ORDINANCE NO.2026-23
AN ORDINANCE ABANDONING TRIPLE CROWN DRIVE IN THE TOWN OF
TROPHY CLUB, DENTON COUNTY, TEXAS, FOR PUBLIC STREET
PURPOSES ONLY; AND PROVIDING FOR SEVERABILITY.
WHEREAS,the owner of Triple Crown Estates has requested the abandonment of Triple Crown Drive
as shown and more particularly described on this replat, for public street purposes; and
WHEREAS, Triple Crown Drive is located exclusively on the owner's land, and Triple Crown Drive is
not needed for public street purposes and will not be needed in the future for such purposes; and
WHEREAS, abandonment of Triple Crown Drive is authorized by Texas Transportation Code Ch. 311
and Section 3.08 of the Town Charter.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF
TROPHY CLUB,TEXAS, THAT:
SECTION 1. Triple Crown Drive, as shown and more particularly described on this replat, is hereby
abandoned for public street purposes only, insofar as all use, right, title, and interest of the general
public for vehicular traffic and pedestrian access in and to Triple Crown Drive are concerned; SAVE
AND EXCEPT, this action shall not affect the public use, right, title, and interest, if any, of any
existing or future public utilities, franchise utilities, or governmental entities currently located, or to be
located in the future, in, under, or adjacent to Triple Crown Drive, or its right of way. Moreover, the
Town expressly reserves for itself and other governmental entities, and does not abandon any
stormwater, water, sewer, or drainage utility rights, in, under, or adjacent to Triple Crown Drive, or its
right of way. The right of the Town and any other governmental entities to access and use Triple Crown
Drive, or its right of way, for fire, solid waste, code enforcement, police, or any other services provided
for the health, safety, and welfare of the general public are expressly reserved by this ordinance.
SECTION 2. The terms and provisions of this ordinance shall be deemed to be severable and that if
the validity of any section, subsection, sentence, clause or phrase of this ordinance should be declared
to be invalid, the same shall not affect the validity of any other section, subsection, sentence, clause or
phrase of this ordinance.
