RESOLUTION NO. 85-1
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF
TROPHY CLUB, TEXAS CREATING THE TROPHY CLUB
PLANNING AND ZONING COMMISSION; PROVIDING TERMS;
PRESCRIBING QUALIFICATIONS, DUTIES AND POWERS FOR
ITS MEMBERS; PROVIDING FOR RULES OF OPERATION;
PROVIDING THAT PUBLIC HEARINGS MAY BE HELD
JOINTLY WITH THE TOWN COUNCIL; APPOINTING
MEMBERS; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Town Council of the Town of Trophy Club, Texas, in
furtherance of the mandate of their electorate to enhance and preserve the quality
and character of the Town's aesthetic and physical surroundings, desires to establish
a commission of residents to assist in the achievement of the mandate; and
WHEREAS, the Town Council finds and determines it necessary and desirable
to appoint a Zoning Commission in order to avail itself of the powers conferred by
Articles 101la-1011j, Vernon's Annotated Texas Civil Statutes, ("V.A.T.C.S"),
relating to zoning; and
WHEREAS, the City Council further finds that it is desirable to have the
same commission also act as a Planning Commission to carry out the powers and
duties conferred by Article 974a, V.A.T.C.S.; and
WHEREAS, the single commission shall be designated and known as the
Trophy Club Planning and Zoning Commission.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF
TROPHY CLUB, TEXAS:
Section 1. Creation. There is hereby created and established the Trophy
Club Planning and Zoning Commission (the "Commission") in and for the Town of
Trophy Club, Texas.
Section 2. Organization.
(A) The Commission shall consist of five (5) members appointed by a
majority of the Town Council, one of whom who shall be appointed as Chairperson.
(B) Each member of the Commission shall be a resident citizen and
qualified voter of the Town.
(C) Each member shall serve an initial term of office of one (1) year
from the date of appointment, and until their respective successor is appointed,
qualified and taken office.
(D) Each member of the Commission shall serve at the will and pleasure
of the Town Council. If a vacancy should exist due to removal from office,

resignation, death, refusal or inability to serve, the Town Council shall appoint a
new member to fill the vacancy for the unexpired term.
Section 3. Duties and Powers. The Planning and Zoning Commission shall
have the following duties and powers:
(A.) Gather factual information on present and proposed land uses and
existing and proposed structures within the Town.
(B) Study and recommend the boundaries of the various original zoning
districts and appropriate regulations to be enforced in such zoning districts as
provided in and authorized by Article 1011f, V.A.T.C.S.
(C) Formulate and recommend to the Town Council a Master
Development Plan for the orderly growth and development of the Town and its
environs, and from time to time recommend such changes in the Plan as it finds will
facilitate the enhancement and preservation of the quality and character of the
aesthetic and physical surroundings of the Town of Trophy Club and will be in the
best interest of the health, safety, and general welfare of the citizens of the Town.
(D) . Formulate a Comprehensive Zoning Plan as may be deemed best to
carry out the goals of the Master Development Plan; make a preliminary report on
the Comprehensive Zoning Plan and hold public hearings on the preliminary report
before submitting a final report to the Town Council, in accordance with Articles
101la-1011j, V.A.T.C.S.
(E) Exercise all the powers of a Planning Commission as to approval or
disapproval of plans, plats, or replats and vacation plans, plats or replats and
conduct public hearings when required, pursuant to Articles 974a and 970a,
V.A.T.C.S.
(F) Recommend to the Town Council the establishment of such auxiliary
citizen study groups and other committees as are necessary to assist in
accomplishing the purposes of the Commission.
(G) Recommending to the Town Council the engagement of such outside
firms or agencies as are necessary to accomplish the purposes of the Commission.
(H) Interact and work with such auxiliary citizen groups and outside firms
and agencies established and engaged by the Town Council.
(I) Recommend to the Town Council such legislative actions as the
Commission determines will further the Council's dedication to the enhancement
and preservation of the quality and character of the aesthetic and physical
surroundings of the Town of Trophy Club, Texas.
(J) Submit a report to the Town Council on the status of the activities of
the Commission at the first regularly scheduled Council meeting of each month.
(K) Prepare and maintain a record of all official activities of the
Commission which by State law are required to be open and available for inspection
by the public.

Section 4. Rules of Operation.
(A) The Commission shall select from among its members a
Vice -Chairperson, Secretary and such other officers as may be deemed necessary
for the conduct of their business.
(B) The Commission shall adopt rules for the practical and efficient
transaction of business and maintenance of its minutes, transactions, findings and
determinations which are required to be kept as a public record.
(C) A majority of the Commission shall constitute a quorum to do
business, and the affirmative vote on a majority of those attending any meeting at
which there is a quorum present shall be necessary to pass any motion,
recomendation or resolution.
(D) Meetings of the Commission may be held as often as necessary to
conduct the business coming before the Commission, at the call of the Chairman and
at such times as a majority of the Commission may determine.
Section 5. Any public hearing required by the Commission may he held
jointly with the Town Council, with proper and legal notice being given for both
bodies. The Town Council shall take no action on any matter related to zoning, until
it has received a final written report from the Commission.
Section 6. Purposes. It shall be the purpose of the Commission to guide and
aid in the accomplishment of a coordinated, adjusted and harmonious development
of the Town and its environs including the implementation of a Comprehensive
Zoning Ordinance which will, in accordance with the present and future needs, best
promote health, safety, morals, order, convenience, prosperity and general welfare,
as well as efficiency and economy in the progress of development; including, among
other things, adequate provision for traffic, the promotion of safety from fire and
other dangers, adequate provision for light and air, the promotion of healthful and
convenient distribution of population, the promotion of good civic design and
arrangement, wise and efficient expenditures of public funds and the adequate
provision of public utilities and other public improvements.
Section 7. The City Council hereby appoints Loren Alexander, as
Chairperson, and Gene Aerstin, Neil Anderson, Bruce Benton, and Bill Tynes as
members of the Commission.
Section 8. Severability. That if any section, article, paragraph, sentence,
clause, phrase or word in this resolution or application thereof to any person or
circumstance is held invalid or unconstitutional by a Court of competent
jurisdiction, such holding shall not affect the validity of the remaining portions of
this resolution, and the City Council hereby declares it would have passed such
remaining portions of this resolution despite such invalidity, which remaining
portions shall remain in full force and effect.
