The meeting was held within the boundaries of the Town and was open to the public. TOWN COUNCIL TO HEAR A PRESENTATION REGARDING THE FINAL DESIGN OF THE 10 ACRE PARK Bryan Klein gave an overview detailing all the facilities of the 10 acre park. TOWN COUNCIL TO CONVENE INTO PUBLIC HEARING: PUBLIC HEARING TOWN COUNCIL TO CONDUCT A PUBLIC HEARING RELATIVE TO THE FOLLOWING: TOWN COUNCIL TO DISCUSS AND TAKE APPROPRIATE ACTION REGARDING THE RETENTION / ELIMINATION OF ADVERTISING IN THE AROUND THE TOWN NEWSPAPER Mr. Jim Moss of 979 Trophy Club Drive and Mr. Dann Davis of 308 Madeline Cove addressed the Council. Mr. Gary Tomlin of 360 Indian Creek stated for the record: My Name is Gary Tomlin I live at 360 Indian Creek Drive, I have just completed my fifth year as owner and publisher of the Trophy Club BuzzzI I request that my words be recorded verbatim in the minutes of this public hearing. I have a prepared speech and request that I be allowed to give it without interruption. I'll be happy to answer questions or provide clarification once I've finished. I want to thank Councilman Williams for bringing this issue to public forum, but with apologizes to William Shakespeare and Mark Anthony, I come to Bury Caesar, Not to praise him. Page 3 REGULAR SESSION July 16, 2001 I come to ask you to continue selling advertisement in your taxpayer -funded newspaper You may have on occasion read my monthly column-- The Pravda Report -- where I generously share constructive criticism of the mistakes you make and how you might improve your tax payer subsidized newspaper, Around the Town, which I call -- with Poetic Accuracy -- Pravda. I started the Pravda Report last October when this government decided to compete directly with me in the local advertising market. Since then, that half page opinion column has generated more positive reader response than anything I've done in fourteen years of Journalism. If you stop selling advertising. I'll have to stop writing our most successful column. I don't really want to do that. I want to tell people how Pravda's Editor, Mr. Gene Hill, who is also Chairman of the Planning and Zoning Commission, just voted to recommend an exception to the Town's sign ordinance for two incoming retailers at the Village Shops. Chairman/Editor Hill is pushing for favorable treatment for two potential advertisers in Pravda. Don't misunderstand, Gene is an honorable man. That recommendation will come to you in August, and you will get to approve an exception to the sign ordinance to two potential advertisers. While I'm certain, no where along the way, will anyone in this government suggest that these favored businesses should buy advertising space in Pravda. I'm still going to get to take two shots at the apparent conflict of interest of both The Planning and Zoning Chairman and the Town Council. I take great delight every time I see Councilman Edstrom's husband's full-page ad in Pravda. You sell and he buys the space at below the free market rate. You deliberately hold your advertising percentage at an unprofitable level. The benefit to the Edstrom Family is indisputable, and I assume Mrs. Edstrom has weighed this and is satisfied in her own mind that no conflict of interest exists or she would recuse herself from the decision that the town continue to sell advertising. I'm sure, Susan is an honorable Councilman. Still, her apparent conflict of interest, and her refusal to recognize it is material for the next Pravda Report. Thank you Susan. It thrills me that by selling advertising and establishing what is essentially a free market business, this government chooses to compete economically in an area that has nothing to do with the governing of our community, I'm confident that if we let you have this, you won't go into other enterprises where you are well positioned to enter -- like banking and selling Real Estate. If we let you have Austria, I'm certain you will be content and not threaten England or France. You are an honorable Town Council. As sometimes inadvertently happens in government financial reporting, the decision makers don't get all the information from the staff. The cost breakdown you received for the expense of Pravda omits some significant and important costs. You are well aware of the different legal questions that have arisen over your forey into the publishing business. Each of those questions have associated attorney fees that are not currently reflected in the cost report of producing Pravda. I will research the legal fees paid by tax dollars to answer questions that arise when bureaucrats and politicians practice Journalism. Page 4 REGULAR SESSION July 16, 2001 My guess is that your legal expenses are rising, and will continue to rise, as you venture further down this road. Of course, I'll be compelled to mention that in a future Pravda report. In the budget workshop, I heard a justification that by selling advertisement, you are able to add more pages to Pravda, and you are thereby able to accept more submissions from residents for stories in the paper. Providing space for stories from different favored interest groups is not an essential government service. You are publishing things that have nothing to do with the government of the Town, but have much to do with shameless pandering to voters. A case can be made, and I expect I'll make it in a future Pravda Report, that taxpayer dollars arc being used to subsidize a political publication. By its nature, no matter how you try to sugar coat it, Pravda is a political propaganda sheet, and trying to pay for it with advertising sales doesn't change a thing. Still, you are an honorable government. So for these reasons, I hope you understand how important your publication Around the Town and your advertising sales have become to the 'Trophy Club Buzzz.! You are providing me with great material. The further you venture into free market competition, the more damage you will bring to the credibility of this government, and the more embarrassment you will bring to this Town. I greatly appreciate your willingness to make these sacrifices for my benefit. Please, please continue to do that which you have no business doing. And continue to sell that which you have no business selling. It's Very Very Good for my business. Ms. Lynn Hale of 18 Sonora Drive stated for the record: Mayor and Council, I too would like to have my comments recorded. I did a little research and wanted to give you a little free consulting here. My flip chart is not going to stay. These are cities that I contacted to see if they had a newsletter/newspaper. Most of them called it a newsletter. Hurst, Colleyville, Grapevine, Bedford, Tarrant County, Ft. Worth, Coppell, Flower Mound, Rockwall, Richardson, University Park, Highland Park, Addison, Mesquite, Plano, Northwest Independent School District, TNRCC, these I didn't call, but I could show you examples and the Arts Council. What I have here are some examples of what these other towns do. They do not have advertising. This is the Hurst newsletter, the Colleyville newsletter, the Grapevine, no ads, Bedford, did I leave Bedford off? No. This is how Tarrant County gets their news out — they take ads out in the Ft. Worth paper, the City of Ft. Worth does the same thing. Coppell doesn't even clutter up their Town map with ads that they give to the public. They don't even; in their senior newsletter have any ads. The TNRCC monthly report does not have any ads, and it's governmental. The Northwest School District no ads. The Art Council, no ads. Trophy Club has both a newspaper; they call it, and advertising. Most of these towns refer to what they publish as a newsletter, which is a periodically published work containing news and announcements of some subject typically with a small circulation. For those of you new to Trophy Club, these are some back copies of the Around Town, these top are some of the newer copies and you see the ad on the back of Council woman Edstrom's husband, who always has the back page. If you go back to several years ago, you notice, or actually a year ago, the paper is smaller, there is only six pages. And there is no ads. Something else I like to find out, is on the newspaper, on the mast head it has this standard presort permit postage paid thing on it. The old one didn't have that so it had a different type of delivery stamped on it. Page 5 REGULAR SESSION July 16, 2001 I'm asking the Council that when you vote on this, to not have advertising and that Susan abstain from voting because if we don't stop this now, the next thing we're going to have infomercials on channel 7. Mr. Glenn Gillock of 211 Phoenix emailed a letter to Council Member Edstrom to have read at the Council meeting. TOWN COUNCIL TO CLOSE PUBLIC HEARING. Town Council closed the Public Hearing at 8:47 p.m. TOWN COUNCIL TO RECONVENE INTO REGULAR SESSION: REGULAR SESSION TOWN COUNCIL TO DISCUSS AND TAKE APPROPRIATE ACTION REGARDING THE RETENTION / ELIMINATION OF ADVERTISING IN THE AROUND THE TOWN NEWSPAPER Mr. Gary Tomlin of 360 Indian Creek Drive addressed the Council. Gene Hill, Chairman of the Editorial Review Board made a presentation. Mr. Hill thanked the citizens for showing interest in the Around the Town, name of the paper since 1999. Mr. Hill gave a summary of the events of the newspaper." From the early 1990's, a quarterly newsletter was published by the Town, with material acquired by the staff, then edited and formatted by Gene Hill and printed by the staff. The first quarter of 1999, publishing was changed to bi-monthly and was prepared wholly by the staff." The first quarter of 1999, publishing was changed to bi-monthly and was prepared by the staff. In May of 1999, the name was changed to Around the Town. September 1999 publication was changed to monthly distribution with newsprint format June 2000 the Editorial Review Board was created and appointed by the Council. Spring of 2000, the Editorial Review Board was asked to consider advertising. October 2000 was the first issue to include advertising. Issue Number of Pages % of Ads Content Cost Sept 2000 8 0 8 $1476 Ju1y2001 12 20% 9.6 $1109 The effect of advertising, comparing the September 2000 issue to the July 2001 issue, the number of content pages increased by 20% and publication costs were reduced by $367.50 or 25%. Council Member Spence noted the divided room. All agree that we need to increase communication. If ethics is a question, there is a problem. Council Member Spence would like to see the newspaper scaled back to a "newsletter." Council Member Huizenga stated, in regards to surrounding publications, the Texas Comptroller, TxDot, there is no advertising, all positive publications. It is a slippery slope and a wispy washy issue. We may be going into the landscaping business. In a recent workshop, quoting the Mayor, "maybe we should end the controversy and bite the bullet and spend that money" and to me, I think $12,000 is not that big of an expenditure to get that much information out to the public. Page 6 REGULAR SESSION July 16, 2001 Council Member Huizenga went on to say that it was the recommendation of the Town Manager, at the same workshop, to put the question of advertising to a Public Hearing. Another near quote from the Mayor is that "the general consensus is to keep the newspaper, its good, it gets out the information, its a good communication means. The point of contention is the ads." "The newspaper is a valuable source, and the town ought to pay for the newspaper," a quote from Council Member Williams from the same workshop. If the issue is ads and right now we are paying our Town engineers to sit through this Public Hearing because we are going to be addressing a $835,000 agenda item plus about 14/15% contingency fees, engineering costs, etc. when this is done. Council Member Huizenga stated that he'd just get on with this and get on with the real business of this town and that is the real portion of this budget. Council Member Edstrom referred to Attorney Patricia Adams regarding a conflict of interest. Ms. Adams explained that a conflict of interest is owning more than ten percent of interest of voting stock of a business. Ms. Adams stated that Council Member Edstrom, legally, does not meet any of the requirements of having a conflict of interest. Mayor Pro Tem Edstrom stated that she is capable of being and voting objectively. Contributors to the paper are typically committee chairs, council members or staff. Staff provides their input based on questions that they have received from residents. When a question becomes consistently asked, it raises an issue in their mind that people need to be informed about that question. In relating to the Pravda question, it appears to Mayor Pro Tem Edstrom, that the tables could be turned and Mr. Tomlin's Buzz could attempt to be Pravda and attempting to put another paper out of business. Mayor Pro Tem guesses that that is something Mr. Tomlin would have to decide. Mayor Pro Tem Edstrom referred to the Workshop stating that she had asked repeatedly which newspapers was the Around the Town in direct conflict with. There was only one paper that had the same type of circulation as ours did. Let's be clear that there is only one paper that has complained, consistently and loudly that would like the positive information regarding Trophy Club be somehow squelched. This is a bad thing and our residents deserve to hear about the good things we, as a community, do as it relates to constructive criticism. Our community needs to hear the good things that are happening and the Around the Town newspaper provides us the ability to do that. The ads provide the ability to offset it. The new administration campaigned extensively to increase communication and reduce costs. Mayor Pro Tem Edstrom is confused about how you increase communication and keep a paper going and yet ask for the one thing that offsets some of those costs to our residents be taken away. Someone needs to ask our administration that ran on that campaign how you do that. Council Member Matthai made a presentation. Council Member Matthai shared that he had received a lot of emails and his concern that this issue is splitting the residents. We need everyone's input. Council Member Ma thai believes that Around the Town has provided a lot of information. Council Member Matthai looked at seven issues of the Trophy Club Times, The Buzz.t and the Around the Town. Council Member Matthai listed, statistically, the number of articles and information that was provided by each publication. Council Member Williams pointed out that we are discussing the ads, not the elimination of the paper. Council Member Williams also pointed out to Mayor Pro Tem Edstrom that the perception is that there is a conflict of interest. Council Member Williams stressed that we are not talking about eliminating the paper. Mayor Smith added that according to the tally he had been keeping of the residents that spoke: 33 residents did not want to retain ads and 11 residents wanted to keep ads, 3 to 1. This is a small price to pay for communication. Gary Tomlin of 360 Indian Creek and Ms. Carol Cotton of 11 Overhill Drive readdressed the Council. Council Member Huizenga made a motion to remove the advertising at the end of this fiscal year. Mayor Pro Tent Edstrom seconded, motion carried unanimously. Gene Hill clarified for the Council that the newspaper solicits articles but does not print editorials or opinion pieces The consensus of the Council was to move the following agenda item forward for discussion: Page 7 REGULAR SESSION July 16, 2001 TOWN COUNCIL TO DISCUSS AND TAKE APPROPRIATE ACTION REGARDING AWARD/REJECTION OF BIDS FOR "PAVING AND DRAINAGE IMPROVEMENTS FOR MARSHALL CREEK ROAD AND TROPHY CLUB DRIVE." Bill LeGrand introduced Nestor Karlis, Chairman of the Public Works Committee. Denton County, as a result of a bond issue, awarded $750,000. The Commissioner's Court offered money to Trophy Club to use to extend Marshall Creek Road. The purpose was to extend Trophy Club Drive to Marshall Creek Road to improve the traffic flow to the schools. Mr. Karlis said that flus could be supported with $100,000 this budget year and $100,000 next budget year Gary Teague of Teague Nall & Perkins explained the process of construction and the traffic flow effectiveness and handling of school traffic flow. A portion of Marshall Creek road will be taken out of service. The low bidder is a well known contractor. Mr. Teague recommends awarding of bid to Apac of Texas, Inc. The road will be an asphalt roadway to give service for several years. Mr. Karlis pointed out that a three way stop sign will control the intersection of Marshall Creek Road and Trophy Club Drive. Council Member Williams added that a portion of the project is stated on all maps as a "loop road." We need to figure out how to do this without spending taxpayers' money. The cost of the "temporary roadway" is $54,000. Council Member Williams voiced a concern asking is this what the residents want? Mayor Pro Tem Edstrom asked to concentrate on the issue at hand, to spend $750,000 to alleviate a traffic problem. We have money to use to remedy this problem. The residents voted for this in a county bond election. Council Member Huizenga asked the Public Works Committee to stand and thanked them. The discussions of this roadway are in question. A cost of $836, 000 plus engineering costs, totaling $915,000. This is a safety and an infrastructure issue. This committee knows what they are doing. Council Member Spence agreed. Mayor Smith asked Bill LeGrand for a timetable. Bill LeGrand replied with 210 days and an approximate start date of August 15. Mr. Chris Clark of I I Palmetto Court addressed the Council. Donna Welsh added that Mr. Teague has been asked to look at the drainage impact fees to be on the developer. Council Member Huizenga made a motion to award the bid of paving and drainage improvements for Marshall Creek Road and Trophy Club Drive to Apac of Texas not to exceed a figure of $835,935.30 with a 210 working day bid. Council Member Matthai seconded, motion carried 4-1-0 with Council Members Matthai, Huizenga, Spence and Mayor Pro Tem Edstrom voting for and Council Member Williams voting against. REPORTS FROM COMMITTEES: (FIVE-MINUTE TIME LIMIT) A. ECONOMIC DEVELOPMENT CORPORATION B • Previous meeting discussion and action Mayor Pro Tem Edstrom shared that ads from local retailers will be in the August issue of the Around the Town, Mayor Smith, to promote the "Shop Trophy Club First" Campaign through the Town's Economic Development Corporation B, introduced this. Developers have agreed to an update in September. B. EDITORIAL REVIEW BOARD • Previous meeting discussion and action Gene Hill stated that the Board is in the planning stage for the August issue and that the publication date will be prior to or on August 1". PARKS AND RECREATION COMMITTEE • Previous meeting discussion and action Billy Hughes reported on the 10 acre park project budget, EDC A will fund the under 5/6 soccer field D. PLANNING AND ZONING COMMISSION • Previous meeting discussion and action Gene Hill reported on the July 12 Planning and Zoning meeting. The Commission heard Sprint's request for a certification of convenience for an addition to the utility pole at the end of Lake Forest. This will be a public hearing on the August 66 Council Agenda. Other agenda items for the August 6� Council Meeting will be a recommendation received from Mr. Berger for a "Coming Soon" sign and a waiver to paint a fence that was denied by the Commission. The appointment of Chairman and Vice Chairman will be coming before the Council soon. E. PUBLIC WORKS COMMITTEE Mr. L• Previous meeting discussion and action i -lis thanked the Council for the award of the paving and drainage improvements and shared that the curbside recycling presentation will be coming in August. TOWN COUNCIL TO CONSIDER AND ADOPT A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS, APPRECIATING THOSE INDIVIDUALS AND ORGANIZATIONS THAT PARTICIPATED IN THE TOWN OF TROPHY CLUB'S JULY 4TH CELEBRATION; AND PROVIDING AN EFFECTIVE DATE. Mayor Pro Tem Edstrom introduced this item and stated that this event could not have taken place without numerous volunteers, MUDS and the EDC, etc. Mayor Pro Tem Edstrom would like to recognize the Public Relations Committee, DPS and the Town Staff. The website link will remain up for six months. There will be a final article in the Around the Town recognizing the sponsors. Mayor Pro Tem Edstrom made a motion to adopt the Resolution as written. Council Member Matthai seconded; motion carried unanimously. TOWN COUNCIL TO CONSIDER AND ADOPT A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TROPHY CLUB, TEXAS, REQUESTING THAT THE TEXAS DEPARTMENT OF TRANSPORTATION AND THE CITY OF FORT WORTH CONTINUE TO PROVIDE A SCHOOL ZONE WITH REDUCED SPEEDS ON HIGHWAY 114 AT THE CURRENT LOCATION IN FRONT OF THE NORTHWEST INDEPENDENT SCHOOL DISTRICT EDUCATION CENTER; AND PROVIDING AN EFFECTIVE DATE. Ms. Beverly Foley, a member of the NCP Transportation Committee, addressed the Council. Mayor Pro Tem Edstrom shared that she has forwarded this Resolution to many area cities and organizations and it is being passed. Mayor Pro Tem Edstrom made a motion to adopt the Resolution as written. Council Member Williams seconded; motion carried unanimously. CONSENT AGENDA: ALL MATTERS LISTED UNDER CONSENT AGENDA ITEM ARE CONSIDERED TO BE ROUTINE BY THE TOWN COUNCIL AND WILL BE ENACTED BY ONE MOTION. THERE WILL NOT BE A SEPARATE DISCUSSION OF THESE ITEMS. IF DISCUSSION IS DESIRED, THAT ITEM WILL BE REMOVED FROM THE CONSENT AGENDA AND WILL BE CONSIDERED SEPARATELY. A. WORKSHOP SESSION MINUTES DATE JUNE 24, 2001 B. REGULAR SESSION MINUTES DATED JULY 2, 2001 Council Member Huizenga removed item A and Council Member Mattliai removed item B from the Consent Agenda. Page 9 REGULAR SESSION July 16, 2001 Council Member Williams made a motion to approve the June 24 Workshop Session minutes as amended. Mayor Pro Tem Edstrom seconded; motion carried unanimously. Page 2, paragraph 3 now reads: Council Member Williams stated that he thought we should not have advertisements in the Around the Town newspaper. Beth Ann Gregory explained that the actual cost of advertising versus paper without advertising is essentially the same. Council Member Matthai stated that advertising gives us the opportunity to do other things with the current procedure. Mayor Pro Tem Edstrom agrees and added that it provides local businesses added exposure and the new EDC project — "Shop Trophy Club" supports advertising in the Around the Town. Council Member Huizenga added that we should investigate circulation numbers and raise rates: Council Member Huizenga has no problem not competing. Council Member Spence added that there is a fine line; we need communication with the residents. We are talking about hard costs, not employee costs, maybe we should ask the residents for input. Gary Tomlin will give a rate sheet and circulation numbers to Beth Ann Gregory. Donna Welsh cautioned the Council to be careful of the other programs that the Town has in effect to offset costs an example being EMS billing. Council Member Williams asked for costs for the newspaper to be included in the budget packet and include employee time. Council Member Huizenga shared that the EDC has asked the Town put July 4th information into the budget as well. Council Member Matthai made a motion to approve the July 2 Regular Session minutes as amended. Mayor Pro Tem Edstrom seconded; motion carried 4-0-1 with Council Member Huizenga abstaining. Page 4, paragraph 5 now reads: Council Member Matthai was surprised to see this now, this is an unusual time to have this. Everyone in town is having increases, Y roperty values went up and school bonds were passed this year. Council Member Huizenga asked on June IS not to have any agenda items regarding the budget on this agenda. Council Member Matthai asked that the Council have a public hearing on this issue. Council Member Matthai also asked Pete Reinke if the Means Committee had not been consulted. ADJOURN. BUDGET WORKSHOP WITH WAYS AND MEANS COMMITTEE TO DISCUSS FISCAL YEAR 2001/2002. Donna Welsh stressed that very few changes have been made to the budget. The August 6's workshop will be the full discussion of the budget. Jim Buxton gave an overview of the changes.
