ORD 1987-274014:W=4491 ORDINANCE 0 67-27 TOWN OF TROPHY CLUB, TEXAS ORDINANCE NO. p 87-27 AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS AMENDING ORDINANCE NO. 85-34 RELATING TO THE ESTABLISHMENT OF A TOWN MUNICIPAL COURT BY AMENDING SECTION 3 THEREOF RELATING TO THE MUNICIPAL COURT CLERK BY AUTHORIZING THE APPOINTMENT BY THE TOWN COUNCIL OF ALTERNATE COURT CLERKS; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS: Section 1. That Ordinance No. 85-34 of the Town of Trophy Club relating to the Town Municipal Court be and the same is hereby amended in the following particulars, and that all other sections, paragraphs, sentences, phrases and words of the said Ordinance are not amended but are hereby ratified, verified, approved and affirmed: A. That Section 3 of Ordinance No. 85--34 relating to the municipal court clerk is hereby amended to read as follows: "Section 3. A clerk, and as many alternate clerks as the Town Council deems necessary, for the municipal court shall be appointed by the Town Council. Said initial appointees shall hold their term of office corresponding to the unexpired term of the mayor, and every two (2) years thereafter a clerk, and alternate clerks as determined by the Town Council, shall be appointed for a term of two (2) years. The clerk shall keep minutes of the proceedings of the municipal court, issue all process and generally perform the duties of the clerk of a court as prescribed by law for a county clerk insofar as the same may be applicable." Section 2. This Ordinance shall be cumulative of all other ordinances of the Town of Trophy Club, Texas, affecting Municipal Court and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this Ordinance. Section 3. 1f any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 4. That this ordinance shall take effect from and after its date of passage as provided by law. PASSED AND APPROVED the 9 day of November 1987.
