ORDINANCE NO. 92-04A
AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS
AMENDING ORDINANCE NO. 92-04 OF THE TOWN
RELATING, TO THE ADOPTION OF THE UNIFORM
BUILDING CODE AND OTHER CODES, BY ADDING A NEW
SECTION B.A. REQUIRING THAT FOLLOWING THE
ISSUANCE OF A PERMIT TO CONSTRUCT, ERECT OR
INSTALL A BUILDING OR STRUCTURE OR OTHERWISE
IMPROVE PROPERTY, BUT PRIOR TO THE INSPECTION
BY THE TOWN OF SUCH BUILDING, STRUCTURE .OR
PROPERTY, STRUCTURE OR FACILITY, THE OWNER OR
THE OWNER'S DESIGNATED REPRESENTATIVE SHALL
SUBMIT TO THE TOWN A FORMS SURVEY SHOWING THE
LOCATION ON THE GROUND OF THE STRUCTURE OR
FACILITY; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB,
TEXAS:
Section 1. That Ordinance No. 92-04 of the Town of Trophy
Club, Texas (the "Town") is hereby amended in the following
particulars, and that all other sections, subsections, paragraphs,
sentences, phrases and words of the said Ordinance are not amended
but are hereby ratified, verified, approved and affirmed:
A. That a new Section 8.A. is hereby added to Ordinance No.
92-04, which Section shall read as follows:
"Section 8.A. Forms ,Survey. Following the issuance of
any permit by the Town to construct, erect, place or
install any building or structure or to otherwise improve
any property, and prior to the inspection by the Town of
such building, structure or property, the Owner of such
building, structure or property, or the Owner's duly
designated representative, shall submit to the Town a
Forms Survey. Such Survey shall be prepared by a
registered and licensed professional surveyor, and shall:
(a) locate all easements, including underground
easements, roads, streets, alleys, and other right-of-
ways or water courses, and building set -back lines and
other matters located on or affecting the Property; (b)
show all proposed and existing improvements (such as
buildings, power lines, fences, etc.), and (c) show any
portion of the Property within any flood plain, f lood
prone or flood hazardous area and any ponds, creeks, or
other water courses."
Section 2. Severability. That if any section, article,
paragraph, sentence, clause, phrase or word in this Ordinance or
application thereof to any person or circumstance is held invalid
or unconstitutional by a Court of competent jurisdiction, such

(A) except as provided in subparagraph (B) of this
paragraph v.(i), no building or structure shall be
constructed, erected or installed closer than
fifteen (15) feet to the said right-of-way; and
(B) a masonry wall not less than six (6) feet in
height shall be constructed contiguous to the said
right-of-way.
(ii) Within the median area of a primary collector
street, trees (which shall have a full grown height
of at least fifteen (15) feet) shall be planted
every fifteen (15) feet, and shrubbery (with a
projected mature height of between 2 to 3 feet)
shall be installed every two to three feet."
B. That Article VI, Section 6.16 relating to Storm Drainage
shall be amended in its entirety so that the said Section shall
hereafter read as provided in Exhibit "A" (entitled "Town of Trophy
Club - Subdivision Drainage Regulations) attached hereto and
incorporated herein by this reference.
Section 2. Savings. This ordinance shall be cumulative of
all other ordinances of the Town affecting the subdivision and/or
platting of land and shall not repeal any of the provisions of
those ordinances except in those instances where provisions of
those ordinances are in direct conflict with the provisions of this
ordinance.
Section 3. Severability. That if any section, article,
paragraph, sentence, clause, phrase or word in this Ordinance or
application thereof to any person or circumstance is held invalid
or unconstitutional by a Court of competent jurisdiction, such
holding shall not affect the validity of the remaining portions of
this Ordinance, and the City Council hereby declares it would have
passed such remaining portions of this Ordinance despite such
invalidity, which remaining portions shall remain in full force and
effect.
Section 4. That this Ordinance shall become effective from
and after its date of adoption and publication as required by law.
PASSED AND APPROVED by the Town Council of the Town of Trophy
Club, Texas this the 17th day of _August F 1993.
