ORD 1991-01DORDINANCE 91-01 D P E A TOWN OF TROPHY CLUB, TEXAS ORDINANCE NO. -_o g7_njn AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS AMENDING ORDINANCE NO. 91-01, THE SAME BEING THE COMPREHENSIVE ZONING ORDINANCE OF THE TOWN, AS FOLLOWS: (1) BY ADDING: (i) THE FOLLOWING ZONING DISTRICTS: (A) R-8 SINGLE FAMILY RESIDENTIAL DISTRICT (SECTION _), (B) R-9 SINGLE FAMILY RESIDENTIAL DISTRICT (SECTION ), AND (C) R-11 SINGLE FAMILY DISTRICT REGULATIONS (SECTION ), AND BY (ii) ADDING A USE TABLE SHOWING DISTRICTS AND PERMITTED PRINCIPAL USES; (2) BY DELETING IN THEIR ENTIRETY THE FOLLOWING ZONING DISTRICTS: (A) R-7.5 SINGLE FAMILY DISTRICT (SECTION 14), (B) R -SECTIONS 1 AND 2 SINGLE FAMILY DISTRICT (SECTION 15A), (C) R -SECTION 3 SINGLE FAMILY DISTRICT (SECTION 15B), (D) R -SECTION 4 SINGLE FAMILY DISTRICT (SECTION 15C), (E) R -SECTION 5 SINGLE FAMILY DISTRICT (SECTION 15D), (F) R -SECTION 6 SINGLE FAMILY DISTRICT (SECTION 15E), (G) R -SECTION 7 SINGLE FAMILY DISTRICT (SECTION 15F), (H) R -SECTION 8 SINGLE FAMILY DISTRICT (SECTION 15G), (I) R -SECTION 9 SINGLE FAMILY DISTRICT (SECTION 15H), (J) R -SECTIONS 10 AND 11 SINGLE FAMILY DISTRICT (SECTION 15I), (K) R -SECTION 12 SINGLE FAMILY DISTRICT (SECTION 15J), (L) R -SECTION 13 SINGLE FAMILY DISTRICT (SECTION 15K), (M) R -LAKE FOREST VILLAGE, PHASE I SINGLE FAMILY DISTRICT (SECTION 15L), (N) R -LAKE FOREST VILLAGE PHASE II SINGLE FAMILY DISTRICT (SECTION 15M), (0) R -VILLAGE WEST, SECTION A SINGLE FAMILY DISTRICT (SECTION 15P), AND (P) R -VILLAGE WEST, SECTION B SINGLE FAMILY DISTRICT (SECTION 15Q); (3) BY AMENDING IN PART THE FOLLOWING SECTIONS: (A) SECTION 12A, R-15 SINGLE FAMILY DISTRICT, (B) SECTION 12B, R-12 SINGLE FAMILY DISTRICT, AND (C) SECTION 13, R-10 SINGLE FAMILY DISTRICT, AND BY (D) AMENDING THE FOLLOWING SECTIONS BY DELETING THOSE DISTRICTS DELETED HEREBY AND ADDING THOSE DISTRICTS ADDED HEREBY AND MAKING THE NECESSARY CHANGES TO REFLECT THE AMENDMENTS HEREIN MADE, AS APPROPRIATE: SECTION 3 -ESTABLISHMENT OF DISTRICTS, SECTION 16 -PLANNED DEVELOPMENT DISTRICT REGULATIONS, SECTION 23 -ACCESSORY BUILDINGS AND USES, AND SECTION 29 - CONDITIONAL USES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY OF NOT LESS THAN ONE DOLLAR ($1.00) NOR MORE THAN TWO THOUSAND DOLLARS ($2,000.00) FOR EACH VIOLATION AND A SEPARATE VIOLATION SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION OCCURS OR CONTINUES; PROVIDING A SAVINGS CLAUSE AND THAT ALL OTHER ORDINANCES IN CONFLICT HEREWITH ARE REPEALED TO THE EXTENT OF SUCH CONFLICT; PROVIDING AN EFFECTIVE DATE. WHEREAS, the Town Council of the Town of Trophy Club, Texas (the "Town"), in accordance with a Comprehensive Plan, heretofore adopted a Comprehensive Zoning Ordinance for the Town, the same being Ordinance No. 91-01 of the Town (the "Comprehensive Zoning Ordinance"); and WHEREAS, the Town Council is, pursuant to Chapter 211, Tex. Loc. Gov. Code (Vernon), as amended, authorized and empowered to amend the Comprehensive Zoning Ordinance; and WHEREAS, the Town Council has adopted and approved this ordinance amending the Comprehensive Zoning Ordinance taking into consideration the character of each district and its peculiar suitability for particular uses, with a view of conserving the value of buildings and encouraging the most appropriate use of land in the Town; and WHEREAS, the Town Council hereby finds that the adoption of this Ordinance promotes the health and general welfare of the citizens of the Town; and WHEREAS, after public notices were given in compliance with State law and public hearings were conducted, and after considering the information submitted at the said public and all other relevant information and materials, the Planning and Zoning Commission of the Town has recommended to the Town Council the adoption of the amendments to the Comprehensive Zoning Ordinance as set forth in this Ordinance; and WHEREAS, after due deliberations and consideration of the recommendation of the Planning and Zoning Commission and the information and other materials received at the public hearings, the Town Council has concluded that the adoption of this Ordinance is in the best interests of the Town of Trophy Club, Texas and of the public health, safety and welfare. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS: Section 1. Incorporation of Preamble. That the above and foregoing preamble is true and correct and is incorporated into the body of this Ordinance as if copied herein in its entirety. Section 2. Amendments to Comprehensive Zoning Ordinance. That Ordinance No. 91-01 of the Town, the same being the Town's Comprehensive Zoning Ordinance, is hereby amended in the following particulars, and that all other Articles, chapters, sections, subsections, paragraphs, sentences, phrases and words are not amended but are hereby ratified, verified, approved and affirmed: A. ADDITIONS TO THE COMPREHENSIVE ZONING ORDINANCE: That the following Sections relating to single-family residential districts and a use table are hereby added to the Comprehensive Zoning Ordinance to read as follows: 1. Section , R-8 Single Family District Regulations, which District shall read as set forth in Exhibit "A" attached hereto and incorporated herein. -2- 2. Section , R-9 Single Family District Regulations, which District shall read as set forth in Exhibit "B" attached hereto and incorporated herein. 3. Section , R-11 Single Family District Regulations, which District shall read as set forth in Exhibit "D" attached hereto and incorporated herein. 4. Section , Use Table, showing the various zoning districts and the permitted principal uses within those districts, which Use Table shall read as set forth in Exhibit "G" attached hereto and incorporated herein. B. DELETIONS FROM THE COMPREHENSIVE ZONING ORDINANCE: That the following Sections of the Comprehensive zoning Ordinance are hereby deleted in their entirety. 1. R-7.5 Single Family District Regulations (Section 14); 2. R -Sections 1 and 2 Single Family District Regulations (Section 15A); R -Sections 10 and 11 Single Family District Regulations (Section 151); 3. R -Section 3 Single Family District Regulations (Section 15J); 15B); 12. R -Section 13 Single Family District Regulations (Section 4. R -Section 4 Single Family District Regulations (Section 15C); 5. R -Section 5 Single Family District Regulations (Section 15D); 6. R -Section 6 Single Family District Regulations (Section 15E) ; 7. R -Section 7 Single Family District Regulations (Section 15F) ; B. R -Section 8 Single Family District Regulations (Section 15G); 9. R -Section 9 Single Family District Regulations (Section 15H); 10. AMENDMENTS TO EXISTING SECTIONS OF THE COMPREHENSIVE ZONING ORDINANCE: That the following Sections of the Comprehensive Zoning Ordinance are hereby amended to read as follows: 1. Section 12A, R-15 Single Family District Regulations, is hereby amended so that it shall hereafter read as set forth in Exhibit '"F" attached hereto and incorporated herein. 2. Section 128, R-12 Single Family District Regulations, is hereby amended so that it shall hereafter read as set forth in Exhibit "Ell attached hereto and incorporated herein. 3. Section 13, R-10 Single Family District Regulations, is hereby amended so that it shall hereafter read as set forth in Exhibit ""C" attached hereto and incorporated herein. 4. That Section 3 -Establishment of Districts shall be amended by the addition and the deletion (deletions being shown by a mark - through) of certain zoning districts so that it shall hereafter read as follows: "SECTION 3 -- ESTABLISHMENT OF DISTRICTS The Town of Trophy Club is hereby divided into the following zoning districts, which districts, where applicable, are shown and described on the Zoning Map of the Town of Trophy Club, which Map is incorporated herein by this reference: R-12 Single Family Residential District: A zone designed to accommodate single family development on lots that are a minimum of 12,000 square feet in area. R-11single Family Residential District: A zone designed to accommodate single family development on lots that are a minimum of 11,000 square feet in area. R-9 Single Family Residential District: A zone designed to accommodate single family development on lots that are a minimum of 9,000 square feet in area. -4- R-8 Single Family Residential District: A zone designed to accommodate single family development on lots that are a minimum of 8,000 square feet in area. }z--rhat are a minimum of 7, sa8- square feet in > > R Seetion 41 Ferest Village,Phase 1; , R-Fairway Village; R-TwentyIn Trophy; R«Village W est —,Seetien A; , Seetien B,1.R--Oak Hill; R-Oak Hill Patio; R-Summit. * * * * * * * * * * * * * * * * * * * * * * * * * * * *11 5. That Section 16 PD Planned Development District Regulations shall be amended by amending subsections B.1 and B.2 so that the said subsections shall hereafter read as follows: "B. Uses Generally: In a PD Planned Development District, no land shall be used and no building shall be installed, erected for or converted to any use other than as hereinafter provided. 1. Permitted Uses: All uses permitted in the district included herein as follows, shall be permitted as part of an approved Planned Development: a. R-15 Single Family Residential District b. R-12 Single Family Residential District C. R-11 Single Family Residential District d. R-10 Single Family Residential District e. R-9 Single Family Residential District f. R-8 Single Family Residential. District g. NS Neighborhood Service District h. PO Professional Office District i. CG Commercial General District j. CR Commercial Recreation District k. GU Governmental Use District 1. Other uses that lend themselves to planning concepts that may not be allowed in other zoning districts. MM 2. Accessory Uses: Accessory uses shall be permitted in a PD in accordance with the regulations provided in Section 23 of this ordinance. Any accessory use permitted within the districts in Paragraph B1. above shall be permitted as accessory uses to a principal use provided that no accessory use permitted in the R-15, R- 12, R-11, R-101 R-9 and R-8 Single Family Residential Districts shall be a source of income to the owner or occupant of the principal use." 6. That Section 23 Accessory Uses shall be amended by amending subsection A so that it shall hereafter read as follows: "A. Residential Accessory Uses: The following districts, R-15, R-12, R-11, R-10, R-9, R- 8, R -Fairway Village, R -Twenty in Trophy, R -Oak Hill, R - Oak Hill Patio, R -Summit, and PD (when used as residential) Districts shall be subject to the following regulations for accessory use for residential purposes: 2. Regarding accessory uses and buildings located in R- 15, R-12, R-11, R-10, R-9, R-8, and PD (when used as residential) Districts, when any of the foregoing permitted residential accessory uses are detached from the principal single-family dwelling, said uses shall be located not less than forty-five (45) feet from the front lot line nor less than twenty (20) feet from any street right-of-way, and six (6) feet from rear and side lot lines, nor within any identified easement. In addition, accessory buildings permitted in these districts shall not exceed 15 feet in height." * * * * * * * * * * * * * * * * * * * * * * * * * * * *11 7. That Section 29 -Conditional Uses shall be amended by amending subsection F so that the said subsection shall hereafter read as follows: 11 F. Residential conditional Uses: The following districts: R-15, R-12, R-11, R-10, R-9, R-8, R -Fairway Village, R -Twenty in Trophy, R -oak Hill, R -Oak Hill Patio, R -Summit, and PD (when used as residential) Districts shall be subject to the following regulations for accessory use for residential conditional use purposes: * * * * * * * * * * * * * * * * * * * * * * * * * * * *11 Section 3. Asterisks. Where an asterisk (*) appears in this Ordinance, unless the context indicates otherwise, the same represents text of the Comprehensive Zoning Ordinance which is not am amended by this Ordinance and which is in all things ratified, verified, approved and affirmed. Section 4. Savings. That this Ordinance shall be cumulative of all other ordinances of the Town affecting zoning and shall not repeal any of the provisions of those ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this Ordinance. Section 5. Penalty. 1t shall be unlawful for any person to violate any provision of this ordinance, and any person violating or failing to comply with any provision of this Ordinance shall be fined, upon conviction, not less than One Dollar ($1.00) nor more than Two Thousand Dollars ($2,000.00) , and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 6. Severability. That if any section, article, paragraph, sentence, clause, phrase or word in this Ordinance or application thereof to any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this Ordinance, and the Town Council hereby declares it would have passed such remaining portions of this Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 7. That this Ordinance shall become effective from and after its date of adoption as required by law. Purpose: The purpose of the R 8 - Single Family District is to allow single family detached dwellings on lots of not less than eight thousand (8,000) square feet, together with the allowed incidental and accessory uses, in order to promote medium population densities within integral neighborhood units. B. Application: Lots in a subdivision legally approved and properly recorded in the Denton County Plat Record prior to the effective date of this ordinance which do not meet the minimum lot sizes and area requirements set forth in this Section shall not be considered to be in violation of said requirements and, for purposes of this Section, shall be deemed to conform to the minimum requirements required in this Section. C. Uses Generally: In an R 8 - Single Family District no land shall be used and no building shall be installed, erected for or converted to any use other than as hereinafter provided. 1. Permitted Uses: The following uses shall be permitted as principal uses: a. Single family detached dwellings. b. Parks, playgrounds, and nature preserves, publicly owned. c. Public utility uses required to service the district. 2. Accessory Uses: Accessory uses shall be permitted within the R 8 - Single Family District in accordance with the regulations provided in Section 23 of this ordinance. 3. Conditional Uses: Conditional uses may be permitted within the R 8 - Single Family District in accordance with the regulations provided in Section 29 of this ordinance. 4. Limitation of Uses: a. Garage sales are prohibited. b. Private or public alleys shall not be allowed. c. Any use not expressly permitted or allowed by permit herein is prohibited. D. Plan Requirements: No application for a building permit for the construction of a building or structure shall be approved unless. Page 1 1. A plat, meeting all requirements of the Town of Trophy Club, has been approved by the Town Council and recorded in the official records of the County in which the property is located; 2. Site Plan: A Site Plan has been approved meeting the conditions as provided in Section 28-A. E. Height Regulations: Except as provided by Section 24 of this ordinance, no building shall exceed thirty-five (35) feet or two and one-half (2-112) stories in height. F. Area Regulations: The following minimum standards shall be required measured from property lines: 1. Lot Size ........................... Lots for any permitted use shall have a minimum area of eight thousand (8,000) square feet. 2. Minimum Open Space.......... All areas not devoted to buildings, walkways, structures or off-street parking area shall be devoted to grass, trees, gardens, shrubs or other suitable landscape material. In addition, all developments shall reserve open space in accordance with the Town Park Land Dedication Ordinance, and other applicable ordinances of the Town. 3. Maximum Building ............. The combined area covered by all main and Coverage accessory buildings and structures shall not exceed thirty-five (35) percent of the total lot area. Swimming pools and spas shall not be included in determining maximum building coverage. 4. Minimum Floor Area........... The minimum square footage of a dwelling unit, exclusive of garages, breezeways and porches, shall be in accordance with the following: Type of Structure One story residence One and one-half story or two story residence Residence on corner lot Golf Course Lots All Other Lots 2,000 1,650 2,000* 1,800* 2,000* 2,000* *Those residences with more than one (I)story shall have a minimum first floor area of 1,100 square feet. Depth of rear yard, feet**...............20 feet minimum (No rear yard shall face any sM provided, however, that this w9mement shall not apply whew the rear yard of a lot abuts a sfireet which is contiguous to the perimeter of the Town.) 7. Width of lot, feet ......................... 60 feet minimum (measured at front building line) 10. Depth of lot, feet ......................... 100 feet minimum (measured from front property line) 11. Depth of lot, cul-de-sac .................. 85 feet minimum or corner lot, feet **All required yards shall comply with Section 25 of this ordinance. G. Buffered Area Regulations: Whenever an R 8 - Single Family development is located adjacent to an existing Mobile Home/Manufactured Housing district, multi- family development or a non-residential district, without any division such as a dedicated public street, park or permanent open space, all principal buildings or structures shall be set back a minimum of twenty (20) feet from the adjoining property line. The setback area shall contain landscape improvements, fencing, berms or trees to adequately buffer adjoining uses. H. Garages: Garages are not permitted to face any public dedicated street for all lots exceeding nine thousand (9,000) square feet. In addition, no more than two contiguous lots may have front entry garages. Garages are not permitted to face any side street. Page 3 Off -Street Parking: Provisions for the parking of automobiles on paved surfaces shall be allowed as an accessory use provided that such shall not be located on a required front yard, with the exception being that a circular drive may be Iocated in the front yard. Parking within a circular drive shall be temporary and may not include permanent parking of recreational vehicles, other vehicles, or vehicles in a state of major disrepair. Off-street parking shall be provided in accordance with the provisions of Section 34 of this ordinance and all other applicable ordinances of the Town. Every residence shall have a garage which shall have a minimum interior measurement of 21 feet by 22 feet. 7. Off -Street Loading: No off-street loading is required in the R S - Single Family District for residential uses. Off-street loading for conditional uses may be required as determined by the Planning and Zoning Commission and Town Council. K. Masonry Requirements: All principal and accessory buildings and structures shall be of exterior fire resistant construction having at least eighty (SO) percent of the total exterior walls, excluding doors, windows and porches, constructed of brick, stone or other masonry material. Other materials of equal or similar characteristics may be allowed upon approval of the Planning and Zoning Commission. Page 4 SECTION ------ R 9 - SINGLE FAMILY DISTRICT REGULATIONS A. The setback area shall contain landscape improvements, fencing, berms or trees to adequately buffer adjoining uses. H. Off -Street Parking: Provisions for the parking of automobiles on paved surfaces shall be allowed as an accessory use provided that such shall not be located on a required front yard, with the exception being that a circular drive may be located in the front yard. Parking within a circular drive shall be temporary and may not include permanent parking of recreational vehicles, other vehicles, or vehicles in a state of major disrepair. Off-street parking shall be provided in accordance with the provisions of Section 34 of this ordinance and all other applicable ordinances of Page 3 the Town.
