AN ORDINANCE OF THE TOWN OF TROPHY CLUB,
TEXAS AMENDING ORDINANCE NO. 66-22 RELATING.
TO FENCES BY AMENDING SECTION G.A. THEREIN
BY REQUIRING THAT ANY GATE OR DOOR IN A
FENCE CONSTRUCTED AROUND A SWIMMING POOL BE
EQUIPPED WITH SELF-CLOSING AND SELF -LATCHING
DEVICES; PROVIDING THAT FENCES AND WALLS
CONSTRUCTED AROUND SWIMMING POOLS PRIOR TO
THE EFFECTIVE DATE OF THIS AMENDMENT TO
SECTION G.A. OF ORDINANCE NO. 86-22 SHALL
COMPLY WITH THE TERMS OF THE AMENDMENT ON OR
BEFOREI , 1987 ;
PROVIDING A SAVINGS CLAUSE; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE 'TOWN COUNCIL OF THE TOWN OF TROPHY
CLUB, TEXAS:
Section 1. That Ordinance No. 86-22 of the Town of
Trophy Club, Texas (the "Town") is hereby amended in the
following particulars, and that all other sections,
subsections, paragraphs, sentences, phrases and words of said
Ordinance are not amended but are hereby ratified, verified,
approved and affirmed:
A. That Section 6.A. of Ordinance No. 86-22 is
amended to read as follows:
"A. Every outdoor swimming pool must be
enclosed by a wall or fence not less than
four (4) feet in height. Said wall or fence
shall be constructed in such a manner that
there are no gaps or openings, other than
gates or doors, larger than four (4) inches
measured in any direction. Such fence shall
be permanent, shall be set and anchored
firmly in the earth, and all gates or doors
in said fence shall be equipped with
self-closing and self -latching devices
capable of keeping the gate or door securely
closed when not in use. Such latching
devices shall be attached to the upper
quarter of the gate or fence on the inside
thereof.
Section 2. That fences and wells constructed around
swimming pools prior to the effective date of this ordinance
shall comply with the terms hereof on or
before August 15 , 1987 .
Section 3. That this ordinance shall be cumulative of
all other ordinances of the Town affecting fences, and shall
not repeal, except as provided herein, any of the provisions of
said ordinances except in those instances where provisions of
those ordinances are in direct conflict with the provisions of
this ordinance.
Section 4. if any section, article, paragraph,
sentence, clause, phrase or word in this Ordinance or
application thereto any person or circumstance is held invalid
or unconstitutional by a Court of competent jurisdiction such
holding shall not affect the validity of the remaining portions
of the Ordinance; and the Town Council hereby declares it would
have passed such remaining portions of the Ordinance despite
such invalidity, which remaining portions shall remain in full
force and effect.
Section 5. That this ordinance shall be effective from
andafter its date of passage as provided by law, which
effective date is August 15 _ , 198.
PASSED AND APPROVED by the Town Council of the Town of
