ORD 1997-25TOWN OF TROPHY CLUB, TEXAS ORDINANCE NO. 9 1- 9 S AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS CANVASSING THE RETURNS, INCLUDING THE RETURNS OF EARLY VOTING BALLOTS CAST IN CONNECTION THEREWITH, AND DECLARING THE RESULTS OF THE SPECIAL ELECTION HELD ON NOVEMBER 4, 1997, FOR THE PURPOSE OF CONSIDERING WHETHER OR NOT A COMMISSION SHOULD BE FORMED TO FRAME A NEW CHARTER, WHICH CHARTER, IF APPROVED, WOULD GIVE HOME RULE STATUS TO THE TOWN, AND THE ELECTION FROM THE TOWN AT LARGE OF A CHARTER COMMISSION CONSISTING OF FIFTEEN (15) MEMBERS TO DRAFT THE CHARTER; AUTHORIZING ISSUANCE OF CANVASS OF THE SAID SPECIAL ELECTION; PROVIDING AN EFFECTIVE DATE. WHEREAS, on _September 16 , 1997, the Town Council of the Town of Trophy Club, Texas (the "Town") passed and approved Ordinance No. 97-20 , which Ordinance ordered a special election (the "Special Election") to be held on November 4, 1997, for the purpose of (i) submitting to the voters of the Town the question of "Shall a commission be chosen to frame a new charter" and (ii) electing a commission comprising of 15 members to draft a new charter; and WHEREAS, the appropriate authority of the Town has heretofore caused to be posted and published, in accordance with the laws of the State of Texas, notices of the Special Election; and WHEREAS, the Special Election was duly and legally held on November 4, 1997 in the Town and in conformity with the election laws of the State, and the results of the Special Election, including the early voting results, have been certified and returned by the proper judges and clerks thereof; and WHEREAS, the Town Secretary, acting as general custodian of the election records, presented the official returns of the presiding judges of the Special Election, including the returns of early voting ballots cast in connection therewith, to the Town Council acting in its capacity as the Canvassing Board; and WHEREAS, the Town Council has considered the returns of the Special Election, including the return of early voting ballots cast in connection therewith; and WHEREAS, the returns of the Special Election, including the returns of early voting ballots, duly and legally made, showed that there were cast at the Special Election the following total valid and legal votes: -1- DOC N: 544713 TOTAL VOTES TOTAL CAST AT POLL EARLY VOTING ON ELECTION TOTAL VOTES ELECTION VOTES CAST DAY CAST SPECIAL ELECTION 78 620 E98 and WHEREAS, the returns of the Special Election, including the returns of the early voting ballots, duly and legally made, showed that the following "yes" and "no" votes were cast with respect to Proposition No. 1 as set forth in the ballot: and WHEREAS, the returns of the Special Election, including the returns of the early voting ballots, duly and legally made, showed that, with respect to Proposition No. 2 set forth in the election ballot, each candidate for the home rule charter commission received the following votes: FIFTEEN (15) MEMBERS OF A CHARTER COMMISSION TO DRAFT A NEW CHARTER NAME OF CANDIDATE Walter R. Incorporation of Premises. The above and foregoing premises are true and correct and are incorporated into the body of this Ordinance and made a part hereof for all purposes. Section 2. Confirmation of Vote Tabulations. The results of the Special Election, as canvassed and tabulated above, reflect the expressed desires of the resident, qualified voters of the Town. Section 3. Creation of Home Rule Charter Commission. In accordance with the canvass and tabulation of the results of Proposition No. 1 of the Special Election, it is hereby found and declared that the vote to decide whether or not to a commission should be chosen to frame a new charter for the Town as described in the Election ballot proposition and as further set forth in Ordinance No. 97-20 calling the said Election has been gassed by the qualified voters of the Town voting at the said Election. Section 4. Members of Home Rule Charter Commission. In accordance with the canvass and tabulation of the results of Proposition No. 2 of the Special Election, the duly elected members -4- DOC #: 544713 of the Home Rule Charter Commission to frame a new charter elected on November 4, 1997, subject to the taking of the oaths of office as requires by State law, are as follows: Pam Irwin Nestor Karlis Linda C. Section 6. Effective Date. This Ordinance shall take effect from and after its date of passage.
