Minutes TC 01/27/1986MINUTES OF REGULAR MEETING TOWN OF TROPHY CLUB TROPHY CLUB, TEXAS THE STATE OF TEXAS > ) COUNTY OF DEWTON ) The Town Council of the Town of Trophy Club met in Regular Session on Monday January 27, 1986 at 7:00PM. The meeting was held at the Municipal Utility District Building, 100 Water Plant Road, Trophy Club, Texas. The meeting was held within the boundaries of the Town and was open to the Public. Jim Carter Terry Vance George Doran Aldo Martignago Absent were: Mayor Mayor Pro Tem Council Member Council Member Council Member Dayton Council Member Neideriberger Also present were members of the Town staff: Chris Casio John Jacobs David Nolte Donna Welsh CALL TO ORDER Attorney City Treasurer City Marshal City Secretary Mayor Carter called the meeting to order at 7:05PM. INVOCATION Mayor Pro Tem Vance led the Invocation. PLEDGE OF ALLEGIANCE Mayor Pro Tem Vance led the Pledge of Allegiance. CONSIDERATION OF MINUTES Council Member Doran made a motion to approve the minutes with modifications, Council Member Martignago seconded, motion carried unanimously. PRESENTATIONS BY CITIZENS PRESENTATIONS BY COUNCIL -Council Member Martignago stated that there is a home on Oakmont Drive that has trash and debris in the front yard. He stated that the home has been this way for some time because the builder evidently went bankrupt and left the home very unsightly. Mayor Carter stated that he has already contacted the builder and has asked him to clean up the debris. -Council Member Doran stated that several residents have pointed out that the ordinances passed by the City are not being carried out. He asked that this item be put on the agenda for the Council to discuss. `+)mrQ�,/l -Council Member Bay'r-i-in stated that maybe the time is right to take on a different posture and work a little more in concert with the prime developer in Trophy Club. "I think its high time that we have more scheduled meetings or more direct input between the City and Independent American," stated Doran. Mayor Carter stated that at the last meeting that the City wants to see the developer maximize its investment~ "The developer owns 50% of Trophy Club and the Council wants to protect the other 50% to make sure the development occurs in good taste," stated Mayor Carter. Council Member Doran stated that he would like to see a fresh approach. Mayor Carter asked Council Member Doran to document any suggestions he might have. -Mayor Carter stated that the Council talked in previous meetings about conserving the barn as a city landmark. He suggested the following committee: Marshal Engelbeck Chairman Ronnie Engelbeck Hope Bailey Carol Nolte Doug Cavalier Mayor Carter suggested naming the committee the "Save Our Barn" Committee. He pointed out that this committee as well as all other committees expire when a new Council takes office. Council Member Martignago made a motion to establish a "Save Our Barn" Committee for the purpose of investigating and researching the possibility of conserving the barn and establishing it as a city landmark, and the people named by the Mayor be named to the committee. Council Member Doran seconded, motion carried unanimously. -Mayor Carter and the Council received a letter from Colonel Nance at the Equestrian center concerning the construction of security lights at the barn. The general consensus of the Council was to have the Planning and Zoning Commission review the request. -At a previous meeting the Council had asked the Mayor and Roger Brown, of Independent American, to contact the Corps of Engineers concerning the intrusion of vehicles on to the new golf course and the destruction of that property. Mr. Brown stated that he and the Mayor met with Mike Ayers, Assistant Reservior Manager with the Corps of Engineers~ Mr. Ayers had several suggestions for the control of people entering the course from the Corp property. One way would be for the Corp to construct a pipe barrier where the people are coming in. Mr. Ayers also stated that the Corps was also considering erecting a major barrier which blocks off a 300 acre tract. This brought up a point of possibly having a city park in that area. Mr. Brown stated that the Corps should take some action in the next few weeks. Mr. Brown reported to the Council that Texas Power and Light was ready to install the lights at the entrances of Trophy Club. The only thing needed was a letter from the City allowing the power company to dig a trench to provide the service. Council Member Doran made a motion to write a letter to Texas Power and Light stating they had the City's approval to trench in order to provide the service. Council Member Martignago seconded, motion carried unanimously. -Mayor Carter reported to the Council that January 27th was the last day to file arguments to the Commissioners concerning the power poles. He stated that legal council had done this. Mayor Carter told the Council that he has contacted a lobbyist in Austin and several political figures that might help the city put pressure on the Public Utility Commission. -Mayor Carter reported to the Council that the M.U.D. Board reconsidered the fees to be charged for the use of the building. The fee will be $10.00 per hour, up to three hours, with a $30.00 limit per meeting. -Mayor Carter reminded the Council and audience that April 5th, the City would have an election for three council seats. He stated that the filing dates run from January 20th to February 19th. PRESENTATION: TROPHY CLUB WOMEN'S CLUB Mrs. Susan Smith, President of the Trophy Club Women's Club, addressed the Council concerning an information board to be placed on a median near the entrance. Mrs. Smith stated that the board was designed by an engineer and would fit in with the decor at the entrance. The board would be funded and maintained by the Women's Club and would be available for the posting of community information. The Council suggested Mrs~ Smith provide the Planning and Zoning Commission with a copy to look over. Mayor Carter thanked Mrs. Smith and the Women's Club for their work in the community. Mayor Pro Tem Vance made a motion to accept the proposal from the Women's Club as presented, Council Member Doran seconded, motion carried unanimously. CONSIDERATION OF ORDINANCES/RESOLUTIONS: SECOND READING The first ordinance to be considered concerned street construction and drainage standards. The City Secretary read the caption: Mayor Carter pointed out that the Planning and Zoning Commission had reviewed the ordinance and had passed it on to the Council without modifications. Mr. Reuss pointed out to the Council that the ordinance did not have street specifications in the ordinance but did address the water and drainage area. Mayor Pro Tem Vance stated that one of the earlier concerns with this ordinance was that it might possibly cross over into the area of the M.U.D.'s responsibilities in the community. He also pointed out the absence of street specifications. Mayor Pro Tem Vance made a motion to remove the ordinance from the agenda until the P & Z can clarify these concerns and also have the M.U.D. review the ordinance. Council Member Martignago seconded, motion carried unanimously. The caption of the next ordinance to be considered by the Council was read by the secretary: AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS, MAKING PROVISIONS REQUIRING A SINGLE FAMILY RESIDENCE LICENSE; PROVIDING DEFINITIONS; PROVIDING A LICENSE FEE AND A REINSPECTION FEE; PROVIDING STANDARDS; PROVIDING FOR INSPECTION OF CERTAIN RECORDS AND THE PREMISES; PROVIDING FOR AN APPEAL TO THE TOWN COUNCIL; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF ONE THOUSAND DOLLARS ($1,000.00) AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION OCCURS OR CONTINUES; PROVIDING A SEVERABILITY CLAUSE, AND DECLARING AN EFFECTIVE DATE. Mayor Carter asked if anyone would like to speak regarding the ordinance. Mr. Art Anderson, representing the Dabney Corporation and Glenn Terrell addressed the Council. Mr. Anderson stated that he was glad to see the single family residence license fee separated from the apartment complex residence license fee. Mr. Bush, Attorney for Glenn Terrell had asked Mr. Anderson to relay his thoughts on the ordinance in his absence. Mr. Anderson listed them for the Council. Mr. Anderson was concerned with the recitals in the ordinance. This is where the City states the purpose of the ordinance. Mr. Anderson felt the City was trying to address density within a single family residence, another assumption is made that a single family residence is occupied by one family and the third concern was that the units were maintained in accordance with applicable town ordinance's. Mr. Anderson was concerned with the fee involved in the ordinance, the privacy of the tenant and the fact that these standards could be an evasion of privacy. Chris Casio, Attorney for the City, stated that this ordinance is in place in several other cities and the invasion of privacy has not been a question. Mayor Pro Tem stated that since the Council received the single family and multi -family residence license fee ordinances Just before the meeting, he would like to have the opportunity to review the ordinances. Mayor Pro Tem Vance made a motion to table the single family residence license fee ordinance until the next regular meeting, Council Member Doran seconded, motion carried unanimously. CONSIDERATION OF ORDINANCES/RESOLUTIONS: FIRST READING The City Secretary read the captions of two ordinances to be considered by the Council at the next meeting: AN ORDINANCE OF THE TOWN OF TROPHY CLUB, TEXAS PROVIDING REGULATIONS FOR A GOVERNMENTAL USE DISTRICT; PROVIDING FOR ACCESSORY AND CONDITIONAL USES; PROVIDING SCREENING REGULATIONS; PROVIDING FOR CONFORMITY TO THE SIGN ORDINANCE; PROVIDING FOR MINIMUM LOT SIZE AND YARD REQUIREMENTS; PROVIDING FOR MAXIMUM LOT COVERAGE BY BUILDINGS AND STRUCTURES; PROVIDING FOR A MAXIMUM HEIGHT FOR BUILDINGS AND STRUCTURES; ESTABLISHING OFF STREET PARKING AND LOADING REQUIREMENTS; PROVIDING FOR SITE PLAN REVIEW AND APPROVAL; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF ONE THOUSAND DOLLARS ($1,000.00) PND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION OCCURS OF CONTINUES; PROVIDING AN EFFECTIVE DATE AND DECLARING AN EMERGENCY. EXECUTIVE SESSION The Council adjourned into Executive Session. OPEN SESSION Council Member Martignago made a motion to adjourn, Mayor Pro Tem Vance seconded, motion carried unanimously. y
