AN ORDINANCE OF THE TOWN OF TROPHY CLUB,
TEXAS AMENDING ORDINANCE NO. 87--15 OF THE
TOWN RELATING TO THE DISPOSAL OF TRASH,
WASTE AND GARBAGE BY REGULATING THE
PLACEMENT OF REFUSE BAGS FOR PICK-UP BY THE
TOWN; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING A SAVING CLAUSE; PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY
CLUB, TEXAS.
Section 1. That Ordinance No. 87-15 of the Town of
Trophy Club, Texas (the "Town") is hereby amended in the
following particulars, and that all other sections,
subsections, paragraphs, sentences, phrases and words of said
Ordinance are not amended but are hereby ratified, verified,
approved and affirmed:
A. That a new Section 2.E, is hereby added to Section
2. as follows:
"E. No person occupying a residence in the
Town shall put any refuse bag out for pickup
or store any refuse bag or bags in a place
or manner so as to be openly visible from
the street prior to 6:00 p.m. on the day
before a pick-up day. As used herein,
"pick-up day" means a day scheduled by the
Town for pick-up of refuse bags for a
portion of the Town which includes the
residence in question, as published by the
Town in Town Newsj)aper
Section 2. If any section, article, paragraph,
sentence, clause, phrase or word in this Ordinance, or
application thereof to any persons or circumstances is held
invalid or unconstitutional by a Court of competent
jurisdiction, such holding shall not affect the validity of the
remaining portions of this Ordinance; and the City Council
hereby declares it would have passed such remaining portions of
the Ordinance despite such invalidity, which remaining portions
shall remain in full force and effect.
Section 3. That this Ordinance shall be cumulative of
all other ordinances of the Town of affecting the disposal of
trash and shall not repeal any of the provisions of said
ordinances except in those instances where provisions of those
ordinances are in direct conflict with the provisions of this
Ordinance.
Section 4. That this Ordinance shall be effective from
and after September 1, 1990, upon publication as provided by
law.
