ORDINANCE 1999-30
AN ORDINANCE PROVIDING FOR THE RELEASE OF INFORMATION
PURSUANT TO THE TEXAS OPEN RECORDS ACT BY NOT USING
FACSIMILE MACHINES; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING AN ENGROSSMENT AND ENROLLMENT CLAUSE;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Town of Trophy Chub, Texas is empowered under §51.001 of the Texas
Local Goveniment Code to adopt an ordinance or rule that is for the good government of the
Town;
WHEREAS, the Town of Trophy Club finds that the release of infomlation pursuant to
the Texas Open Records Act would not be facilitated by the use of facsimile machines; and
WHEREAS, the Town of Trophy Club finds that Texas law contains no prohibition
against the release of information pursuant to the Texas Open Records Act by not using facsimile
machines;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF TROPHY CLUB, TEXAS:
SECTION 1
The Town of Trophy Club will not provide infonnation requested pursuant to the Texas Open
Records Act by use of facsimile machines.
SECTION 2
SEVERABILITY
It is hereby declared to be the intention of the Town Council that the phrases, clauses, sentences,
paragraphs, and sections of this ordinance are severable, and if any phrase, clause, sentence,
paragraph, or section of this Ordinance shall be declared unconstitutional by a valid judgment or
decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs, or sections of this Ordinance, and the Town
Council hereby declares that it would have enacted the remaining portions of the Ordinance
despite any such invalidity.
SECTION 2
ENGROSSMENT AND ENROLLMENT
The Town Secretary of the Town of Trophy Club, Texas is hereby directed to engross and enroll
this Ordinance by copying the exact caption and the effective date clause in the minutes of the
Town Council of the Town of Trophy Club, and by filing this Ordinance in the Ordinance
Records of the town.

SECTION 3
EFFECTIVE DATE
This ordinance shall be in full force and effect from and after its passage.
