ORD 2004-22TOWN OF TROPHY CLUB, TEXAS ORDINANCE NO. 2004-22 AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS ADOPTING THE 2003 EDITION OF THE INTERNATIONAL BUILDING CODE AND ADOPTING PROVISIONS AS FOLLOWS: PROVIDING FOR INCORPORATION OF PREMISES; PROVIDING FOR APPLICABILITY; ADOPTING THE 2003 EDITION OF THE INTERNATIONAL BUILDING CODE; PROVIDING LOCAL AMENDMENTS THERETO, REGULATING THE CONSTRUCTION, ALTERATION, MOVEMENT, ENLARGEMENT, REPLACEMENT, REPAIR, EQUIPMENT, USE AND OCCUPANCY, LOCATION, MAINTENANCE, REMOVAL AND DEMOLITION OF EVERY BUILDING OR STRUCTURE OR ANY APPURTENANCES CONNECTED OR ATTACHED TO SUCH BUILDINGS OR STRUCTURES EXCEPT ONE -AND TWO- FAMILY DWELLINGS AND MULTIPLE SINGLE FAMILY DWELLINGS (TOWNHOUSES) WITHIN THE TOWN OF TROPHY CLUB; PROVIDING FOR THE ISSUANCE OF PERMITS AND THE COLLECTION OF FEES THEREFORE; PROVIDING FOR A BOARD OF APPEALS; PROVIDING SEVERABILITY; PROVIDING FOR SAVINGS; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($3,000.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION OCCURS OR CONTINUES; PROVIDING A PUBLICATION CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Town of Trophy Club, Texas is a general law municipality empowered under the Texas Local Government Code, Section 51.001, to adopt an ordinance or rule that is for the good government of the Town; WHEREAS, the Town adopted the 1997 Uniform Building Code on June 16, 1998 through the passage of Ordinance No. 98-17; WHEREAS, beginning in the summer of 2003, the North Central Texas Council of Government's, (hereinafter "NCTCOG"), Regional Codes Coordinating Committee, (hereinafter "RCCC") and its four advisory boards conducted 26 open review meetings over a 10 -month period to review the 2003 editions of the International Codes and to develop regional amendments. Their review and recommendations were completed and endorsed by NCTCOG's Executive Board in March 2004. Now NCTCOG encourages jurisdictions in North Central Texas to adopt the 2003 International Building Code along with its respective regional amendments with an effective date WHEREAS, the Town of Trophy Club Building Inspections Officials have reviewed the International Building Code, 2003 Edition, (hereinafter "IBC") along with specific local amendments recommended by the NCTCOG and finds that it is in the best interest of the Town of Trophy Club to adopt those amendments reflected in this Ordinance; and WHEREAS, the Town Council of the Town of Trophy CIub, Texas deems it necessary and beneficial to adopt the updated 2003 Edition of the International Building Code and the local amendments specified in this Ordinance to safeguard the health, property, safety and general welfare of the citizens of the Town of Trophy Club by regulating and controlling the use, occupancy, maintenance, repair, design, construction and quality of materials for residential structures within the Town. NOW, THE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS: SECTION 1. INCORPORATION CLAUSE That all of the above premises are true and correct and are hereby incorporated in the body of this Ordinance as if fully set forth herein. SECTION 2. APPLICABILITY CLAUSE That certain documents, copies of which are on file in the office of the Building Inspections Department of the Town of Trophy Club, being marked and designated as International Building Code, 2003 Edition, including Appendix Chapters, as published by the International Code Council, Inc., are hereby adopted as if fully set out herein, along with the local amendments set out herein, as the Building Code of the Town of Trophy Club regulating the construction, alteration, movement, enlargement, replacement, repair, equipment, use and occupancy, location, maintenance, removal and demolition of every building or structure or any appurtenances connected or attached to such buildings or structures except detached one -and two-family dwellings and multiple single family dwellings (townhouses) within the Town of Trophy Club. SECTION 3. ADOPTION CLAUSE That the Town Council of the Town of Trophy Club, Texas, does hereby adopt the International Building Code, 2003 Edition, published by the International Code Council, including local amendments referenced herein, including Appendix Chapters A, C, F, G, H, I and J are hereby adopted as the Building Code for the Town of Trophy Club regulating the construction, alteration, movement, enlargement, replacement, repair, equipment, use and occupancy, Iocation, maintenance, removal and demolition of every building or structure or any appurtenances connected or attached to such buildings or structures except detached one -and two-family dwellings and multiple single family dwellings (townhouses) within the Town of Trophy Club SECTION 4. AMENDMENTS TO THE 2003 INTERNATIONAL BUILDING CODE The following sections, paragraphs aphs and sentences of the 2003 International Building Code are hereby amended as follows: Standards type is text from the IBC. These regulations shall be known as the Building Code of The Town of Trophy Club, Texas, and shall be cited as such as will be referred to herein as "this code". Section 101.2, exception No. 2; change to read as follows: 2. Existing buildings undergoing repair, alterations or additions, and change of occupancy shall be permitted to comply with the International Existing Building Code with prior approval of the Building Official. Otherwise see chapter 34. Section 101.4; change to read as follows: 101.4 Referenced Codes. The other codes listed in Sections 101.4.1 through 101.4.7 and referenced elsewhere in this code, when specifically adopted, shall be considered part of the requirements of this code to the prescribed extend of each such reference. Whenever amendments have been adopted to the referenced codes and standards each reference to said code and standard shall be considered to reference the amendmentsas well. Any reference to NFPA 70 or the ICC Electrical Code shall mean the . Electrical Code as adopted. B. Section 109.3.5; delete. C. Section 202; add a new definition to read as follows: High -Rise Building;.: A building having any floor used for human occupancy „located more than 55 feet (16 764 mm) above the lowest Ievel of fire department vehicle access. D. Section 302.1.1, change to read as follows: 302.1.1 Incidental Use Areas. Spaces which are incidental to the main occupancy shall be separated or protected, or both, in accordance with Table 302.1.1 or the building shall be elassifTe erle®eupaney and eempl3Lwith Seetion 392.3. Areas that are incidental to the main occupancy shall be classified in accordance with the main occupancy of the portion of the building in which the incidental use area is located. Exception: Incidental use areas within and serving a dwelling unit are not required to comply with this section. Section 302.2.1; change to read as follows: 302.2.1 Assembly Areas. Accessory assembly areas are not considered separate occupancies if the floor area is equal to or less than 750 square feet (69.7 m2). New and existing spray booths and spraying rooms shall be protected , .,.., p by automatic fire -extinguishing system. 903.2.10.6 Buildings Over 6,000 sq.ft. An automatic sprinkler system shall be installed throughout all buildings with a building area over 6,000 sq.ft. For the purpose of this provision, fire walls shall not define separate buildings. All control valves in the s rinIder and standpipe systems excCl2t for fire department hose connection valves shall be electrically supervised to initiate a supervisory signal at the central station upon tampering. Add Section 903.6.2 to read as follows: 903.6.2 Spray Booths and Rooms. New and existing spray booths and spray rooms shall be protected by an approved automatic fire -extinguishing system in accordance with IFC Section 1504. Q. Section 905.2; change to read as follows: 905.2 Installation Standards. Standpipe systems shall be installed in accordance with this section and NFPA 14. Manual dry stand i e systems shall be supervised with a minimum of 10 psig and a maximum of 40 psig air pressure with a high/low alarm. Section 905.3.2; delete exceptions #1 and 2. Where the roof has a slope less than four units vertical in 12 units horizontal (33.3 - percent slope), each standpipe shall be provided with a two-way hose connection located either ... Alarm systems serving more than 75 smoke detectors or more than 200 total alarm activating devices shall be analog intelligent addressable fire detection systems. Exception: Existing systems need not comply „unless the total building remodel or expansion initiated after the effective date of this code, as adopted, exceeds 30% of the building. When cumulative building remodel or expansion exceeds 50% of the building must comply within 1$ months of permit „application. Section 907.2.3; change to read as follows: 907.2.3 Groin E. A manual fire alarm system shall be installed in Group E educational occupancies. When automatic sprinkler systems or smoke detectors are installed, such systems or detectors shall be connected to the building fire alarm system. An approved smoke detections stem shall be installed in Group E day care occupancies. Unless separated by a minimum of 100' open space, all buildings whether portable buildings or the main building, will be considered one building for alarm occupant load consideration and interconnection of alarms stems. Section 907.2.3; change exception #1 and add exception #1.1 to read as follows: Group E educational and daycare occupancies with an occupant load of less than 50 when provided with an approved automaticsprinkler system. 1.1 Residential In -Home day care with not more than 12 children may use interconnected single station detectors in all habitable rooms. For care of more than five children 2 1/2 or less years of age, see Section 907.2.6. Section 907.2.12; change to read as follows: 907.212 High -Rise Buildings. Buildings having any floor used for human occupancy located more than q4 55 feet (22 960 16 764 mm) above the lowest level of fire department vehicle access shall be provided with an automatic fire alarm system and an emergency voice/alarm communications system in accordance with Section 907.2.12.2. Section 907.2.12, exception #3; change to read as follows: 3. Buildings with an occupancy in Group A-5 in accordance with Section 303. 1. when used for open air seating, however, this exception does not apply toaccessory uses including but not limited to sky boxes, restaurants and similarly enclosed areas. The portions of this section which will qpply are identified by an engineer in the construction documents, BB. **Section 2901.1; add a sentence to read as follows: The provisions of this Chapter are meant to work in coordination with the provisions of Chapter 4 of the International Plumbing Code. Should any conflicts arise between the two chapters, the Building Official shall determine which provision applies. Section 2902.11 2902.1.1 and 2902.1.2; change to read as follows and add sub sections: 2902.1 Minimum Number of Fixtures. Plumbing fixtures shall be provided for the type of occupancy and in the minimum number as follows: 1. Assembly Occupancies: At least one drinking fountain shall be provided at each floor level in an approved location. Exception. A drinking fountain need not be provided in a drinking or dining establishment. 2. Groups A B. F H. I M and S Occupancies: Buildings or portions thereof where persons are employed shall be provided with at least one water closet for each sex except as provided for in Section 2902.2. 3. Group E Occiiancies: Shall be provided with fixtures as shown in Table 2902.1. 4. Group R Occupancies: Shall be provided with fixtures as shown in Table 2902.1. It is recommended but not required. that the minimum number of fixtures provided also comply with the number shown in Table 2902.1. Types of occupancies not shown in Table 2902.1 shall be considered individually by the ling code official. The number of occupants shall be determined by this code. Occupancy classification shall be determined in accordance with Chapter 3. 2902.2 Finish Material. Finish materials shall comply with Section 1210. SECTION 5. BOARD OF APPEALS The Town Council shall appoint five (5) members to the Building Board of Appeals as authorized by the International Residential Code, 2000 Edition, as amended, each to be appointed by a majority of the Town Council for a term of two (2) years; and shall appoint five (5) members to the Fire Board of Appeals as authorized by the Uniform Fire Code, 1997 Edition, each to be appointed by a majority of the Town Council for a term of two (2) years. For purposes of this Ordinances, the I.R.C. and the Uniform Fire Code, the Zoning Board of Adjustment of the Town shall be and is designated as the Building Board of Appeals and the Fire Board of Appeals. SECTION 6. SEVERABILITY CLAUSE If any section, article, paragraph, sentence, clause, phrase or work in this Ordinance, or application thereof to any person or circumstance, is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of the Ordinance, and the Town Council hereby declares it would have passed such remaining portions of the Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. SECTION 7. SAVINGS CLAUSE All rights and remedies of the Town of Trophy Club, Texas, are expressly saved as to any and all violations of the provisions of any other Ordinances of the Town affecting building codes regulating the construction, alteration, movement, enlargement, replacement, repair, equipment, use and occupancy, location, maintenance, removal and demolition of every building or structure or any appurtenances connected or attached to such buildings or structures except one -and two-family dwellings and multiple single family dwellings (townhouses) within the town of trophy club, which have secured at the time of the effective date of this Ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such Ordinances same shall not be affected by this Ordinance but may be prosecuted until final disposition by the courts. SECTION 8. PENALTY CLAUSE It shall be unlawful for any person to violate any provision of this Ordinance, and any person violating or failing to comply with any provision hereof shall be fined, upon conviction, in an amount not more than Two Thousand Dollars ($2,000.00), and a separate offense shall be deemed committed each day during or on which a violation occurs or continues. SECTION 9. PUBLICATION CLAUSE The Town Secretary of the Town of Trophy Club is hereby directed to publish, the Caption, Penalty and Effective Date of this Ordinance as required by Section 52.011 of the Texas Local Government Code. SECTION 10. ENGROSSMENT AND ENROLLMENT CLAUSE The Town Secretary of the Town of Trophy CIub is hereby directed to engross and enroll this Ordinance by copying the exact Caption, Penalty and Effective Date in the minutes of the Town Council and by filing this Ordinance in the ordinance records of the Town. SECTION 11. EFFECTIVE DATE CLAUSE That this Ordinance shall be in full force and effect from and after its date of passage, in accordance with law, and it is so ordained.
