Minutes TC 01/19/2004MINUTES NOTICE OF REGULAR TOWN COUNCIL MEETING FOR THE TOWN OF TROPHY CLUB JANUARY 19, 2004 LOCATION: 100 MUNICIPAL DRIVE, TROPHY CLUB, TEXAS WORKSHOP FEATURING PUBLIC SAFETY ADVISORY GROUP 6:30 P.M. 1. CALL TO ORDER AND ANNOUNCE A QUORUM. Mayor Smith called the Workshop session to order at 6:34 p.m. noting a quorum was present TOWN COUNCIL MEMBERS PRESENT: Scott Smith Beverly Foley Susan Edstrom Roger Williams Scott Spence TOWN COUNCIL MEMBERS ABSENT: Bill Matthai Mayor Mayor Pro Tem arrived 6:34 p.m. Council Member Council Member Council Member Council Member STAFF AND GUEST(S) PRESENT: Diane Cockrell Town Secretary Roger Unger Finance Director Randy Briggs Community Development Manager/Interim Director of DPS 2. PUBLIC SAFETY ADVISORY GROUP TO DISCUSS CURRENT PROJECTS WITH TOWN COUNCIL AND RESIDENTS. Randy Briggs introduced the Public Safety Advisory Group, George Gearner, Michael Giehl, Bob Radder, and Dan Gannon. The Council, residents and staff were informed that the group is working on the "Standard Operating Policies" for the Fire Department. The members of the group expanded on their pian of action for rewriting the SOP. George Gearner updated the Council, residents and staff regarding the "speed signs" to be installed at the three schools in Trophy Club. The cost of the signs will be sponsored by outside sources. Other projects for future study by the group are: safety for pedestrians, neighborhood watch program, and another table top for "Emergency Management". 3. ADJOURN WORKSHOP. The Workshop adjourned at 6:55 p.m. REGULAR SESSION — 7:00 P.M. STATE OF TEXAS COUNTY OF DENTON The Town Council of the Town of Trophy Club, Texas, met in Regular Session on Monday, January 19, 2004. CALL TO ORDER AND ANNOUNCE A QUORUM. Mayor Smith called the Regular session to order at 7:02 p.m. noting a quorum was present 2. INVOCATION. Jim Moss gave the invocation 3. PLEDGE OF ALLEGIANCE TO THE AMERICAN FLAG. PLEDGE OF ALLEGIANCE TO THE TEXAS FLAG. "Honor the Texas flag; I pledge allegiance to thee, Texas one and indivisible." Matthew Michalak, Quinn Reckmeyer, and Robert Cowan of Boy Scout Troop #328 led the pledges 4. CITIZEN PRESENTATIONS: THIS IS AN OPPORTUNITY FOR CITIZENS TO ADDRESS THE COUNCIL ON ANY MATTER WHETHER OR NOT IT IS POSTED ON THE AGENDA. THE COUNCIL IS NOT PERMITTED TO TAKE ACTION ON OR DISCUSS ANY PRESENTATIONS MADE TO THE COUNCIL AT THIS TIME CONCERNING AN ITEM NOT LISTED ON THE AGENDA. THE COUNCIL WILL HEAR PRESENTATIONS ON SPECIFIC AGENDA ITEMS PRIOR TO THE COUNCIL ADDRESSING THOSE ITEMS. Robert Medigovich 2010 California Parkway, Dallas, addressed the Council. 5. TOWN COUNCIL TO ANNOUNCE A "CITIZEN OF THE YEAR FOR 2003" AND TO PRESENT A CERTIFICATE OF RECOGNITION TO THE RECIPIENT. Mayor Smith recognized Mr. Bud Fluty as the Citizen of the Year for 2003. 6. TOWN COUNCIL TO RECOGNIZE OFFICER LARRY FISCHER FOR YEARS OF SERVICE TO THE RESIDENTS OF TROPHY CLUB AND TO DISCUSS SAME. Mayor Smith recognized Officer Larry Fischer for his years of service to the Town of Trophy Club. Randy Briggs, Interim Police Chief recognized Sgt. Larry Fischer by presenting a U.S. Flag in a framed and inscribed flag case. 7. TOWN COUNCIL TO DISCUSS AND TAKE APPROPRIATE ACTION REGARDING A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS, APPOINTING ONE (1) CITIZENS TO ONE (1) SEAT ON THE ECONOMIC DEVELOPMENT CORPORATION B FOR THE REMAINDER OF THE UNEXPIRED TERM EXPIRING ON JUNE 30,2004; AND PROVIDING AN EFFECTIVE DATE. Council Member Edstrom moved to approve. Council Member Mattahi seconded; motion carried unanimously. 8. TOWN COUNCIL TO DISCUSS AND TAKE APPROPRIATE ACTION REGARDING A PROCLAMATION OF THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS, TO RECOGNIZE NICK SANDERS FOR HIS DONATION OF RECORDS MANAGEMENT SOFTWARE TO ENABLE THE IMAGING AND ACCESS OF PERMANENT TOWN/MUD RECORDS VIA THE INTERNET. Beth Ann Gregory gave a background of the record needs of the Town. Mr. Sanders offered approximately $16,000 software that has been customized for on]- Town. Mayor Smith presented a proclamation to Mr. Sanders for his contributions to the Town of Trophy Club. 9. COUNCIL TO VIEW A DEMONSTRATION OF RECORDS IMAGING SOFTWARE, WHICH WILL ALLOW INTERNET ACCESS TO TOWN/MUD PERMANENT RECORDS SUCH AS Page 3 Regular Session January 19, 2004 MINUTES, AGENDAS, RESOLUTIONS AND EVENTUALLY ORDINANCES, AND TO DISCUSS SAME. Beth Ann Gregory, gave an over view of the service that is now available to the residents via the internet on the Town's website. 10. TOWN COUNCIL TO DISCUSS AND TAKE APPROPRIATE ACTION REGARDING AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS, REPEALING ORDINANCE NO.2002-38 P&Z, ESTABLISHING SIGN REGULATIONS, AND ADOPTING NEW PROVISIONS FOR SIGN REGULATIONS; PROVIDING FOR INCORPORATION OF PREMISES; PROVIDING DEFINITIONS; PROVIDING GENERAL STANDARDS RELATING TO THE HEIGHT OF SIGNS, APPLICABLE BUILDING AND ELECTRICAL CODES, ILLUMINATED SIGNS, AND REQUIREMENTS TO REPAIR; PROVIDING FOR TRAFFIC SAFETY; PROVIDING FOR POLITICAL SIGNS; PROVIDING FOR DEVELOPER/BUILDER AND REAL ESTATE SIGNS; ESTABLISHING PROVISIONS FOR ALL AREAS AND ZONING DISTRICTS; PROVIDING FOR COMMERCIAL SIGNS; PROVIDING SIGNAGE CRITERIA; PROVIDING FOR PERMISSIBLE SIGNS NOT REQUIRING PERMITS; PROVIDING PERMIT REQUIREMENTS; PROVIDING FOR TEMPORARY PERMITS; PROVIDING FOR NONCONFORMING USES; PROVIDING FOR MERITORIOUS EXCEPTIONS AND APPEALS; PROVIDING FOR PROHIBITION OF SIGNS NOT SPECIFICALLY AUTHORIZED; PROVIDING GRAFFITI REGULATIONS; PROVIDING A CUMULATIVE REPEALER CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION OCCURS OR CONTINUES; PROVIDING FOR PUBLICATION; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. Patricia Adams explained that based on Council comments at the January 5"' meeting and Section 216.903 of the Local Government Code amendments; she recommends approval with changes and return the sign ordinance to Planning and Zoning for continued revision. Susan Edstrom asked to go on record stating that: "she supports the recommendation of the election judge that it be done beginning with early voting because as she stated part of what it does is raise awareness that an election is going on." Council Member Williams moved to approve. Mayor Pro Tem Foley seconded; motion carried unanimously. 11. TOWN COUNCIL TO DISCUSS AND TAKE APPROPRIATE ACTION REGARDING AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS, ESTABLISHING REGULATIONS TO PROHIBIT THE SCAVENGING OF REFUSE; PROVIDING FOR INCORPORATION OF PREMISES; PROVIDING FOR DEFINITIONS; PROHIBITING THE SCAVENGING OF DISCARDED MATERIALS; PROVIDING EXCEPTIONS; PROVIDING A CUMULATIVE REPEALER CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY NOT TO EXCEED TWO THOUSAND DOLLARS ($2,000.00) AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; PROVIDING FOR PUBLICATION; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. Randy Briggs introduced a compromise by offering an ordinance that specifically addresses opening a trash bag or a sealed box as a violation. Violations of this type could be tracked by the police department and/or the Citizen Relationship Management program to be in effect March 1. Randy Shiflet of Trinity Waste, 6100 Elliott Reeder, Fort Worth addressed the Council. Page 4 Regular Session January 19, 2004 Council Member Williams moved to deny this motion, Mayor Pro Tem Foley seconded, motion failed 2- 3-0 with Council Member Williams and Mayor Pro Tem Foley voting for; and Council Members Spence, Matthai and Edstrom voting against. Council Member Spence moved to approve the Ordinance. Council Member Edstrom seconded, Mayor Pro Tem Foley asked for an amendment to Section 4, 4.01 adding after the word machinery: "and in accordance with the carriers contract or franchise with the Town." Council Members Spence and Edstrom agreed with the amendment. Motion passed 3-2-0 with Council Members Spence, Edstrom and Matthai voting for and Mayor Pro Tem Foley and Council Member Williams voting against. 12. TOWN COUNCIL TO DISCUSS AND EVALUATE TOWN ORDINANCE REGULATIONS REGARDING "3-5 A.M. PARKING ON STREET(ST, INCLUDING APPLICABLE PERMIT FEES, AND TO PROVIDE DIRECTION TO STAFF. Mayor Pro Tem Foley asked that Randy Briggs' suggestion to have the $50 fee be a one-time fee. Randy Briggs added that there have been four permits issued in the last four years. It has been over 10 years since the decals were ordered. The police department has a relief program for holiday guests of the residents. A consensus of the Council to amend the Schedule of Fees before being amended in the May/June timeframe. 13. COUNCIL/STAFF REPORTS. COUNCIL/STAFF REPORTS: THIS IS AN OPPORTUNITY FOR COUNCIL AND STAFF TO PROVIDE BRIEF UPDATES ON PROJECTS AND TO PROVIDE PUBLIC SERVICE ANNOUNCEMENTS. IT IS NOT A TIME FOR THE EXPRESSION OF OPINIONS, QUESTIONS AND ANSWERS, OR DISCUSSION AMONG STAFF AND COUNCIL. DISCUSSION IS LIMITED TO WHETHER COUNCIL DESIRES TO HAVE A TOPIC PLACED ON A FUTURE AGENDA FOR FUTURE CONSIDERATION. Council and Staff reports were given. Mayor Smith also recognized Cpl. Lance Anderson and Cpl. Wes Tyler by reading a letter of commendation from Chief Anslett of Marshall Creek for professional assistance with felony investigations, felony search warrants and felony arrests, as well as agency -to -agency backups. 14. CONSENT AGENDA: ALL MATTERS LISTED UNDER CONSENT AGENDA ITEM ARE CONSIDERED TO BE ROUTINE BY THE TOWN COUNCIL AND WILL BE ENACTED BY ONE MOTION. THERE WILL NOT BE A SEPARATE DISCUSSION OF THESE ITEMS. IF DISCUSSION IS DESIRED, THAT ITEM WILL BE REMOVED FROM THE CONSENT AGENDA AND WILL BE CONSIDERED SEPARATELY. A. TOWN COUNCIL TO CONSIDER AND TAKE APPROPRIATE ACTION TO SPEND COURT SECURITY FUNDS TO: 1. REPLACE A MALFUNCTIONING VCR RECORDER AND AGING VIDEO TAPES TO BE USED TO RECORD VIDEO FROM THE COURT SURVEILLANCE CAMERAS, NOT TO EXCEED $450. 2. PURCHASE A MOBILE TELEPHONE FOR COURT USE. B.
