UNA ORDENANZA DEL CONCILIO DEL POBLADO DEL POBLADO
DE TROPHY CLUB, TEXAS, ORDENANDO Y LLAMANDO A UNA
ELECC16N ESPECIAL PARA EL POBLADO DE TROPHY CLUB ("EL
POBLADO") QUE SE DEBE LLEVAR A CABO EL 3 DE NOVIEMBRE
DE 2015 CON EL PROPOSITO DE PRESENTAR A LOS RESIDENTES
VOTANTES CALIFICADOS DEL POBLADO DE TROPHY CLUB, DOS
(2) PROPOSICIONES RELACIONADAS CON LA ENMIENDA A LA
CARTA CONSTITUCIONAL AUTONOMA DEL POBLADO, DE
ACUERDO A LO QUE SE MANIFIESTA EN EL CONTENIDO DEL
PRESENTE DOCUMENTO; ESTIPULANDO LA INCORPORACION DE
PREMISAS; ESPECIFICANDO LA FECHA DE LA ELECCION;
ESPECIFICANDO EL PROPOSITO DE LA ELECCION; ESTIPULANDO
PARA EL NOMBRAMIENTO DE UN JUEZ PRESIDENTE DE LA
ELECCION Y UN JUEZ PRESIDENTE DE LA ELECCION SUPLENTE;
ESTABLECIENDO OTROS PROCEDIMIENTOS PARA CONDUCIR LA
ELECCION; ESTABLECIENDO UNA FECHA PARA EL ESCRUTINIO
DE LOS VOTOS; ESTIPULANDO LAS ACCIONES NECESARIAS;
ESTIPULANDO UN CONTRATO DE ELECCION CONJUNTA CON EL
CONDADO DENTON; ESTIPULANDO UNA CLAUSULA
ACUMULATIVA DE REVOCACION; ESTIPULANDO UNA CLAUSULA
DE SEPARACION; ESTIPULANDO SOME LA PUBLICACION;
ESTIPULANDO PARA QUE SEA PASADA A FORMATO LEGAL Y
REGISTRADA; Y ESTIPULANDO UNA FECHA DE VIGENCIA.
CONSIDERANDO QUE, la Seccion 41.001 (a)(3) del Codigo Electoral de Texas
(de aqui en adelante mencionado como "el Codigo") establece al primer martes de
noviembre como una Fecha Uniforme para Elecciones, con el proposito de conducir
una Eleccion Especial y;
CONSIDERANDO QUE, la Seccion 3.004 del Codigo Electoral de Texas
establece que el cuerpo de gobierno de una municipalidad debe ser la autoridad que
ordene una Eleccion Especial y;
CONSIDERANDO QUE, el Concilio del Poblado considera y declara que la junta
en la cual es considerada esta ordenanza esta abierta al publico de acuerdo a to
requerido por la ley y, que el aviso al publico de la hora, el lugar y el proposito de
dichas juntas fue dado de acuerdo a to requerido por el Capitulo 551, del Codigo de
Gobierno de Texas, con sus enmiendas y;
CONSIDERANDO QUE, la Seccion 3.005 del Codigo Electoral de Texas estipula
que una eleccion ordenada por una autoridad de una municipalidad, debera ser
ordenada a mas tardar el 71 avo dia antes del Dia de la Eleccion y;
CONSIDERANDO QUE, debido a que el Poblado de Trophy Club se encuentra
localizado en el Condado Denton y el Condado Tarrant, el Poblado establecera un
Contrato de Servicios de Elecci6n con el Condado Denton y un Contrato de Servicios
de Eleccion con el Condado Tarrant, de forma tal que esas entidades proporcionaran
servicios de elecci6n para los residentes de Trophy Club en el Condado Denton y en el
Condado Tarrant y;
CONSIDERANDO QUE, la Eleccion debera ser conducida de acuerdo con el
C6digo bajo la jurisdicci6n de la Administracion de Elecciones del Condado Denton (el
"Administrador de Elecciones del Condado Denton") en cumplimiento con el Contrato
de Servicios de Eleccion (el "Contrato"), un Acuerdo Interlocal por y entre la
Administracion de Elecciones del Condado Denton ("DCEA") y otras entidades
participantes, si las hay, descrito en un Contrato entre el Poblado y el Condado Denton;
una copia de dicho Contrato sera incorporada en el presente documento como
Documento "A" al recibir la aprobaci6n y ejecuci6n final por parte del Poblado y;
CONSIDERANDO QUE, la Eleccion debe ser conducida de acuerdo con el
C6digo bajo la jurisdiccion de la Administracion de Elecciones del Condado Tarrant (el
"Administrador de Elecciones del Condado Tarrant") en cumplimiento con un Contrato
de Servicios de Eleccion (el "Contrato"), un Acuerdo Interlocal por y entre la
Administraci6n de Elecciones del Condado Tarrant ("TCEA") y otras entidades
participantes, si las hay, descritos en el Contrato entre el Poblado y el Condado
Tarrant. Al ser aprobado el Acuerdo Interlocal con el Condado Tarrant por el Concilio
del Poblado, debera ser incorporada a este documento, como referencia, una copia de
ese acuerdo como Documento "B" y;
CONSIDERANDO QUE, la Secci6n 85.004 del C6digo Electoral de Texas
estipula que una orden de elecci6n y el aviso de la elecci6n deben indicar la ubicaci6n
de cada una de las casillas para votar en la votaci6n por anticipado y;
CONSIDERANDO QUE, que la primera Carta Constitucional Aut6noma del
Poblado fue adoptada por los residentes de Trophy Club en una elecci6n que se Ilev6 a
cabo el martes 3 de noviembre de 2004 (de aqui en adelante Ilamada "Carta
Constitucional") y fue enmendada posteriormente en una elecci6n que se Ilev6 a cabo
en mayo de 2009 y mayo de 2013 y;
CONSIDERANDO QUE, de acuerdo con la Secci6n 9.001 del C6digo de
Gobierno Local de Texas y el Articulo 11, Secci6n 5 de la Constituci6n de Texas, el
Poblado esta autorizado a enmendar la Carta Constitucional municipal y;
CONSIDERANDO QUE, el Concilio ha determinado que es apropiado presentar
dos (2) proposiciones de enmiendas iniciadas por el Concilio, las cuales fueron puestas
a consideraci6n por el Concilio en dos reuniones abiertas al publico, a los votantes
calificados en la elecci6n del 3 de noviembre de 2015 (de aqui en adelante
mencionados como "Enmiendas Propuestas"), siendo esa fecha mas de dos anos
despues de la adopci6n y/o enmienda de la Carta Constitucional del Poblado y una
fecha que es mas del 30avo dia despues de la adopci6n de esta Ordenanza y;

CONSIDERANDO QUE, el Concilio del Poblado considera que cads proposici6n
contenida en las Enmiendas Propuestas abarca un tema y que el lenguaje de la balota
proporcionado se prepar6 para informar a los votantes de forma completa y clara la
naturaleza de las Enmiendas Propuestas y;
CONSIDERANDO QUE, el Concilio del Poblado considera que al terminar el
escrutinio de los votos depositados en la elecci6n del 3 de noviembre de 2015, aquellas
proposiciones que fueron aprobadas por una mayoria de los votantes de acuerdo con
la ley estatal, la Carta Constitucional Aut6noma del Poblado, esta Ordenanza y la orden
de la elecci6n, deberan ser promulgadas como parte de la Carta Constitucional
Aut6noma del Poblado y dichas provisiones de la Carta Constitucional seran
promulgadas de acuerdo a to establecido a continuaci6n en esta Ordenanza y;
MORA, POR LO TANTO, SEA ORDENADO POR EL CONCILIO DEL
POBLADO DEL POBLADO DE TROPHY CLUB, TEXAS:
SECCION 1
INCORPORACION DE PREMISAS
Todas las premisas anteriores son verdaderas y correctas y son por medio del presente
documento, incorporadas en el cuerpo de esta Ordenanza como se presentan de forma
completa en el presente documento.
Todos los votantes calificados residentes del Poblado, son elegibles para votar en la
Elecci6n
SECCION 2
FECHA DE LA ELECCION
Por medio del presente documento se ordena que debe Ilevarse a cabo una Elecci6n
Especial (de forma colectiva la "Elecci6n") en y a traves de todo el Poblado de Trophy
Club el martes 3 de noviembre de 2015 utilizando una balota combinada.
SECCION 3
PROPOSITO DE LA ELECCION
EI prop6sito de la Elecci6n Especial Conjunta es Ilevar a cabo una elecci6n acerca de
las Medida, a saber: dos (2) enmiendas a la Carta Constitucional Aut6noma del
Poblado, adoptada en 2004 con las enmiendas hechas en 2009 y 2013, enmiendas
iniciadas por el Concilio del Poblado para el Poblado de Trophy Club. Se debe permitir
que los votantes voten "A favor" o "En contra" para cada una de las Enmiendas
Propuestas.

SECCION 4
LENGUAJE EN LA BALOTA ACERCA DE LAS MEDIDAS
Las balotas oficiales para la Elecci6n Especial deberan ser preparadas de acuerdo con
el C6digo Electoral de Texas para permitir que los electores voten "A FAVOR" o "EN
CONTRA" en cada proposici6n, de acuerdo a to requerido en una elecci6n acerca de
una medida, con las balotas conteniendo dichas provisiones, marcas y lenguaje de
acuerdo a to requerido por la ley y, con dichas proposiciones expresadas
sustancialmente de la siguiente forma:
4.01. PROPOSICION NO. 2:
LIMITES DE LOS PERIODOS: UNA ENMIENDA PARA DEROGAR LA
SECCION 3.22 "LIMITES DE LOS PERIODOS" EN SU TOTALIDAD PARA
ELIMINAR LA ESTIPULACION EN LA CARTA CONSTITUCIONAL QUE
RESTRINGE A LAS PERSONAS PARA OCUPAR EL PUESTO DE ALCALDE O
MIEMBRO DEL CONCILIO POR PERIODOS COMPLETOS SUCESIVOS QUE
SEAN POR UN TOTAL DE MAS DE SEIS (6) ANOS.

[ ] EN CONTRA
Si esta Proposici6n es aprobada por la mayoria de los votantes que votan sobre
esta Proposicion en la Eleccion, debera ser derogado en su totalidad el Articulo
III, Secci6n 3.02 "Limites de los Periodos" de la Carta Constitucional del Poblado
y la estipulaci6n que esta a continuaci6n, sera eliminada de la Carta
Constitucional Aut6noma del Poblado enmendada en 2013.
3.22 Limites de los Periodos
4.02. PROPOSICION NO. 3:
PRESUPUESTO, FINANZAS E IMPU ESTOS-DECLARACION; UNA ENMIENDA
A LA SECCION 9.02 "DECLARACION" DEROGANDO EL LENGUAJE DONDE
SE REQUIERE QUE EL GERENTE DEL POBLADO PRESENTE UNA
PROPUESTA DE PRESUPUESTO Y UN MENSAJE AL CONCILIO DEL
POBLADO ANTES DEL 10 DE AGOSTO DE CADA ANO Y ADOPTANDO UN

LENGUAJE QUE REQUIERA LA PRESENTACION DEL PRESUPUESTO Y EL
MENSAJE CADA ANO, DE ACUERDO CON LOS REQUERIMIENTOS DE LA
LEY ESTATAL.

[ ] EN CONTRA
Si esta Proposicion es aprobada por la mayoria de los votantes que votan sobre
esta Proposicion en la Eleccion, el primer parrafo del Articulo IX, Seccion 9.02
"Presentacion" de la Carta Constitucional del Poblado, debe ser enmendada de
acuerdo con el lenguaje que se presenta a continuacion (las revisiones sobre las
que se va a votar resaltando los agregados y con raya to que va a ser) y todos los
parrafos y secciones que no han sido enmendadas de forma especifica, deberan
permanecer vigentes de acuerdo a to establecido por la Carta Constitucional
Autonoma Enmendada de 2013, del Poblado:
9.02 Presentacion
EI Gerente del Poblado debera presentar cada ano al Concilio una propuesta de
presupuesto y el mensaje que to acompana antes del primer dia de age6to de de
acuerdo con los requerimientos de la ley Estatal.
SECCION 5
DISTRITOS PARA VOTACION
Los distritos para votar para la Eleccion son asignados por los numeros de distrito del
condado respectivos. Los horarios y los lugares propuestos para la votacion por
anticipado en el Condado Denton y el Condado Tarrant se establecen en el
Documento "C", una copia del cual se anexa al presente documento y se incorpora
tambien al mismo. EI Documento "C" debera ser enmendado para incluir el programa
final de horarios y locales para la votacion por anticipado para los residentes del
Poblado de Trophy Club en los dos Condados, el Condado Denton y el Condado
Tarrant, cuando sea anunciado por el Administrador de Elecciones del Condado
Denton y/o el Administrador de Elecciones del Condado Tarrant. Independiente de to
anterior, los horarios y los locales de la votacion por anticipado que se establecen en el
Documento "C" pueden ser cambiados sin que el Concilio del Poblado tenga que
realizar ninguna otra accion si asi es ordenado por el Administrador de Elecciones del
Condado Denton o el Administrador de Elecciones del Condado Tarrant.
Ademas de los locales para la votacion por anticipado dentro del Poblado, todos los
votantes de Trophy Club del Condado Denton podran votar en los locales para el voto
por anticipado que hayan sido asignados y sean mantenidos por el Condado Denton a
traves del Condado.

Los votantes de Trophy Club del Condado Tarrant pueden votar solo en los lugares
para votar en la votaci6n por anticipado que hayan sido asignadas y sean mantenidas
por el Condado Tarrant a traves de todo el Condado.
Los Administradores de Elecciones del Condado Denton y el Condado Tarrant son, por
medio del presente documento, autorizados a instruidos para realizar esos cambios en
los locales para votaci6n segun sea necesario para la conducci6n apropiada de la
Elecci6n. Cada casilla para votaci6n debera estar abierta de 7:00 a.m. a 7:00 p.m. el
dia de la Elecci6n.
SECCION 6
ADMINISTRACION DE ELECCIONES
6.1 Condado Denton. EI Administrador de Elecciones del Condado Denton, Lannie
Noble es, por medio del presente documento, nombrado como Secretario de la
Votaci6n por Anticipado para la Elecci6n en el Condado Denton. Los jueces,
secreta rios/emplead os suplentes de la votaci6n por anticipado seran nombrados segun
sea necesario para procesar la correspondencia para la votaci6n por anticipado y para
conducir la votaci6n por anticipado. La votaci6n por anticipado por correo debera ser
conducida de acuerdo con los requerimientos del C6digo. Las solicitudes de balotas y
las balotas votadas y enviadas por coreo, deberan ser dirigidas a: Early Voting Clerk,
701 Kimberly Drive, Suite A101, Denton, Texas 76208. EI Administrador de Elecciones
y/o la/el Secretaria(o) de la Votaci6n por Anticipado son, por medio del presente,
autorizados para que nombren a los miembros de la Junta de Balotas de la Votaci6n
por Anticipado y al juez presidente y juez suplente, de acuerdo con los requerimientos
del C6digo. EI Voto por Anticipado en persona, debera ser conducido en los horarios,
fechas y lugares designados en el Documento "C" del presente documento. La casilla
principal para votaci6n por anticipado es designada, por medio del presente, para que
sea el local en 701 Kimberly Drive, Suite A101, Denton, Texas 76208. La votaci6n por
anticipado debera ser conducida por la (el) Secretaria(o) de la Votaci6n por Anticipado
en el local principal de la votaci6n por anticipado que fue designado previamente en
este documento y, en los lugares asignados en el Documento "C" incluido aqui; EI
Administrador de Elecciones del Condado Denton y/o del Condado Tarrant podran
cambiar de localidad o agregar otros locales para la votaci6n por anticipado, sin que el
Concilio del Poblado tenga que realizar ninguna otra acci6n, si asi es requerido para
que la Elecci6n sea conducida de forma apropiada.
6.2 Condado Tarrant. EI Administrador de Elecciones del Condado Tarrant, Frank
Phillips es, por medio del presente, nombrado como Secretario de la Votaci6n por
Anticipado del Condado Tarrant para la Elecci6n. Los jueces/secretarios suplentes de
la votaci6n por anticipado, seran nombrados segun sea necesario para procesar la
correspondencia de la votaci6n por anticipado y para Ilevar a cabo la votaci6n por
anticipado. La votaci6n por anticipado por correo debera ser conducida en
cumplimiento con los requerimientos del C6digo. Las solicitudes de balotas y las
balotas con los votos enviadas por correo deberan ser enviadas a: Early Voting Clerk,
PO Box 961011, Fort Worth, Texas 76161-0011. EI Administrador de Elecciones y/o el
Secretario de la Votaci6n por Anticipado son, por medio del presente, autorizados para

nombrar a los miembros de la Junta de Balotas de la Votaci6n por Anticipado y al juez
presidente y al juez suplente, de acuerdo con los requerimientos del C6digo. La
votaci6n por anticipado haciendolo en persona debera ser conducida en los horarios,
en las fechas y en los locales designados en el Documento "C" del presente. En el
presente documento se designa como casilla principal para la votaci6n por anticipado a
Condado Tarrant Election Center, 2700 Premier Street, Fort Worth, Texas 76111. La
Votaci6n por Anticipado debera ser conducida por el Secretario o la Secretaria de la
Votaci6n por Anticipado en la casilla principal para la votaci6n por anticipado que se
menciona anteriormente y en los lugares designados en el Documento "C" del
presente; EI Administrador de la Elecci6n puede cambiar estos lugares o agregar otros
locales para la votaci6n por anticipado, sin que Concilio del Poblado tenga que realizar
ninguna otra acci6n, si es necesario para que la Elecci6n sea conducida de forma
apropiada.
SECCION 7
COMPENSACION
La compensaci6n para los jueces y jueces suplentes por sus servicios en la Elecci6n
debe ser determinada por el Administrador de la Elecci6n del Condado Denton y el
Administrador de la Elecci6n del Condado Tarrant respectivamente. E -slate, un Sistema
de Registro Electr6nico Directo (DRE por sus siglas en ingles), debera ser utilizado
para el voto por anticipado apareciendo en persona en la elecci6n del 3 de noviembre
de 2015 en las casillas de votaci6n del Condado Denton y el Condado Tarrant. Las
balotas de papel, las cuales son digitalizadas 6pticamente, deben ser usadas para la
votaci6n por anticipado por correo. En la elecci6n del 3 de noviembre de 2015, los
Administradores de Elecciones del Condado Denton y el del Condado Tarrant deben
ocuparse de que las balotas sean preparadas en la forma establecida arriba, en ingles
y en espanol y dichas balotas deben ser proporcionadas a los oficiales de la elecci6n,
junto con cualesquier otras formas u hojas en blanco, de forma que se apegue a to
establecido en la Carta Constitucional del Poblado de Trophy Club, la Constituci6n y las
leyes del Estado de Texas y la Ley de Derechos de Votaci6n de 1965 y cualquier
enmienda a la misma, siempre y cuando los mismos sean pertinentes.
SECCION 8
VOTACION POR ANTICIPADO
Ademas del local de la casilla principal para la votaci6n por anticipado, los votantes del
Poblado de Trophy Club pueden votar en todas las casillas designadas y mantenidas
por el Condado Denton para la votaci6n por anticipado, a traves del Condado y en el
Condado Tarrant a traves del Condado, siendo los locales los que se presentan en el
Documento "C" adjunto al presente documento, con las modificaciones y
actualizaciones que haga cada Administrador de la Elecci6n.

SECCION 9
MATERIALES DE LA ELECCION
Los materiales de la eleccion que se especifican en el Codigo, deberan estar impresos
en ingles y espanol para ser usados en las casillas de votacion y en el voto por
anticipado para la Eleccion y, deben hacerse preparaciones para prestar ayuda oral a
los votantes que hablan espanol.
SECCION 10
CONTEO DE LOS VOTOS
Los oficiales de la eleccion deben hacer el conteo de votos para la Eleccion en la forma
que es requerida por la ley y las balotas que estan marcadas de forma correcta de
conformidad con las estipulaciones del Codigo para los votos depositados durante el
periodo de la votacion por anticipado y el dia de la Eleccion deberan ser contados en la
forma que to especifica la ley.
SECCION 11
PUBLICACION DEL AVISO DE ELECCION
EI Aviso de la Eleccion debe ser dado colocando un aviso que contenga una copia fiel
de esta Ordenanza en ingles y en espanol en el Palacio Municipal del Poblado, en el
tablero de avisos que se utiliza para colocar el aviso de las juntas del Concilio del
Poblado y mediante la publicacion de dicho aviso en un periodico de circulacion general
publicado dentro del Poblado; la fecha de la publicacion no debe ser menos de diez
(10) dias ni mas de treinta (30) dias antes de la fecha establecida para que se Ileve a
cabo la Eleccion.
SECCION 12
ESCRUTINIO DE LA ELECCION
En cumplimiento con la Seccion 67.003 del Codigo Electoral de Texas, el Concilio del
Poblado hard el escrutinio de la eleccion no antes del 11 de noviembre de 2015 y a
mas tardar el 16 de noviembre de 2015. EI aviso de la hora y el lugar para hacer el
escrutinio debe ser colocada en el tablero de boletines oficiales de la misma forma
como es requerido por la Ley de Juntas Abiertas (Open Meeting Act) para otras juntas
del Concilio del Poblado, de acuerdo con el Capitulo 51 del Codigo de Gobierno Local
(Local Government Code).
SECCION 13
LEY DE DERECHOS PARA VOTAR
EI Alcalde y la Secretaria del Poblado del Poblado, consultando con el Abogado del
Poblado, son, por medio del presente documento, autorizados a instruidos para que
tomen cada una de y todas las acciones necesarias para apegarse a las estipulaciones
del Codigo y de la Ley Federal de Derechos para Votar, al Ilevar a cabo y conducir la
Eleccion, ya sea o no expresamente autorizado en el presente documento.

SECCION 14
SEPARABILIDAD
Es declarado, por medio del presente documento, que la intenci6n Concilio del Poblado
del Poblado de Trophy Club es que las frases, clausulas, oraciones, parrafos y
Secciones de esta Ordenanza son separables y, si alguna frase, clausula, oraci6n,
parrafo o Secci6n de esta Ordenanza debe ser declarado inconstitucional por un juicio
o decreto valido de cualquier corte de jurisdicci6n competente, dicha
inconstitucionalidad no debe afectar a ninguna de las frases, clausulas, oraciones,
parrafos o Secciones restantes de esta Ordenanza, ya que las mismas habrian sido
promulgadas por el Concilio del Poblado sin incorporaci6n de cualquier frase, clausula,
oraci6n, parrafo o secci6n inconstitucional.
SECCION 15
CONTRATOS PARA LA ELECCION
EI Gerente del Poblado o la persona que designe el Gerente del Poblado esta
autorizado para enmendar o suplementar cualquiera y todos los contratos de la
administraci6n de la Elecci6n del 3 de noviembre de 2015, hasta donde sea requerido
para que la Elecci6n sea conducida en una forma eficiente y legal, de acuerdo a to
determinado por el Administrador de Elecciones del Condado Denton y/o el Condado
Tarrant. Al ser aprobado por el Concilio del Poblado, debera ser incorporado en el
presente documento como referencia, un Contrato de Elecci6n Conjunta entre el
Poblado y el Departamento de Elecciones del Condado Denton, como Documento
"A". Al ser aprobado por el Concilio del Poblado, debera ser incorporado al presente
documento como referencia, un Contrato de Elecci6n Conjunta entre el Poblado y el
Departamento de Elecciones del Condado Tarrant como Documento "B".
SECCION 16
FORMATO LEGAL
La Secretaria del Poblado del Poblado de Trophy Club es, por medio del presente
documento, instruida para pasar en formato legal a inscribir esta Ordenanza de
acuerdo a to requerido por la Carta Constitucional del Poblado.
SECCION 17
FECHA DE VIGENCIA
Esta Ordenanza debera entrar en vigencia inmediatamente al ser adoptada.

COUNTY OF DENTON
JOINT ELECTION AGREEMENT AND CONTRACT FOR ELECTION SERVICES
THIS CONTRACT for election services is made by and between the Denton County Elections Administrator and
the following political subdivisions, herein referred to as "Participating Authority or Participating Authorities" located
entirely or partially inside the boundaries of Denton County:
City of Coppell Town of Trophy Club
Town of Copper Canyon Alpha Ranch Water Control and Improvement District of
Town of Flower Mound Denton and Wise Counties
City of Lewisville Denton County Fresh Water Supply District No. 1-H
Town of Little Elm Mobberly Road Municipal Utility District
City of The Colony Tradition MUD 2B
This contract is made pursuant to Texas Election Code Sections 31.092 and 271.002 and Texas Education Code
Section 11.0581 for a joint November 3, 2015 election to be administered by Lannie Noble, Denton County Elections
Administrator, hereinafter referred to as "Elections Administrator."
RECITALS
Each "Participating Authority" listed above plans to hold a General or Special Election on November 3, 2015.
Denton County plans to hold county -wide voting for a Constitutional Amendment Election.
The County owns an electronic voting system, the Hart InterCivic eSlate/eScan Voting System (Version 6.2.1),
which has been duly approved by the Secretary of State pursuant to Texas Election Code Chapter 122 as amended, and
is compliant with the accessibility requirements for persons with disabilities set forth by Texas Election Code Section
61.012. The contracting political subdivisions (Participating Authorities) desire to use the County's electronic voting
system, to compensate the County for such use, and to share in certain other expenses connected with joint elections, in
accordance with the applicable provisions of Chapters 31 and 271 of the Texas Election Code, as amended.
NOW THEREFORE, in consideration of the mutual covenants, agreements, and benefits to the parties, IT IS
AGREED as follows:
I. ADMINISTRATION
The Participating Authorities agree to hold a "Joint Election" with Denton County and each other in accordance
with Chapter 271 of the Texas Election Code and this agreement. The Elections Administrator shall coordinate,
supervise, and handle all aspects of administering the Joint Election as provided in this agreement. Each Participating
Authority agrees to pay the Elections Administrator for equipment, supplies, services, and administrative costs as
provided in this agreement. The Denton County Elections Administrator shall serve as the administrator for the Joint
Election; however, each Participating Authority shall remain responsible for the decisions and actions of its officers
necessary for the lawful conduct of its election. The Elections Administrator shall provide advisory services in connection
with decisions to be made and actions to be taken by the officers of each Participating Authority as necessary.
It is understood that other political subdivisions may wish to participate in the use of the County's electronic
voting system and polling places, and it is agreed that the Elections Administrator may enter into other contracts for
election services for those purposes, on terms and conditions generally similar to those set forth in this contract. In such
cases, costs shall be pro -rated among the participants according to Section XI of this contract.
At each polling location, joint participants shall share voting equipment and supplies to the extent possible. The
Participating Authorities shall share a mutual ballot in those polling places where jurisdictions overlap. However, in no
instance shall a voter be permitted to receive a ballot containing an office or proposition stating a measure on which the

voter is ineligible to vote. Multiple ballot styles shall be available in those shared polling places where jurisdictions do not
overlap.
II. LEGAL DOCUMENTS
Each Participating Authority shall be responsible for the preparation, adoption, and publication of all required
election orders, resolutions, notices, and any other pertinent documents required by the Texas Election Code and/or the
Participating Authority's governing body, charter, or ordinances, except that the Elections Administrator shall be
responsible for the preparation and publication of all voting equipment testing notices that are required by the Texas
Election Code. Election orders should include language that would not necessitate amending the order if any of the Early
Voting and/or Election Day polling places change.
Preparation of the necessary materials for notices and the official ballot shall be the responsibility of each
Participating Authority, including translation to languages other than English. Each Participating Authority shall provide a
copy of their respective election orders and notices to the Elections Administrator.
VOTING LOCATIONS
The Elections Administrator shall select and arrange for the use of and payment for all Election Day voting
locations. Voting locations will be, whenever possible, the usual voting location for each election precinct in elections
conducted by the county, and shall be compliant with the accessibility requirements established by Election Code Section
43.034 and the Americans with Disabilities Act (ADA). All voting locations must be within the boundaries of Denton
County. The proposed voting locations are listed in Attachment A of this agreement. In the event a voting location is not
available or appropriate, the Elections Administrator will arrange for use of an alternate location. The Elections
Administrator shall notify the Participating Authorities of any changes from the locations listed in Attachment "A."
If polling places for the November 3, 2015 joint election are different from the polling place(s) used by a
Participating Authority in its most recent election, the authority agrees to post a notice no later than November 3, 2015 at
the entrance to any previous polling places in the jurisdiction stating that the polling location has changed and stating the
political subdivision's polling place names and addresses in effect for the November 3, 2015 election. This notice shall be
written in both the English and Spanish languages.
IV. ELECTION JUDGES, CLERKS, AND OTHER ELECTION PERSONNEL
Denton County shall be responsible for the appointment of the presiding judge and alternate judge for each
polling location. The Elections Administrator shall make emergency appointments of election officials if necessary.
Upon request by the Elections Administrator, each Participating Authority agrees to assist in recruiting polling
place officials who are bilingual (fluent in both English and Spanish). In compliance with the Federal Voting Rights Act of
1965, as amended, each polling place containing more than 5% Hispanic population as determined by the 2010 Census
shall have one or more election officials who are fluent in both the English and Spanish languages. If a presiding judge is
not bilingual, and is unable to appoint a bilingual clerk, the Elections Administrator may recommend a bilingual worker for
the polling place. If the Elections Administrator is unable to recommend or recruit a bilingual worker, the Participating
Authority or authorities served by that polling place shall be responsible for recruiting a bilingual worker for translation
services at that polling place.
The Elections Administrator shall notify all election judges of the eligibility requirements of Subchapter C of
Chapter 32 of the Texas Election Code, and will take the necessary steps to insure that all election judges appointed for
the Joint Election are eligible to serve.
The Elections Administrator shall arrange for the training and compensation of all election judges and clerks. The
Elections Administrator shall arrange for the date, time, and place for presiding election judges to pick up their election
supplies. Each presiding election judge will be sent a letter from the Elections Administrator notifying him of his
appointment, the time and location of training and distribution of election supplies, and the number of election clerks that
the presiding judge may appoint.

Each election judge and clerk will receive compensation at the hourly rate established by Denton County pursuant
to Texas Election Code Section 32.091. The election judge, or his designee, will receive an additional sum of $25.00 for
picking up the election supplies and equipment prior to Election Day and for returning the supplies and equipment to the
central counting station after the polls close.
The compensation rates established by Denton County are:
Early Voting — Lead Clerk ($10 an hour), Clerk ($9 an hour)
Election Day— Presiding Judge ($11 an hour), Alternate Judge ($10 an hour), Clerk ($9 an hour)
Election judges and clerks who attend voting equipment training and/or procedures training shall be compensated
at the rate of $9 an hour.
The Elections Administrator may employ other personnel necessary for the proper administration of the election,
including such part-time help as is necessary to prepare for the election, to ensure the timely delivery of supplies during
early voting and on Election Day, and for the efficient tabulation of ballots at the central counting station. Part-time
personnel working in support of the Early Voting Ballot Board and/or central counting station on election night will be
compensated at the hourly rate set by Denton County in accordance with Election Code Sections 87.005, 127.004, and
127.006.
V. PREPARATION OF SUPPLIES AND VOTING EQUIPMENT
The Elections Administrator shall arrange for all election supplies and voting equipment including, but not limited
to, the County's electronic voting system and equipment, official ballots, sample ballots, voter registration lists, and all
forms, signs, maps and other materials used by the election judges at the voting locations. The Elections Administrator
shall ensure availability of tables and chairs at each polling place and shall procure rented tables and chairs for those
polling places that do not have tables and/or chairs. Any additional required materials must be provided by the
Participating Authority, and delivered to the Elections Office fourteen (14) calendar days (October 5, 2015) prior to the first
day of early voting. If this deadline is not met, the material must be delivered by the entity, to all Early Voting and Election
Day locations affected, prior to voting commencing. The Elections Administrator shall be responsible for conducting all
required testing of the electronic equipment, as required by Chapters 127 and 129 of the Texas Election Code.
At each polling location, joint participants shall share voting equipment and supplies to the extent possible. The
participating parties shall share a mutual ballot in those precincts where jurisdictions overlap. However, in no instance
shall a voter be permitted to receive a ballot containing an office or proposition stating a measure on which the voter is
ineligible to vote. Multiple ballot styles shall be available in those shared polling places where jurisdictions do not overlap.
The Elections Administrator shall provide the necessary voter registration information, maps, instructions, and other
information needed to enable the election judges in the voting locations that have more than one ballot style to conduct a
proper election.
Each Participating Authority shall furnish the Elections Administrator a list of candidates and/or propositions
showing the order and the exact manner in which the candidate names and/or proposition(s) are to appear on the official
ballot (including titles and text in each language in which the authority's ballot is to be printed). Said list must be provided
to the Elections Office within three (3) business days following the last day to file for a place on the ballot or after the
election is ordered, whichever is later. Said list must be in a Word document, the information must be in an upper and
lower case format, be in an Arial 12 point font, and contain candidate contact information for the purposes of verifying the
pronunciation of the candidates' names. Each Participating Authority shall be responsible for proofreading and approving
the ballot insofar as it pertains to that authority's candidates and/or propositions. Each Participating Authority shall be
responsible for proofing and approving the audio recording of the ballot insofar as it pertains to that authority's candidates
and/or propositions. The approvals must be finalized with the Elections Office within five (5) calendar days of receipt of
the proofs.
The joint election ballots shall list the County's election first. The joint election ballots that contain ballot content
for more than one joint participant because of overlapping territory shall be arranged with the appropriate school district

ballot content appearing on the ballot following the County's election, followed by the appropriate city ballot content, and
followed by the appropriate water district or special district ballot content.
Early Voting by Personal Appearance and on Election Day shall be conducted exclusively on Denton County's
eSlate electronic voting system. Provisional ballots cast on election day will be cast on the eSlate electronic voting
system.
The Elections Administrator shall be responsible for the preparation, testing, and delivery of the voting equipment
for the election as required by the Election Code.
The Elections Administrator shall conduct criminal background checks on the relevant employees upon hiring as
required by Election Code 129.051(g).
VI. EARLY VOTING
The Participating Authorities agree to conduct joint early voting and to appoint the Election Administrator as the
Early Voting Clerk in accordance with Sections 31.097 and 271.006 of the Texas Election Code. Each Participating
Authority agrees to appoint the Elections Administrator's permanent county employees as deputy early voting clerks. The
participating authorities further agree that the Elections Administrator may appoint other deputy early voting clerks to
assist in the conduct of early voting as necessary, and that these additional deputy early voting clerks shall be
compensated at an hourly rate set by Denton County pursuant to Section 83.052 of the Texas Election Code. Deputy
early voting clerks who are permanent employees of the Denton County Elections Administrator or any Participating
Authorities shall serve in that capacity without additional compensation.
Early Voting by personal appearance will be held at the locations, dates, and times listed in Attachment "B" of this
document. Any qualified voter of the Joint Election may vote early by personal appearance at any one of the joint early
voting locations.
As Early Voting Clerk, the Elections Administrator shall receive applications for early voting ballots to be voted by
mail in accordance with Chapters 31 and 86 of the Texas Election Code. Any requests for early voting ballots to be voted
by mail received by the participating authorities shall be forwarded immediately by fax or courier to the Elections
Administrator for processing. The address of the Early Voting Clerk is as follows:

The Elections Administrator shall post on the county website each Participating Authority's early voting report on a
daily basis and a cumulative final early voting report following the close of early voting. In accordance with Section
87.121(g) of the Election Code, the daily reports showing the previous day's early voting activity will be posted to the
county website no later than 8:00 a.m. each business day.
VII. EARLY VOTING BALLOT BOARD
Denton County shall appoint an Early Voting Ballot Board (EVBB) to process early voting results from the Joint
Election. The Presiding Judge, with the assistance of the Elections Administrator, shall appoint two or more additional
members to constitute the EVBB. The Elections Administrator shall determine the number of EVBB members required to
efficiently process the early voting ballots.
VIII. CENTRAL COUNTING STATION AND ELECTION RETURNS

The Elections Administrator shall be responsible for establishing and operating the central counting station to
receive and tabulate the voted ballots in accordance with the provisions of the Texas Election Code and of this
agreement.
The participating authorities hereby, in accordance with Section 127.002, 127.003, and 127.005 of the Texas
Election Code, appoint the following central counting station officials:

Tabulation Supervisor: Kerry Martin, Denton County Deputy Elections Administrator
Presiding Judge: Brandy Grimes, Denton County Technical Operations Manager
Alternate Judge: Paula Paschal, Denton County Contract Manager
The counting station manager or his representative shall deliver timely cumulative reports of the election results
as precincts report to the central counting station and are tabulated. The manager shall be responsible for releasing
unofficial cumulative totals and precinct returns from the election to the joint participants, candidates, press, and general
public by distribution of hard copies at the central counting station and by posting to the Denton County web site. To
ensure the accuracy of reported election returns, results printed on the tapes produced by Denton County's voting
equipment will not be released to the participating authorities at the remote collection sites or by phone from individual
polling locations.
The Elections Administrator will prepare the unofficial canvass reports that are necessary for compliance with
Election Code Section 67.004, after all precincts have been counted and will deliver a copy of the unofficial canvass to
each Participating Authorities as soon as possible after all returns have been tabulated, via the website. Each
Participating Authorities shall be responsible for the official canvass of its respective election(s), and shall notify the
Elections Administrator, or his designee, of the date of the canvass, no later than three days after Election Day.
The Elections Administrator will prepare the electronic precinct -by -precinct results reports for each Participating
Authority to upload to the Secretary of State as required by Section 67.017 of the Election Code
The Elections Administrator shall be responsible for conducting the post-election manual recount required by
Section 127.201 of the Texas Election Code unless a waiver is granted by the Secretary of State. Notification and copies
of the recount, if waiver is denied, will be provided to each Participating Authorities and the Secretary of State's Office.
IX. PARTICIPATING AUTHORITIES WITH TERRITORY OUTSIDE DENTON COUNTY
The Elections Administrator shall administer only the Denton County portion of the elections held by the
Participating Authorities.
X. RUNOFF ELECTIONS
Each Participating Authority shall have the option of extending the terms of this agreement through its runoff
election, if applicable. In the event of such runoff election, the terms of this agreement shall automatically extend unless
the Participating Authorities notifies the Elections Administrator in writing within 3 business days of the original election.
Each Participating Authorities shall reserve the right to reduce the number of early voting locations and/or Election
Day voting locations in a runoff election
Each Participating Authority agrees to order any runoff election(s) at its meeting for canvassing the votes from the
November 3, 2015 election and to conduct its drawing for ballot positions at or immediately following such meeting in
order to expedite preparations for its runoff election.
Each Participating Authority eligible to hold runoff elections agrees that the date of the runoff election, if
necessary, shall be Tuesday, December 8, 2015, with early voting being held in accordance with the Election Code.
XI. ELECTION EXPENSES AND ALLOCATION OF COSTS

The Participating Authorities agree to share the costs of polling places with Denton County. If a polling location is
shared by more than one Participating Authority, the costs shall be pro -rated equally among the participants utilizing that
polling place.
Costs for Early Voting by Personal Appearance shall be allocated based upon the actual costs associated with
each early voting site. Each Participating Authority shall be responsible for a pro -rata portion of the actual costs
associated with the early voting sites located within their jurisdiction. Participating Authorities that do not have a regular
(non -temporary) early voting site within their jurisdiction shall pay a pro -rata portion of the nearest regular early voting site.
Costs for Early Voting by Mail shall be allocated according to the actual number of ballots mailed to each
Participating Authority's voters.
Each Participating Authority agrees to pay the Denton County Elections Administrator an administrative fee equal
to ten percent (10%) of its total billable costs in accordance with Section 31.100(d) of the Texas Election Code.
The Denton County Elections Administrator shall deposit all funds payable under this contract into the appropriate
fund(s) within the county treasury in accordance with Election Code Section 31.100.
Failure on the part of the Participating Authority to meet the deadlines outlined in this agreement may result in
additional charges, including but not limited to, overtime costs for Denton County employees.
XII. WITHDRAWAL FROM CONTRACT DUE TO CANCELLATION OF ELECTION
Any Participating Authority may withdraw from this agreement and the Joint Election should it cancel its election in
accordance with Sections 2.051 - 2.053 of the Texas Election Code.
XIII. RECORDS OF THE ELECTION
The Elections Administrator is hereby appointed general custodian of the voted ballots and all records of the Joint
Election as authorized by Section 271.010 of the Texas Election Code.
Access to the election records shall be available to each Participating Authority as well as to the public in
accordance with applicable provisions of the Texas Election Code and the Texas Public Information Act. The election
records shall be stored at the offices of the Elections Administrator or at an alternate facility used for storage of county
records. The Elections Administrator shall ensure that the records are maintained in an orderly manner so that the
records are clearly identifiable and retrievable.
Records of the election shall be retained and disposed of in accordance with the provisions of Section 66.058 of
the Texas Election Code. If records of the election are involved in any pending election contest, investigation, litigation, or
open records request, the Elections Administrator shall maintain the records until final resolution or until final judgment,
whichever is applicable. It is the responsibility of each Participating Authority to bring to the attention of the Elections
Administrator any notice of pending election contest, investigation, litigation or open records request which may be filed
with the Participating Authorities.
XIV. RECOUNTS
A recount may be obtained as provided by Title 13 of the Texas Election Code. By signing this document, the
presiding officer of the contracting Participating Authorities agrees that any recount shall take place at the offices of the
Elections Administrator, and that the Elections Administrator shall serve as Recount Supervisor and the Participating
Authority's official or employee who performs the duties of a secretary under the Texas Election Code shall serve as
Recount Coordinator.
The Elections Administrator agrees to provide advisory services to each Participating Authority as necessary to
conduct a proper recount.

XV. MISCELLANEOUS PROVISIONS
It is understood that to the extent space is available, other districts and political subdivisions may wish to
participate in the use of the County's election equipment and voting places, and it is agreed that the
Elections Administrator may contract with such other districts or political subdivisions for such purposes
and that in such event there may be an adjustment of the pro -rata share to be paid to the County by the
Participating Authorities.
2. The Elections Administrator shall file copies of this document with the Denton County Judge and the
Denton County Auditor in accordance with Section 31.099 of the Texas Election Code.
3. Nothing in this contract prevents any party from taking appropriate legal action against any other party
and/or other election personnel for a breach of this contract or a violation of the Texas Election Code.
4. This agreement shall be construed under and in accord with the laws of the State of Texas, and all
obligations of the parties created hereunder are performable in Denton County, Texas.
5. In the event that one of more of the provisions contained in this Agreement shall for any reason be held to
be invalid, illegal, or unenforceable in any respect, such invalidity, illegality, or unenforceability shall not
affect any other provision hereof and this agreement shall be construed as if such invalid, illegal, or
unenforceable provision had never been contained herein.
6. All parties shall comply with all applicable laws, ordinances, and codes of the State of Texas, all local
governments, and any other entities with local jurisdiction.
7. The waiver by any party of a breach of any provision of this agreement shall not operate as or be
construed as a waiver of any subsequent breach.
8. Any amendments of this agreement shall be of no effect unless in writing and signed by all parties hereto.
XVI. COST ESTIMATES AND DEPOSIT OF FUNDS
The total estimated obligation for each Participating Authority under the terms of this agreement is listed below.
The exact amount of each Participating Authority's obligation under the terms of this agreement shall be calculated after
the November 3, 2015 election (or runoff election, if applicable). The Participating Authority's obligation shall be paid to
Denton County within 30 days after the receipt of the final invoice from the Elections Administrator, or his designee.
The total estimated obligation and required deposit for each Participating Authority under the terms of this
agreement shall be provided within 45 days after the last deadline for ordering an election:

RECITALS
Each participating authority listed above plans to hold a general and/or special election on November 3, 2015.

amendments on November 3, 2015.
The County owns an electronic voting system, the Hart InterCivic eSlate/eScan Voting System (Version 6.2.1),
which has been duly approved by the Secretary of State pursuant to Texas Election Code Chapter 122 as amended, and
is compliant with the accessibility requirements for persons with disabilities set forth by Texas Election Code Section
61.012. The contracting political subdivisions desire to use the County's electronic voting system and to compensate the
County for such use and to share in certain other expenses connected with joint elections in accordance with the
applicable provisions of Chapters 31 and 271 of the Texas Election Code, as amended.
NOW THEREFORE, in consideration of the mutual covenants, agreements, and benefits to the parties, IT IS
AGREED as follows:
I. ADMINISTRATION
The parties agree to hold a "Joint Election" with Tarrant County and each other in accordance with Chapter 271 of
the Texas Election Code and this agreement. The Tarrant County Elections Administrator shall coordinate, supervise,
and handle all aspects of administering the Joint Election as provided in this agreement. Each participating authority
agrees to pay the Tarrant County Elections Administrator for equipment, supplies, services, and administrative costs as
provided in this agreement. The Tarrant County Elections Administrator shall serve as the administrator for the Joint
Election; however, each participating authority shall remain responsible for the decisions and actions of its officers
necessary for the lawful conduct of its election. The Elections Administrator shall provide advisory services in connection
with decisions to be made and actions to be taken by the officers of each participating authority as necessary.
It is understood that other political subdivisions may wish to participate in the use of the County's electronic
voting system and polling places, and it is agreed that the Elections Administrator may enter into other contracts for
election services for those purposes on terms and conditions generally similar to those set forth in this contract. In such
cases, costs shall be pro -rated among the participants according to Section XI of this contract.

At each polling location, joint participants shall share voting equipment and supplies to the extent possible. The
participating parties shall share a mutual ballot in those polling places where jurisdictions overlap. However, in no
instance shall a voter be permitted to receive a ballot containing an office or proposition stating a measure on which the
voter is ineligible to vote. Multiple ballot styles shall be available in those shared polling places where jurisdictions do not
overlap.
LEGAL DOCUMENTS
Each participating authority shall be responsible for the preparation, adoption, and publication of all required
election orders, resolutions, notices, and any other pertinent documents required by the Texas Election Code and/or the
participating authority's governing body, charter, or ordinances, except that the Elections Administrator shall be
responsible for the preparation and publication of all voting system testing notices that are required by the Texas Election
Code.
Preparation of the necessary materials for notices and the official ballot shall be the responsibility of each
participating authority, including translation to languages other than English. Each participating authority shall provide a
copy of their respective election orders and notices to the Tarrant County Elections Administrator.
It is understood by all parties that there will be no preclearance submission to the United States Department of
Justice made by the Elections Administrator related to the joint election.
III. VOTING LOCATIONS
The Elections Administrator shall select and arrange for the use of and payment for all election day voting
locations. Voting locations will be, whenever possible, the usual voting location for each election precinct in elections
conducted by the county, and shall be compliant with the accessibility requirements established by Election Code Section
43.034 and the Americans with Disabilities Act (ADA). The proposed voting locations are listed in Attachment A of this
agreement. In the event that a voting location is not available or appropriate, the Elections Administrator will arrange for
use of an alternate location with the approval of the affected participating authorities. The Elections Administrator shall
notify the participating authorities of any changes from the locations listed in Attachment A.
If polling places for the November 3, 2015 joint election are different from the polling place(s) used by a
participating authority in its most recent election, the authority agrees to post a notice no later than November 2, 2015 at
the entrance to any previous polling places in the jurisdiction stating that the polling location has changed and stating the
political subdivision's polling place names and addresses in effect for the November 3, 2015 election. This notice shall be
written in both the English and Spanish languages.
IV. ELECTION JUDGES, CLERKS, AND OTHER ELECTION PERSONNEL
Tarrant County shall be responsible for the appointment of the presiding judge and alternate judge for each
polling location. The Elections Administrator shall make emergency appointments of election officials if necessary.
Upon request by the Elections Administrator, each participating authority agrees to assist in recruiting polling
place officials who are bilingual (fluent in both English and Spanish). In compliance with the Federal Voting Rights Act of
1965, as amended, each polling place containing more than 5% Hispanic population as determined by the 2010 Census
shall have one or more election official who is fluent in both the English and Spanish languages. If a presiding judge is
not bilingual, and is unable to appoint a bilingual clerk, the Elections Administrator may recommend a bilingual worker for
the polling place. If the Elections Administrator is unable to recommend or recruit a bilingual worker, the participating
authority or authorities served by that polling place shall be responsible for recruiting a bilingual worker for translation
services at that polling place.

The Elections Administrator shall notify all election judges of the eligibility requirements of Subchapter C of
Chapter 32 of the Texas Election Code, and will take the necessary steps to ensure that all election judges appointed for
the Joint Election are eligible to serve.
The Elections Administrator shall arrange for the training and compensation of all election judges and clerks. The
Elections Administrator shall arrange for the date, time, and place for presiding election judges to pick up their election
supplies. Each presiding election judge will be sent a letter from the Elections Administrator notifying him of his
appointment, the time and location of training and distribution of election supplies, and the number of election clerks that
the presiding judge may appoint.
Each election judge and clerk will receive compensation at the hourly rate established by Tarrant County pursuant
to Texas Election Code Section 32.091. The election judge will receive an additional sum of $25.00 for picking up the
election supplies prior to election day and for returning the supplies and equipment to the central counting station after the
polls close.
Election judges and clerks who attend voting equipment training and/or procedures training shall be compensated
at the same hourly rate that they are to be paid on election day.
The Elections Administrator may employ other personnel necessary for the proper administration of the election,
including such part-time help as is necessary to prepare for the election, to ensure the timely delivery of supplies during
early voting and on election day, and for the efficient tabulation of ballots at the central counting station. Part-time
personnel working as members of the Early Voting Ballot Board and/or central counting station on election night will be
compensated at the hourly rate set by Tarrant County in accordance with Election Code Sections 87.005, 127.004, and
127.006.
V. PREPARATION OF SUPPLIES AND VOTING EQUIPMENT
The Elections Administrator shall arrange for all election supplies and voting equipment including, but not limited
to, official ballots, sample ballots, voter registration lists, and all forms, signs, maps and other materials used by the
election judges at the voting locations. The Elections Administrator shall ensure availability of tables and chairs at each
polling place and shall procure rented tables and chairs for those polling places that do not have tables and/or chairs.
At each polling location, joint participants shall share voting equipment and supplies to the extent possible. The
participating parties shall share a mutual ballot in those precincts where jurisdictions overlap. However, in no instance
shall a voter be permitted to receive a ballot containing an office or proposition stating a measure on which the voter is
ineligible to vote. Multiple ballot styles shall be available in those shared polling places where jurisdictions do not overlap.
The Elections Administrator shall provide the necessary voter registration information, maps, instructions, and other
information needed to enable the election judges in the voting locations that have more than one ballot style to conduct a
proper election.
Each participating authority shall furnish the Elections Administrator a list of candidates and/or propositions
showing the order and the exact manner in which the candidate names and/or proposition(s) are to appear on the official
ballot (including titles and text in each language in which the authority's ballot is to be printed). Each participating
authority shall be responsible for proofreading and approving the ballot insofar as it pertains to that authority's candidates
and/or propositions.
Early Voting by Personal Appearance shall be conducted exclusively on Tarrant County's eSlate electronic voting
system. On election day, voters shall have a choice between voting on the eSlate electronic voting system or by a paper
ballot that is scanned at the polling place using Tarrant County's eScan voting system. Provisional ballots cast on election
day will be cast only on the eSlate electronic voting system to prevent the possibility of paper provisional ballots from
being immediately counted via the eScan ballot scanner.
The number of paper ballots printed for election day voting shall be, at a minimum, equal to the same election day
turnout as in the last comparable election plus 25 percent of that number, with the final number of ballots ordered per
polling place or precinct adjusted upward to end in a number divisible by 50.

The Elections Administrator shall be responsible for the preparation, testing, and delivery of the voting equipment
for the election as required by the Election Code.
The Elections Administrator shall conduct criminal background checks on relevant employees upon hiring as
required by Election Code Section 129.051(g).
VI. EARLY VOTING
The participating authorities agree to conduct joint early voting and to appoint the Election Administrator as the
Early Voting Clerk in accordance with Sections 31.097 and 271.006 of the Texas Election Code. Each participating
authority agrees to appoint the Elections Administrator's permanent county employees as deputy early voting clerks. The
participating authorities further agree that the Elections Administrator may appoint other deputy early voting clerks to
assist in the conduct of early voting as necessary, and that these additional deputy early voting clerks shall be
compensated at an hourly rate set by Tarrant County pursuant to Section 83.052 of the Texas Election Code. Deputy
early voting clerks who are permanent employees of the Tarrant County Elections Administrator or any participating
authority shall serve in that capacity without additional compensation.
Early Voting by personal appearance will be held at the locations, dates, and times listed in Attachment "B" of this
document. Any qualified voter of the Joint Election may vote early by personal appearance at any of the joint early voting
locations.
As Early Voting Clerk, the Elections Administrator shall receive applications for early voting ballots to be voted by
mail in accordance with Chapters 31 and 86 of the Texas Election Code. Any requests for early voting ballots to be voted
by mail received by the participating authorities shall be forwarded immediately by fax or courier to the Elections
Administrator for processing.
The Elections Administrator shall post on the county website each participating authority's early voting report on a
daily basis and a cumulative final early voting report following the close of early voting. In accordance with Section
87.121(g) of the Election Code, the daily reports showing the previous day's early voting activity will be posted to the
county website no later than 8:00 AM each business day.
VII. EARLY VOTING BALLOT BOARD
Tarrant County shall appoint an Early Voting Ballot Board (EVBB) to process early voting results from the Joint
Election. The Presiding Judge, with the assistance of the Elections Administrator, shall appoint two or more additional
members to constitute the EVBB. The Elections Administrator shall determine the number of EVBB members required to
efficiently process the early voting ballots.
VIII. CENTRAL COUNTING STATION AND ELECTION RETURNS
The Elections Administrator shall be responsible for establishing and operating the central and remote counting
stations to receive and tabulate the voted ballots in accordance with the provisions of the Texas Election Code and of this
agreement.
The participating authorities hereby, in accordance with Section 127.002, 127.003, and 127.005 of the Texas
Election Code, appoint the following central counting station officials:

Alternate Judge: Emma Allen
The counting station manager or his representative shall deliver timely cumulative reports of the election results
as precincts report to the central and remote counting stations and are tabulated. The manager shall be responsible for
releasing unofficial cumulative totals and precinct returns from the election to the joint participants, candidates, press, and
general public by distribution of hard copies at the central counting station and by posting to the Tarrant County web site.
To ensure the accuracy of reported election returns, results printed on the tapes produced by Tarrant County's voting
equipment will not be released to the participating authorities at the remote collection sites or by phone from individual
polling locations.
The Elections Administrator will prepare the unofficial canvass reports that are necessary for compliance with
Election Code Section 67.004 after all precincts have been counted, and will deliver a copy of these unofficial canvass
reports to each participating authority as soon as possible after all returns have been tabulated. Each participating
authority shall be responsible for the official canvass of its respective election(s).
The Elections Administrator will prepare the electronic precinct -by -precinct results reports for uploading to the
Secretary of State as required by Section 67.017 of the Election Code. The Elections Administrator agrees to upload
these reports for each participating authority unless requested otherwise.
The Elections Administrator shall be responsible for conducting the post-election manual recount required by
Section 127.201 of the Texas Election Code unless a waiver is granted by the Secretary of State. Notification and copies
of the recount, if waiver is denied, will be provided to each participating authority and the Secretary of State's Office.
IX. PARTICIPATING AUTHORITIES WITH TERRITORY OUTSIDE TARRANT COUNTY
The Elections Administrator shall administer only the Tarrant County portion of the election held by the City of
Azle, City of Burleson, City of Crowley, Town of Flower Mound, City of Fort Worth, City of Grand Prairie, City of
Grapevine, City of Haslet, City of Mansfield, City of Newark, City of Reno, City of Roanoke, City of Southlake, Town of
Trophy Club, City of Westlake, Aledo ISD, Azle ISD, Burleson ISD, Crowley ISD, Godley ISD, Grapevine-ColleyviIle ISD,
Lewisville ISD Mansfield ISD, Northwest ISD and Trophy Club MUD #1.
X. RUNOFF ELECTIONS
Each participating authority shall have the option of extending the terms of this agreement through its runoff
election, if applicable. In the event of such runoff election, the terms of this agreement shall automatically extend unless
the participating authority notifies the Elections Administrator in writing within 3 business days of the original election.
Each participating authority shall reserve the right to reduce the number of early voting locations and/or election
day voting locations in a runoff election.
Each participating authority agrees to order any runoff election(s) at its meeting for canvassing the votes from the
November 3, 2015 election and to conduct its drawing for ballot positions at or immediately following such meeting in
order to expedite preparations for its runoff election.
Each participating authority eligible to hold runoff elections agrees that the date of the runoff election, if
necessary, shall be December 8, 2015 with early voting held November 23, 2015 through December 4, 2015.
XI. ELECTION EXPENSES AND ALLOCATION OF COSTS

The participating authorities agree to share the costs of administering the Joint Election. Allocation of costs,
unless specifically stated otherwise, is mutually agreed to be shared according to a formula which is based on the
average cost per election day polling place (unit cost) as determined by adding together the overall expenses and dividing
the expenses equally among the total number of polling places. Costs for polling places shared by more than one
participating authority shall be pro -rated equally among the participants utilizing that polling place.
It is agreed that charges for election day judges and clerks and election day polling place rental fees shall be
directly charged to the appropriate participating authority rather than averaging those costs among all participants.
If a participating authority's election is conducted at more than one election day polling place, there shall be no
charges or fees allocated to the participating authority for the cost of election day polling places in which the authority has
fewer than 50% of the total registered voters served by that polling place, except that if the number of registered voters in
all of the authority's polling places is less than the 50% threshold, the participating authority shall pay a pro -rata share of
the costs associated with the polling place where it has the greatest number of registered voters.
Costs for Early Voting by Personal Appearance shall be allocated based upon the actual costs associated with
each early voting site. Each participating authority shall be responsible for a pro -rata portion of the actual costs
associated with the early voting sites located within their jurisdiction. Participating authorities that do not have a regular
(non -temporary) early voting site within their jurisdiction shall pay a pro -rata portion of the nearest regular early voting site.
Costs for Early Voting by Mail shall be allocated according to the actual number of ballots mailed to each
participating authority's voters.
Participating authorities having the majority of their voters in another county, and fewer than 500 registered voters
in Tarrant County, and that do not have an election day polling place or early voting site within their jurisdiction shall pay a
flat fee of $400 for election expenses.
Each participating authority agrees to pay the Tarrant County Elections Administrator an administrative fee equal
to ten percent (10%) of its total billable costs in accordance with Section 31.100(d) of the Texas Election Code.
The Tarrant County Elections Administrator shall deposit all funds payable under this contract into the appropriate
fund(s) within the county treasury in accordance with Election Code Section 31.100.
XII. WITHDRAWAL FROM CONTRACT DUE TO CANCELLATION OF ELECTION
Any participating authority may withdraw from this agreement and the Joint Election should it cancel its election in
accordance with Sections 2.051 - 2.053 of the Texas Election Code. The withdrawing authority is fully liable for any
expenses incurred by the Tarrant County Elections Administrator on behalf of the authority plus an administrative fee of
ten percent (10%) of such expenses. Any monies deposited with the Elections Administrator by the withdrawing authority
shall be refunded, minus the aforementioned expenses and administrative fee if applicable.
It is agreed that any of the joint election early voting sites that are not within the boundaries of one or more of the
remaining participating authorities, with the exception of the early voting site located at the Tarrant County Elections
Center, may be dropped from the joint election unless one or more of the remaining participating authorities agree to fully
fund such site(s). In the event that any early voting site is eliminated under this section, an addendum to the contract
shall be provided to the remaining participants within five days after notification of all intents to withdraw have been
received by the Elections Administrator.
XIII. RECORDS OF THE ELECTION
The Elections Administrator is hereby appointed general custodian of the voted ballots and all records of the Joint
Election as authorized by Section 271.010 of the Texas Election Code.

Access to the election records shall be available to each participating authority as well as to the public in
accordance with applicable provisions of the Texas Election Code and the Texas Public Information Act. The election
records shall be stored at the offices of the Elections Administrator or at an alternate facility used for storage of county
records. The Elections Administrator shall ensure that the records are maintained in an orderly manner so that the
records are clearly identifiable and retrievable.
Records of the election shall be retained and disposed of in accordance with the provisions of Section 66.058 of
the Texas Election Code. If records of the election are involved in any pending election contest, investigation, litigation, or
open records request, the Elections Administrator shall maintain the records until final resolution or until final judgment,
whichever is applicable. It is the responsibility of each participating authority to bring to the attention of the Elections
Administrator any notice of pending election contest, investigation, litigation or open records request which may be filed
with the participating authority.
XIV. RECOUNTS
A recount may be obtained as provided by Title 13 of the Texas Election Code. By signing this document, the
presiding officer of the contracting participating authority agrees that any recount shall take place at the offices of the
Elections Administrator, and that the Elections Administrator shall serve as Recount Supervisor and the participating
authority's official or employee who performs the duties of a secretary under the Texas Election Code shall serve as
Recount Coordinator.
The Elections Administrator agrees to provide advisory services to each participating authority as necessary to
conduct a proper recount.
XV. MISCELLANEOUS PROVISIONS
1. It is understood that to the extent space is available, other districts and political subdivisions may wish to
participate in the use of the County's election equipment and voting places, and it is agreed that the
Elections Administrator may contract with such other districts or political subdivisions for such purposes
and that in such event there may be an adjustment of the pro -rata share to be paid to the County by the
participating authorities.
2. The Elections Administrator shall file copies of this document with the Tarrant County Judge and the
Tarrant County Auditor in accordance with Section 31.099 of the Texas Election Code.
3. Nothing in this contract prevents any party from taking appropriate legal action against any other party
and/or other election personnel for a breach of this contract or a violation of the Texas Election Code.
4. This agreement shall be construed under and in accord with the laws of the State of Texas, and all
obligations of the parties created hereunder are performable in Tarrant County, Texas.
5. In the event that one or more of the provisions contained in this Agreement shall for any reason be held to
be invalid, illegal, or unenforceable in any respect, such invalidity, illegality, or unenforceability shall not
affect any other provision hereof and this agreement shall be construed as if such invalid, illegal, or
unenforceable provision had never been contained herein.
6. All parties shall comply with all applicable laws, ordinances, and codes of the State of Texas, all local
governments, and any other entities with local jurisdiction.
7. The waiver by any party of a breach of any provision of this agreement shall not operate as or be
construed as a waiver of any subsequent breach.

8. Any amendments of this agreement shall be of no effect unless in writing and signed by all parties hereto.
XVI. COST ESTIMATES AND DEPOSIT OF FUNDS
The total estimated obligation for each participating authority under the terms of this agreement is listed below.
Each participating authority agrees to pay the Tarrant County Elections Administrator a deposit of approximately 75% of
this estimated obligation no later than 15 days after execution of this agreement. The exact amount of each participating
authority's obligation under the terms of this agreement shall be calculated after the November 3, 2015 election (or runoff
election, if applicable), and if the amount of an authority's total obligation exceeds the amount deposited, the authority
shall pay to the Elections Administrator the balance due within 30 days after the receipt of the final invoice from the
Elections Administrator. However, if the amount of the authority's total obligation is less than the amount deposited, the
Elections Administrator shall refund to the authority the excess amount paid within 30 days after the final costs are
calculated.
The total estimated obligation and required deposit for each participating authority under the terms of this agreement shall
be as follows:
