Minutes TC 03/31/1987 - Special SessionMINUTES OF SPECIAL MEETING TOWN OF TROPHY CLUB TROPHY CLUB, TEXAS THE STATE OF TEXASCOUNTY OF DENTON } } The Town Council of the Town of Trophy Club met in special session on March 311 1987. The meeting was held within the boundaries of the Town and was open to the Public. INVOCATION Pastor Ron Adams led in the Invocation. PLEDGE OF ALLEGIANCE Council Member Dayton led in the Pledge of Allegiance. CONSIDERATION OF RESOLUTIC&I A RESOLUTION OF THE TQWN OF TROPHY CLUB, TEXAS ASSURING THE FEDERAL INSURANCE ADMINISTRATION THAT IT WILL ENACT AS NECESSARY ADEQUATE LAND USE AND CONTROL MEASURES TO REDUCE FLOOD AND EROSION HAZARDS; APPOINTING THE MAYOR OF THE TOWN TO ASSIST THE FEDERAL INSURANCE ADMINISTRATION; REQUIRING CERTAIN RECORD-KEEPING; PROVIDING AN EFFECTIVE DATE. Council Member Vance made a motion to approve the resolution as written, Council Member Martignago seconded, motion carried unanimously. COUNCIL TO CONSIDER AN APPLICATION FOR PARTICIPATION IN THE NATIONAL FLOOD INSURANCE PROGRAM. Council Member Dayton made a motion to approve the application, Council Member Martignago seconded, unanimous. / page 2 WORKSHOP: COUNCIL TO DISCUSS INGRESS AND EGRESS FROM MONTERREY TO THE METHODIST CHURCH SITE. Mr. John Hill, attorney for the Town, had earlier presented the Town with a letter from his law firm outlining the Towns alternatives in this matter. Mr. Hill reviewed the report with the Council and stated that in his opinion, the Town may not close Monterrey Drive but may vacate and abandon the public easement in that street. Several residents were in attendance from the Village West area. They expressed concerns such as environmental impact, safety, parking problems, increased traffic, etc. Dr. Steve Harris, Member from Roanoke, stated that the Church did not come to Roanoke for permits before construction. He stated that Roanoke required a dedication of easement from the church site to Dorman Road. Mr. Worty Chaiken of Westar Homes stated that he hoped the two towns can get together and solve the problem because his company is losing money over the situation. He also stated that his company would be interested in dedicating land if that would help. Mr. Rob Dillard, attorney for the Methodist Church, stated that the plat was approved in Westlake in 1983. The church is comprised of citizens and they also have rights. He added that without the churches consent, the Town could not deny access. He pointed out that everyone on a public street creates traffic and the church is no different. The residents from Village West stated that although the church says they want to work to solve the problem, they have no intention of closing the road to protect property values and promote safety in that area. The general consensus of the Council was to hold a meeting with Roanoke to address the emergency access situation and to lessen the impact on the Village West residents. Council Member Kunkel made a motion to have two or three members of the Town Council meet with the same number of Roanoke Council Members to discuss this problem of access, Mayor Pro Tem Venetoff seconded, motion carried unanimously. Council Member Vance offered an amendment to the motion stating that the committee will approach the church on a one to one basis to determine if there is any action or any alternate position that they would be willing to take. Council Member Martignago seconded, motion carried with Council Member Kunkel abstaining. page 3 The committee appointed to approach the church and Roanoke consists of: Council Members Kunkel, Vance and Dayton. *7COUNCIL TO CONSIDER NELSON TRACT: Mr. George Staples, attorney for B.L. Nelson, told the Council that if the Planning and Zoning Commission fails to take action on a plat within 30 days the plat is approved. Mr. Staples pointed out that Mr. Nelson delivered his plat to the Tctwr on February 23rd. On March 23rd the Planning and Zoning Commission voted on a motion made by Commissioner Kemp to approve the plat. The motion failed. Commissioner Kemp left the meeting stating that he resigned from the Commission. Mr. Staples stated that a vote was never taken to turn down the plat. Mr. Hill stated there is no case law on the question of when a plat is determined to be filed. He pointed out that there is a difference in presenting and filing. He stated that the Town Secretary, Donna Welsh, had written Mr. Nelson on March 12 advising him that Mr. Boutwell was reviewing his plans and the Commission would place it on the March 23rd agenda for- final orfinal plat approval. On the 23rd, the Commission reviewed the plat for approximately three hours outlining several items that did not meet with the goals and objectives and reviewing Mr. Boutwell's letter of suggested changes. The general consensus of the Council was to stand by the Commissions determination that the plat was denied. Mayor Carter pointed out that the next Planning and Zoning Commission meeting was within the 30 days and they could address the final plat at their April 6th meeting. CONSIDERATION OF ORDINANCE: AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS REQUIRING APPROVAL OF A PRELIMINARY AND FINAL PLAN, PLAT OR REPLAT BY THE TOWN PLANNING AND ZONING COMMISSION AND THE TOWN COUNCIL; PROVIDING PROCEDURES FOR REVIEW OR PRELIMINARY AND FINAL PLATS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE. Mayor Pro Tem Venetoff made a motion to approve the ordinance amending it to require the Council to review final plats only and instituting the 3/4 rule relating to the Planning and Zoning Commission. Mr. Hill will provide the wording on the 3/4 rule. Mayor Pro Tem Venetoff seconded, motion carried unanimously.
