AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS
.AMENDING ORDINANCE NO. 91-02, RELATING TO THE
ADOPTION OF DESIGN STANDARDS FOR PAVING, DRAINAGE
AND UTILITY IMPROVEMENTS, BY REVISING IN ITS
ENTIRETY SECTION XV RELATING TO STORM DRAINAGE AND
APPURTENANCES; PROVIDING A SAVINGS CLAUSE;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB,
TEXAS:
Section 1. That Ordinance No. 91-02 of the Town of Trophy
Club, Texas (the "Town") relating to the adoption of design
standards for paving, drainage and utility improvements is hereby
amended in the following particulars, and that all other sections,
subsections, paragraphs, sentences, phrases and words are not
amended but are hereby ratified, verified, approved and affirmed:
A. That Section XV of Ordinance No. 91-02, which Section is
entitled "Storm Drainage & Appurtenances", is hereby amended in its
entirety, so that it shall hereafter read as set forth in Exhibit
"A" attached hereto and incorporated herein for all purposes.
Section 2. Savings. That this Ordinance shall be cumulative
of all other ordinances of the Town affecting design standards for
paving, drainage, utility and other improvements within the Town,
and shall not repeal any of the provisions of those ordinances
except in those instances where provisions of those ordinances are
in direct conflict with the provisions of this Ordinance.
Section 3. Seyerability. That if any section, article,
paragraph, sentence, clause, phrase or word in this Ordinance or
application thereof to any person or circumstance is held invalid
or unconstitutional by a Court of competent jurisdiction, such
holding shall not affect the validity of the remaining portions of
this Ordinance, and the City Council hereby declares it would have
passed such remaining portions of this Ordinance despite such
invalidity, which remaining portions shall remain in full force and
effect.
Section 4. Effective Date. That this Ordinance shall become
effective from and after_ its date of adoption and publication as
required by law.
