ORD 1986-15a' a"Wilux ORDINANCE 0 85-15 TOWN OF TROPHY CLUB, TEXAS ORDINANCE NO. 0 96-15 AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS, PROVIDING FOR A MAXIMUM RATE OF SPEED FOR MOTOR VEHICLES OF TWENTY (20) MILES PER HOUR WITHIN A CERTAIN DISTANCE OF SCHOOLS LOCATED WITHIN THE CORPORATE LIMITS OF THE TOWN; PROVIDING FOR THE POSTING OF SCHOOL ZONE AND SPEED LIMIT SIGNS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH A VIOATION OCCURS OR CONTINUES; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Town Council of the Town of Trophy Club, Texas (the "Town") is empowered under articles 1011 and 1015 of the Texas Revised Civil Statutes Annotated (Vernon), as amended, to do all acts and make all regulations which may be necessary or expedient for the promotion of the public health; and WHEREAS, the Town under article 1016 of said State statutes is given control and power over the streets and roads of the Town including the power to regulate said streets and roads; and WHEREAS, the Town Council is authorized under sections 26 and 27 of article 6701d of said State statutes to adopt local traffic regulations with respect to streets and roads under its jurisdiction; and WHEREAS, the Town Council is authorized under section 169 of article 6701d of said State statutes to alter the prima facie speed limits within the corporate limits of the Town; and WHEREAS, the Town Council desires to establish regulations governing the maximum speed of vehicles as they travel through school areas within the corporate limits of the Town; and WHEREAS, the Town Council hereby finds that the establishment of a reasonable and safe prima taxie maximum speed in and around school locations is in the best interest of the health, safety and welfare of the citizens of the Town. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS: Section 1. That all of the above premises are found to be true and correct and are incorporated into the body of this ordinance as if copied in their entirety. Section 2. That it is determined and declared that a reasonable and safe prima facie maximum speed in and around schools located within the Town is as follows: 0040) A. The maximum speed at around Lakeview Elementary School ' control and be in force from the block of Village Trail Road. which a motor vehicle shall travel in and Ls twenty (20) miles per hour, said speed to 0 block to the 200 B. For purposes of this ordinance, the term "motor vehicle" shall mean every vehicle which is self-propelled. Section 3. That school zone and speed limit signs in conformity with the manual and specifications for uniform traffic control devices as adopted by the State Highway Commission shall be and hereby are directed to be erected at the appropriate locations as determined by the Town Marshal. Section 4. That the Town Marshal or such representative as he may appoint is hereby authorized and directed to cause school zone and speed limit signs to be posted and maintained throughout the Town. Section 5. That if any section, paragraph, sentence, clause, phrase or word of this ordinance, or application hereof to any person or circumstance, is held invalid by any Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of the ordinance; and the Town Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining sections and parts shall remain in full force and effect. Section 6. That it shall be unlawful for any person to violate any provision of this ordinance, and any person violating any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be subject to a fine in an amount not to exceed the sum of Two Hundred Dollars ($200.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 7. The fact that the present ordinances and regulations of the Town are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the Town creates an emergency for the immediate preservation of the public welfare which requires that the provisions of this ordinance shall take effect upon the posting of the signs directed by Sections 3 and 4 above, and publication of this ordinance as provided by law, and it is accordingly so ordained. 0040) -2- PASSED AND APPROVED by the Town Council of the Town of Trophy Club, Texas [SEAL] APPROVED AS T FORM: Town 4ttorney, own of Trophy Club, Texas 0040) -3-
