ORD 1985-05TOWN OF TROPHY CLUB, TEXAS ORDINANCE NO. o 8 5 - 5 AN ORDINANCE PROVIDING FOR STAGGERED TERMS OF OFFICE FOR THE MEMBERS OF THE TOWN COUNCIL OF TROPHY CLUB, TEXAS; PROVIDING FOR THE MANNER OF DETERMINING WHICH COUNCIL MEMBERS ARE TO SERVE A TWO YEAR TERM AND WHICH COUNCIL MEMBERS ARE TO SERVE A ONE YEAR TERM; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY; PROVIDING AN EFFECTIVE DATE. WHEREAS, Article 979 of Vernon's Annotated Texas Civil Statutes ("V.A.T.C.S.") provides for staggered terms of the Council, and that the Town Council of the Town of Trophy Club, Texas may fix by ordinance what number of Council members shall go out of office in one year, and determine by lot which Council members shall hold office for a two year term and which for a one year term; and WHEREAS, the Town Council desires to stagger the terms of its members. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS: Section 1. That hereinafter the term of office of the members of the Town Council of the Town of Trophy Club, Texas shall be staggered so that at each annual election either three (3) council members, or a mayor and two (2) council members shall be elected, as provided by the terms of this ordinance. Section 2. That the terms of office of the Town Council elected in 1985 shall be as follows: Three (3) of the Council members' term of office shall expire on election day 1986, and the term of the remaining two (2) Council members and the Mayor shall expire on election day 1987. Section 3. Council members Neidenberger , Doran __ and Vance are hereby chosen by lot to hold office for an initial term of one (1) year, and until their respective successors shall have been elected, qualified and taken office. At the regular Town election of 1986, the positions held by Council members Neidenberger , Doran , and Vance are hereby chosen by lot to hold office for a period of two (2) years, and until their respective successors shall have been elected, qualified and taken office. Section 4. The Mayor, James P. Carter, and Councilmembers Dayton Martignago , Maul Nolte and are hereby chosen by lot to hold office for a initial term of two (2) years, and until their respective successors shall have been elected, qualified and taken office. At the regular Town election of 1987, the positions held by the Mayor, James P. Carter, and Councilmembers Dayton Martignago , and Marshal Nolte 0031L shall be elected to hold office for a period of two (2) years, and until their respective successors shall have been elected, qualified and taken office. Section 5. Commencing with the election held in 1986, the Mayor and each Council member shall be elected for and hold office for a period of two (2) years and until a respective successor is elected, qualified and taken office, with the positions held by Council members Neldenberger Doran and Vance being elected at the regular Town election in 1986 and at each regular Town election at two (2) year intervals thereafter, and with the positions held by the Mayor, dames P. Carter, and Council members Dayton and Martignago being elected at the regular Town election in 1987 and at each regular Town election at two (2) year intervals thereafter. Section 6. That if any section, article, paragraph, sentence, clause, phrase or word in this ordinance or application thereof to any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance, and the Town Council hereby declares it would have passed such remaining portions of this ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 7. The fact that the present ordinances and regulations of the Town of Trophy Club, Texas are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the Town of Trophy Club, Texas creates an emergency for the immediate preservation of public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its passage and it is accordingly so ordained.
