ORDINANCE NO. 0 86-17
AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS
DECLARING AND ESTABLISHING A MORATORIUM ON THE
PLACEMENT, CONSTRUCTION AND ERECTION OF SIGNS
WITHIN THE CORPORATE LIMITS OF THE TOWN FOR A PERIOD
OF SIXTY (60) DAYS OR UNTIL SUCH TIME AS THE SIGN
ORDINANCE IS PASSED, WHICHEVER IS EARLIER; PROVIDING
THAT THE TOWN SHALL HAVE THE AUTHORITY TO ENFORCE
THIS ORDINANCE BY INJUNCTION OR ANY OTHER LEGAL
REMEDY; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A
PENALTY NOT TO EXCEED THE SUM OF TWO HUNDRED
DOLLARS ($200,00) FOR EACH OFFENSE AND A SEPARATE
OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING
OR ON WHICH A VIOLATION OCCURS OR CONTINUES; DE-
CLARING AN EFFECTIVE.
WHEREAS, the Town of Trophy Club, Texas (the "Town") Town Council
has currently pending before it a sign ordinance generally regulating the
placement, size, construction and erection of signs within the corporate limits
of the Town; and
WHEREAS, the Town Council desires to maintain the status quo during
the period of time prior to passage of the sign ordinance; and
WHEREAS, the Town Council finds that a temporary moratorium on the
construction and erection of signs is necessary for the effectiveness of the new
sign ordinance; and
WHEREAS, the Town Council finds that this moratorium is in the best
interest of the public health, safety and welfare of the citizens of the Town.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS:
Section 1. That all of the above premises are found to be true and
correct and are incorporated into the body of this ordinance as if copied in their
entirety.
Section 2. That there is hereby declared and established a moratorium
on the placement, construction and erection of signs for a period of sixty (60)
days from the date of this ordinance or until such time as the Town sign
ordinance is enacted, whichever is earlier. During the period that the
moratorium is in effect, no building permit shall be issued for the erection or
construction of any sign within the corporate limits of the Town.
Section 3. The Town shall have the power and authority to enforce the
provisions of this ordinance by injunction or by any other legal means available.
Section 4. If any section, article, paragraph, sentence, clause, phrase or
word in this ordinance, or application thereto any person or circumstance is held
invalid or unconstitutional by a Court of competent jurisdiction, such holding
shall not affect the validity of the remaining portions of this ordinance; and the
City Council hereby declares it would have passed such remaining portions of the
ordinance despite such invalidity, which remaining portions shall remain in full
force and effect.
Section 5. Any person violating any of the provisions of this ordinance
shall be deemed guilty of a misdemeanor and upon conviction thereof shall be
subject to a fine in a sum not to exceed Two Hundred Dollars ($200.00) for each
offense and a separate offense shall be deemed committed upon each day during
or on which a violation occurs or continues.
Section 6. That this ordinance shall take effect immediately from and
after its passage.
PASSED AND APPROVED by the Town Council of the Town of Trophy
Club, Texas on this the 4_ day of August , 1986.
