Minutes TC 09/29/1986MINUTES OF REGULAR MEETING TOWN OF TROPHY CLUB TROPHY CLUB, TEXAS THE STATE OF TEXAS ) COUNTY OF DENTON ) The Town Council of the Town of Trophy Club met in Regular Session on Monday September E9, 1986. The meeting was held at the Municipal Utility District Building at 7:00PM and was open to the Public. INVOCATION The Invocation was led by Council Member Vance. PLEDGE OF ALLEGIANCE The Pledge was led by Marshal Nolte. PRESENTATION BY MR. ED WALTS Mr. Waits, who has been working on the 1. B. M. /McGuire Thomas Partners Project, presented the Council with a proposal from the State Highway Department. They wanted to know if Trophy Club wanted to intersect Precinct Line, which has been re- routed approximately 950 feet to the east, with Indian Creek Drive. Several reasons were brought up that supported the decision not to have the roads intersect. The land that would be effected by the road does riot belong to the City and is a predominately residential section of Trophy Club.. page 2 Council Member Vance made a Resolution► acknowledging the fact that the Council was given the option to connect Precinct Line with Indian Creek Drive and desire not to connect the two. Council Member Kunkel seconded the motion, motion carried unanimously. PRESENTATIONS BY CITIZENS Nene PRESENTATIONS BY COUNCIL -Council Member Dayton asked if the Plantation had been contacted concerning the banners can their buildings. Marshal Nolte stated that they had been sent the Ordinance and he would contact Lt. Malden to have then►a cited. --Council Member Vance asked about the boats that are still not in compliance with the ordinance. The City Secretary stated that they have been cited and many have complied. The officers will follow up on a list to see who has not complied. -Council Member Kunkel reported to the Council that the Commissioners Court has put into force a new committee called Denton County Industrial Development Corporation.The committee will help Denton County attract more industry. The Board consists of three members. They are: John Emmel from Flower Mound, John Tidwell from Roanoke and Tracy Kunkel from Trophy Club. -Mayor Pro Tem Venetoff read a letter from Bill Richardson► of Independent American. At the last meeting, Mayor Carter asked for information concerning the inventory of homes in Trophy Club. A copy of the report is filed with these minutes. CONSIDERATION OF ORDINANCES AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS ADOPTING AND APPROVING THE BUDGET FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1986, AND TERMINATING SEPTEMBER 30, 1987, AND MAKING APPROPRIATIONS FOR EACH DEPARTMENT, PROJECT AND ACCOUNT; REPEALING CONFLICTING ORDINANCES; PROVIDING A SAVINGS CLAUSE AND A SEVERABILITY CLAUSE; AND DECLARING AN EFFECTIVE DATE. Council Member Vance made a motion to accept the Ordinance as written, Council Member Kunkel seconded, motion carried unanimously. Page 3 AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS FIXING AND LEVYING MUNICIPAL AD VALOREM TAXES FOR 'THE FISCAL YEAR BEGINNING OCTOBER 1, 1986 AND ENDING SEPTEMBER 30, 1587, AND FOR EACH FISCAL YEAR THEREAFTER UNTIL OTHERWISE PROVIDED AT A RATE OF 1E CENTS PER ONE HUNDRED DOLLARS ($100.00) ASSESSED VALUATION OF ALL TAXABLE PROPERTY WITHIN THE CORPORATE LIMITS OF THE TOWN AS OF JANUARY 1, 1985; DIRECTING THE ASSESSMENT THEREIN TO PROVIDE REVENUES FOR THE PAYMENT OF CURRENT OPERATION AND MAINTENANCE EXPENSES; PROVIDING FOR DUE AND DELINQUENT DATES TOGETHER WITH PENALTIES AND INTEREST; REPEALING; CONFLICTING ORDINANCES; PROVIDING A SAVINGS CLAUSE AND SEVERABILITY CLAUSE; AND DECLARING AN EFFECTIVE DATE. Council Member Martignago made a motion to approve the Ordinance as written, Council Member Kunkel seconded, motion carried unanimously. CONSIDERATION OF ORDINANCES: FIRST READING AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS GRANTING PLANNED CABLE SYSTEMS CORPORATION A FRANCHISE TO CONSTRUCT, OWN, OPERATE AND MAINTAIN A CABLE TELEVISION SYSTEM WITHIN THE TOWN OF TROPHY CLUB, TEXAS; SETTING FORTH THE TERRITORIAL AREA ENCOMPASSED BY THIS FRANCHISE; ESTABLISHING LIABILITY AND PROVIDING FOR IMDEMNIFICATION ESTABLISHING OPERATIONAL STANDARDS AND STANDARDS OF SERVICE; ESTABLISHING CONDITIONS OF STREET OCCUPANCY; PROVIDING FOR PAYMENT OF A FRANCHISE FEE TO THE TOWN; PROVIDING PERIODIC REVIEW AND AMENDMENTS; PRESCRIBING THE TERMS, CONDITIONS, OBLIGATIONS AND LIMITATIONS UNDER WHICH THIS FRANCHISE SHALL BE EXERCISED; PROVIDING A SEVERABILITY CLAUSE. In Section 21, page 15 of the Ordinance, a security fund of $25,000.00 is required. The Council asked the attorney to check with other towns and see if this deposit is in line with other Towns the size of Trophy Club. AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS PROVIDING FOR THE REMOVAL AND IMPOUNDMENT OF ANY ILLEGALLY PARKED, STOPPED OR STANDING VEHICLE LOCATED UPON ANY STREET, HIGHWAY OR ALLEY WITHIN THE CORPORATE LIMITS OF THE TOWN; ESTABLISHING A PROCEDURE FOR REMOVING SUCH VEHICLES; ESTABLISHING AN IMPOUNDING FEE; DECLARING THE STOPPING, STANDING OR PARKING OF VEHICLES IN VIOLATION OF OTHER TOWN ORDINANCES AS NUISANCES PER SE; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF ONE THOUSAND DOLLARS ($1,000.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION OCCURS OR CONTINUES; PROVIDING AN EFFECTIVE DATE. PAGE 4 AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS REGULATING ALARM BUSINESSES, SYSTEMS AND USERS; PROVIDING DEFINITIONS; REQUIRING A PERMIT TO OPERATE AN ALARM SYSTEM AND THE PAYMENT OF A FEE FOR SUCH PERMIT; ESTABLISHING STANDARDS FOR PROPER ALARM SYSTEM OPERATION AND MAINTENANCE; ESTABLISHING REGULATIONS GOVERNING REPORTING OF ALARM SIGNALS; REQUIRING RECORD KEEPING BY ALARM BUSINESSES; REQUIRING A FEE FOR FALSE ALARM NOTIFICATION; AUTHORIZING THE REVOCATION OF AN ALARM PERMIT; PROVIDING FOR AN APPEAL; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION OCCURS OR CONTINUES; PROVIDING AN EFFECTIVE DATE. The general consensus of the Council was to strike item "a" in Section 21 of page 7. Marshal Nolte noted that on page 2 section "d" the following phrase was omitted. "For example, this would include a real estate agent acting on behalf of the owner of the premises." The attorney will redraft the ordinance before the second reading. WORKSHOP ON TOWN ORGANIZATION This item was posponed until Wednesday, October 15th at 7:OOPM at the Country Club. EXECUTIVE SESSION The Council adjourned into Executive Session in accordance with Article 6252-17 V. A. T. C. S. to discuss the following subjects: A. Council to consider personnel matters. b. Council to consider contemplated litigation. OPEN SESSION The Council took no action on these matters.
