in use
at the corner of Trophy Club Drive and Indian Creek Drive. The submitted site plans do not
affect the existing building, as it will continue to operate until it is possibly replaced with new
development in the future.
A creek and its 100-year flood zone is located east of where the townhomes would be located.
Some of the townhome lots will have 100-year flood zone in their backyard, but all homes will
be built outside of it. The flood zone also extends into the backyards of the homes on the other

side of the creek on Brook Hollow Lane, which is not uncommon adjacent to a waterway. A
note has been made on this plat to require an elevation certificate at the time of building
permit application for Lots 26 – 45 to protect the future residents.
The applicant has completed revisions on the final plat requested by Town staff and Teague,
Nall, & Perkins (TNP). In addition, revisions requested from Town staff and TNP have been
completed on the civil plans, the retail site plan package, the multifamily site plan package, the
townhomes site plan package, and the tree survey. The site plan packages for this project are
not required to be presented to the Planning and Zoning (P&Z) Commission and Town Council,
per the approved PD-30 development standards.
Parkland Dedication has been settled between the Town and the property owner, as
documented in an agreement filed with the Town Secretary’s office. A note referring to the
Parkland Dedication agreement is found on the final plat.
In addition, notes protecting the access easements that run behind the townhomes from being
fenced-in are included on the plat.
P&Z Commission Recommendation:
The P&Z Commission will review the proposed final plat at a meeting to be held on Thursday,
January 25, 2018. Town staff will forward the discussion points and results of the vote to Town
Council.
Council Consideration:
The proposed final plat is in compliance with Trophy Club’s Subdivision Ordinance.
