The meeting was held within the boundaries of the Town and was open to the public. PLEDGE OF ALLEGIANCE TO THE AMERICAN AND TEXAS FLAG: Both pledges were led by District Manager, Roger Unger. CITIZENS PRESENTATIONS: THIS IS AN OPPORTUNITY FOR CITIZENS TO ADDRESS THE COUNCIL ON ANY MATTER WHETHER OR NOT IT IS POSTED ON THE AGENDA. THE COUNCIL IS NOT PERMITTED TO TAKE ACTION ON ANY PRESENTA TION MADE TO THE COUNCIL AT THIS TT11E CONCERNING ANITENI NOT LISTED ON THE AGENDA. THE COUNCIL WILL HEAR PRESENTATION ON SPECIFIC AGENDA ITEMS PRIOR TO THE COUNCIL ADDRESSING THOSE ITEMS: There were no citizen presentations at this time. TOWN COUNCIL TO ADOPT AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS PROVIDING FOR THE ANNEXATION OF A 166 ACRE TRACT OF LAND AS DESCRIBED BY METES AND BOUNDS HEREIN WHICH TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE TOWN OF TROPHY CLUB, TEXAS; PROVIDING AN EFFECTIVE DATE; Following discussion, Mayor Pro Tem Engelbeck, moved to adopt an ordinance of the Town of Trophy Club, Texas providing for the annexation of a 166 acre tract of land as described by metes and bounds herein which territory lies adjacent to and adjoins the present boundary limits of the Town of Trophy Club, Texas; providing an effective date. Council Member Brewster seconded; motion passed unanimously. TOWN COUNCIL TO ADOPT A RESOLUTION OF THE TOWN OF TROPHY CLUB, TEXAS, GRANTING A PETITION TO ANNEX CERTAIN LAND (11.589 ACRES) INTO THE TOWN, FILED BY JOHN HARBIN, BECK PROPERTIES, INC. AND SETTING A DATE, TIME AND PLACE FOR PUBLIC HEARINGS ON THE PROPOSED ANNEXATION OF THAT LAND BY THE TOWN OF TROPHY CLUB, TEXAS, AUTHORIZING THE TOWN SECRETARY TO PUBLISH NOTICE OF SUCH PUBLIC HEARINGS; PROVIDING AN EFFECTIVE DATE: Vice President of Development, John Harbin, gave a presentation to the Council. Following discussion, Council Member Pratt moved to adopt a resolution of the Town of Trophy Club, Texas, granting a petition to annex certain land (11.589 acres) into the Town, filed by John Harbin, Beck Properties, Inc. And setting a date, time and place for public hearings on the proposed annexation of that land by the Town of Trophy Club, Texas, authorizing the Town Secretary to publish notice of such public hearings; providing an effective date. Al Chappell 225 Pebble Beach Dr. Page 3 Town Council Meeting June 29 1998 Following discussion, Council Member Carr moved to adopt a resolution of the Town of Trophy Club, Texas, supporting the existing boundary between Denton County and Tarrant County; opposing Tarrant County's lawsuit to take land form Denton County' s borders; and providing an effective date. Council Member Brewster seconded; motion passed unanimously. STAFF AND COMMITTEE REPORTS: Police Chief, David Miller, updated the Council. His report included that Officer Chris Almonrode, was chosen as Police Officer of the Year, and that Volunteer Firefighter Danny Thomas, was selected as the Firefighter of the Year. Finance Committee member, Dave Robison, invited the Council to a presentation from the North Texas Commission on June 3, 1998 at 7 p.m. in the Boardroom of the MUD building. This is during the Finance Committee's meeting. Town Manager, Donna Welsh, updated the Council. Her report included: Channel 10 being dedicated to Trophy club only, and TXDOT sending maps regarding the new highway bypass in Roanoke. PRESENTATIONS BY COUNCIL: Council Member Carr acknowledged the FD letter of commendation. Mayor Pro Tem Engelbeck asked what was being done regarding the Y2K and our Information systems. District Manager Unger explained that we are actively working on it. Council Member Pratt updated the Council on the Parks and Recreation committee presentation to the TCEDC. Mayor Carter asked to call a June meeting with the Parks and Recreation Committee , the Baseball Association, and the Council regarding the ball fields. He also asked the status of the use of Corps. property. ADJOURN REGULAR TOWN COUNCIL MEETING: Mayor Pro Tem Engelbeck moved to adjourn the regular Town Council meeting at 7:35 p.m. Council Member Carr seconded; motion passed unanimously. CALL TO ORDER AND ANNOUNCE A QUORUM: A. TOWN COUNCIL: Mayor Carter called the meeting to order and announced a quorum at 7:35 p.m., with Council Member McCabe absent. B. Council Member Carr seconded; motion passed unanimously. PLANNING AND ZONING COMMISSION TO OPEN JOINT PUBLIC HEARING WITH TOWN COUNCIL: Commissioner Hill moved to open the joint public hearing with the Town Council. Commissioner Reed seconded; motion passed unanimously. TOWN COUNCIL TO OPEN JOINT PUBLIC HEARING WITH THE PLANNING AND ZONING COMMISSION: Mayor Pro Tem Engelbeck moved to open the joint public hearing with the Planning and Zoning Commission. Council Member Carr seconded; motion passed unanimously. TOWN COUNCIL TO CONDUCT A PUBLIC HEARING JOINTLY WITH THE PLANNING AND ZONING COMMISSION RELATIVE TO THE FOLLOWING: A. TO CONSIDER AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS AMENDING ORDINANCE NO. 94-09 OF THE TOWN, THE SAME BEING THE COMPREHENSIVE ZONING ORDINANCE, BY AMENDING THE OFFICIAL ZONING MAP OF THE TOWN ZONING A CERTAIN TRACT OF LAND DESCRIBED IN EXHIBIT "A" ATTACHED HERETO AND INCORPORATED HEREIN, ACCORDING TO THE R15 SINGLE FAMILY RESIDENTIAL DISTRICT STANDARDS; PROVIDING THAT SUCH TRACT OF LAND SHALL BE USED IN ACCORDANCE WITH THE REQUIREMENTS OF THE COMPREHENSIVE ZONING ORDINANCE AND ALL OTHER APPLICABLE ORDINANCES OF THE TOWN; PROVIDING THAT THE ZONING MAP SHALL REFLECT THE R15 ZONING HEREIN MADE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION OCCURS OR CONTINUES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE. P&Z Chairman Hamper explained to the Council that R15 means a minimum lot size of 15,000 square feet and what type of setbacks etc. are required and that an R15 has the most restrictive zoning requirements. Page 5 Joint Public Hearing Town Council/ P&Z June 2, 1998 Vice president of Development, John Harbin, explained these two (2) pieces would be in Eagles Ridge which is zoned R12. He wanted to know if these two (2) pieces were zoned R15, how they would be zoned back to R 12. Attorney Liston explained that the two (2) pieces have to come in as R 15 but can be rezoned as R 12 through the public hearing process, which includes publishing a notice and holding a public hearing. PLANNING AND ZONING COMMISSION TO CLOSE JOINT PUBLIC HEARING AND/OR CONTINUE TO A DATE CERTAIN: Commissioner Hill moved to close the joint public hearing at 7:55 p.m. Commissioner Cotton seconded; motion passed unanimously. TOWN COUNCIL TO CLOSE THE JOINT PUBLIC HEARING AND/OR CONTINUE TO A DATE CERTAIN: Council Member Carr moved to close the joint public hearing at 7:55 p.m. Council Member Brewster seconded; motion passed unanimously. JOINT SESSION: TOWN COUNCIL/PLANNING AND ZONING COMMISSION TO CONVENE INTO A JOINT PUBLIC SESSION: Mayor Carter announced the joint session. TOWN COUNCIL TO CONSIDER A RECOMMENDATION FROM THE P&Z AND TAKE APPROPRIATE ACTION REGARDING: A. Commissioner Hill moved to recommend to the Town Council to adopt the ordinance of zoning the 166 acres at R15. Commissioner Reed seconded; motion passed the Planning and Zoning Commission unanimously. Mayor Pro Tem Englebeck moved to accept the recommendation of the P&Z and adopt the ordinance that amends the zoning map to include the 166 acres as R15. Mayor Pro Tem Engelbeek moved to accept the recommendation from the Planning and Zoning Commission and adopt the ordinance to zone the two (2) pieces of land R15. Council Member Brewster seconded; motion passed unanimously.
