ORDINANCE NO. p 88-13
AN ORDINANCE OF THE TOWN OF TROPHY CLUB,
TEXAS AMENDING ORDINANCE NO. 86-22 RELATING
TO FENCES BY AMENDING SECTION 12 RELATING TO
FENCES CONSTRUCTED PRIOR TO THE EFFECTIVE
DATE OF ORDINANCE NO. 86-22; PROVIDING THAT
FENCES ERECTED PRIOR TO THE EFFECTIVE DATE OF
ORDINANCE NO. 86-22 SHALL BE SUBJECT TO THE
PROHIBITION AGAINST ALTERING THE NATURAL OR
PLANNED DRAINAGE ON A RESIDENTIAL LOT;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING A
PENALTY NOT TO EXCEED THE SUM OF TWO HUNDRED
DOLLARS (1200.00) FOR EACH OFFENSE AND A
SEPARATE OFFENSE SHALL BE DEEMED COMMITTED
EACH DAY DURING OR ON WHICH A VIOLATION
OCCURS OR CONTINUES; PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY
CLUB, TEXAS:
Section 1. That
Ordinance No.
86-22
of the Town of
Trophy Club, Texas (the
"Town") is
hereby
amended in the
following particulars,
and that
all
other sections,
subsections, paragraphs,
sentences, phrases
and words of the
said Ordinance are not
amended but
are
hereby ratified,
verified, approved and affirmed:
A. That Section 12 of Ordinance No. 86-22 is hereby
amended to read as follows:
"Section 12. Fences constructed prior to the
effective date of this ordinance are hereby
declared lawful and valid; provided, however,
that such fences shall be subject to Sections
4.C, 5.A., 5.C., 5.D., 5.F., 5.H., S.J., 6, 7
and 10 of this ordinance."
Section 2. if any section, article, paragraph,
sentence, clause, phrase or word in this ordinance, or
application thereto any person or circumstances is held invalid
or unconstitutional by a Court of competent jurisdiction, such
holding shall not affect the validity of the remaining portions
of this ordinance; and the Town Council hereby declares it
would have passed such remaining portions of the ordinance
despite such invalidity, which remaining portions shall remain
in full force and effect.

Section 3. Any person violating any of the provisions
of this ordinance shall be deemed guilty of a misdemeanor and
upon conviction thereof shall be subject to a fine in a sum not
to exceed Two Hundred. Dollars (t200.00) for each offense and a
separate offense shall be deemed committed upon each day during
or on which a violation occurs.
Section a. That this ordinance shall be effective from
and after its date of passage and publication as provided by
law.
PASSED AND APPROVED by the Town Council of the Town of
