The Town Council of the Town of Trophy Club, Texas, met in a Special Session on Monday, September
23, 2002. The meeting was held within the boundaries of the Town and was open to the public.

CALL TO ORDER AND ANNOUNCE A QUORUM.
Workshop called to order at 7:40 p.m.
TOWN COUNCIL TO CONDUCT A WORKSHOP REGARDING THE U.S. ARMY CORPS OF
ENGINEERS MARSHALL CREEK PARK PROPERTY AND THE POTENTIAL LEASING
AND OPERATION OF THE PROPERTY FOR PUBLIC USE.
Paul Rosenberger explained that there are four reasons to lease the property at Marshall Creek Park:
1. Control of the future development at this site.
2. Future park, open, green space.
3. Possible revenue source.
4. Economic development.
Paul further stated that the property has several liabilities: They are:
1. The controversies between the ORV enthusiasts and environmentalists;
2. Vague fiscal responsibilities;
3. Unknown desires and needs of the community.

Paul gave Park Budget Scenarios and, stated that after reviewing the lease document, he identified three
concerns with the lease document:
1. "City of Trophy Club" will be rewritten as "Town of Trophy Club".
2. Section 21(b) — relinquishment will be 30 days, not 1 year.
3. Preliminary Assessment Screening — The term will be 6 months, not 25 years.
Above changes were going to be made to the Lease Document by the COE and sent to Donna Welsh.
Patricia Adams expressed concerns regarding the lease. Mr. Cox responded to Ms. Adams' concerns.

Mayor Smith called the regular session to order at 9:08 p.m., noting a quorum was present.
INVOCATION.
Gary Tomlin gave the invocation.
PLEDGE OF ALLEGIANCE TO THE AMERICAN FLAG.
PLEDGE OF ALLEGIANCE TO THE TEXAS FLAG.
"Honor the Texas flag; I pledge allegiance to thee, Texas one and indivisible."
Susan Edstrom led the pledges.
CITIZEN PRESENTATIONS: THIS IS AN OPPORTUNITY FOR CITIZENS TO ADDRESS
THE COUNCIL ON ANY MATTER WHETHER OR NOT IT IS POSTED ON THE AGENDA.
THE COUNCIL IS NOT PERMITTED TO TAKE ACTION ON OR DISCUSS ANY
PRESENTATIONS MADE TO THE COUNCIL AT THIS TIME CONCERNING AN ITEM NOT
LISTED ON THE AGENDA. THE COUNCIL WILL HEAR PRESENTATIONS ON SPECIFIC
AGENDA ITEMS PRIOR TO THE COUNCIL ADDRESSING THOSE ITEMS.
Michael Paris of 265 Oak Hill, Trophy Club and Laura White of 260 Mt. View, Azle addressed the Council.

TOWN COUNCIL TO HEAR AN UPDATE PRESENTATION, DISCUSS AND TAKE
APPROPRIATE ACTION ON THE USE, OPERATION, AND POSSIBLE LEASE OF THE U.S.
ARMY CORPS OF ENGINEERS MARSHALL CREEK PARK, AND AUTHORIZING THE
MAYOR TO EXECUTE ALL NECESSARY DOCUMENTS.
Robert Schnee of 2701 High Road, Flower Mound addressed the Council.
Council Member Matthai made a motion to enter a six month lease with the Army Corps of Engineers for
Marshall Creek Park subject to a written letter of clarification/modification that will address American
Disabilities Act issues, erosion, etc, subject to review by Patricia Adams and also providing the same
conditions extended to the City of Grapevine.
Council Member Edstrom seconded; motion passed unanimously.
ADJOURN.
Council Member Edstrom made a motion to adjourn at 9:22 p.m. Council Member Matthai seconded;
motion passed unanimously.
