ORD 2001-04TOWN OF TROPHY CLUB, TEXAS ORDINANCE NO. 2001- 04 AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS, REPEALING ORDINANCE NO. 2000-22 PROHIBITING PARKING ON THE SOUTHSIDE OF VILLAGE TRAIL DRIVE; ADOPTING NEW PROVISIONS FOR THE PROHIBITION OF PARKING ON VILLAGE TRAIL DRIVE; PROVIDING A SAVINGS CLAUSE; PROVIDING A REPEALER CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY NOT TO EXCEED FIVE HUNDRED DOLLARS (x500.00) AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICII A VIOLATION OCCURS; PROVIDING A PUBLICATION CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Town of Trophy CIub, Texas, under Sections 542.201 and 542.202 of the Texas Transportation Code, is authorized to adopt local traffic regulations with respect to streets Under its jurisdiction. WHEREAS, the Town, under Section 311.002 of the Texas Transportation Code, is given exclusive control over the highways, streets, and alleys of the Town. WHEREAS, the Town Council finds that the adoption of this ordinance is in the best interest of the citizens of the Town. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS: SECTION L PROHIBITIONS (a) It shall be unlawful for any person to stop, stand or park a motor vehicle, except when necessary to avoid conflict with other traffic or in compliance with directions of a police officer, on the Southside of Village Trail from one -hundred and twenty (120) feet north of Chimney Rock Drive to the southwest corner of the intersection of Village Trail and Alaniosa Drive. (b) There shall be an exception to subsection (a) above; that parking shall be permitted on the soiathside of Village Trail on school days from the southwest corner of the intersection of Village Trail and Alamosa Drive to the northwest corner of the intersection of Village Trail and Sonora Drive between the hours of 7:00 a.m. and 9:00 a.m. and between the hours of 2:00 p.m. and 3:30 p.m. (c) It shall be unlawful for an , person to stop, stand or ark a motor vehicle, except when necessary to avoid conflict with other traffic or in conl liance with directions of a police officer, on the north side of the 1.00 block of„Villg-e Trail between the no earl ii g siianape Q:ITOWNSC CIPciiding Ord'€nances\NO PARKING Village Trail 30501.doc located at a point 114 feet east of the southeast corner of Sundance Court, and the no parking sinnage located at the southeast conger of Sundance Court. (d) It shall be unlawful for any person to stop, stand or park a motor vehicle, excel) when necessary to avoid conflict �ct with other ,. ,traffic or in coniplia�ice with directions of a police . ,., .. officer, on the north side of the 100 block of Village Trail between the no parking signage located at the southeast corner of„50 Alamosa Drive, and the no parking si�2naae located at a point 123 feet west of the southeast corner of 50 Alamosa Drive. SECTION 2. SAVINGS AND REPEALER CLAUSE That this Ordinance shall be cumulative of all other ordinances of the Town affecting Barking and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this Ordinance; provided, however, that Ordinance No. 2000-22 is hereby repealed in its entirety, but provided that any complaint, action, cause of action or claim which prior to the effective date of this Ordinance has been initiated or has arisen under or pursuant to the said repealed Ordinance No. 2000-22 shall continue to be governed by the provisions of that Ordinance and for that purpose the Ordinance shall be deemed to remain and continue in full force and effect. SECTION 3. SEVERABILITY CLAUSE If any section, article, paragraph, sentence, clause, phrase or word in this Ordinance, or its application to any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this Ordinance; and the Town Council hereby declares it would have passed such remaining portions of the Ordinance despite such invalidity, which remaining portions shall remain in frill force and effect. SECTION 4. PENALTY It shall be unlawful for any person to violate any provision of this Ordinance, and airy person violating or failing to comply with any provision of this Ordinance shall be fined, upon conviction, not less than One Dollar ($1.00) nor more than Five Hundred Dollars ($500.00), and a separate offense shall be deemed conunitted upon each day during or on which a violation oCCUrs or continues. SECTION 5. PUBLICATION CLAUSE The Town Secretaly is hereby directed to publish the Caption, Penalty, and Effective Date clause of this Ordinance as required by Section 52.011 of the Texas Local Government Code. ENGROSSMENT AND ENROLLMENT CLAUSE The Town Secretary is hereby directed to engross and enroll this Ordinance by copying the Caption and Effective Date clause in the minutes of the Town Council nid by filing this Ordinance in the ordinance records of the Town. SECTION 7. EFFECTIVE DATE This ordinance shall become effective from and after its date of passage and publication as required by later, and it is so ordained.
