ORD 1988-06�. .A WA � 19 0C ORDINANCE 0 88--06 TOWN OF TROPHY CLUB, TEXAS ORDINANCE NO. 0 88-06 AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS PROVIDING FOR A TEMPORARY MAXIMUM RATE OF SPEED OF TWENTY (20) MILES PER HOUR ALONG TROPHY CLUB DRIVE FROM STATE HIGHWAY 114 TO INDIAN CREEK DRIVE WITHIN THE CORPORATE LIMITS OF THE TOWN; PROVIDING FOR THE POSTING OF SPEED LIMIT SIGNS; DESIGNATING A TEMPORARY STOP INTERSECTION ON EACH CORNER OF TROPHY CLUB DRIVE AT ITS INTERSECTION WITH INDIAN CREEK DRIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS ($500.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION OCCURS OR CONTINUES; PROVIDING AN EFFECTIVE DATE. WHEREAS, the Town Council is empowered under Section 51.012 of the Texas Local Government Code (Vernon), as amended, and article 1015, Texas Revised Civil Statutes (Vernon), as amended to do all acts and make all regulations which may be necessary or expedient for the promotion of the public health; and WHEREAS, the Town under article 1016, V.A.T.C.S., is given control and power over the streets and roads of the Town including the power to regulate said streets and roads; and WHEREAS, the Town Council and 27 of the said article regulations with respect to jurisdiction; and is authorized under sections 26 6701d to adopt local traffic streets and roads under its WHEREAS, the Town Council is authorized under section 91 of article 6701d to erect stop signs at specified entrances to highways and streets under its jurisdiction and designate any intersection as a stop intersection and erect appropriate signs at one or more entrances to such intersections; and WHEREAS, the Town Council is authorized under section 169(c) of the said article 6701d to alter the maximum prima facie speed limit upon streets within the corporate limits of the Town when a street is under repair, construction or maintenance; and WHEREAS, the Town Council desires to alter the maximum prima facie speed limit upon the hereinafter designated street, which street, or part thereof as designated herein, is under repair, maintenance and construction; and 0 1 2 1 j i 4 WHEREAS, upon the basis of a traffic investigation taking into consideration the health, safety and general welfare of the citizens of the community, the number of children residing in and throughout the Town, the type of development throughout the Town, the width and condition of the pavement or other surface of the streets and roads within the Town, the usual traffic thereon, and other circumstances on such streets and roads, the Town Council hereby finds and determines that the maximum speed limit on the streets designated herein is one which is reasonable and prudent under the conditions and potential hazards, and that the placement of stop signs at the locations designated herein is necessary for the promotion of the health, safety and welfare of the citizen of the Town. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS: Section 1. That all of the above premises are found to be true and correct and are incorporated into the body of this ordinance as if copied in their entirety. Section 2. Stop Signs. A. That a temporary stop sign shall be erected on each corner of Trophy Club Drive at its intersection with Indian Creek Drive, and said intersection is hereby designated as a stop intersection. Every driver of a vehicle and every motorman of a street car approaching said stop intersection shall stop before entering the crosswalk an the near side of the intersection or, in the event there is no crosswalk, shall stop at a clearly marked stop line, but if none, then at the point nearest the intersecting roadway where the drive has a view of the approaching traffic on the intersecting roadway before entering the intersection, except when directed to proceed by a police officer or traffic control signal. The said intersection shall be and remain a stop intersection until such time as the street construction along that part of Trophy Club Drive designated herein is completed and is again made a four lane divided roadway, at which time this Ordinance shall be deemed repealed. B. That stop signs in conformity with the manual and specifications for uniform traffic control devices as adopted by the State Highway Commission shall be and hereby are directed to be erected by the Town Marshal, or his duly authorized agent, in accordance with State law at the location specified in Section 2 of this ordinance. Section 3. Speed Limit. A. That it is determined and declared that a reasonable and safe prima facie maximum speed limit on Trophy Club Drive, from its intersection with State Highway 114 to its -2- 0121 j/5 intersection with Indian Creek Drive located within the corporate limits of the Town, is twenty (20) males per hour. This part of Trophy Club Drive shall be and remain subject to a twenty (20) miles per hour speed limit until such time as the street construction along the said part is completed and is again made a four lane divided roadway, at which time this Ordinance shall be deemed repealed. B. That speed limit signs in conformity with the manual and specifications for uniform traffic control devices as adopted by the State Highway Commission shall be and hereby are directed to be erected at the appropriate locations as determined by the Town Marshal or his duly authorized representative. Section a. That if any section, paragraph, sentence, clause, phrase or word of this ordinance, or application hereof to any person or circumstance, is held invalid by any Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of the ordinance; and the Town Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining sections and parts shall remain in full force and effect. Section 5. This Ordinance shall be cumulative of all other ordinances of the Town of Trophy Club, Texas affecting traffic control and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this Ordinance. Section 6. That it shall be unlawful for any person to violate any provision of this ordinance, and any person violating any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be subject to a fine in an amount not to exceed five hundred dollars ($500.00) for each offense and a separate offense shall be deemed committed each day during or on which a violation occurs or continues. Section 7. That this ordinance shall take effect from and after its date of passage and publication as provided by law and the posting of the signs as required by Sections 2.B. and 3.B. of this Ordinance.
