ORDINANCE NO. 90-06
AN ORDINANCE OF THE TOWN OF TROPHY CLUB,
TEXAS IMPOSING A FEE FOR EMERGENCY AMBULANCE
AND PARAMEDIC SERVICES; PROVIDING THAT THE
FEE SHALL BE AS SET FORTH IN A SCHEDULE OF
FEES ADOPTED BY THE TOWN ADMINISTRATOR;
REQUIRING THE PERSON RECEIVING EMERGENCY
MEDICAL SERVICE TO BE RESPONSIBLE FOR PAYMENT
OF THE FEE; REPEALING ORDINANCE NO. 89-02;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING A
PENALTY NOT TO EXCEED THE SUM OF FIVE HUNDRED
DOLLARS ($500.00) FOR EACH OFFENSE AND A
SEPARATE OFFENSE SHALL BE DEEMED COMMITTED
EACH DAY DURING OR ON WHICH A VIOLATION
OCCURS OR CONTINUES; PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the Town of Trophy Club, Texas (the "Town")
provides emergency medical service to the citizens of the Town;
and
WHEREAS, the Town has the authority pursuant to §122.005,
Tex. Health & Safety Code (Vernon) , as amended, to do all acts
and make all regulations which may be necessary or expedient
for the promotion of health or the suppression of disease.
NOW, THEREFORE BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS:
Section 1. That all of the above premises are found to
be true and correct and are incorporated into the body of this
ordinance as if copied in their entirety.
Section 2. That there shall be charged a fee for each
emergency response made by the Trophy Club Emergency Medical
Service; provided, however, that the Town Administrator shall
have the authority to waive or reduce the said fee where the
Administrator finds that imposing the same would cause an undue
hardship or where the interests of justice require such a
waiver or reduction. The fee shall be established by the Town
Administrator in a Schedule of Fees, which Schedule shall be
kept in the office of the Administrator.
Section 3. The person receiving emergency medical
service shall be responsible for payment of the fee charged
herein.

Section 4. Ordinance No. 89-02 relating to fees for
emergency medical service is repealed; provided, however, that
any fee imposed or incurred by any person or any action taken
pursuant to Ordinance No. 89--02 prior to the effective date of
this Ordinance shall remain in full force and effect, and for
that purpose Ordinance No. 89--02 shall remain in effect and not
be repealed.
Section 5. 7f any section, article, paragraph,
sentence, clause, phrase or word in this ordinance, or
application thereto any person or circumstances is held invalid
or unconstitutional by a Court of competent jurisdiction, such
holding shall not affect the validity of the remaining portions
of this ordinance; and the Town Council hereby declares it
would have passed such remaining portions of the ordinance
despite such invalidity, which remaining portions shall remain
in full force and effect.
Section 6. Any person violating any of the provisions
of this Ordinance shall be deemed guilty of a misdemeanor and
upon conviction thereof shall be fined in a sum not to exceed
Five Hundred Dollars ($500.00) and a separate offense shall be
deemed committed upon each day during or on which a violation
occurs or continues.
Section 7. That this ordinance shall take effect from
and after its date of passage and publication as provided by
law.
PASSED AND APPROVED by the Town Council of the Town of
Trophy Club, Texas this the 6 day of March, 1990.
