ORDINANCE NO. 0 88--07
AN ORDINANCE OF THE TOWN OF TROPHY CLUB,
TEXAS RELATING TO GENERAL PENALTY AND
CONTINUING VIOLATIONS; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY
CLUB, TEXAS:
Section 1. Whenever in any ordinance of the Town of
Trophy Club, Texas (the "Town") an act is prohibited or is made
or declared to be unlawful or an offense or a misdemeanor, or
whenever in any such ordinance the doing of any act is required
or the failure to do any act is declared to be unlawful, the
violation of any provision of such ordinance shall be
punishable by a fine in a sum not to exceed two thousand
dollars ($2;000.00) for each offense relating to fire safety,
zoning or public health and sanitation, including dumping of
refuse, nor to exceed five hundred dollars ($500.00) for each
offense for all other violations; provided, however, that where
the offense is one for which penalty is fixed by state law, the
penalty for such offense shall be the same as fixed by state
law.
Each day any violation of any ordinance of the Town shall
occur or continue shall constitute a separate offense unless
otherwise provided.
Section 2. if any section, article,. paragraph,
sentence, clause, phrase or word in this Ordinance, or
application thereto any person or circumstances is held invalid
or unconstitutional by a Court of competent jurisdiction, such
holding shall not affect the validity of the remaining portions
of this Ordinance; and the Town Council hereby declares it
would have passed such remaining portions of this Ordinance
despite such invalidity, which remaining portions shall remain
in full force and effect.
Section 3. That this ordinance shall become effective
from and after its date of passage and publication as provided
by law.
