ORD 2004-24TOWN OF TROPHY CLUB, TEXAS ORDINANCE NO. 2004-24 AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS ADOPTING THE 2002 EDITION OF THE NATIONAL ELECTRICAL CODE AND ADOPTING PROVISIONS AS FOLLOWS: PROVIDING FOR INCORPORATION OF PREMISES; PROVIDING FOR APPLICABILITY; ADOPTING THE 2002 EDITION OF THE NATIONAL ELECTRICAL CODE, PROVIDING LOCAL AMENDMENTS THERETO; PROVIDING FOR THE ISSUANCE OF PERMITS AND THE COLLECTION OF FEES THEREFORE; PROVIDING SEVERABILITY; PROVIDING FOR SAVINGS; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION OCCURS OR CONTINUES; PROVIDING A PUBLICATION CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Town of Trophy Club, Texas is a general law municipality empowered under the Texas Local Government Code, Section 51.001, to adopt an ordinance or rule that is for the good government of the Town; WHEREAS, the Town adopted the 1996 Edition of the National Electrical Code on December 17, 2001 through the passage of Ordinance No. 2001-31; WHEREAS, beginning in the summer of 2003, the North Central Texas Council of Government's, (hereinafter "NCTCOG"), Regional Codes Coordinating Committee, (hereinafter "RCCC") and its four advisory boards conducted 26 open review meetings over a 10 -month period to review the 2003 editions of the International Codes and the 2002 National Electrical Code and to develop regional amendments. Their review and recommendations were completed and endorsed by NCTCOG's Executive Board in March 2004. Now NCTCOG encourages jurisdictions in North Central Texas to adopt the 2002 National Electrical Code along with its respective regional amendments with an effective date of July 1, 2004. WHEREAS, the Town of Trophy Club Building Inspections Officials have reviewed the National Electrical Code, 2002 Edition, (hereinafter "NEC") along with the specific local amendments recommended by NCTCOG and finds that it is in the best interest of the Town of Trophy Club to adopt those amendments reflected in this Ordinance; and WHEREAS, the Town Council of the Town of Trophy Club, Texas deems it necessary and beneficial to adopt the updated 2002 Edition of the National Electrical Code and the local amendments specified in this Ordinance to safeguard the health, property, safety and general welfare of the citizens of the Town of Trophy Club by regulating and controlling the use, occupancy, maintenance, repair, design, construction and quality of materials for residential structures within the Town. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS: SECTION 1. INCORPORATION CLAUSE That all of the above premises are true and correct and are hereby incorporated in the body of this Ordinance as if fully set forth herein. SECTION 2. APPLICABILITY CLAUSE That certain documents, copies of which are on file in the office of the Building Inspections Department of the Town of Trophy Club, being marked and designated as National Electrical Code, 2002 Edition, as published by The National Fire Protection Inc., are hereby adopted as if fully set out herein, along with the local amendments set out herein, as the Electrical Code of the Town of Trophy Club. SECTION 3. ADOPTION CLAUSE That the Town Council of the Town of Trophy Club, Texas, does hereby adopt the National Electrical Code, 2002 Edition, published by The National Fire Protection, Inc., with the local amendments reflected in this Ordinance as the Electrical Code for the Town of Trophy Club. SECTION 4. AMENDMENTS TO THE 2002 NATIONAL ELECTRICAL CODE The following sections, paragraphs and sentences of the 2002 National Electrical Code are hereby amended as follows: Standards type is text from the NEC. A building or other structure served shall be supplied by only one service unless permitted in 230.2(A) through (D). Additional services shall be permitted to supply the following: (1) Fire Pumps (G) In supplying electrical service to multifamily dwellings, two or more laterals or overhead service drops shall be permitted to a building when both of the following conditions are met: a. The building has six or more individual gang meters and all meters are grouped at the same location. b. Each lateral or overhead service drop originates from the same point of service. Section 230.71(A) add an exception, 230.71 Maximum Number of Disconnects. (A) General. The service disconnecting means for each service permitted by 230.2, or for each set of service -entrance conductors permitted by 230.40, Exception Nos. 1, 3, 4, or 5, shall consist of not more than six switches or sets of circuit breakers, mounted in a single enclosure, in a group of separate enclosures, or in or on a switchboard. Wiring located within the cavity of a fire -rated floor - ceiling or roof -ceiling assembly shall not be secured to, or supported by, the ceiling assembly, including the ceiling support wires.. unless tested as part of a fire -rated assembly. An independent means of secure support shall be provided. SECTION 5. SEVERABILITY CLAUSE If any section, article, paragraph, sentence, clause, phrase or work in this Ordinance, or application thereof to any person or circumstance, is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of the Ordinance, and the Town Council hereby declares it would have passed such remaining portions of the Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. SECTION 6. SAVINGS CLAUSE All rights and remedies of the Town of Trophy Club, Texas, are expressly saved as to any and all violations of the provisions of any other Ordinances of the Town affecting electrical codes, which have secured at the time of the effective date of this Ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such Ordinances same shall not be affected by this Ordinance but may be prosecuted until final disposition by the courts. SECTION 7. PENALTY CLAUSE It shall be unlawful for any person to violate any provision of this Ordinance, and any person violating or failing to comply with any provision hereof shall be fined, upon conviction, in an amount not more than Two Thousand Dollars ($2,000.00), and a separate offense shall be deemed committed each day during or on which a violation occurs or continues. SECTION 8. PUBLICATION CLAUSE The Town Secretary of the Town of Trophy Club is hereby directed to publish, the Caption, Penalty and Effective Date of this Ordinance as required by Section 52.011 of the Texas Local Government Code. SECTION 9. ENGROSSMENT AND ENROLLMENT CLAUSE The Town Secretary of the Town of Trophy Club is hereby directed to engross and enroll this Ordinance by copying the exact Caption, Penalty and Effective Date in the minutes of the Town Council and by filing this Ordinance in the ordinance records of the Town. SECTION 10. EFFECTIVE DATE CLAUSE That this Ordinance shall be in full force and effect from and after its date of passage, in accordance with law, and it is so ordained.
