ORD 2000-10ORDINANCE 2000-10 REPEALED im ORDINANCE NO. 2000-13 Ordinance 2000-10 CERTIFICATE FOR ORDINANCE THE STATE OF TEXAS § COUNTY OF DENTON § TOWN OF TROPHY CLUB § We, the undersigned officers of said Town, hereby certify as follows: 1. The Town Council of said Town convened in REGULAR MEETING ON THE 2ND DAY OF MAY, 2000, at the Town Hall, and the roll was called of the duly constituted officers and members of said Town Council, to -wit: Marshall Engelback, Mayor Ben Brewster Susan Edstrom Bill Matthai Scott Smith Barb Tweedie Diane Cockrell, Town Secretary and all of said persons were present, except the following absentees: , thus constituting a quorum. Whereupon, among other business, the following was transacted at said Meeting: a written ORDINANCE CALLING BOND ELECTION was duly introduced for the consideration of said Town Council and read in full. It was then duly moved and seconded that said Ordinance be passed as an emergency measure; and, after due discussion, said motion carrying with it the passage of said Ordinance, prevailed and carried by the following vote: AYES: All members of said Town Council shown present above voted "Aye". NOES: None. 2. That a true, full and correct copy of the aforesaid Ordinance passed at the Meeting described in the above and foregoing paragraph is attached to and follows this Certificate; that said Ordinance has been duly recorded in said Town Council's minutes of said Meeting; that the above and foregoing paragraph is a true, full and correct excerpt from said Town Council's minutes of said Meeting pertaining to the passage of said Ordinance; that the persons named in the above and fore- going paragraph are the duly chosen, qualified and acting officers and members of said Town Council as indicated therein; that each of the officers and members of said Town Council was duly and sufficiently notified officially and personally, in advance, of the time, place and purpose of the aforesaid Meeting, and that said Ordinance would be introduced and considered for passage at said Meeting, and each of said officers and members consented, in advance, to the holding of said Meeting for such purpose, and that said Meeting was open to the public and public notice of the time, place and purpose of said meeting was given, all as required by Chapter 551, Texas Government Code, 3. That the Mayor of said Town has approved and hereby approves the aforesaid Ordinance; that the Mayor and the Town Secretary of said Town have duly signed said Ordinance; and that the Mayor and the Town Secretary of said Town hereby declare that their signing of this Certificate shall constitute the signing of the attached and following copy of said Ordinance for all purposes. 6// SEAL D the 2nd day of May, 2000. Mayor ORDINANCE CALLING A BOND ELECTION THE STATE OF TEXAS COUNTY OF DENTON TOWN OF TROPHY CLUB WHEREAS, this Town Council of said Town deems it advisable to call the election hereinafter ordered; and WHEREAS, it is hereby officially found and determined: that holding the hereinafter called election on a date other than a uniform election date established by Section 41.001(a), Texas Election Code, is in the public interest; and that said meeting was open to the public, and public notice of the time, place, and purpose of said meeting was given, all as required by Texas Government Code, Chapter 551. BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS: 1. That an election shall be held between the hours of 7:00 A.M. and 7:00 P.M. on July 15, 2000 in said Town, at the following designated polling place: Trophy Club Municipal Building 100 Municipal Drive, Trophy Club, Texas 76262 Said Town shall constitute a single election precinct for said election, and the following election officers are hereby appointed to hold said election: Presiding Judge: Annette "Pepper" Slusar Alternate Presiding Judge: Judy Williams 2. That the Presiding Judges shall appoint not less than two qualified election clerks to serve and assist in conducting said election; provided that if the Presiding Judge actually serves as expected, the Alternate Presiding Judge shall be one of such clerks. 3. That early voting shall be conducted by personal appearance and by mail at the Trophy Club Municipal Building, 100 Municipal Drive, Trophy Club, Texas 76262, and during the period early voting is required or permitted by law, being June 28, 2000 through July 11, 2000; the hours designated for early voting by personal appearance shall be from 8:00 A.M. to 5:00 P.M. on each day except Saturdays (other than prescribed below), Sundays and legal state holidays; and the early voting clerk shall keep said early voting place open during such hours for early voting by personal appearance. The early voting clerk for said election shall be Diane Cockrell. Early voting location for Saturday, July 8, 2000 - 8:00 A.M. to 12:00 Noon Trophy Club Municipal Building 100 Municipal Drive Trophy Club, Texas 76262 4. That an early ballot board is hereby created to process early voting results, and Annette "Pepper" Slusar is hereby appointed the presiding judge of said board. The presiding judge shall appoint at least two other members of the board. 5. That all resident, qualified electors of said Town shall be entitled to vote at said election. 6. That notice of said election shall be given by posting a substantial copy of this Ordinance at the Town Hall on the bulletin board used for posting notices of the meetings of the Town Council, and at three other places in said Town, not less than 15 days prior to the date set for said election; and a substantial copy of this Ordinance also shall be published on the same day in each of two successive weeks in a newspaper of general circulation published in said Town, the date of the first publication to be not earlier than the 30th day or later than the 14th day prior to the date set for said election. with law: That at said election the following PROPOSITIONS shall be submitted in accordance PROPOSITION NO. 1 Shall the Town Council of said Town be authorized to issue the bonds of said Town, in one or more series or issues, in the aggregate principal amount of 54,170,732, with the bonds of each such series or issue, respectively, to mature serially within not to exceed 40 years from their date, and to be sold at such prices and bear interest at such rates as shall be determined within the discretion of the Town Council, for the purpose of constructing and improving the Town's streets, to -wit: a loop road, and shall said Town Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? PROPOSITION NO. 2 Shall the Town Council of said Town be authorized to issue the bonds of said Town, in one or more series or issues, in the aggregate principal amount of 56,256,098, with the bonds of each such, series or issue, respectively, to mature serially within not to exceed 40 years from their date, and to be sold at such prices and bear interest at such rates as shall be determined within the discretion of the Town Council, for the purpose of constructing and improving the Town's streets, and shall said Town Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? PROPOSITION NO. 3 Shall the Town Council of said Town be authorized to issue the bonds of said Town, in one or more series or issues, in the aggregate principal amount of $6,151,829, with the bonds of each such series or issue, respectively, to mature serially within not to exceed 40 years from their date, and to be sold at such prices and bear interest at such rates as shall be determined within the discretion of the Town Council, for the purpose of park acquisition, construction and improvements, including baseball Fields and park recreation/community center together with other parr improvements, and shall said Town Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? PROPOSITION NO. 4 Shall the Town Council of said Town be authorized to issue the bonds of said Town, in one or more series or issues, in the aggregate principal amount of $521,341, with the bonds of each such series or issue, respectively, to mature serially within not to exceed 40 years from their date, and to be sold at such prices and bear interest at such rates as shall be determined within the discretion of the Town Council, for the purpose of constructing and equipping a municipal maintenance building, and shall said Town Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? 8. That the official ballots for said election shall be prepared in accordance with the Texas Election Code so as to permit the electors to vote "FOR" or "AGAINST" the aforesaid PROPOSITIONS, with the ballots to contain such provisions, markings and language as required by law, and with such PROPOSITIONS to be expressed substantially as follows: FOR AGAINST FOR AGAINST PROPOSITION NO. I THE ISSUANCE OF $4,170,732 IMPROVEMENT, TO -WIT: A LOOP ROAD TAX BONDS PROPOSITION NO.2 THE ISSUANCE OF $6,256,098 IMPROVEMENT TAX BONDS PROPOSITION NO. 3 FOR THE ISSUANCE OF 56,151,829 PARK ACQUISITION, CONSTRUCTION AND IMPROVEMENTS, INCLUDING BASEBALL FIELDS AND PARK RECREATION/COMMUNITY CENTER AND OTHER PARK IMPROVEMENT TAX BONDS AGAINST PROPOSITION NO.4 FOR THE ISSUANCE OF $521,341 MAINTENANCE BUILDING IMPROVEMENT TAX BONDS AGAINST 9. That in all respects said election shall be conducted in accordance with the Texas Election Code and voting at the election shall be by use of electronic ballots.
