ORD 1987-24/ - �:,- � c-/- TOWN OF TROPHY CLUB, TEXAS ORDINANCE NO. 0 R7-24 AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS AMENDING ORDINANCE NO. 86-23 RELATING TO THE PLACEMENT OF MOBILE HOMES, BOATS, TRAILERS AND RECREATIONAL VEHICLES WITHIN THE TOWN BY AMENDING SECTION 6 THEREOF RELATING TO THE LOCATION OF BOATS, TRAILERS AND RECREATIONAL VEHICLES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION OCCURS OR CONTINUES; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS: Section 1. That Ordinance No. 86-23 of the Town of Trophy Club, Texas (the "Town") relating to the location of mobile homes, boats, trailers and recreational vehicles within the Town is hereby amended in the following particulars, and that all other sections, paragraphs, sentences, phrases and words of the said Ordinance are not amended but are hereby ratified, verified, approved and affirmed: A. That Section 6 of Ordinance No. 86-23 is hereby amended to read as follows: "Section 6. (a) It shall be unlawful for any person who is a resident of the Town of Trophy Club to locate or maintain any recreational vehicle, boat or trailer within the corporate limits of the Town for more than two (2) days per month unless the recreational vehicle, boat or trailer is enclosed by a six (6) foot fence or a garage and is not visible from a public street; provided, however, that a recreational vehicle, boat or trailer shall be deemed enclosed by a six (6) foot fence when no more than eighteen (18) inches of said recreational vehicle, boat or trailer is visible above the top of the fence." Section 2. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstance is held invalid 0049V or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the Town Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 3. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be subject to a fine in a sum not to exceed Two Hundred Dollars ($200.00) for each offense and a separate offense shall be deemed committed upon each day during or on which a violation occurs. Section 4. That this ordinance shall take effect from and after its date of passage and publication, as provided by law.
