ORD 1997-02TOWN OF TROPHY CLUB, TEXAS ORDINANCE NO. 97-02 AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS REGULATING THE USE OF ATHLETIC FIELDS, INCLUDING PUBLIC PARKS, WITHIN THE TOWN; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS ($500.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION OCCURS OR CONTINUES; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS: Section 1. Definitions. For the purpose of this Ordinance the following definitions shall apply: Town sponsored league play athletic event means an athletic event which is authorized, organized or scheduled in whole or in part by the Town. Town co-sponsored league play athletic event means an athletic event which is authorized, organized or scheduled with the assistance of the Town by a nonprofit organization which is authorized by the Town of Trophy Club. Coordinator means the parks supervisor for the Town as designated by the Town Manager. Playing field means any portion of a park or open space that is either owned or ]eased by the Town that has been designated as an area in which athletic league games are played. This would include fields for football, soccer, softball, baseball or any other sport activity sponsored or co-sponsored by the Town. Closed field means a playing field or game field that has been closed for any use due to inclement weather or maintenance requirements by the Coordinator. Ganie field means a field that has been designated by the Coordinator to be used only for the purpose of conducting league play or tournament play for Town sponsored or Town co- sponsored league play athletic events only. -1- OOC #: 409753 Section 2. Authorization to Designate Game Field: Posting Penalty. (a) The Coordinator is authorized to designate fields as game fields and shall post thereon a sign stating "Game Field -Restricted to Town Sponsored League Play or Town Co - Sponsored Athletic Events Only - $1.00 - $500.00 Penalty for Violation." (b) It shall be unlawful to go upon a field which has been designated as a game field and has posted thereon a sign stating "Game Field -Restricted to Town Sponsored League Play or Town Co -Sponsored Athletic Events Only - $1.00 - $500.00 Penalty for Violation" unless for the purpose of participating in league play or tournament play in a Town of Trophy Club sponsored or co-sponsored league play athletic event. Section 3. Authorization to Close Playing or Game Field: Penalty for Going Upon a Closed Field. (a) The coordinator may designate any playing field or game field owned or leased by the Town of Trophy Club a "closed field" for the purposes of maintenance or to protect the surface of the playing field or game field from damage. (b) It shall be unlawful to go upon a playing field or game field which has been designated a "closed field" and has been posted thereon a sign stating "Closed Field - Do Not Trespass Upon this Field - $1.00 to $500.00 Fine" unless authorized by the Coordinator for the purpose of going upon a closed field to maintain said field. Section 4. Penal . It shall be unlawful for any person to violate any provision of this Ordinance, and any person violating or failing to comply with any provision hereof shall be fined, upon conviction, in an amount not more than Five Hundred Dollars ($500.00), and a separate offense shall be deemed committed each day during or on which a violation occurs or continues. Section 5. Savings. This Ordinance shall be cumulative of all other ordinances of the Town affecting the Town's parks and open spaces and shall not repeal any of the provisions of those ordinances except in those instances where the provisions of those Ordinances are in direct conflict with the provisions of this Ordinance. Section 6. Severability. The sections, paragraphs, sentences, phrases, clauses and words of this Ordinance are severable, and if any section, paragraph, sentence, phrase, clause or word in this Ordinance or application thereof to any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this Ordinance, and the Town Council hereby declares that it would have passed such remaining portions of this Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 7. Effective date.
