ORD 2004-23TOWN OF TROPHY CLUB, TEXAS ORDINANCE NO. 2004-23 AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS ADOPTING THE 2003 EDITION OF THE INTERNATIONAL RESIDENTIAL CODE AND ADOPTING PROVISIONS AS FOLLOWS: PROVIDING FOR INCORPORATION OF PREMISES; PROVIDING FOR APPLICABILITY; ADOPTING THE 2003 EDITION OF THE INTERNATIONAL RESIDENTIAL CODE FOR ONE, TWO-FAMILY DWELLINGS AND MULTIPLE SINGLE FAMILY DWELLINGS (TOWNHOUSES) NOT MORE THAN THREE STORIES IN HEIGHT WITH A SEPARATE MEANS OF EGRESS; PROVIDING LOCAL AMENDMENTS THERETO, REGULATING THE CONSTRUCTION, ALTERATION, MOVEMENT, ENLARGEMENT, REPLACEMENT, REPAIR, EQUIPMENT, USE AND OCCUPANCY, LOCATION, REMOVAL AND DEMOLITION OF DETACHED ONE -AND TWO-FAMILY DWELLINGS AND MULTIPLE SINGLE FAMILY DWELLINGS (TOWNHOUSES) NOT MORE THAN THREE STORIES IN HEIGHT WITH A SEPARATE MEANS OF EGRESS WITHIN THE TOWN OF TROPHY CLUB; PROVIDING FOR THE ISSUANCE OF PERMITS AND THE COLLECTION OF FEES THEREFORE; PROVIDING FOR A BOARD OF APPEALS; PROVIDING SEVERABILITY; PROVIDING FOR SAVINGS; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION OCCURS OR CONTINUES; PROVIDING A PUBLICATION CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Town of Trophy Club, Texas is a general law municipality empowered under the Texas Local Government Code, Section 51.001., to adopt an ordinance or rule that is for the good government of the Town; WHEREAS, Chapter 214 of the Texas Local Government Code provides for the adoption of the International Residential Code (hereinafter "IRC") as a municipal residential building code for the State of Texas and authorizes municipalities to adopt local amendments to the IRC; WHEREAS, the Town adopted the 2000 IRC and local amendments on December 17, 2001 through the passage of Ordinance No. 2001-31; WHEREAS, beginning in the summer of 2003, the North Central Texas Council of Government's, (hereinafter "NCTCOG"), Regional Codes Coordinating Committee, (hereinafter "RCCC") and its four advisory boards conducted 26 open review meetings over a 10 -month period to review the 2003 editions of the International Codes and to develop regional amendments. Their review and recommendations were completed and endorsed by NCTCOG's Executive Board in March 2004. Now NCTCOG encourages jurisdictions in North Central Texas to adopt the 2003 International Residential Code for One -and Two -Family Dwellings along with regional amendments; and WHEREAS, the Town of Trophy Club Building Inspections Officials have reviewed the International Residential Code, 2003 Edition, along with the specific local amendments recommended by the NCTCOG and finds that it is in the best interest of the Town of Trophy Club to adopt those amendments reflected in this Ordinance; and WHEREAS, the Town Council of the Town of Trophy Club, Texas deems it necessary and beneficial to adopt the updated 2003 Edition of the IRC and the local amendments specified in this Ordinance to safeguard the health, property, safety and general welfare of the citizens of the Town of Trophy Club by regulating and controlling the use, occupancy, maintenance, repair, design, construction and quality of materials for residential structures within the Town. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS: SECTION 1. INCORPORATION CLAUSE That all of the above premises are true and correct and are hereby incorporated in the body of this Ordinance as if fully set forth herein. SECTION 2. APPLICABILITY CLAUSE That certain documents, copies of which are on file in the Building Inspections Department of the Town of Trophy Club, being marked and designated as International Residential Code, 2003 Edition, including Appendix Chapters, as published by the International Code Council, Inc., are hereby adopted as if fully set out herein, along with the local amendments set out herein, as the Residential Building Code of the Town of Trophy Club regulating the construction, alteration, movement, enlargement, replacement, repair, equipment, use and occupancy, location, removal and demolition of one -and two-family dwellings and multiple single family dwellings (townhouses) not more than three stories in height with a separate means of egress within the Town of Trophy Club. SECTION 3. ADOPTION CLAUSE That the Town Council of the Town of Trophy Club, Texas, does hereby adopt the International Residential Code for one -and two-family dwellings and multiple single family dwellings (townhouses) not more than three stories in height with a separate means of egress, 2003 Edition, published by the International Code Council, including local amendments referenced herein, including Appendix Chapters A, B, C, D, E, F, G, H, I and 1 are hereby adopted as the Residential Building Code for the Town of Trophy Club regulating the construction, alteration, movement, enlargement, replacement, repair, equipment, use and occupancy, location, removal and demolition of detached one -and two-family dwellings and multiple single family dwellings (townhouses) within the Town of Trophy Club. SECTION 4. AMENDMENTS TO THE 2003 INTERNATIONAL RESIDENTIAL CODE The following sections, paragraphs and sentences of the 2003 International Residential Code are hereby amended as follows: Standards type is text from the IRC. The passageway shall have continuous unobstructed solid flooring in accordance with Chapter 5 not less than -2 — 30 inches (649 762 mm) wide. A level service space at least 30 inches (762 mm) deep and 30 inches (762 mm) wide shall be present along all sides of the appliance where access is required. The maximum length of a clothes dryer exhaust duct shall not exceed 25 feet (7620 mm) from the dryer location to the wall or roof termination with not more than two bends. When extra bends are installed, the maximum length of the duct shall be reduced 2.5 feet (762 mm) for each 45 -degree (0.79 rad) bend and 5 feet (1524 mm) for each 90 -degree (1.6 rad) bend that occur after the first two bends, measuring in the direction of airflow. BOARD OF APPEALS The Town Council shall appoint five (5) members to the Building Board of Appeals as authorized by the International Residential Code, 2003 Edition, as amended, each to be appointed by a majority of the Town Council for a term of two (2) years; and shall appoint five (5) members to the Fire Board of Appeals as authorized by the Uniform Fire Code, 1997 Edition, each to be appointed by a majority of the Town Council for a term of two (2) years. For purposes of this Ordinances, the I.R.C. and the Uniform Fire Code, the Zoning Board of Adjustment of the Town shall be and is designated as the Building Board of Appeals and the Fire Board of Appeals. SECTION 6. SEVERABILITY CLAUSE If any section, article, paragraph, sentence, clause, phrase or work in this Ordinance, or application thereof to any person or circumstance, is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of the Ordinance, and the Town Council hereby declares it would have passed such remaining portions of the Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. SECTION 7. SAVINGS CLAUSE All rights and remedies of the Town of Trophy Club, Texas, are expressly saved as to any and all violations of the provisions of any other Ordinances of the Town affecting building for one -and two-family dwellings and multiple single family dwellings (townhouses) not more than three stories in height with a separate means of egress, which have secured at the time of the effective date of this Ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such Ordinances same shall not be affected by this Ordinance but may be prosecuted until final disposition by the courts. SECTION S. PENALTY CLAUSE It shall be unlawful for any person to violate any provision of this Ordinance, and any person violating or failing to comply with any provision hereof shall be fined, upon conviction, in an amount not more than Two Thousand Dollars ($2,000.00), and a separate offense shall be deemed committed each day during or on which a violation occurs or continues. SECTION 9. PUBLICATION CLAUSE The Town Secretary of the Town of Trophy Club is hereby directed to publish, the Caption, Penalty and Effective Date of this Ordinance as required by Section 52.011 of the Texas Local Government Code. SECTION 10. ENGROSSMENT AND ENROLLMENT CLAUSE The Town Secretary of the Town of Trophy Club is hereby directed to engross and enroll this Ordinance by copying the exact Caption, Penalty and Effective Date in the minutes of the Town Council and by filing this Ordinance in the ordinance records of the Town. SECTION 11.
