The Town Council of the Town of Trophy Club, Texas met in
a regular session on Tuesday, September G, 1594' The meeting
was held within the boundaries of the Town and was open to
the Public.

CALL TO ORDER.
Mayor Pro Tem Hill called the meeting to order at 7:00 p.m.
noting an adequate number was present for a quorum. Hee then
welcomed Council Members, Queata, and staff.
INVOCATION.
An Invocation was given by John Carter" Finance Committee
Chairman.
PLEDGE OF ALLEGIANCE TO THE AMERICAN AND TEXAS FLAGS.
The pledge of allegiance to the American and Texas Flags was
led by Councilmember Stoltz.

PUBLIC HEARING: TOWN COUNCIL OF THE TOWN OF TROPHY CLUB TO
CONDUCT A PUBLIC HEARING ON THE BUDGET FOR FISCAL YEAR
OCTOBER 1, 1994 TO SEPTEMBER 30, 1994.
Councilmember Moore made a motion to open the Public Hearing.
Councilmember Stoltz seconded; motion carried unanimously.
No questions, comments, nor discussion ensued from the Town
Council, Staff, and Finance Committee Chairman concerning the
budget.
Councilmember Glaspell then made a motion to close the Public
Hearing. Councilmember Moore seconded; motion passed
unanimously.
LOU OPIPARE, FIRE CHIEF, TO PRESENT FIRE AND E.M.S.
DEPARTMENT REPORTS.
The presentation included a monthly activity handout
indicating 29 calls with 6 personnel per run which is an
increase from the previous month.
Both departments will be under budget for this fiscal year.
TOWN COUNCIL TO CONSIDER AN ORDINANCE APPROVING AND ADOPTING
THE BUDGET FOR FISCAL YEAR BEGINNING OCTOBER 1, 1994 AND
ENDING SEPTEMBER 30, 1995, AND MAKING APPROPRIATIONS FOR EACH
DEPARTMENT, PROJECT AND ACCOUNT; REPEALING CONFLICTING
ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN
EFFECTIVE DATE.
Since there was no discussion, Councilmember Glaspell made a
motion to adopt the 1994-1995 budget which Councilmember
Stoltz seconded. Before the Council could vote Town Manager
Welsh informed them that the next meeting, date, and proposed
tax rate needed to be included.
Councilmember Glaspell then amended the motion to adopt the
1994-1995 budget and announce that another Public Hearing is
scheduled for September 20th for adopting a tax rate.
Councilmember Stoltz again seconded; motion passed
unanimously.
TOWN COUNCIL TO CONSIDER AN ORDINANCE REVISING THE RATES OF
LONE STAR GAS COMPANY IN THE TOWN; PROVIDING FOR CONDITIONS
AND REPEAL OF CONFLICTING ORDINANCES; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING AN
EFFECTIVE DATE.
Town Manager Welsh informed the Council that Lone Star Gas
had extended the rate increase deadline another 35 days.
Councilmember Glaspell then made a motion to table this item
until the September 20th meeting to learn if the rate
decreases any more. Councilmember Moore seconded; motion
passed unanimously.

AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS PROHIBITING
THE USE, INSTALLATION OR PLACEMENT OF WOOD SHINGLES OR WOOD
SHAKES: (1) AS A ROOF COVERING ON ANY BUILDING OR STRUCTURE
FOR WHICH A BUILDING PERMIT IS ISSUED ON OR AFTER THE
EFFECTIVE DATE HEREOF, OR; (2) TO REPLACE THE ROOF COVERING
ON ANY BUILDING OR STRUCTURE FOR WHICH A BUILDING PERMIT WAS
ISSUED OR WHICH WAS CONSTRUCTED OR ERECTED PRIOR TO THE
EFFECTIVE DATE OF THIS ORDINANCE; PROVIDING DEFINITIONS; PRO-
VIDING A SAVINGS CLAUSE; PROVIDING A PENALTY NOT TO EXCEED
THE SUM OF TWO THOUSAND DOLLARS ($ 2,000.00) FOR EACH OFFENSE
AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY
DURING OR ON WHICH A VIOLATION OCCURS OR CONTINUES; PROVIDING
A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE.
The Council had a revised copy of this ordinance with the
following amendments:
1. The added provision that a building permit must
first be obtained before any replacement of a roof
covering; and
2. The ordinance applies to the replacement of any roof
or "any part thereof".
Councilmember Glaspell made a motion to approve the amended
ordinance. Councilmember Stoltz seconded for discussion
purposes only.
It was learned from the Planning and Zoning Administrator and
the Fire Chief that there are wooden shingles on the market
which have vacuumed -pressured retardant treatments which are
guaranteed the life of the product. it was recommended that
a thirty year roof with a class A heat factor be considered.
Also, any new roofing technology and products be presented to
the Planning and Zoning Commission for research and approval.
Another suggestion was to change the ordinance wording to
include a percentage number of the roof replacement and not
"any part thereof".
Because the Council considered these major changes, Council -
members Glaspell and Stoltz withdrew their original motion
which was passed unanimously.
Then Councilmember Glaspell made a motion to place this item
with the updated revisions on the next meeting agenda.
Councilmember Stoltz seconded; motion passed unanimously.
TOWN COUNCIL TO CONSIDER GRANTING A VARIANCE TO ORDINANCE
92-06 CONCERNING THE HEIGHT OF A FENCE TO MR. LEW ANDERTON OF
403 HILL TOP DRIVE.
The Council had concerns about the 8 foot fence being on
three sides of the property (not just the one side as first
indicated) and that the fence material had not been chosen.

Mr. Anderton is diligently searching for the brick to match
the house, but admits he may have to use Something else.
CoVnoilmember Glaapell then made a motion to table this
agenda item until the next meeting. Councilmember Moore
seconded; motion passed unanimously.
TOWN COUNCIL TO CONSIDER GRANTING THE STAFF REQUEST OF A
$ 3,000.00 TRANSFER FROM CONTINGENCY (LINE ITEM 10-5122)
TO IRRIGATION REPAIRS (LINE ITEM 40-7018`.
It was explained to the Council that Fort Worth impact fees
were not waived for changing the irrigation system from
effluent to fresh water.
Cuuncilmember Glaspell made 8 motion to honor this request.
Counoilmember Stoltz seconded; motion passed unanimously.
CONSENT AGENDA: ALL NATTERS LISTED ARE CONSIDERED TO BE
ROUTINE By THE TOWN COUNCIL AND WILL BE ENACTED By ONE
MOTION. THERE WILL NOT BE A SEPARATE DISCUSSION OF THESE
ITEMS. IF DISCUSSION IS DESIRED, THAT ITEM WILL BE REMOVED
FROM THE CONSENT AGENDA AND WILL BE CONSIDERED SEPARATELY.
As there was no discussion, Councilmember Glaapell made a
motion to approve the Consent Agenda. Councilmemher Stoltz
seconded; motion passed unanimously with Cnunoilmember Moore
abstaining.
The approved item is as follows:
A. Minutes of the August 16' 1994 regular Town
Council Meeting.
*PRESENTATIONS BY CITIZENS
No presentations were given.
STAFF AND COMMITTEE REPORTS
Planning and Zoning Administrator, Pauline Shaw, reported
that 67 building permits worth 8 million dollars have been
issued since October, 1993. Also, bids for the East Entrance
construction will be accepted on the 15th, 5o the Council
will have the results at the next meeting.
Town Attorney, John Hill, informed the Council that the East
Entrance negotiations have not been finalized but is hopeful
for e positive report at the meeting on the 20th.
Town Manager, Donna Welsh, updated the Council on the back
taxes issue. The Town, both M.U.D.`s, and the N.W.I.S.D.
have refused the first offer and made a Counter offer. In
the near future all four entities want to meet for strategy
planning.

Councilmember Stoltz made a motion to adjourn at 7:48 p.m.
and reconvene September 2U-th in another joint Public
Hearing/Town Council Meeting. Councilmember Glaspell
seconded; motion passed unanimously.
