ORDINANCE NO. 2014-01
AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF
TROPHY CLUB, TEXAS APPROVING A PROJECT AND FINANCING
PLAN FOR REINVESTMENT ZONE NUMBER ONE, TOWN OF
TROPHY CLUB, TEXAS; MAKING VARIOUS FINDINGS RELATED TO
SUCH PLAN; PROVIDING FOR SEVERABILITY; PROVIDING FOR
ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN
EFFECTIVE DATE..
WHEREAS, as authorized by Chapter 311 of the Texas Tax Code (the "Act")
and pursuant to Ordinance No. 2013-23, adopted by the Town Council of the Town of
Trophy Club, Texas (the "Town Council") on August 19, 2013, the Town created Tax
Increment Reinvestment Zone Number One, Town of Trophy Club, Texas (the "Zone");
and
WHEREAS, on January 27, 2014 the Board of Directors of the Zone (the
"Board") considered a preliminary project and financing plan for the Zone, and after
review of the plan adopted a project and financing plan for the Zone, a copy of which is
attached hereto and incorporated herein as Exhibit "A" (the "Plan"), as required by
Section 311.011(a) of the Act; and
WHEREAS, the Board of Directors has submitted the Plan to the Town Council
for consideration and approval;
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS:
Section 1.
Incorporation of Premises.
The facts and recitations contained in the preamble of this Ordinance are hereby
found and declared to be true and correct and are adopted as part of this Ordinance for
all purposes.
Section 2
Findings.
The Town Council having considered the Plan submitted by the Board of Directors of
the Zone, hereby makes the following findings of fact:
A. The Board of Directors of the Zone duly considered and adopted the project plan
and financing plan which is attached hereto as Exhibit "A" and incorporated
herein for all purposes (the "Plan").
B. The Plan includes all information required by Chapter 311 of the Texas Tax
Code, including without limitation, Section 311.011(b) and (c) of the Act.
C. The Plan is feasible and conforms to the Town's Zoning Ordinance and
Comprehensive Land Use Plan.
Section 3.
Approval of Plan.
Based upon the findings set forth in Section 2 of this Ordinance, the Town
Council hereby approves the Plan.
Section 4.
Severability.
That if any portion, section or part of a section of this Ordinance, including
without limitation, the Plan which is attached hereto and incorporated herein as Exhibit
"A", is subsequently declared invalid, inoperative or void for any reason by a court of
competent jurisdiction, the remaining portions, sections or parts of sections of this
Ordinance shall be and remain in full force and effect and shall not in any way be
impaired or affected by such decision, opinion or judgment.
Section 5.
Engrossment and Enrollment.
The Town Secretary of the Town of Trophy Club is hereby directed to engross
and enroll this Ordinance in accordance with the Town Charter.
Section 6.
Effective Date.
This ordinance shall be in full force and effect from and after its passage, as
provided by the Town Charter and the laws of the State of Texas.
PASSED AND APPROVED by the Town Council of the Town of Trophy Club,
