RESOLUTION NO. R 93-01
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN
OF TROPHY CLUB, TEXAS SUPPORTING LEGISLATION
PROVIDING FOR THE APPOINTMENT OF AN
INDEPENDENT BOARD AS HEREIN DESCRIBED TO
REVIEW AND FINALLY RESOLVE LAND USE DISPUTES
AT THE DALLAS/FORT WORTH INTERNATIONAL
AIRPORT; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the State Legislature enacted the Texas Municipal
Airports Act in 1947, which Act has been from time to time amended;
and
WHEREAS, on September 27, 1965, the Cities of Dallas and Fort
Worth established the Dallas/Fort Worth Airport Board pursuant to
the Texas Municipal Airports Act to plan, establish, operate and
improve Dallas/Fort Worth International Airport (the "Airport");
and
WHEREAS, the Cities of Dallas and Fort Worth in a 1968
Agreement authorized the Airport Board to proceed with the
development of the Airport to be jointly owned by the Cities of
Dallas and Fort Worth and operated by the Board; and
WHEREAS, the Airport was opened for airline service in
January, 1974, located between the Cities of Dallas and Fort Worth
and primarily within four cities (the "Four Cities") and two
counties; and
WHEREAS, the Airport has grown to be the second busiest
airport in the world today and is projected to be the world's
busiest airport by the year 2000; and
WHEREAS, the Airport has the need to expand to meet the
growing air traffic needs of the North Texas region, the State of
Texas, and the entire national air transportation system; and
WHEREAS, the Airport Board must be able to reasonably operate,
develop and expand the Airport to ensure the safety of the
traveling public, to maintain its competitiveness in the market, to
meet the projected needs of the traveling air public, to protect
31,000 jobs and a $30 billion stimulus to the Texas economy over a
twenty year period, to increase the capacity of the national air
transportation system by 150, and to reduce delay costs which
impact the airlines and the traveling public; and
WHEREAS, the operation and continued viability of the Airport
has a direct impact upon the economic welfare of the Town in that
many residents of the Town derive a part or all of their income
from the Airport; and
WHEREAS, after twenty years of growth and development at
Dallas/Fort Worth International Airport, a dispute has arisen
between the Airport Board and the Four Cities as to the Airport
Board's authority to control the use of its land; and
WHEREAS, while the Town respects the right of Texas
municipalities to control the development of land within their
respective jurisdictions, the Town also recognizes the critical
role of the Airport to the economy of the Dallas/Fort Worth area;
and
WHEREAS, it is the Town's belief and desire that Airport land
use disputes can and should be resolved through an independent
board empowered with the authority to issue binding, non -appealable
decisions.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN
OF TROPHY CLUB, TEXAS:
Section 1. The Town of Trophy Club, Texas, for the purpose of
resolving disputes and avoiding extensive litigation regarding
Airport land use matters, supports, and hereby recommends that the
Texas Legislature enact legislation implementing, the procedure
generally described below:
There shall be established an Airport Board of Review to
evaluate Airport land use concerns which cannot be amicably
resolved. The Board shall, after hearing the arguments of the
parties and reviewing any and all evidence presented to it, have
the power and authority to render a final, non -appealable decision.
The Board shall have seven (7) members who shall be appointed as
follows: Two (2) members shall be appointed by the Four Cities,
two (2) members shall be appointed by the Airport Board, and three
(3) members, including the Chairman of the Board, who shall have
the power to vote on all matters coming before the Board, shall be
appointed by the Governor of the State of Texas. The members
appointed by the Governor shall neither reside nor have any
economic interest in the area served by the North Central Texas
Council of Governments.
Section 2. The Mayor is hereby directed and empowered to
cause copies of this Resolution to be delivered to all parties
interested in the growth and development of Dallas/Fort Worth
International Airport.
Section 3. That this Resolution shall take effect from and
after its date of passage.
PASSED AND APPROVED by the Town Council of the Town of Trophy
Club, Texas this the 19th day of January, 1993.
