ORD 1986-10TOWN OF TROPHY CLUB, TEXAS ORDINANCE NO. p 66-LO— AN 6-La AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS, CANVASSING RETURNS AND DE- CLARING THE RESULTS OF THE GENERAL AND SALES AND USE TAX ELECTION HELD APRIL 5, 1986, FOR THE PURPOSES OF ELECTING THREE (3) COUNCILMEMBERS OF THE TOWN OF TROPHY CLUB, TEXAS AND VOTING ON THE ADOPTION OF A ONE PERCENT (1%) LOCAL SALES AND USE TAX WITHIN THE TOWN; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, the Town Council of the Town of Trophy Club, Texas (the "Town"), caused to be published in accordance with the laws of the State of Texas notice of the election held April 5, 1986, to elect three (3) Council - members of the Town and to vote on the adoption of a local sales and use tax within the Town; and WHEREAS, notice of election was actually given by the Town as required by law; and WHEREAS, the Town Council has considered the returns of said election held April 5, 1986; WHEREAS, said election was duly and legally held on April 5, 1986, in the Town and in conformity with the election laws of the State of Texas, and the results of said election have been certified and returned by the proper judges and clerks thereof; and WHEREAS, the general election returns, duly and legally made, showed that there were cast in said election a total of C h valid and legal votes, and that each of the candidates in said election received the following votes: FOR COUNCILMEMBER Name of Candidate Total No. of Votes Received Terry Vance 398 Larry Best 335 Ted Neidenberger 284 Dick Venetoff 359 Tracy Kunkel 443 WHEREAS, the three (3) Councilmember positions are filled by the three (3) candidates receiving the greatest number of votes; and WHEREAS, the sales and use tax election returns, duly and legally made, showed that there were cast in said election a total of 6()n valid and legal votes, and that said votes were cast as follows: 359 Votes FOR adoption of a one percent (1%) local sales and use tax within the Town. 241 Votes AGAINST adoption of a local sales and use tax within the Town; and WHEREAS, a true and correct copy of a map of the Town showing the boundaries thereof is attached hereto and incorporated herein. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS: Section 1. That each and every one of the recitals, findings and determinations contained in the preamble of this ordinance are found to be true and correct and are hereby repeated and incorporated herein as if copied in their entirety. Section 2. That it is further found and determined that the results of the election as canvassed and tabulated in the preamble reflect the expressed desires of the resident, qualified voters of the Town. Section 3. That the duly elected members of the Town Council of the Town of Trophy Club, Texas, elected April 5, 1986, subject to the taking of the oaths as provided by the laws of the State of Texas, are as follows: Terry Vance Dick Venetoff Tracy Kunkel Section 4. That a one percent (1%) local sales and use tax with the Town has been adopted by the resident, qualified voters of the Town. Section 5. That the public importance of this measure and the fact that it is in the best interest of the Town to declare the duly elected officers of the Town at the earliest possible date for the immediate preservation of the public peace, property, health and safety of the Town and its citizens creates an emergency and an imperative public necessity which requires that this ordinance shall take effect and be in force from and after its final passage and approval, and it is accordingly so ordained.
