ORDINANCE NO. 91-03 A
AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS
AMENDING ORDINANCE NO. 91-03 OF THE TOWN, THE
SAME BEING THE SUBDIVISION REGULATIONS OF THE
TOWN, BY (1) AMENDING SECTION 6.14 RELATING TO
STREETS BY ADDING A NEW PARAGRAPH V TO REQUIRE
THAT, ALONG PRIMARY COLLECTOR STREETS NO
BUILDING OR STRUCTURE (EXCEPT FOR A MASONRY
WALL) SHALL BE ERECTED OR INSTALLED WITHIN 15
FEET OF THE STREET RIGHT-OF-WAY, A MASONRY
WALL NOT LESS THAN SIX (6) FEET BE
CONSTRUCTED, AND CERTAIN MINIMUM LANDSCAPING
BE PROVIDED, AND (2) REVISING IN ITS ENTIRETY
SECTION 6.1.6 RELATING TO STORM DRAINAGE
REQUIREMENTS; PROVIDING A SAVINGS CLAUSE;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the Town Council of the Town of Trophy Club, Texas
(the "Town") heretofore adopted Ordinance No. 91-03, the same being
the Subdivision Ordinance of the Town, regulating the laying out of
subdivisions within the Town; and
WHEREAS, the Town Council, having received a recommendation
from the Town Planning Commission, now desires to amend the
Subdivision Ordinance as provided for herein, and finds that the
said amendments are in the best interest of the health, safety and
welfare of the citizens of the Town.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB,
TEXAS:
Section 1. That Ordinance No. 91-03 of the Town of Trophy
Club, Texas, the same being the Town Subdivision Ordinance, is
hereby amended in the following particulars, and that all other
articles, sections, paragraphs, sentences, phrases and words of the
said Ordinance are not amended but are hereby ratified, verified
and approved:
A. That Article VI, Section 6.14 relating to streets is
hereby amended by adding a new paragraph v. to read as follows:
"v. Primary Collector, Streets, - Along all primary
collector streets, the following shall apply:
(i) When a side or rear yard abuts or lies
adjacent to the right--of-way of a primary collector
street:

(A) except as provided in subparagraph (B) of this
paragraph v.(i), no building or structure shall be
constructed, erected or installed closer than
fifteen (15) feet to the said right-of-way; and
(B) a masonry wall not less than six (6) feet in
height shall be constructed contiguous to the said
right-of-way.
(ii) Within the median area of a primary collector
street, trees (which shall have a full grown height
of at least fifteen (15) feet) shall be planted
every fifteen (15) feet, and shrubbery (with a
projected mature height of between 2 to 3 feet)
shall be installed every two to three feet."
B. That Article VI, Section 5.16 relating to Storm Drainage
shall be amended in its entirety so that the said section shall
hereafter read as provided in Exhibit "A" (entitled "Town of Trophy
Club - Subdivision Drainage Regulations) attached hereto and
incorporated herein by this reference.
Section 2. savings. This Ordinance shall be cumulative of
all other ordinances of the Town affecting the subdivision and/or
platting of land and shall not repeal any of the provisions of
those ordinances except in those instances where provisions of
those ordinances are in direct conflict with the provisions of this
Ordinance.
Section 3. Severability. That if any section, article,
paragraph, sentence, clause, phrase or word in this Ordinance or
application thereof to any person or circumstance is held invalid
or unconstitutional by a Court of competent jurisdiction, such
holding shall not affect the validity of the remaining portions of
this Ordinance, and the City Council hereby declares it would have
passed such remaining portions of this Ordinance despite such
invalidity, which remaining portions shall remain in full force and
effect.
Section 4. That this Ordinance shall become effective from
and after its date of adoption and publication as required by law.
PASSED AND APPROVED by the Town Council of the Town of Trophy
Club, Texas this the 17th day of August 1 1993.
