ORDINANCE NO. 2003 - 23
AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS
REPEALING ORDINANCE NO. 2001-16 WHICH REPEALED
ORDINANCE NO. 2000-11, PROVIDING FOR MEMBERSHIP ON THE
UTILITY FRANCHISE COMMITTEE AND ESTABLISHING RELATED
TERMS, DUTIES, AND CONDUCT FOR SAME, IN ITS ENTIRETY;
PROVIDING FOR THE INCORPORATION OF PREMISES;
COMMENDING THE COMMITTEE FOR ITS SERVICE TO THE
TOWN; PROVIDING A CUMULATIVE REPEALER CLAUSE;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR
ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, on May 2, 2000 the Town Council of the Town of Trophy Club adopted
Ordinance No. 2000-11, Texas, creating a Utility Franchise Committee; and
WHEREAS, during its three year tenure, the Utility Franchise Committee has served the
Town well by providing quality recommendations and guidance to Council and by assisting with
the growth of the Town's utility franchise services; and
WHEREAS, Ordinance No. 2000-11, provided for the creation of the Utility Franchise
Committee, membership, terms of office, chair -person, obligation and duties of committees,
conduct of meetings and removal and vacancies; and
WHEREAS, on August 18, 2003, the Town Council appointed a Committee Task Force
to review the current volunteer committee system utilized by the Town and to make
recommendations to improve the efficiency and effectiveness of the Town's current committee
system; and
WHEREAS, having concluded its assessment of the existing committee system, the
Committee Task Force made recommendations to the Town Council; and
WHEREAS, the Town Council hereby finds by adopting the recommendations from the
Task Force, it has become necessary to repeal Ordinance No. 2000-11, so that conflicting
ordinances and resolutions are not in place and that such action serves the best interests of the
Town;
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF TROPHY CLUB, TEXAS, THAT:
SECTION 1.
INCORPORATION OF PREMISES
The above and foregoing premises are true and correct and are incorporated herein and
made a part hereof for all purposes. Further, Ordinance No. 2001-01, duly passed and approved
by the Town Council of the Town of Trophy Club on May 2, 2000, is hereby repealed in its
entirety.
SECTION 2.
COMMENDATION
The Town Council commends the members of the Utility Franchise Committee for their
efforts and services over the past three years..
SECTION 3.
CUMULATIVE REPEALER CLAUSE
This Ordinance shall be cumulative of all other Ordinances of the Town and shall not
repeal any of the provisions of such other Ordinances except those instances where those
provisions are in direct conflict with the provisions of this Ordinance.
SECTION 4.
SEVERABILITY CLAUSE
if any section, article, paragraph, sentence, clause, phrase or word in this Ordinance, or
its application to any person or circumstance is held invalid or unconstitutional by a Court of
competent jurisdiction, such holding shall not affect the validity of the remaining portions of this
Ordinance; and the Town Council hereby declares it would have passed such remaining portions
of the Ordinance despite such invalidity, which remaining portions shall remain in full force and
effect.
SECTION 5.
ENGROSSMENT AND ENROLLMENT CLAUSE
The Town Secretary is hereby directed to engross and enroll this Ordinance by copying
the caption and effective date clause in the minutes of the Town Council and by filing this
Ordinance in the ordinance records of the Town.
SECTION 6.
EFFECTIVE DATE
This ordinance shall become effective from and after its date of passage as required by
Iaw.
