Minutes TC 07/13/1987` MINUTES OF REGULAR MEETING TOWN OF TROPHY CLUB TROPHY CLUB, TEXAS THE STATE OF TEXAS ) } COUNTY OF DENTON ) The Town Council of the Town of Trophy Club met in Regular Session on Monday July 13, 1987. The meeting was held at the Municipal Utility District Building and was open to the Public. Aldo Martignago Tracy Kunkel Terry Vance Beverly Foley Mayor Pro Tem Council Member Council Member Council Member Absent: Mayor Carter and Council Member Venetoff Also present were members of the Town Staff: John Hill Attorney David Nolte Marshal Jack Jacobs Treasurer Donna Welsh Secretary Mayor Pro Tem Martignago called the meeting to order at 7:00. Council Member Vance gave the Invocation. PLEDGE OF ALLEGIANCE Mayor Pro Tem Martignago led in the Pledge of Allegiance. CONSIDERATION OF MINTUES Council Member Kunkel made a motion to approve the mintues of the June 22, 1987 meeting as written, Council Member Foley seconded, motion carried unanimously. PRESENTATIONS BY CITIZENS -Ms. Carole Nolte, 226 Oakmont, thanked the Laughlin family for donating the flag for the Fire Department. She also stated she was concerned with the vandalism on the golf course lately and that if residents could help monitor the golf course at night to deter vandalism, she would be glad to help. The Council suggested she contact the Golf Course Superintendent concerning this. page 2 -Mr. Bill Richardson stated that the bikers are still a nusiance on the golf course. Independent American will be placing no tresspassing signs on the property. This will allow the police officers to issue citations to the bikers. COUNCIL PRESENTATIONS -Council Member Vance thanked the residents and various groups that worked on the 4th of July Committee. He stated the celebration gets better every year thanks to these hard working people. Council Member Vance also asked who is responsible for placing street lights in the Town. Mr. Hill stated that the Town might consider putting up the lights or contact the developer in the area and see if they would help. The Public Works Committee will look into who's responsibility this. would be. REQUEST FOR VARIANCE: MR. GARY BOWER, 220 FRESH MEADOW, REQUESTS A VARIANCE TO ORDINANCE NO. 0 86-22 REQUIRING A SWIMMING POOL TO BE FENCED. The Council reviewed the variance request from Mr~ Bower and decided this is a safety hazard. They felt a fence is mandatory around a swimming pool. Council Member Kunkel made a motion to deny the variance and require Mr. Bower to erect a fence around the pool. Council Member Foley seconded, motion carried unanimously. PRESENTATION: MR. GARY TERRY, OF SOUTHWESTERN BELL, TO ADDRESS THE COUNCIL CONCERNING THE TELECOMMUNICATIONS ORDINANCE. Mr. Terry stated that at this time, the telecommunication companies were exempt from paying sales tax. He pointed out that the State passed this bill to generate tax revenues on a state level and to make the taxing requirements equitable in the phone business. Mr. Terry pointed out that by passing this ordinance the town would realize increased revenues. Council Member Vance made a motion not to approve the ordinance at this time, Council Member Foley seconded, motion carried with Council Member Kunkel abstaining. PAGE 3 CONSIDERATION OF ORDINANCES: FIRST READING A) AN ORDINANCE REPEALING ORDINANCE NO. 0 86-11 OF THE TOWN RELATING TO TRASH AND GARBAGE. Council Member Vance made a motion to approve the ordinance as presented, Council Member Kunkel seconded, motion carried unanimously. A copy of the ordinance is filed with the mintues of this meeting. B) AN ORDINANCE AMENDING ORDINANCE NO. 0 86-18 RELATING TO SWIMMING POOLS. THIS ORDINANCE PROVIDES THAT WATER AND SWIMMING POOLS MUST BE OF SUFFICIENT CLARITY TO ALLOW A PERSON TO SEE TO THE BOTTOM. Council Member Vance made a motion to accept the amendment to the ordinance as written with the following amendment: It shall be unlawful to drain a pool onto the surface of a lot. It must be drained into the storm sewer to prevent the water from getting into the water table or to cause harm to adjacent property. Council Member Foley seconded, motion carried unanimously. C) AN ORDINANCE AMENDING ORDINANCE NO. 0 86-22. THIS ORDINANCE AMENDS SECTION 6 BY REQUIRING THAT GATES AND FENCES BE SELF -LATCHING AND SELF-CLOSING. Council Member Vance made a motion to approve the amendment as written with the following amendment to paragraph a, page 3, sentance 2: "Said wall or fence shall be constructed in such a manner that there are no gaps or openings, other than gates or doors, larger that four (4) inches measured in a horizontal direction, except that if a picket fence is used, the measurement shall be made in a horizontal direction. COUNCIL TO SET A DATE FOR A WORKSHOP SESSION ON THE 1987-88 BUDGET. The workshop session will be held on Thursday, July 16, 1987 at the Municipal Utility District Building at 7:00 p.m. COMMITTEE/COMMISSION REPORTS PLANNING AND ZONING COMMISSION Chairman Mike Hamper thanked the Council for their vote of confidence in passing the 3/4 vote rule. Chairman Hamper stated that Vance Booker had been appointed as Co --Chairman of the P & Z. Mr. Julian Jones was appointed as Co -Chairman of the Plan Review Committee and Mr. Dale Heistand was appointed to the Plan Review Committee. M-Tff�w Chairman Hamper stated that the P & Z hopes to have the Comprehensive Zoning Ordinance to the Council by the end of August. He is also working with Freese and Nichols to set up an orientation seminar that would cover P & Z activities and procedures. It would also address such areas as the Sub - Division Regulations and Zoning Ordinances. Chairman Hamper will keep the Council updated on the project. TROPHY CLUB/WESTLAKE/ROANOKE METHODIST CHURCH Council Member Vance stated that he had talked with a member of the Church concerning the ingress and egress of traffic to the Church property~ Council Member Vance was told that the Church would like to construct some kind of barriers to restrict traffic from using the Church property as a short cut to Roanoke and Marshal Creek. PUBLIC WORKS COMMITTEE Council Member Kunkel stated that her committee had studied the proposal from Freese and Nichols for the street specifications. They also contacted various engineering firms and decided the proposal from Freese and Nichols would be best for the Town. Council Member Kunkel made a motion to accept the proposal from Freese and Nichols in the amount of $7,500 for street specifications. Council Member Vance seconded the motion, motion carried unanimously. FINANCE COMMITTEE Treasurer Jack Jacobs stated that there would be a workshop on the budget on Thursday, July 16th at 7:00. The committee will take the figures from the workshop and re -work the budget for the Public Hearing. PARK DEDICATION COMMITTEE Council Member Vance stated that the first appraisal had been sent to Austin. The appraisal on the land was around $750,000. The second appriasal will be sent this week. PARKS AND RECREATION COMMITTEE Council Member Vance stated that the Committee is looking into items for the park system to be considered in the new budget. PUBLIC SAFETY Mr. Doug Cavileer, Chairman of the Public Safety Committee stated that the Neighborhood Crime Watch meeting will be on July 14° at 7:00. The committee is still looking into the feasibility of having our own Police Department. Mr. Cavileer stated that the 9-1-1 program will be on the ballot for the August 8th election. He asked the Mayor to address this in the newsletter. COUNCIL TO CONSIDER A GENERAL CONSULTING CONTRACT WITH FREESE AND NICHOLS ENGINEERING, INC. Council Member Kunkel made a motion to accept the consulting contract as written, Council Member Foley seconded, motion carried unanimously. MARSHAL NOLTE TO ADDRESS THE COUNCIL CONCERNING LAW ENFORCEMENT MATTERS. Marshal Nolte reported on the following items: 1. The traffic signals at the front entrance will be operative within the week. 2. Marshal Nolte met with the M.U.D. Board concerning leasing the land for a police building~ He stated that they were very receptive to the idea and offered the land for $1.00 per year. 3. Marshal Nolte stated that drawings for the police building will be available for review on Tuesday the 14th. 4. At the next Council meeting, Marshal Nolte will present a cost comparison for police protection between the Town and Denton County.
