ORD 1987-26TOWN OF TROPHY CLUB, TEXAS ORDINANCE N0. _p AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS ESTABLISHING A HEALTH AUTHORITY; PROVIDING THAT THE HEALTH AUTHORITY SHALL PERFORM ALL DUTIES WHICH ARE NECESSARY TO IMPLEMENT AND ENFORCE PUBLIC HEALTH LAWS; SETTING FORTH THE DUTIES AND QUALIFICATIONS OF THE PUBLIC HEALTH OFFICER; RATIFYING A PREVIOUS APPOINTMENT OF A HEALTH AUTHORITY; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING AN EFFECTIVE DATE. WHEREAS, the Town Council of the Town of Trophy Club, Texas ;the "Town") is autr`ioriz� by article 4436b, 52.01, riexas Revised Civil Statutes (Vernon), as amended, to enforce any law which is reasonably necessary to protect the public health; and WHEREAS, in order to aid in enforcing such public health laws and to protect the health of the citizens of the Town, the Town Council desires to appoint a health authority pursuant to article 4416b. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS: Section 1. That all of the above premises are found to be true and correct and are incorporated into the body of this ordinance as if copied in their entirety. Section 2. That there is hereby established a Health Authority for the Town of Trophy Club, which. Health Authority shall have and perform the following duties: A. all duties as may be prescribed by the Texas Board of Health (the "Board"); B. establishing, maintaining, and enforcing quarantine within the Town; C. assisting and aiding the Board and Town in all matters of local quarantine, inspection, disease prevention and suppression, birth and death statistics, and general sanitation within the Town; D. reporting to the Board and Town, in such manner and form and at such times as they shall prescribe, the presence of contagious, infectious, and dangerous epidemic diseases within the Town; E. reporting to the Board and Town on all other matters as may be proper for the Board and Town to direct; and F. aiding the Board and Town at all times in the enforcement of proper rules, regulations, requirements, and ordinances and in the enforcement of all sanitation laws, quarantine regulations, and vital statistics collections in the Town. Section 3. That the Town Council may, by motion, authorize the payment of necessary expenses which may be incurred by the Health Authority in attending Board conferences relating to the duties and functions of the Health Authority. Section 4. That the Town Council shall appoint a Health Authority for a term of two ycur.s to serve within the Town. The Health Authority so appointed shall serve in that capacity for a term of two (2) years and may be reappointed for successive terms. A Health Authority shall be: A. a competent physician who is legally qualified to practice medicine under the laws of the State of Texas and who is of reputable professional standing; and B. a resident of the State of Texas. Each appointee shall take and subscribe to an official oath and file a copy of the oath and appointment with the Board. The said appointee shall not be deemed legally qualified to serve as Health Authority until such documents are filed. Section S. A Health Authority may be removed from office for cause pursuant to the personnel procedures applicable to the .heads of departments of the Town. Section 6. The Town Council does hereby ratify and confirm the appointment as Health Authority of Dr. Catherine L. Matchett made prior to the date of adoption of this ordinance. The term of office as Health Authority to be held by Dr. Matchett shall be for two (2) years from , 1987. Section 7. That this ordinance shall be cumulative of all other ordinances of the Town affecting public health and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this ordinance. Section 8. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstance, is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 9. That this ordinance shall take effect from and after its date of passage as provided by law.
